Box 1376, Greeley, Colorado 80632, and WHEREAS, Bennie Rodriguez is the current owner of the facility located on property being further described as follows: Lot A of Recorded Exemption, RE -2063; being part of the NW1/4 of Section 35, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing of February 9, 2022, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, finds that the site is now in compliance due to no evidence of anyone living on the site, and, therefore, deemed it advisable to dismiss said matter. Buck 2022-0139 PL1619 MEMORANDUM TO: Board of County Commissioners DATE: February 7, 2022 FROM: Chris Gathman — Planner III SUBJECT: PCSC21-0039 - Show Cause Hearing to determine if applicant is in compliance with USR-1371 (Storage Units) Property Information: Property Owner: Bennie Rodriguez Property Address: 4236 W. 49th Street Parcel Number: 0959-35-2-00-011 Legal Description: Lot A Recorded Exemption RE -2063, Part of the NW4 Section 35, T5N, R66W of the 6th PM USR-1371 Background: USR-1371 (storage units) was approved by the Board of County Commissioners on August 14, 2002. The USR was approved for indoor storage buildings, no outside storage. The applicant was the current owner (Bennie Rodriguez). Complaint Background: Prior to 1/10/2022 Probable Cause Hearing: The Department of Planning Services received an e-mail and photos from the Front Range Fire Rescue re: a vehicle (sedan) being lived in on -site and an RV potentially being occupied on the property. Front Range had responded to the site on two occasions in response to emergency medical calls. Also, Front Range Fire Rescue stated that the applicant had not completed installation of the Knox Box on the property. The property owner had been contacted by the Fire District — but they had not been able to get calls back to arrange an appointment with the Fire District to install the keys in the Knox Box. The Fire District also indicated that the couple that had been living on -site were employees and were given keys by Mr. Rodriguez. Since the 1/10/2022 Probable Cause Heari Chris Gathman visited the site on 2/3/2022, met with Mr. Rodriguez and took photos. The vehicle that was being lived in was no longer on -site. Staff could find no evidence that other automobiles on site were being occupied. The RV was not connected to power and had a pad -lock installed. This was consistent with the condition of the unit in Summer/Fall of 2021. There were some footprints in the snow outside of the entrance. Mr. Gathman discussed the site with Mr. Rodriguez. Mr. Rodriguez stated that the husband that was living in the sedan on -site had since passed away and that the wife had moved to another facility. Mr. Rodriguez stated that the RV was not being lived in and indicated his son occasionally accessed the RV to make repairs. Mr. Rodriguez stated that the Front Range Fire District had met with him and installed keys and locked the Knox box. Mr. Drage confirmed that this had occurred. The Board of County Commissioners found probable cause of a violation of the following development standards and scheduled a Show Cause Hearing for February 9, 2022: Standard 1 A Site Specific Development Plan and Use by Special Review Permit #1371, is for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (storage units) in the A (Agricultural) Zone District, as indicated in the application materials and subject to the Development Standards stated hereon. Standard 12 The site shall be used for self -storage for lease to customers only. No vehicle washing, concrete processing, mixing, pouring or forming shall be conducted on - site. Standard 17 No parking of vehicles except that of employees and patrons visiting the site. Standard 18 The property owner or operator shall be responsible for complying with the development standards of Section 23-2-240, Weld County Code. Standard 21 The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. Standard 22 The property owner or operator shall be responsible for complying with all of the foregoing development standards. Noncompliance with any of the foregoing development standards may be reason for revocation of the permit by the Board of County Commissioners. SHOW CAUSE CODE SECTIONS/CONSIDERATIONS: The Board of County Commissioners scheduled PCSC21-0038 for a Show Cause hearing for Wednesday, February 9, 2022: Section 2-4-50.O of the Weld County Code: Where the Board is considering the revocation or suspension of a permit or license, including but not limited to uses by special review and permits issued under Chapter 21, but specifically excluding liquor licenses, the Board shall consider evidence and statements in mitigation and in aggravation of the violation prior to determining the appropriate penalty. Such evidence and statements may relate to and include, but not be limited to, the following: 1.The compliance history of the party against whom the complaint was made with respect to the permit at issue or other County -issued permits. 2.Good faith efforts on behalf of the person against whom the complaint is made to comply. 3. Duration of the violation. 4. Economic benefit of noncompliance to the person against whom the complaint is made. 5.Impact on, or threat to, the public health or welfare or the environment as a result of the violation. 6. Malfeasance. 7.Whether legal and factual theories were advanced for purposes of delay. 2 In addition to the factors set forth in this Subsection, the following circumstances shall be considered as grounds for reducing or eliminating penalties: 8.The voluntary and complete disclosure by the person against whom the complaint is made of such violation in a timely fashion after discovery of the noncompliance. 9. Full and prompt cooperation by the person against whom the complaint is made following disclosure of the violation, including, when appropriate, entering into a legally enforceable commitment to undertake compliance and remedial efforts. 10.The existence and scope of a regularized and comprehensive environmental compliance program or an environmental audit program. 