A public hearing was conducted on July 25, 2022, at 9:00 a.m., with the following present:

The following business was transacted:
A public Probable Cause hearing, PCSC22-0010, was conducted to consider setting a Show
Cause Hearing to determine whether or not the permittee, Paul Page, is in compliance with certain
Development Standards contained in Use by Special Review Permit, USR-413, for Aircraft
Storage and Salvage in the A (Agricultural) Zone District, Bruce Barker, County Attorney, made
this a matter of record.
Diana Aungst, Department of Planning Services, provided the general location of the site and
stated the permittee, Paul Page, had just told to her the property is for sale and going under
contract. She presented a brief summary of the original USR, approved in July of 1980, for Aircraft
Storage and Salvage and mentioned the Town of Erie contacted Weld County in April, 2022, with
concerns of construction work and fill/concrete being brought onto the property, as well as a large
amount of truck traffic, causing severe dust issues. She stated staff from the Department of Public
Health and Environment (EH) conducted a site visit in May 2022, and observed the property
owner/operator was engaging in sand and gravel stockpiling and mining, and indicated the
property owner worked with EH staff and the State of Colorado to obtain an Air Pollution Emission
Notice (APEN) permit. Ms. Aungst stated she conducted a site visit on June 13, 2022, confirmed
the observations by EH staff, as well as the storage of telephone poles on pallets, other
miscellaneous items, cargo containers leased as storage units, construction trailers, commercial
vehicles and two (2) 500 -gallon fuel cubes. She displayed images of the site, recommended the
applicant submit a Pre -Application request form to address the Use changes on the site, and
relayed the applicant stated they are conducting some of the allowed uses listed in the original
USR inside of a building, but indicated she was not given a tour of the building so she cannot
confirm that.

=1 Paul Page, property owner, stated he is currently negotiating the sale of the property with a
local school district which has intentions to clear the property after giving sufficient notice to the
current tenants. He indicated, if the school district purchases the property, there would be a
five (5) year buildout plan and the clearing of the property would happen immediately after the
sale. Commissioner Freeman suggested the Board continue the Probable Cause hearing to
October 24, 2022, at 9:00 a.m., to allow Mr. Page adequate time to get the property under
contract.
e. In the matter of Probable Cause hearing, PCSC22-0010, Commissioner Freeman moved to
continue the matter to October 24, 2022, at 9:00 a.m., to allow the potential contract, for sale of
the subject property to a local School District, to commence. The motion was seconded by
Commissioner Saine, and it carried unanimously. There being no further discussion, the hearing
was completed at 11:01 a.m.
This Certification was approved on the 8th day of August, 2022.
