HomeMy WebLinkAbout20220963.tiffFINDINGS AND RESOLUTION RE: FINDINGS AND RESOLUTION CONCERNING APPLICATION OF REA'S DINER AT DILLARDS, LLC, DBA REA'S DINER AT DILLARDS, FOR HOTEL AND RESTAURANT (COUNTY) LIQUOR LICENSE, AND AUTHORIZE CHAIR TO SIGN The application of Rea's Diner at Dillards, LLC, dba Rea's Diner at Dillards, 24851 County Road 74, Galeton, Colorado 80622, for a Hotel and Restaurant (County) Liquor License, was presented in a public hearing on the 28th day of March, 2022, at 9:00 a.m., and the Board of County Commissioners of Weld County, Colorado, having considered the testimony, evidence and remonstrances filed with said Board, and having carefully weighed the same, now makes the following findings: 1 The evidence discloses that the applicant has sustained the burden of proof as to the desires of the inhabitants. 2. The applicant is of good character and reputation. 3. The applicant has proven the reasonable requirements of the neighborhood. 4. The proposed licensed premises is not directly connected to a different licensed premises, pursuant to C.R.S. §44-3-301(3)(a). 5. The diagram of the proposed licensed premises is correct. 6. There are no other Hotel and Restaurant (County) Liquor Licensed premises in the neighborhood, pursuant to C.R.S. §44-3-301(2)(b) and there are no other license types located in the immediate area. 7 There are no public or parochial schools, or principal campus of any college, university, or seminary within 500 feet of the proposed licensed premises, pursuant to C.R.S. §44-3-313(1)(d)(l). 8. The Hotel and Restaurant (County) classification of license requires the sale of food, pursuant to C.R.S. §44-3-407. The proposed premises has the capability of heating and serving meals, pursuant to C.R.S. §44-3-103(20). 9. The sign noticing the place, date, and time of the hearing for the Liquor License application was posted by the applicant in such a manner that the notice was conspicuous and plainly visible to the public, when I was there at approximately 9:00 a.m. on March 17, 2022. cc: SOCP,Strnic/Sic), CAC 3a), APPL o� / Co r as 2022-0963 LC0058 HOTEL AND RESTAURANT (COUNTY) LIQUOR LICENSE - REA'S DINER AT DILLARDS, LLC, DBA REA'S DINER AT DILLARDS PAGE 2 RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has considered the application of Rea's Diner at Dillards, LLC, dba Rea's Diner at Dillards, 24851 County Road 74, Galeton, Colorado 80622, for a Hotel and Restaurant (County) Liquor License for the sale of malt, vinous, and spirituous liquors for consumption by the drink on the premises only, in compliance with all applicable rules and regulations found in Article 3, Title 44, C.R.S., and WHEREAS, pursuant to Exhibit 5-H of the Weld County Code, said applicant has paid to the County of Weld the sum of $1,075.00 for the hearing fee, in addition to the other required fees, and WHEREAS, due to the Findings of the Board of County Commissioners in this matter as stated herein, the Board deems it advisable to approve said application for a Hotel and Restaurant (County) Liquor License for Rea's Diner at Dillards, LLC, dba Rea's Diner at Dillards, conditional upon the applicant providing a property lease between the landlord and Rea's Diner at Dillards, LLC, and WHEREAS, the Licensee shall require "responsible vendor" training of each employee, as agreeable to the Colorado Department of Revenue, Liquor Enforcement Division, and the Licensee shall provide documentary evidence that each employee has been "responsible vendor" trained upon request by the Weld County Sheriff's Office or the Colorado Liquor Enforcement Division. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that having examined said application, the qualifications of the applicant, and the testimony of those present at the hearing, does hereby grant License Number 2022-03 to said applicant for a Hotel and Restaurant (County) Liquor License for the sale of malt, vinous, and spirituous liquors, for consumption by the drink on the premises only, at retail at said location; and the Board does hereby authorize and direct the issuance of said license by the Chair of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which license shall be in effect until July 13, 2023, providing that said licensee operates in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, per Article 3, Title 44, C.R.S., heretofore passed by the Board of County Commissioners of Weld County, Colorado, and any violations thereof shall be cause for revocation of the license. BE IT FURTHER RESOLVED by the Board that the applicant must provide a property lease between the landlord and Rea's Diner at Dillards, LLC, prior to License Number 2022-03 being released. Default If default shall at any time be made by Tenant in the payment of rent when due to Landlord as herein provided, and if said default shall continue for fifteen (15) days after written notice thereof shall have been given to Tenant by Landlord, or if default shall be made in any of the other covenants or conditions to be kept, observed and performed by Tenant, and such default shall continue for thirty (30) days after notice thereof in writing to Tenant by Landlord without correction thereof then having been commenced and thereafter diligently prosecuted. Landlord may declare the term of the Lease ended and terminated by giving Tenant written notice of such intention, and if possession of the Leased Premises is not surrendered, Landlord may recover said premises. Landlord shall have, in addition to the remedy above provided, any other right or remedy available to Landlord on account of any Tenant default either in law or equity. Landlord shall use reasonable efforts to mitigate its damages. 14. Condemnation If any legally, constituted authority condemns the Building or such part thereof which shall make the Leased Premises unsuitable for leasing, this Lease shall cease when the public authority takes possession, and Landlord and Tenant shall account for rental as of that date. Such termination shall be without prejudice to the rights of either party to recover compensation from the condemning authority for the loss or damage caused by the condemnation. Neither party shall have any rights in or to an award made to the other by the condemning authority. 15. Secwity Deposit The Security Deposit shall be held by Landlord without liability for interest and as security for the performance by Tenant of Tenant's covenants and obligations under this Lease, it being expressly understood that the Security Deposit shall not be considered an advance payment of rental or a measure of Landlord's damages in case of default by Tenant. Unless otherwise provided by mandatory non-waivabie law or regulation, Landlord may commingle the Security Deposit with Landlord's other funds. Landlord may♦ from time to time, without prejudice to any other remedy, use the Security Deposit to the extent necessary to make good any arrearages of rent or to satisfy any other covenant or obligation of Tenant hereunder.
