On behalf of Public Service Company of Colorado (PSCo), a Colorado corporation doing business
as Xcel Energy, POWER Engineers has prepared this letter to demonstrate the potential effects of
the Northern Colorado Area Plan: Ault to Cloverly Transmission Project (Project) in Weld
County, Colorado on state -protected species (threatened, endangered, and species of special
concern).
Project Description
PSCo is proposing to construct, operate, and maintain an approximately 15.9 -mile -long 115/230
kilovolt (kV) overhead electric power transmission line and associated electric power substation
(Figure 1). The Project's preferred and alternative transmission line routes are primarily located in
unincorporated Weld County, Colorado with the remainder located in the Town of Ault and the
Town of Eaton. The location of the final preferred route is subject to change based on landowner
discussions, and the County and municipal permit process.
The majority of the land crossed by the Project consists of irrigated agriculture, rural residential,
commercial, industrial, urban development and transportation infrastructure (i.e., roadways,
railroads). Construction would occur entirely on private land and primarily in areas that have been
previously disturbed, such as along railroad rights -of -way, Highway 85, and county roads.
Wetlands and drainages would be spanned by the transmission line and vegetation would not be
removed or disturbed in these areas.
As part of the Project's Transmission Line Routing and Substation Siting Study, a Community
Working Group was formed to provide input on transmission routes and substation sites, and Xcel
Energy appreciates your participation as the Colorado Parks and Wildlife (CPW) representative
for the Community Working Group.
Methodology
To determine the potential effects of the proposed Project on state protected species, POWER
Engineers biologists conducted a study consisting of the following four steps: (1) compiled a list
of state -protected species potentially occurring in the Project area (defined as a 300 -foot -buffer of
the Project centerline) from the CPW threatened and endangered list (CPW 2020); (2) conducted a
literature review of the habitat requirements for each species; and (4) conducted a field visit of the
Project area on December 15, 2020 to verify the presence/absence of suitable habitat from

Results
State -Protected Species
Five state -protected species have potential to occur in the Project area according to CPW (Table 1;
CPW 2020). The northern portion of the Project area, between the existing Ault substation and
County Road 29, contains undisturbed prairie remnants, fallow agricultural fields, and non-native
grasslands that provide suitable habitat for burrowing owl (Athene cunicularia), black -tailed
prairie dog (Cynomys ludovicianus), and swift fox (Vulpes velox). Suitable habitat for these
species was not observed in any other portions of the Project area, which are characterized by
actively farmed agricultural fields, irrigated pasture, highly disturbed field edges and ditches,
industrial lands and other developed areas, and railroad rights -of -way.
Other state -protected species that may occur in the Project area are bald eagle (Haliaeetus
leucocephalus) and ferruginous hawk (Buteo regalis). Bald eagle nest sites, roost sites, and winter
concentration areas are located approximately 0.5-2 miles from the Project area (CPW 2015).
Therefore, bald eagles may occasionally use the Project area for foraging. Large trees suitable for
nesting or roosting by bald eagles or other large raptors are not present in Project area. Similar to
bald eagles, ferruginous hawk may also occasionally use the Project area for foraging.
If construction of the Project occurs during the nesting season, nest surveys will be conducted for
raptors and other migratory birds following CPW and USFWS guidelines. Appropriate nest buffer
zones would be established specific to each species until nests are no longer active, thereby
minimizing impacts on raptors and other migratory birds.

Portions of the Project not visible from publicly accessible vantage points were reviewed using

Results
The USFWS IPaC list (attached) identified nine ESA -listed species that have the potential to
occur within the Project area (USFWS 2020a; see attached IPaC list). No USFWS-designated
critical habitat for ESA -listed species was identified on the IPaC list. The regulatory status, habitat
descriptions, and occurrence potential for each species is provided in Table 1. Five of the species
are not known to occur in Colorado (least tern [Sterna antillarum], pallid sturgeon
[Scaphirhynchus albus], piping plover [Charadrius melodus], Western prairie fringed orchid
[Platanthera praeclara], and whooping crane [Grits americana]), but because the Project is in the
Platte River Basin, these species are included for consideration of potential water depletions in the
Platte River Basin that may have downstream effects on these species in Nebraska. Water for
construction of the Project would be brought in from off -site sources by a construction water
provider. The source of the construction water would be from either a private well owned by the
construction water company or from a municipality. No existing water rights will be impacted and
there would be no long-term use of water. Therefore, the Project would not be expected to result
in any measurable changes to water levels of downstream hydrological systems or ESA -listed
species in Nebraska.

