( 2) The Railroad Company reserves unto itself at all times dur- ing the term of this license, the right to use said premises, or to license the use of said premises, for sewers, water mains, conduits, and ether underground construction ( except oulverts or bridges to be constructed thereon as a part of said highway), and also for tele- phone, telegraph, and power and light transmission wires, and all other kinds of aerial construction, together with the supports therefor, and for all other purposes, including the use of the surface of said premises, not inconsistent with the maintenance and use by the second party of said public highway thereover. (3) The said highway shall be oonstruoted and maintained by the second party at its sole cost and expense, and the second party shall be charged with all duty and obligation as to the due and pro- per construction, maintenance and use of said highway, it being under- stood and agreed that the first party does not warrant its premises to be in a suitable condition for the use herein granted; and that the second party shall release and protect, indemnify and save harm- less the first party from all claims, demands, suits, judgments, costs and expenses for loss, damage or injury to the person or property of any person or persons, whomsoever, in any manner arising from, or growing out of, the construction, maintenance, existence or use of said highway on the said premises of the first party and to whatsoever cause. (4) It is further understood and agreed that if at any time in the future any change in the use of its said premises by the first party shall in its judgment mete such action necessary, the first party shall have the right, upon six months' notice in writing to the second party, to terminate this license, and that upon the expiration of said notice period, all the tights and privileges herein granted to the second party shall cease and determine. ( 5) This license shall be binding upon the successors or assigns of the parties hereto. Dear Madam:- Replying to your recent letter relative to right of way for road purposes through your land , I beg to advise that the County Surveyor has not yet completed his survey of the entire line of road. The road in question extends from the Logan County line East of Stoneham. thence along the IBurlington right of way to a point just north of the town of Buckingham, thence Westward to Briggsdale , thence in .a Southwesterly direction to Cornish on the Union Pacific. , thence West through the town of Eaton to the Larimer County line on the West side of Weld County. This entire line has been designated by the State Highway Commission as a State Primary Road, which should be of considerable importance to the territory through which it passes. When the Surveyor ,bas completed his survey and makes his report to the Board of County Commissioners and the viewers who viewed the road, the matter of damages will be further considered. North line of section 30 township 8 north range 59 west ; thence west on the section to the northwest corner of said section 30; thence west to the northwest corner of section 28 township 8 range 60; thence from the northwest corner of section 26-8-61 west on section line to the northwest corner of section 30 said township and range; we also viewed that part of proposed road commencing at Buckingham on the Burlington Railroad, thence on the south side of the right of way of said road to the town of Sligo. the last named point being the terminus thereof, and the road as above laid out and viewed being over the most practicable route which we, in our judgment, can find. We found it necessary to make the following changes in the proposed route as prayed for, mz: We the viewers herein recommend that the line of road prayed for be alter- .--- ed and laid out as follows: Commencing at the Logan County Line on the Fast - ► range line of range 56 just south of the Burlington railroad right of way and adjoining said right of way on the south; thence westerly along the south side of said right of way to a point where the said right of way crosses the town- ship line between townships 7 and 8 in range 57, connecting at that point with an established road known of record as No. 453 granted July 8th, 1902; thence commencing on the north line of section 2 township 7 N. R. 58 W. , at the intersection of the south line of the right of way of the Bulrington rail- road, thence following said right of way westward to a point where said right of way intersects the north line of section 30 township 8 N. R. 59 west; thence west on section line 'to the northwest corner of said section 30; thence - west to the northwest corner of sect on 28, T. 6 A. R. 6O W. , tnencw -from the northwest corner of section 26, P. 8 N. R. 61 W. , west on section line to the northwest corner of section 30 said township and range ; We recommend that no action be taken on any part of said proposed road that has been here- tofore established. We further recommend that that part of proposed road commencing at the north line of section 30, T. 8 N.
