HomeMy WebLinkAbout20222873.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, OCTOBER 17, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 17, 2022, at the hour of 9:00 a.m. irk; irAT ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli 1 MINUTES: Commissioner Buck moved to approve the Minutes of the Board of County Commissioners meeting of October 3, 2022, as printed. Commissioner Moreno seconded the motion and it carried unanimously. 't` READ ORDINANCE BY AUDIO: Commissioner Freeman moved to read Code Ordinance #528-A by audio. The motion was seconded by Commissioner Buck, and it carried unanimously. PUBLIC INPUT: No public input was given. iE AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Commissioners Buck and Freeman each indicated their respective departments are doing well. Commissioner Moreno reported Weld Project Connect will be held Thursday, October 20, 2022. Commissioner Saine reported the Department of Human Services conducted a department -wide, self -care event that was well received. Chair James confirmed Weld Project Connect will be held later this week, with Commissioners Perry, Freeman and Moreno being in attendance. Minutes, Monday, October 17, 2022 Page 1 2022-2873 BC0016 IR WARRANTS: 1) GENERAL WARRANTS - OCTOBER 13, AND 14, 2022: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner Freeman seconded the motion and it carried unanimously. i'.i 2) COMMISSIONER WARRANTS (LORI SAINE) - OCTOBER 14, 2022: Commissioner Moreno moved to approve the Warrant, as printed. Commissioner Buck seconded, and upon a roll call vote of four (4) to zero (0), the motion carried with Commissioner Saine recused. LEI BIDS: 1) APPROVE BID #62200136, JAIL 1 WEST ROOF TOP UNIT REPLACEMENT - FACILITIES DEPARTMENT: Christie Peters, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, NoCo Energy Solutions, LLC, for a total amount of $295,134.00. Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner Moreno, and it carried unanimously. t2 NEW BUSINESS: 1) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR MAIL BALLOT DROP-OFF BOX AND VIDEO SURVEILLANCE RECORDING SYSTEM, AND AUTHORIZE CHAIR TO SIGN — TOWN OF PLATTEVILLE: Bruce Barker, County Attorney, on behalf of Carly Koppes, Weld County Clerk and Recorder, stated this agreement allows for a drop-off box with video surveillance, purchased and owned by Town of Platteville, for mail -in ballots during the 2022 Election. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. fa 2) CONSIDER LOBBYING AGREEMENT AND AUTHORIZE CHAIR TO SIGN - COLORADO LEGISLATIVE SERVICES, LLC, DBA COLORADO LEGISLATIVE STRATEGIES: Don Warden, Director of the Department of Finance and Administration, stated this agreement is a continuation of services and reflects a nine percent (9%) increase from last year, for a fee in the amount of $72,268.00, consistent with the Cost -of -Living Allocation (COLA) for the 2023 legislative session. Commissioner Moreno moved to approve said agreement and authorized the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. 'rm 3) CONSIDER TEMPORARY CLOSURE OF CR 50 BETWEEN CRS 53 AND 55 (CONT'D FROM 10/10/2022): Amy Mutchie, Department of Public Works, stated this closure will begin on October 31, 2022, and go through November 3, 2022, for the replacement of an irrigation culvert, and water will be used for dust mitigation on the gravel portions of the detour route. Commissioner Moreno moved to approve said temporary closure. The motion was seconded by Commissioner Buck, and it carried unanimously. LB 4) EMERGENCY ORDINANCE NO. 258- A, IN THE MATTER OF A SUPPLEMENTAL APPROPRIATION FOR 2022: Jennifer Oftelie, Budget Manager, stated this is the first of two (2) supplemental appropriations to allow for unexpected adjustments to be made for the 2022 Final Budget. She referenced the exhibits that detail the balance of funds, including a $1.18 million reduction to the General Fund. No public testimony was made concerning this matter. Commissioner Moreno moved to approve Emergency Ordinance No. 258-A. The motion was seconded by Commissioner Buck, and it carried unanimously. Minutes, Monday, October 17, 2022 Page 2 2022-2873 BC0016 - 5) SECOND READING OF CODE ORDINANCE #2022-07, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 3 HUMAN RESOURCES OF THE WELD COUNTY CODE (APPEARANCE/DRESS CODE AND SICK/LEAVE TIME): Commissioner Freeman moved to read Code Ordinance #2022-07 by title only. The motion was seconded by Commissioner Buck, and it carried unanimously. Mr. Barker read the title for the record. Ryan Rose, Director of Administrative Services, alongside Jill Scott, Director of the Department of Human Resources, stated there have been no changes since First Reading. No public testimony was made concerning this matter. Commissioner Moreno moved to approve Code Ordinance #2022-07 on Second Reading. The motion was seconded by Commissioner Freeman, and it carried unanimously. PLANNING: 1) CONSIDER VACATION OF USE BY SPECIAL REVIEW PERMIT, USR18-0028 - DITTMER FARM, LLC, AND BLUE PILL, LLC, BOTH C/O TIMOTHY DITTMER (CONT'D FROM 4/18/2022): Michael Hall, Department of Planning Services, detailed the history of Use by Special Review Permit, USR18-0028, and stated the original request was to rescind; however, the plat was subsequently recorded by the applicant outside of County staff protocol, and Mr. Dittmer has produced proof that he is the sole manager of both entities. Timothy Dittmer, applicant, was present and confirmed the decision to change course in action and vacate the use was due to the business partner who passed away earlier this year. Commissioner Saine moved to approve said vacation. The motion was seconded by Commissioner Freeman, and it carried unanimously. (Clerks Note: Commissioner Buck introduced her niece, Heidi Schilling, for the record and stated she is shadowing for the day as a career development opportunity.) RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. Ordinance #258-A was approved on an emergency basis; and Code Ordinance #2022-07 was approved on Second Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