Based on the results of the field visit and a follow-up review of Google Earth for areas not visible
from publicly accessible vantage points, there is no suitable habitat for Mexican spotted owl (Strix
occidentalis lucida), eastern black rail (Laterallusjamaicensis ssp. jamaicensis), or Preble's
meadow jumping mouse (Zapus hudsonius preblei) in the Project area. Mexican spotted owls are
found in canyons and montane forest, neither of which occur in Weld County, Colorado. Eastern
black rail habitat in Colorado consists of shallow wetlands dominated by cattails, which were not
observed during the field visit or in the Google Earth review. Additionally, eastern black rails are
not known to occur in northern Colorado. Preble's meadow jumping mouse is known to occur
within 5 miles of the Project (CNHP 2019), but areas near water with adequate cover were not
observed during the field visit or through the Google Earth review.
Ute ladies' -tresses (Spiranthes diluvialis) are known to occur within 5 miles of the Project (CNHP
2019), but the presence/absence of suitable habitat could not be verified during the field visit or
based on a desktop review of the USFWS National Wetland Inventory (NWI)/Google Earth. The
Google Earth review identified two small areas of potential habitat located on private land
adjacent to an irrigation canal that would be crossed by the northern portion of the Project,
between the Ault Substation and US Highway 85. Both areas appear greener than the surrounding
landscape and may experience seasonally saturated soils and support hydrophytic vegetation. One

(AKN). The AKN data is based on a growing collection of sum, banding, and citizen science datasets and is
queried and filtered to return a list of those birds reported as occurring in the 10km grid cell(s) which your project
intersects, and that have been identified as warranting special attention because they are a BCC species in that
area, an eagle (Eagle Act requirements may apply), or a species that has a particular vulnerability to offshore
activities or development.
Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your project area. It is not
representative of all birds that may occur in your project area. To get a list of all birds potentially present in your

What does IPaC use to generate the probability of presence graphs for the migratory birds potentially
occurring in my specified location?

How do I know if a bird is breeding, wintering, migrating or p went ar-round in my project area?

year-round), you may refer to the following resourc 5: Tht %nell Lab of Ornithology All About Birds Bird Guide, or
(if you are unsuccessful in locating the bird of jfterest there), the Cornell Lab of Ornithology Neotropical Birds
guide. If a bird on your migratory bird cieslist has a breeding season associated with it, if that bird does occur
in your project area, there may be njtjresenf�t some point within the timeframe specified. If "Breeds
elsewhere" is indicated, then �kcNke1?oes not breed in your project area.

What are the Ie. s of cncern for migratory birds?
Migratorirde ered through IPaC fall into the following distinct categories of concern:
"B 0wide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range
n ere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands);
2. CC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the
continental USA; and
3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of
the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in offshore areas from
certain types of development or activities (e.g. offshore energy development or longline fishing).
Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to
avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. For

For additional details about the relative occurrence and abundance of both individual bird species and groups of

Bird tracking data can also provide additional details about occurrence and habitat use throughout the year,
including migration. Models relying on survey data may not include this information. For additional information on

What if I have eagles on my list?
If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the
Eagle Act should such impacts occur.
Proper Interpretation and Use of Your Migratory Bird Report
The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priori
concern. To learn more about how your list is generated, and see options for identifying what other bi s e