11 Substantial economic impact of a penalty on the violator 12.Other mitigating factors. Where a civil penalty in lieu of suspension is available, the Board shall first impose the revocation or a term of suspension. The amount of the civil penalty shall then be determined on the basis of imposing an economic penalty equivalent to the loss which would have occurred had the facility not operated during the term of the suspension. A portion of the civil penalty may be deferred on the condition that certain actions to correct the violation be taken. The failure to pay the civil assessment will result in imposition of the suspension. ii94►IIF-11i:[s]L►LN.Xu11€i1'1y i.]2:["III[.1 • Dismissal • Continue to Later Hearing Date • Suspension • Fine • Revocation • Injunctive Action STAFF COMMENTS: Staff could not find evidence of anyone living on -site (ongoing violation) when visiting the site on 2/3/2022 and the Knox Box has been secured. However, staff has concerns regarding the ability of this property to remain in compliance in the future. Section 2-4- 50.0 of the Weld County Code allows the Board to consider the compliance history of this site. This is not the first violation on this site for vehicles being occupied for living purposes. Staff received a complaint and photos regarding RVs being occupied on -site in December 2020. A probable cause/show cause process was initiated under PCSC20- 0030 (which was eventually dismissed after the property was brought in compliance). Staff is also concerned that after the Show Cause PCSC20-0030 was dismissed on October 27, 2021, it took the Mr. Rodriguez until January 2022 to get the keys placed and Knox Box locked. Front Range Fire Rescue indicated at the probable cause hearing that they had made many attempts to contact Mr. Rodriguez about the Knox Box prior to this. 3 PCSC21-0039 Owner: Bennie Rodriguez Legal Description: Lot A of Recorded Exemption RE -2063; Part of the NW4 of Section 35, T5N, R66W of the 6th PM Location: South of and adjacent to 49th Street and Approximately 3,725 feet west of 35th Avenue. HISTORY OF THE FACILITY August 14, 2002 USR-1371 —Use permitted as a USR for a Use by Right, An Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (Storage Units) approved by the Board of County Commissioners August 17, 2002 Planning Staff had a pre -application meeting with Mr Rodriguez to discuss adding additional storage units for indoor RV storage Amended USR application was never submitted Dec 9, 2021 Front Range Fire Protection District sent an e-mail indicating paramedics had visited to the site in response to a medical situation for a couple living in a vehicle onsite Photos were provided photos indicating motor vehicles being occupied/lived in on site along with an RV being occupied Also, Knox Box had not yet been secured Dec 29, 2021 Front Range Fire Protection District sent an e-mail indicating that there have been two medical incidents on site — December 9th and December 28th Jan 10, 2022 Board of County Commissioners determined Probable Cause of a violation and scheduled for a Show Cause Hearing for Feb 9, 2022 Feb 3, 2022 — Staff conducted Site Visit, met with on -site with Mr Rodriguez and took photos Feb 4, 2020 - Ty Drage — Deputy Fire Chief - Front Range Fire Rescue — confirmed that Front Range Fire met onsite with Mr Rodriguez and installed and locked keys in the Knox Box J SUBJECT: Probable Cause Hearing for USR-1 371 - A Site Specific Development Plan and Use by Special Review Permit for a Use Permitted as a Use by Right, an Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (Storage Units) in the A (Agricultural) Zone District. Hi Chris, I wanted to let you know that Mr. Rodriguez has scheduled with us to put the padlock key in the Knox box tomorrow morning (1/20/22). I'll let you know once that has been completed. Also, I've been thinking about the Show Cause hearing coming up next month for Mr. Rodriguez. Since the majority of the information we have regarding reported violations of his USR comes from our responding company officers, the only testimony I may be able to legally provide is presenting our incident reports. Unfortunately, the incident reports I've got from those two medical calls are very light and do not provide the level of detail that would support any findings regarding the issue at hand. I've had several conversations with Lt West, who was on the 12/9/21 incident. He's got quite a bit of information that he did not include in his incident report. Since it would be hearsay if I were to testify about it, do you need him to be present for the hearing? Or, in lieu of him being present, could he provide a sworn written statement that provides the additional information that was not included in his original incident report? Please let me know what you'll need from us on this. Thanks Chris, Yes, we were able to get the gate keys locked in the Knox box, so that's been addressed. I'm sorry to hear that the individual in question may have passed away, but I'm optimistic that we won't see anyone else living in the storage facility. I'm not entirely sure I trust that, given Mr. Rodriguez's track record, so it's definitely something I would like to bring up for consideration on how best to help him manage that. Mr. Rodriguez indicated he had met with your Department re the knox box. Just confirming that this has been finalized. I could not find any vehicles or RVs being occupied/lived in on -site during my visit. He indicated that the previous occupant of the care (I believe) had passed away — his wife was no longer living on -site as well. Took several photos. I verified that the existing RV/camper on -site was not plugged in (at least as best I could with the snow covering the ground). Also, I've been thinking about the Show Cause hearing coming up next month for Mr. Rodriguez. Since the majority of the information we have regarding reported violations of his USR comes from our responding company officers, the only testimony I may be able to legally provide is presenting our incident reports. Unfortunately, the incident reports I've got from those two medical calls are very light and do not provide the level of detail that would support any findings regarding the issue at hand. I've had several conversations with Lt West, who was on the 12/9/21 incident. He's got quite a bit of information that he did not include in his incident report. Since it would be hearsay if I were to testify about it, do you need him to be present for the hearing? Or, in lieu of him being present, could he provide a sworn written statement that provides the additional information that was not included in his original incident report?
