This proposal has been reviewed on behalf of the Weld County Department of Public Works and
Department of Planning and Zoning. Staff comments made during this phase of the application process
may not be all-inclusive, as other issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and 2nd Amendment to Use by Special Review No.
USR-1343 for open mining (sand gravel, stone) and processing of minerals, with ancillary operations and
equipment including a Ready -Mixed Plant, a Hot Mix Asphalt (HMA) Batch Plant, the exporting of
aggregates, concrete and asphalt recycling, mine office with scale house and scale, a fueling/lubricating
station, portable generators, mobile mining equipment parking and storage, and employee and vendor
parking and more than two (2) conex containers for storage of products for plant operations and
maintenance and ongoing in -ground water storage reservoir to operate independently of previously
permitted mining and reclamation activities outside of subdivisions and historic townsites in the A
(Agricultural) Zone District

This project is south of and adjacent to State Highway 66, north of and adjacent to CR 28, and is west of
and adjacent to CR 19.

Access: The existing permitted access (AP21-00023) is onto CR 28.
ACCESS
Development Review has reviewed the application materials related to access.
The applicant has proposed that the primary access to the site will be onto State i

to ensure the approved accesses are compatible with your layout. Per Sec. 24-8-40, when feasible, there
shall be no net increase in the number of accesses to a public road. Minimum access spacing are shown
in Weld County Code, Sec. 8-14-30 Table 1. Please refer to Chapter 8 of the Weld County Code for more
information regarding access.
ROADS AND RIGHTS -OF -WAY
County Road 28 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way (along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld County
Code, Sec. 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that
physical roadways may not be centered in the right-of-way. This road is maintained by Weld County.
County Road 17 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way (along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld County
Code, Sec. 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that

it shall be dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld
County Code, Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware

The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways.

The Colorado Department of Transportation (CDOT) has completed a HW 66 Planning and Environmental
Linkages (PEL) Study. The objective of the HW 66 PEL Study is to develop a strategic vision for HW 66
between McConnell Drive in Lyons and Weld County Road 19. Please review the HW 66 PEL Study to
ensure you are in compliance with the requirements. More information about this study can be accessed
at: https://www.codot.govilibrary/studiesico-66-pel.
Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way
or easement. Right -of -Way Use Permit instructions and application can be found at
https:I/www.weldgov.comldepartments/publicworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
The accepted Traffic Impact Study (TIS) is dated January 14, 2022, updated March 11, 2022. This TIS
indicates that initially the traffic using the primary access onto Highway 66 will be approximately 500 daily
roundtrips of trucks and 20 daily roundtrips of passenger vehicles. It is noted that the TIS indicates additional
future traffic, associated with the concrete production, will be approximately 300 daily roundtrips of trucks
and 15 daily roundtrips of passenger vehicles. Haul routes for all traffic will be: 70% of the traffic will be
going east on State Highway 66 and 30 % of the traffic wi I be traveling to the west on Hwy 66.
No current traffic information is available for this portion of CR 28.
The TIS indicates that the traffic associated with the secondary access for the proposed maintenance shop
would be approximately 15 passenger vehicle roundtrips per day. All the traffic would travel to the west on
CR 28.
The TIS proposes no change to the traffic associated with the permitted access (AP21-00023) onto CR 28.
1 MUSR20-02-1343 application materials indicate approximately 5 passenger vehicle roundtrips per day for
this access point.
No additional traffic information is needed at this time.
RIGHT-OF-WAY USE
This project appears to use Weld County Right -of -Way associated with County Roads 28 . This use may
require a Right -of -Way Use Permit. The Right -of -Way Use Permit is a tool to help regulate unauthorized
obstructions of, excavations in, and use of the County's rights -of -way and easements by utilities and line
providers by requiring permits for ALL construction activities within the Weld County rights -of -way, whether
gravel or paved, and including all public drainage easements. A Right -of -Way Use Permit grants a permit
holder permission to occupy, excavate, survey, perform locations, or construct facilities within the County
rights -of -way or easement, and provide for the subsequent restoration upon completion. Review the

TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For
access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road
base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction
unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not
allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior
to entering publicly maintained roadways. A variance request for alternatives to the tracking control
requirement can be submitted to Development Review for review and consideration.
This site requires double cattle guards and 100 ft. of road base or road base on all driving surfaces as the
tracking control for CR 28 access.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
Development Review is requesting an updated Improvements and Road Maintenance Agreement with
triggered off -s to improvements based on the existing and on the proposed traffic and haul routes. The
Agreement will be for dust control, damage repairs to specified haul routes, anc triggered off -site
improvements.
Improvements/Road Maintenance Agreement: An example current agreement is available at:

It will detail the approved haul route, designate when off -site improvements will be triggered, and include a
maintenance agreement for the haul routes.
DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of
runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at
the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas.
Detention pond waived and a simple drainage narrative:
The applicant has submitted an acceptable drainage narrative stating that the site meets drainage exception
6. Gravel pits if the stormwater drains into the gravel pit. Releases from the site shall comply with the Weld
County Storm Drainage Criteria, including dewatering. Topographical information shall be provided.
Located in Sec. 8-11-40. Drainage Policy.
The topographical information has been received and there is no other stormwater management information
needed.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
If more than 1 acre is to be disturbed for construction of non -gravel pit items such as structures, parking
lots, laydown yards etc., a Weld County grading permit will be required prior to the start of construction.
Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early
Release Request Form may be entertained only after the applicant, Public Works and Planning Department
have reviewed the referral and surrounding property owner comments. The Early Release Request may or
may not be granted depending on referral comments and surrounding property owner concerns. Contact
an Engineering representative from the Development Review for more information.
CONDITIONS OF APPROVAL
A. A rev sed Improvements and Road Maintenance Agreement is required for triggered off -site
improvements and road maintenance. Road maintenance includes, but is not limited to, dust control
and damage repair to specified haul routes. The Agreement shall include provisions addressing
engineering requirements, submission of collateral, and testing and approval of completed
improvements. (Development Review)
B. The plan shall be amended to delineate the following:
1. County Road 28 is a gravel road and is designated on the Weld County Functional Classification
Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the
documents creating the existing right-of-way) and the physical location of the road. All setbacks
shall be measured from the edge of right-of-way. This road is maintained by Weld County.

5. Show and label the existing permitted access point (AP20-00023 —Commercial) and the proposed
access location onto CR 28, approved access width and the appropriate turning radii on the site
plan. The applicant must obtain an access permit in the approved location prior to construction.

6. Show the approved Colorado Department of Transportation (COOT) access onto State Highway
66 on the site plan and label with the approved access permit number if applicable. (Development

7. Show and label the approved tracking control on the site plan. (Development Review)
8. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled
surface be less than 35 feet. (Development Review)
9. Show and label the drainage flow arrows. (Development Review)
10. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around

Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on -site construction.

B. If more than one (1) acre is to be disturbed for construction outside of the gravel mining area, a Weld

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Development Review)
3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire

the Minimum Access Spacing Criteria as specified in Table 1 of Sec. 8-14-30 of the Weld County Code.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access with Public Works prior to laying out your site plan to ensure

Latest ADT (2012) on this portion of CR 28 counted 87 vpd with 14% trucks. The 85th percentile speed is
41 mph.
Latest ADT (2020) on this portion of CR 19 counted 2,310 vpd with 29% trucks. The 85th percentile speed
is 61 mph.
A preliminary Traffic Impact Study (TIS), signed and stamped by a professional engineer licensed in the
State of Colorado, was submitted with the application materials. This TIS indicates that initially there will
be approximately 500 daily roundtrips of trucks and 20 daily roundtrips of passenger vehicles. It is noted
that the TIS indicates additional future traffic, associated with the concrete production, will be 93 daily
roundtrips of trucks and 15 daily roundtrips of passenger vehicles. 100% of the traffic will be going east on
CR 28, then north on CR 19. From there, 60% will be traveling to the west and 30% will be traveling to the
east on State Highway 66.
An acceptable Final Traffic Impact Study shall be submitted.

