RE: APPROVE PARTIAL VACATION OF TWO -LOT RECORDED EXEMPTION, RE -1772

WHEREAS, the Board of ,County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on August 22, 1995, the Department of Planning Services approved Two -Lot
Recorded Exemption, RE -1772, and
WHEREAS, the Board has received a request from the current property owner,
Arthur Griffiths, 9216 County Road 48.5, Johnstown, Colorado 80534, to vacate Lot B of
Recorded Exemption, RE -1772, located on the following described real estate, to wit:
Lot B of Recorded Exemption, RE -1772; being part
of Section 3, Township 4 North, Range 67 West of
the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said partial vacation, and makes
the following findings:
No property resulting from the vacation will be left without access to a public road
right-of-way.
2. No property resulting from the vacation will continue to use any access across any
other lots within the exemption plat.
3. No easements are being included in this vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Arthur Griffiths, for Partial Vacation of Two -Lot Recorded
Exemption, RE -1772, for removal of Lot B, be, and hereby is, approved, subject to the following
condition:
As described in Section 24-11-50(H) and (I) of the Weld County Code, the
applicant shall submit an exemption vacation plat and deed to the Department of
Planning Services within ninety (90) days.

NARRATIVE On November 17, 2021 the Department of Planning Services received the
attached vacation request letter signed by Mr Arthur Griffiths The letter is
requesting a partial vacation of the plat of Recorded Exemption RE -1772,
recorded July 23, 1996, reception #2502334 to vacate Lot B, being the largest lot
There are multiple easements on the property but none of them were created by
the original Recorded Exemption plat so they will not be affected by this request
The resulting parcel will be larger than thirty-five (35) acres
The Lot A is also owned by Mr Arthur Griffiths and is not a part of this request
Lot A and B have access from CR 48 %2
A draft vacation plat is also attached and requires minor revisions prior to
recording A metes and bounds description for the lot to be vacated has been
included on the draft vacation plat
The Department of Planning Services staff has reviewed this request and recommends that this
request be approved

This Vacation is being requested to allow us to fully exercise our rights to create distinct parcels of land when each
parcel is greater than thirty-five acres (See C.R.S 30-28-101). This will enable us to generate more revenue from our
property by enabling us to enter into more leases and have different uses on parcels instead of being limited by one
parcel.
The improvements that currently exist are in two areas:
Area I
• A one story out building with a concrete pad and steel culvert.
• A two story framed house that is approximately 1,240 square feet.

• A 175 square foot storage space.
