HomeMy WebLinkAbout20223544.tiffRESOLUTION RE: APPROVE EXPENDITURE AUTHORIZATION AND WORK PLAN FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) VETERAN'S SERVICE TO CAREER PROGRAM (VSCP), AND AUTHORIZE CHAIR TO SIGN ELECTRONICALLY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Expenditure Authorization and Work Plan for the Workforce Innovation and Opportunity Act (WIOA) Veteran's Service to Career Program (VSCP) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the Colorado Department of Labor and Employment, commencing July 1, 2022, and ending December 31, 2023, with further terms and conditions being as stated in said expenditure authorization and work plan, and WHEREAS, after review, the Board deems it advisable to approve said expenditure authorization and work plan, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Expenditure Authorization and Work Plan for the Workforce Innovation and Opportunity Act (WIOA) Veteran's Service to Career Program (VSCP) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the Colorado Department of Labor and Employment, be, and hereby is, approved. The Colorado Department of Labor and Employment (CDLE) has issued a funding stream under a Notice of Funding Authorization for Veteran's Service to Career Program (VSCP). The funding streams, programs, and activities are subject to the laws and regulations of the Colorado VSCP. The VSCP Grant provides expanded service options for Veterans in Weld County tailored to meet each Veteran's individual needs. This grant will complement services currently being offered under the Workforce Innovation and Opportunity Act (WIOA), including services for those Veterans who have not previously qualified for WIOA programs. The short title of this part 2 is the "Colorado Veterans' Service -to -career Not Program" SECTION 2. In Colorado Revised Statutes, add 8-14 3-201 5 as Capital letters or bold & italic numbers indicate new material added to existing statutes, dashes through words indicate deletions from existing statutes and such material not part of act follows 8-14.3-2015. Legislative declaration. (1) THE GENERAL ASSEMBLY FINDS, DETERMINES, AND DECLARES THAT (a) THE PILOT PROGRAM ENACTED IN HOUSE BILL 16-1267, WHICH CREATED THE COLORADO VETERANS' SERVICE -TO -CAREER PILOT PROGRAM THAT AUTHORIZED NONPROFIT AGENCIES TO PARTNER WITH WORK FORCE CENTERS SELECTED BY THE DEPARTMENT TO PROVIDE VETERANS AND OTHER ELIGIBLE PARTICIPANTS WITH SKILLS TRAINING, INTERNSHIPS, WORK PLACEMENTS, MEOTORSHIP OPPORTUNITIES, CAREER AND PROFESSIONAL COUNSELING, AND SUPPORT SERVICES, HAS BEEN SUCCESSFUL IN INCREASING THE EMPLOYMENT EATES FOR VETERANS, VETERANS' SPOUSES, AND ELIGIBLE PARTICIPANTS, AND (b) THE SERVICES OFFERED THROUGH THE PILOT PROGRAM WERE DESIGNED TO ENHANCE WORK FORCE CENTER SERVICES NOT AVAILABLE UNDER THE FEDERAL ACT (2) THE GENERAL ASSEMBLY FURTHER FINDS, DETERMINES, AND DECLARES THAT THE COLORADO VETERANS' SERVICE -TO -CAREER PILOT PROGRAM SHOULD CONTINUE AS A PROGRAM WHOSE GOAL IS TO ASSIST VETERANS, SPOUSES, AND ELIGIBLE PARTICIPANTS IN SEEKING, OBTAINING, AND RETAINING EMPLOYMENT SECTION 3. In Colorado Revised Statutes, 8-14 3-202, amend (1), (4), (5), (6), and (9), and add (5 5) and (8 5) as follows. 8-14.3-202. Definitions. As used in this part 2, unless the context otherwise requires (1) "Act' Opportunity Ad", means the FEDERAL "Workforce Innovation and Pub L 113-128 (4) "Eligible participant" means A (a) VETERAN, (b) VETERAN'S SPOUSE, PAGE 2 -HOUSE BILL 18-1343 (a) (c) A Veteran's dependent child who is twenty-six years of age or younger and lives m the home of the veteran, and (b) (d) A Veteran's caregiver who is eighteen years of age or older and has significant responsibility for managing the well-being of an injured veteran, AND (e) PERSON WHO IS ACTIVELY SERVING IN THE UNITED STATES ARMED FORCES AND WHO IS WITHIN SIX MONTHS OF BEING DISCHARGED UNDER CONDITIONS OTHER THAN DISHONORABLE OR A MEMBER OF THE NATIONAL GUARD OR MILITARY RESERVES WHO HAS COMPLETED INITIAL ENTRY TRAINING (5) "Integrated service and support center" means a nonprofit center that is affiliated with a work force center and veterans service offices or IN A CENTRALIZED LOCATION WHERE GOVERNMENT AGENCIES, NONPROFIT ORGANIZATIONS, AND OTHER ENTITIES COLLABORATE TO PROVIDE SERVICES TO ELIGIBLE PARTICIPANTS SERVICES OFFERED MAY INCLUDE ASSISTANCE FOR ELIGIBLE PARTICIPANTS IN SECURING FEDERAL BENEFITS, COUNSELING SERVICES, EMPLOYMENT SUPPORT, EDUCATION, LIFE SKILLS, AND WELLNESS SUPPORT (5 5) "INTERNSHIP" MEANS A TRAINING PROGRAM WITH A BUSINESS OR NONPROFIT ORGANIZATION DURING WHICH THE ELIGIBLE PARTICIPANT RECEIVES SKILLS TRAINING THAT COULD RESULT IN FUTURE EMPLOYMENT IN THAT SECTOR OR INDUSTRY (6) "Program" means the Colorado veterans' service -to -career pilot program CREATED IN THIS PART 2 (8 5) "WORK -BASED LEARNING" MEANS A CONTINUUM OF ACTIVITIES THAT OCCUR, IN PART OR IN WHOLE, IN THE WORKPLACE, PROVIDING THE LEARNER WITH HANDS-ON, REAL -WORLD WORK EXPERIENCE (9) (a) "Work force center" means a work force center created by a work force investment DEVELOPMENT board pursuant to the "Colorado CAREER ADVANCEMENT Act", part 2 of article 83 of this title 8. PAGE 3 -HOUSE BILL 18-1343 (b) FOR PURPOSES OF A GRANT APPLICATION UNDER SECTION 8-14 3-203, "WORK FORCE CENTER" ALSO INCLUDES A NONPROFIT ENTITY THAT (I) HAS A PRIMARY FOCUS OF SERVING VETERANS, AND (II) JOINS APPLICATION WITH THE WORK FORCE CENTER TO SUBMIT A JOINT SECTION 4. In Colorado Revised Statutes, 8-14 