Public Works is requesting an updated Improvements and Road Maintenance Agreement with Up -Front
Improvements based on the existing and on the proposed traffic and haul routes. The Agreement will be
for dust control, damage repairs to specified haul routes, triggered off -site improvements, and up -front off -
site improvements to include but not be limited to:
• Paving CR 28 from west of the permitted access point to just east of the intersection of CR 28 and
CR 19.
• Construction of appropriate auxiliary turn lanes on CR 28 at the site access (WB Deceleration Lane,
EB Acceleration Lane).
• Construction of improvements to the intersection of CR 28 and CR 19 (CR 28: LT lane, WB
Acceleration Lane. CR 19: SB RT Lane, NB Acceleration Lane).
• Construction of improvements on CR 19 at the intersection with Highway 66 (RT Lane, LT Lane).

As mining is considered a temporary use, portable toilets and bottled water are
acceptable for sanitary uses in accordance with EH policy.
Noise is restricted to the level allowed in the industrial zone district. The application
contains a noise modeling report completed by Behrens and Associates Inc. The report
indicates the industrial limit can be met and states: "Two modeling scenarios were
created to predict the sound levels at compliance points surrounding the proposed site
and are described in Table 4-2. Mining cells #1 and #3 were chosen since these were in
closest proximity to the nearest neighbors and therefore represent the worst -case
scenario for equipment placement and impact. The modeling results for Scenario 1
indicate that the noise levels of the proposed mining operations at Cell #1 and the Plant
Site (processing area) are predicted to comply with the Industrial noise limits of CIS 25-
12-103. The modeling results for Scenario 2 indicate that the noise levels of the
proposed mining operations at Cell #3 and the Plant Site (processing area) are
predicted to comply with the Industrial noise limits of CRS 25-12-103."

There will be fuel storage tanks on site which may require permitting through the state
along with secondary containment and an SPCC plan.
Odor from the batch plant must comply with Air Pollution Control Regulations odor
emission regulation No. 2. and is only a violation if odor is passing across property lines.
Odor is a violation if it is greater than 7:1 dilution for areas that are residential or
commercial.
Environmental Health Services has included the development standards that were
previously approved under 1 USi 2g-02-1 43. The prior development standards are 1
through 23.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, g -2o-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. In accordance with the Above Ground Storage Tank Regulations (7 CCR 1101-
14) a spillage retention berm shall be constructed around the tank battery. The
volume retained by the spillage berm should be greater than the volume of the
largest tank inside the berm. Alternative protective measures may be allowed
provided they comply with the Above Ground Storage Tank Regulations.
. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a "solid
waste" in the Solid Wastes Disposal Sites and Facilities Act, 0-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
Fugitive dust shall be controlled on this site.
6. The facility shall operate in accordance with the approved dust control plan. The
facility shall have sufficient equipment available to implement appropriate dust
control. Additional control measures shall be implemented as required by the
Weld County Health Officer.
This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S.
8. The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
9. The facility shall utilize the existing public water supply. (Central Weld County
Water District)
10. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11. The operation shall comply with all applicable rules and regulations of the
Colorado Division of Minerals and Geology.
12. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items
that might wash away during flooding shall be securely anchored and adequately
flood proofed to avoid creation of a health hazard.
13. Adequate handwashing and toilet facilities shall be provided for employees and
the public.
14. In the event the facility utilizes the residence on the property for commercial
purposes, the septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the system's ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. If the system is found to be inadequately sized or constructed, the
system must be brought into compliance with current Regulations.
15. Portable toilets may be utilized on sites that are temporary locations of the
working face and portable processing equipment, etc. for up to six months at
each location.
6. The operation shall comply with the Occupational Safety and Health Act (OSHA).
7. The operation shall comply with the Mine Safety and Health Act (MSHA).
8. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from drum washing and the washing of vehicles in accordance with the Weld
County code, the Rules and Regulations of the Water Quality Control
commission, and the Environmental Protection Agency
19. The operation shall submit an Air Pollution Emission Notice (A.P.E.N.) and
Emissions Permit Application and obtain a permit from the Air Pollution Control
Division, Colorado Department of Public Health and Environment, as applicable.
20. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to On -Site Wastewater Treatment System Systems.
21. The operation shall comply with all applicable rules and regulations of the
Colorado Division of Reclamation Mining and Safety.
22. The facility shall notify the county of any revocation and/or suspension of any
State issued permit.
23. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.
24. Portable toilets and bottled water are acceptable to provide drinking and sanitary
services to the site. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County, contain hand sanitizers and be
screened from existing adjacent residential properties and public rights -of -way.
25. Odors detected off site shall not exceed the level of seven -to -one dilution
threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution
Control Regulations.