Data limitations
The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level
information on the location, type and size of these resources. The maps are prepared from the analysis of high
altitude imagery. Wetlands are identified based on vegetation, visible hydrology and geography. A margin of rro
is inherent in the use of imagery; thus, detailed on -the -ground inspection of any particular site may re
revision of the wetland boundaries or classification established through image analysis.
The accuracy of image interpretation depends on the quality of the imagery, the experien a of a it ge analysts,
the amount and quality of the collateral data and the amount of ground truth verifittor4 c ducted.
Metadata should be consulted to determine the date of the source imagery used an ny ap ing problems.
Wetlands or other mapped features may have changed since the date the ' e o field work. There may be
occasional differences in polygon boundaries or classifications be n e in r ation depicted on the map and
the actual conditions on site.
Data exclusions
Certain wetland habitats are excluded from t&Nat'DQnmapping program because of the limitations of aerial
imagery as the primary data source a odetlands. These habitats include seagrasses or submerged
aquatic vegetation that are foci tidal and subtidal zones of estuaries and nearshore coastal waters.
Some deepwater reef cornmtities (cdtal or tuberficid worm reefs) have also been excluded from the inventory.
These habitats, becaus o, ,thefr-4th, go undetected by aerial imagery.

di re anner than that used in this inventory. There is no attempt, in either the design or products of this
inve tory, to define the limits of proprietary jurisdiction of any Federal, state, or local government or to establish
the geographical scope of the regulatory programs of government agencies. Persons intending to engage in
activities involving modifications within or adjacent to wetland areas should seek the advice of appropriate federal,
state, or local agencies concerning specified agency regulatory programs and proprietary jurisdictions that may
affect such activities.

I wanted to correct and clarify some information I had written below in paragraph 3.
On page 2 of your letter, you had written that least terns, pallid sturgeons, piping
plovers, western prairie fringed orchids, and whooping cranes are not known to occur
in Colorado. You are correct that pallid sturgeons do not occur in Colorado and that
western prairie fringed orchids (WPFO) have not been documented in Colorado.
WPFO is "believed to occur [ecos.fws.govl" in Colorado. Least terns [cpw.state.co.us]
and piping plovers [cpw.state.co.us] breed/have bred in Bent and Kiowa counties, and
least terns have a "possible occurrence" in 28 counties as well, including Weld County.
Historic records of piping plovers breeding in Colorado include Adams, Washington,
and Logan counties. Current records include Prowers and Bent counties. Whooping
cranes in Colorado are experimental/nonessential [ecos.fws.govl, and this species
hasn't been documented in Colorado since 2010 [cpw.state.co.us]. Because your
project doesn't involve water -related activities/use in the North Platte, South Platte,
and Laramie River Basins, and doesn't contain suitable habitat for these species, I
agree with your "no effects" determination for these 5 species. Apologies that my
original statement was not entirely correct. I wanted to provide you with sources for
the caveats for the other species.
You may have already seen the Federal Register announcement [govinfo.govl stating
the that "interior" least tern will be removed from the Federal List of Endangered and
Threatened Wildlife, effective February 12, 2O21 due to successful recovery. And you
may already know about this source as well, but CPW has GIS public use data
available for download [hub.arcgis.com].

We received your letter about the Ault to Cloverly Transmission Project (FRE 199-
267416O476 [2O2O-12-31] EN) dates December 31, 2O2O. I have a few questions for
clarification.
On page 1, you wrote, "The location of the final preferred route is subject to change
based on landowner discussions, and the County and municipal permit process." Does
this statement mean that the preferred route could be something other than the two
options you provided in Figure 1? If so, I will put this request for technical
assistance on hold until all alternatives are developed. If you mean that the alternative
transmission route provided in Figure 1 may become the preferred transmission
route, and vice versa, please let me know. If you have shapefiles for each of the
proposed routes, can you please share those?
On page 2, you listed five species as "not known to occur in Colorado." Each of those
five species do occur in Colorado. However, they only need to be considered if the
project includes water -related activities and/or use in the North Platte, South Platte,
and Laramie River Basins.
On page 5, you wrote, "The Project would be constructed to span all wetlands and
drainages; therefore, the Project would not be expected to impact any suitable habitat
for Ute ladies' -tresses." By "spanning", do you mean the cable/wire will go over the
top of the potential habitat, but that no construction will occur in the potential
habitat? If there will be stream crossing by ATVs, trucks, cranes, etc., there may be an
impact to potential habitat, and a commitment to crossings that would not impact
potential habitat should be included in the project design.
