RESOLUTION RE: ACTION OF BOARD CONCERNING SHOW CAUSE HEARING, PCSC22-0002, CONCERNING PLANNED UNIT DEVELOPMENT FINAL PLAN, PF-622 - ESTATES AT HILL LAKE HOA, C/O STACY KISSAM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 16, 2022, a Show Cause Hearing was conducted to show whether or not Estates at Hill Lake HOA, c/o Stacy Kissam, 18620 Hill Lake Drive, Johnstown, Colorado 80534, was in compliance with certain Conditions of Approval (plat notes) contained in Planned Unit Development Final Plan, PF 622, and, WHEREAS, Estates at Hill Lake HOA, c/o Stacy Kissam, is the current owner of the PUD located on property being further described as follows: Open Space, The Estates at Hill Lake PUD; being part of the NW1/4 of Section 31, Township 4 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on February 16, 2022, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, finds that the site is now in compliance, due to Staff's concerns about the detention pond being satisfied pursuant to the signed and stamped letter and map (Labeled Exhibit 1) from Dennis R. Messner, P.E., dated February 8, 2022, a copy of which is attached hereto and incorporated herein by referenced, detailing why the installation of an outlet structure and a drainage pipe are not necessary, and WHEREAS, with the PUD being brought into compliance with the plat notes, the Board deemed it advisable to dismiss said matter and vacate the hearing previously scheduled for June 15, 2022. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the signed and stamped letter and map (Labeled Exhibit 1) from Dennis R. Messner, P.E., dated February 8, 2022, submitted by the Estates at Hill Lake HOA, c/o Stacy Kissam, brings the site into compliance with certain Conditions of Approval (plat notes) contained in Planned Unit Development Final Plan, PF 622, and that the Show Cause Hearing be, and hereby is, dismissed. It is my professional opinion that their is no need for any outlet structure for the "Detention Basin" identified as A. The basin functions as an Infiltration Basin and, as such, there is no need for an outlet structure. Due to the soil composition and the permeability of the soils of the subdivision, for whatever reason, the storm water on this property is either fully absorbed prior to entering the basin or if it does enter the basin, it continuously infiltrates the into the basin. In addition, the basin operates passively and does not subject the stormwater runoff to any active treatment process, the basin operates solely for stormwater management and the basin does not impound any water from the use of downstream users/owners. Further the basin works without the intervention of any man made/controlled outlet structure, i.e., being an Infiltration Basin negates the need for an outlet structure and discharge pipe. The Inspection Report is attached. The inspector found that, while the Swale serving the northernmost two lots was in compliance with the approved drainage report and detention design, the detention pond serving southernmost seven lots was missing the outlet structure. At the Probable Cause hearing on February 7, 2022, the Board instructed the Homeowners Association of The Estates at Hill Lake (the HOA) that, if a signed and stamped letter from an engineer stating that the pond was sufficient to manage the stormwater 01 180 neighborhood without the missing outlet structure, then the case could be dismissed. Cu February 9, 2022, the County received a signed and stamped letter from Dennis R. Messner, P.E., the original engineer who designed the stormwater management system for the neighborhood, stating, "The basin functions as an Infiltration Basin and, as such, there is no need for an outlet structure." Recommendation The Department of Planning Services requests the Show Cause case be dismissed on grounds that the subdivision stormwater management plan is compliance. PCSC 18-0022 Page1of1