I spoke with Tim Bilobran and he said that the newest traffic study states that traffic coming from the project is not high
enough to warrant a traffic signal and that the first traffic study actually over estimated turn movements, which
triggered the signal initially. The latest traffic study has not been signed off on by CDOTs traffic engineer, but Tim was
fairly certain that it will be. They will be required to build out turn lanes, but not a signal (At least at this time). He said
that a signal could still be approved at that location in the future, even if it is not shown on the PEL maps. He said that a
signal could be approved if it was 1/z mile between other county road intersections, even if not included in the PEL
maps.

Dear Mr. Ogle:
The Town of Platteville would like to thank you for the opportunity to provide additional comments regarding
the addendum to the Amended Use by Special Review Permit No. USR-1343. Platteville initially received a
referral regarding this USR on October 21, 2021 in which the Town Planner responded indicating that
Platteville did not find any immediate conflicts and did not want to pursue annexation.
In relation to this USR, the Towns of Platteville and Firestone have been working on a land use
intergovernmental agreement (IGA) during the past year in which CR19 from SH66 south to CR24 will be the
IGA Growth Boundary Line with Firestone's growth area on the west and Platteville's growth area on the east
of the boundary line. Due to this proposed IGA the Town of Platteville did not initially have comments or
concerns regarding USR-1343.
Once the USR-1343 addendum was sent out for review and comment on January 19, 2022 the USR was
scheduled for the Platteville Planning Commission and Board of Trustee meetings on February Pt for additional
review based upon the updated Traffic Impact Study (TIS) dated January 14, 2022 and the proposed change to
the Nix Gravel Mine site entrance.
The Town of Platteville Planning Commission and Board of Trustees offer the following comments based upon
the review of the amended USR submittal:
The Town has concerns regarding the updated TIS and site access change that forecasts approximately
70% of the proposed commercial truck traffic travelling east along 51466 that will likely go through
Platteville to access US85 (summary of Trip Distribution, page 31). The Town understands that SH66
will be used as the primary haul route for this operation but the impact to Platteville will be significant.
The Town has experienced increased traffic congestion the past few years along the two block section of
SH66 from US85 west to the South Platte River and increased truck traffic will produce significantly
more congestion issues. By reducing or limiting haul routes on other roadways (i.e. CR19) more
negative impacts from the increased traffic will be experienced by Platteville.
In 2017 the Town annexed the SH66 right-of-way from Division Blvd (C 25.5) west to CR19 and
further west along SH66 to the St. Vrain River in 2021. The Platteville Police Department has
jurisdictional authority to regulate and enforce traffic laws along this portion of SH66 and have worked
numerous accidents on this stretch of roadway during the past few years. Due to the much higher
volume of commercial truck traffic generated from this site the Town has additional concerns regarding
traffic enforcement and the potential increase in vehicle accidents.
During the February 1, 2022 Platteville Planning Commission meeting several rural county residents
voiced concerns of having increased truck traffic near their properties along SH66 and CR21. A specific
concern was raised regarding trucks bypassing the route on SH66 to US85 and using CR21 south of
SH66 to connect to CR28 and then east to US85. The Town requests that various concerns stemming
from county residents within the Town's growth area are considered and mitigation efforts are made to
reduce negative impacts to these properties.
The Town of Platteville would like to thank you again for this opportunity to provide additional comments

Dear Kim,
Thank you for providing the Town the opportunity to comment on the
proposed 2nd amendment to a Use by Special Review No. USR-1343 and
associated site specific development plan for the Ready Mixed Concrete
aggregate mining operations.
The Town of Firestone offers the following comments in addition to the
comment letter dated November 18, 2021:
1)
While the traffic study has been updated to remove all
accesses to WCR 28, the updated USR still has a WCR 28
access labeled "Primary approved commercial
access(paved) - to be utilized as a secondary access point,
main access will be off of Highway 66." This is unclear as to
what type of access this will actually be; primary or secondary;
commercial or non-commercial use. If it is to be a primary
commercial access until the Highway 66 access is
constructed, there is no timeline or requirement for when the
access will be removed. In addition, there is also another
secondary access for an office, shops, and parking area but
there are no discussions in the Traffic Study of what the usage
and impacts of these secondary accesses are. Comments 2,
3, 4, and 6 from the Town's original comment responses are
still valid with any access from WCR 28 being shown on the
USR.

