The proposal has been reviewed on behalf of the Weld County Department of Public Works and the
Department of Planning and Zoning. Staff comments made during this phase of the application process
may not be all-inclusive, as other issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site -Specific Development Plan and Use by Special Review to exceed the maximum
allowed building coverage in the A (Agricultural) Zone District in the Aristocrat Ranchettes subdivision from
10.3% to 12%.
This project is north of and adjacent to Lamb Avenue — Aristocrat Ranchettes and is east of Patrick Street.
Parcel number: 130926309007.
Access is via Lamb Avenue to Patrick Street.
ACCESS
Development Review has reviewed the application materials related to access.
The applicant has proposed using Lamb Avenue to access Patrick Street, the closest County -maintained
road. The applicant shall obtain an access permit for this location on Patrick Street.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access location with Development Review prior to laying out your
site plan. All "preliminarily approved" accesses are subject to change during the access permitting process.
Per Sec. 24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road.
Minimum access spacing widths are shown in Weld County Code Sec. 8-14-30. Please refer to Chapter 8
of the Weld County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
The proposed parcel uses Lamb Avenue to access Patrick Street. Lamb Avenue has platted right-of-way,
dedicated to Weld County, that is privately maintained as part of the subdivision Aristocrat Ranchettes 3rd
FG. The submitted map shall show this right-of-way, provide creation document information, and shall label
it as privately -maintained. The map shall also include the access to the site from the maintained County
Road, Patrick Street., from the lot to and including the maintained County Road access point. The physical
location of the road within the right-of-way or easement shall be shown on the plat. Reception numbers
shall be referenced for right-of-way or easement documents. Please contact Development Review with
questions.
Patrick Street is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way (along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the required
setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered
in the right-of-way. This road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way
or easement. Right -of -Way Use Permit instructions and application can be found at
https://www.weldgov.com/departments/publicworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
No recent traffic information is available for Patrick Street.
Traffic information submitted with the application materials indicates that traffic will be typical of a residential
dwelling (i.e. approximately 9 round trips per day).
No additional traffic information is needed.
DRAINAGE REQUIREMENTS
This area IS within a Non -Urbanizing Drainage Area Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -
URBANIZING areas.
Detention pond waived and a simple drainage narrative
The applicant has submitted a drainage narrative stating that the site meets drainage exception 8.
Development of sites where the change of use does not increase the imperviousness of the site. Located
in Sec. 8-11-40. Drainage Policy.
No additional stormwater management and detention information is needed.
Historic Flows
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
CONDITIONS OF APPROVAL
The USR map shall be amended to delineate the following:
1. Patrick Street is a gravel road and is designated on the Weld County Functional Classification Map
as an local road which requires 60 feet of right-of-way at full buildout. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way (along with the documents
creating the existing right-of-way) and the physical location of the road. All setbacks shall be
measured from the edge of right-of-way. This road is maintained by Weld County. (Development

2. Lamb Avenue is a gravel road with platted right-of-way, dedicated to Weld County, that is privately
maintained as part of the subdivision Aristocrat Ranchettes 3rd FG. The submitted map shall show
this right-of-way, provide creation document information, and shall label it as privately -maintained.
The map shall also include the access to the site from the maintained County Road, Patrick Street.,
from the lot to and including the maintained County Road access point. The physical location of the

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. Prior to the release of building permits, the applicant shall be required to submit a complete access
application for the "preliminarily approved" access location as shown on this plan. (Development

3. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review)

Environmental Health Services has reviewed this proposal for a Site -Specific Development Plan and
Use by Special Review to exceed the maximum allowed building coverage in the A (Agricultural)
Zone District in the Aristocrat Ranchettes subdivision 10.3% to 12%.
The existing residence is served by an individual domestic well (296569) and an on -site wastewater
treatment system (OWTS) permitted for 4 bedrooms (SP -1500070). The OWTS is located to the east
of the residence and appears to meet setback requirements from the building.
We recommend that the following requirement be incorporated into the permit as a development
standard:
1. All structures must meet the required setbacks from the existing On -site Wastewater
Treatment System in compliance with provisions of the Weld County Code,
pertaining to On -site Wastewater Treatment Systems.

Dear Angela Snyder:
We have received the May 16, 2022 proposal for a site specific development plan and use by special
review permit for buildings exceeding the maximum building coverage in the A (Agricultural) Zone
District.
This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S.
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county
planning directors, this office will only perform a cursory review of the referral information and provide
informal comments. The comments do not address the adequacy of the water supply plan for this project
or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the
comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The water supply source for the property is a well operating under permit no. 296569. It is unclear if
the proposed additional building will have a water demand. Permit no. 296569 was issued December 24,
2014 pursuant to section 37-92-602(3)(b)(II)(A), C.R.S. as the only well on 1.05 acre described as lot 7,
block 78, filing 3, Aristocrat Ranchettes Subdivision. The well is permitted to withdraw groundwater from
the not-nontributary Lower Arapahoe aquifer to be used for ordinary household purposes inside one
single-family dwelling. This office has no comments on the proposal as long as the terms and conditions
of permit no. 296569 are complied with. Should the applicant wish to use the well for uses beyond those
permitted, the applicant would need to first obtain a well permit that allows for such uses.