3-203, amend (1) introductory portion, (1)(b), (2), (3)(e), (4), (5), and (6), and add (1 5) as follows 8-14.3-203. Colorado veterans' service -to -career program - report. (1) One or more work force centers selected by the department pursuant to the grant program developed by the department in subsection (4) of this section may contract with a nonprofit agency to administer the , program Work force centers selected by the department and the nonprofit agency shall develop and expand programs to provide work force development -related services specifically tailored to the unique needs and talents of vcterans, spouscs, and eligible participants The services may include - (b) Opportunities for apprenticeship OR INTERNSHIP placements, including an apprenticeship INTERNSHIP that allows for direct entry of ELIGIBLE PARTICIPANTS; (1 5) THE DEPARTMENT SHALL COLLABORATE WITH STAKEHOLDERS AND, IF FEASIBLE, DEVELOP A GRANT APPLICATION FORM BY MARCH 1, 2019, SO THAT A NONPROFIT AGENCY MAY SUBMIT ONE APPLICATION FOR MULTIPLE SERVICE CENTERS EFFECTIVE WITH THE FISCAL YEAR 2019-20 GRANT CYCLE (2) (a) If an internship, as allowable, nndcr the act, is not fully funded by the employer, the employer and the work force center shall MAY share the cost of the hourly wage or stipend for the vctciaii, spouse, or eligible participant, as determined by the work force center and as permitted under state and federal law. III. BACKGROUND: On May 20, 2016, Governor John Hickenlooper signed House Bill 16-1267 Colorado Veterans' Service -to -Career Pilot Program into law. In 2018, House Bill 18-1343 established this as an ongoing program through January 1, 2024. The law creates the Colorado Veterans' Service -to - Career Program in the Colorado Department of Labor & Employment (CDLE). Local workforce areas may apply for the funds to support veterans, their spouses and other eligible participants who are seeking new employment and careers. In selecting grantees, CDLE "shall give preference to a workforce center that partners with a nonprofit agency that is an integrated service and support center for veterans and their families; that is located in the state of Colorado; has existing programs or partnerships with businesses or organizations in the community to provide services appropriate to the program; and has the capacity to provide a wide range of services tailored to the unique workforce needs of veterans, spouses, and other eligible participants." It also states services provided under the program shall not duplicate services currently provided under WIOA. The program's success will be measured through gainful employment and participation in skills training or educational programs for eligible participants. The legislation requires CDLE to develop an evaluation methodology to measure program outcomes and effectiveness prior to initiating the bid process for awarding grants. To the extent feasible, the evaluation process must enable a comparison between programs serving similar populations. 1 IV. POLICY/ACTION: A. Definitions 1. In accordance with U.S.C. Title 38, as amended, "Veteran" means a person who: a.Served on active duty for a period of more than 180 days and was discharged or released therefrom with other than a dishonorable discharge; b. was discharged or released from active duty because of a service - connected disability; or c. as a member of a reserve component under an order to active duty, served on active duty during a period of war or in a campaign or expedition for which a campaign badge is authorized and was discharged or released from such duty with other than a dishonorable discharge. 2. "Eligible Participants" are: a. Veterans; b. Spouse of a veteran; c. A veteran's dependent child who is twenty-six years of age or younger and lives in the home of the veteran; d. A veteran's caregiver who is eighteen years of age or older and has significant responsibility for managing the well-being of an injured veteran who has been determined unemployable by the Veterans' Administration; or e.A person who is actively serving in the United States Armed Forces and who is within six months of being discharged under conditions other than dishonorable or a member of the National Guard or military reserves who has completed initial entry training. 3. "Integrated Service and Support Center" means a nonprofit center that is affiliated with a workforce center and veterans' service offices, in a centralized location where government agencies, nonprofit organizations, and other entities collaborate to provide services to eligible participants. Services offered may include assistance for eligible participants in securing federal benefits, counseling services, employment support, education, life skills, and wellness support. 4. "Workforce center" means a workforce center created by a workforce development board pursuant to the Colorado Career Advancement Act and WIOA. OA. B. Local Area Participation Participating local areas include Denver, Larimer, Mesa, Pikes Peak, and Weld. Local areas may contract with an integrated service and support center to administer the program, but it is not required. 