James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick County Attorney, Bruce Barker Department of Planning Services representative, Angela Snyder Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated May 17, 2022, and duly published May 20, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Juan Antonio Garcia Ramirez, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0005, to exceed the maximum allowed building coverage in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Angela Snyder, Department of Planning Services, noted the site is actually 920 feet north of County Road (CR) 18, presented a brief summary of the proposal, described the desire to add a greenhouse and a covered patio in the future, and relayed the existing lot coverage is 4.5% and the proposed structures will cover no more than 17% of the property. She stated the applicant has applied for a building permit or exempt Certificate of Application for all qualified structures; however, the permits are on hold pending approval of this USR. Ms. Snyder described the posting of the hearing, and relayed the site is located within the Aristocrat Ranchettes Subdivision, as well as the three (3) mile referral area of the City of Fort Lupton. She stated 39 surrounding property owners (SPOs) were noticed, no responses were received, and the applicant submitted numerous letters of support from SPOs. Ms. Snyder explained the red, detached garage caused the applicant to exceed the allowed lot coverage, and an addition to the accessory structure was removed, after the Board of Adjustment denied the request for a variance from the offset buildings. Ms. Snyder relayed the Development Engineer has indicated the parcel has an existing residential access off Coleman Avenue, which requires an Access Permit, and Patrick Street is a paved, local road with 60 feet of right-of-way and no traffic counts. She explained the application indicated residential traffic only. Ms. Snyder reviewed the seven (7) criteria for USRs, displayed images of the site and surrounding views, entered the favorable recommendation of the Planning Commission into the record, and relayed staff's recommendation for removal of a Condition of Approval. PLCTP/rtW) 30 /22. 2022-1765 PL2827 HEARING CERTIFICATION - JUAN ANTONIO GARCIA RAMIREZ (USR22-0005) PAGE 2 Lauren Light, Department of Public Health and Environment, stated the existing residence is served by an individual domestic well and an On -site Wastewater Treatment System (OWTS), which is permitted for four (4) bedrooms. She noted there is one Development Standard requested to be incorporated into the permit and Environmental Health has no outstanding issues with the request. Courtney Thomas, represented the applicant, and stated they encourage neighbors to take pride in their home and promote homegrown vegetation. Steve Teets, Greeley, stated this is a good idea, given the food crisis. Ei In response to Chair James, Ms. Thomas indicated the applicant has reviewed, and agrees to abide by, the Conditions of Approval, as corrected, and Development Standards, as presented. The Board discussed the Conditions of Approval (COA). Ms. Snyder recommended removal of COA #2 (setback and offset requirements) as they have been met. The Board reviewed the Development Standards (DS), which were accepted as presented. The Board agreed the aforementioned changes. No public testimony was offered regarding changes made to the Conditions of Approval. Ei Commissioner Moreno moved to approve the request of Juan Antonio Garcia Ramirez for a Site Specific Development Plan and Use by Special Review Permit, USR22-0005, to exceed the maximum allowed building coverage in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Saine, and it carried unanimously.