2 C Allowable Activities for Participants Participating workforce centers shall develop and expand programs to provide workforce development -related services for eligible participants that do not qualify for WIOA funding or for whom WIOA funding is insufficient to meet their unique needs The funds must be used for direct services to eligible participants Program costs associated with providing direct services are allowable These services must include one or more of the following 1 Skills training, 2 Registered apprenticeships, 3 Internships and other work -based learning opportunities, including wage or stipend costs (for a specified and limited time period as long as the task performed by the intern does not replace the task currently performed by a paid contractor or erpployee), and 4 Supportive services, as needed,to secure gainful employment or participate in an educational or s ills training program If a veteran, spouse, or eligible participant is eligible for funding through WIOA, that funding must bemused first If funding is not available or is limited under WIOA or if the use of funds is not allowable, the veteran, spouse, or eligible participant may use the Veterans' Service -To -Career Program funding Transition services may be provided if those services are not available to the eligible participant through a military installation to which the participant has access If an internship as allowable under WIOA is not fully funded by the employer, the employer and workforce center may share the cost of the hourly wage or stipend for the veteran, spouse, or eligible participant as determined by the workforce center and as permitted under state and federal law D. Administrative and Program Costs Up to eight percent (8%) of the funds awarded to each local area may be used for administrative costs incurred by the local area and the integrated service and support center (if included) ,, Administrative costs for this Program include the following functions 1 Accounting, budgeting, financial and cash management, 2 Procurement and purchasing, 3 Property management, 4 Personnel management, 5 Payroll, 6 Coordinating the resolution of findings arising from audits, reviews, investigations and incident reports, 7 Audits, 8 General legal services, , 9 Developing systems and procedures, including information systems required for these administrative functions, 3 10 Costs of goods and services required for administrative functions of the program, including goods and services such as rental or purchase of equipment, utilities, office supplies, postage, and rental and maintenance of office space, 11 Travel costs incurred for official business in carrying out administrative activities or the overall management of the program, 12 Costs of information systems related to administrative functions (for example, personnel, procurement, purchasing, property management, accounting and payroll systems) including the purchase, systems development and operating costs, and 13 Indirect costs related to the program J Program Costs for this Program are generally related to direct costs to support an eligible participant, and include but are not limited to the following functions 1 Relevant staff time for case management and tracking or monitoring of participant and performance information, 2 Use of employment statistics information, including job listing information, job skills information, and demand occupation information, 3 Expenses related to supportive services, as needed to secure gainful employment or participate in an educational or skills training program including but not limited to travel, housing, food, tools, personal care items, mental health and related services, 4 Costs of services delivered directly to eligible participants, including skills training, registered apprenticeships, internships; including wage or stipend costs (for a specified and limited time period as long as the task performed by the intern does not replace the task currently performed by a paid contractor or employee), and examination and licensure fees, 5 Relevant travel, operating and overhead costs Subcontracting is only allowable with an integrated service and support center E Program Enrollment and Tracking Connecting Colorado is the database of record for the Veterans Service to Career Program Program participants must be registered in Connecting Colorado under Program Code VC All services must be entered using existing service codes in Connecting Colorado Program participants with barriers to employment as described above will be tracked as a distinct tub -group F. Reporting Participating workforce centers must report on the services offered on a quarterly and annual basis to CDLE using the forms that will be provided to grantees CDLE will report on the program annually to the State, Veterans, and Military Affairs committees of the House of Representatives and the Senate, or to their successor committees The program's success will be measured through gainful employment and participation in skills training or educational programs for veterans, spouses, and eligible participants 4 Quarterly Reports: Grantee performance will be assessed based on the following outcomes reported to CDLE on a quarterly basis. Quarterly reports are due via email to tom.morgan@state.co.us on the following dates: April 16, 2019; July 16, 2019; October 15, 2019; January 15, 2020; April 15, 2020; and July 15, 2020. The quarterly report must include the information required in Attachment 1, Evaluation and Reporting Elements. Invoicing Invoicing requirements and forms will accompany the Notice of Funding Allocation (NFA) issued to local workforce areas that are awarded grants. H. Monitoring Monitoring of grant performance will be conducted by the Workforce Development Programs' Regional Services unit as part of annual compliance monitoring and program reviews.