The Town of Firestone offers the following comment:
1) Upon approval of the amended USR, the Town requests the
annexation of the lands subject to the USR into the Town of
Firestone.
2) The proposed USR is showing that access from the site will
be WCR 28 east to the intersection of WCR 19. The Town of
Firestone has recently annexed the WCR 19 right-of-way and
has serious concerns with adding significant turning truck
traffic to this intersection.
3) The provided traffic study needs to be updated to use the
Town of Firestone Design Standards and Construction
Specifications for Public Improvements when determining
improvements to WCR 19. The Town classifies WCR 19 to
be a principal arterial and based on the traffic counts from the
} study, both a southbound right -turn deceleration lane and
northbound left -turn deceleration lane are required. In
addition, street lighting will be required to be installed. All

work at the WCR 28 and WCR 19 intersection will be
permitted by the Town of Firestone and must meet the Town's
standards.
The traffic study calls out a sight distance issue at the WCR
28 and WCR 19 intersection, but no long-term
recommendation for addressing it. Simply relying on the
County or Town to be responsible for an issue created by this
use is not acceptable and will need to be addressed with the
intersection safety improvements discussed above.
The Town agrees with the recommendation from the traffic
study that a signal be installed at WCR 19 and Highway 66
and believes this should be required as a condition of
approval.
The Town has concerns with the use of a dirt road (WCR 28)
as a primary access for such a large scale commercial
trucking operation. The Town believes at a minimum WCR
28 should be paved from WCR 19 up to the primary access.
The Town requests that the County as a condition of approval
require the applicant to dedicate the necessary Right-of-way
along the \NCR 19 frontage for the future roadway build -
out. This would be 60' of right-of-way from the centerline of
WCR 19 to the west (120' total future right-of-way).

Resources, LL, February 2021), including stability analyses demonstrating acceptable factors of safety for
cut slopes, and an approval letter from the Colorado Division of Mining, Reclamation and Safety (DRMS,
June 28, 2021) for amendment AMO1 to Nix Sand & Gravel Mine Permit M2001-046. Provided the applicant
adheres to all DRMS permit conditions, CGS has no objection to approval of 2MJJTJSR21-02-1343.

Dear Kim Ogle,
We have received the October 21, 2021 submittal from Ready Mix Concrete Company (Applicant)
concerning the above -referenced proposal for a site specific development plan and second amendment
to the use by special review permit no. USR-1343. The applicant proposes open mining and associated
industrial uses at the Nix Gravel Mine to be located in Sec. 28, Twp. 3N, Rng, 67W, 6th P.M. The Nix
Gravel Mine is permitted by the Division Reclamation Mining and Safety ("DBMS") under permit no. M-
2001-046. After mining is complete, the property will be reclaimed for water storage and agricultural
purposes.
This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S.
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county
planning directors, this office will only perform a cursory review of the referral information and provide
informal comments. The comments do not address the adequacy of the water supply plan for this project
or the ability of the water supply plan to satisfy any county regulations or requirements. In addition,
the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure,
the issuance of a well permit, or physical availability of water.
Estimated water usage for the mining operation is as follows: 1.34 acre-feet/year of water lost to
evaporation, 23.1 acre-feet of water retained in mined aggregate, and 4 acre-feet/year for dust control,
totaling 28.4 acre-feet/year. The Applicant proposes that no mining below the groundwater table until
a slurry wall is approved will occur. Out -of -priority depletions which occur to the stream system due to
the mining operation must be replaced under a court -approved augmentation plan or Substitute Water
Supply Plan (SWSP) approved by the State Engineer.
Water may also be used for truck and equipment washing and aggregate washing; no demand estimates
were provided for these uses. Bottled water and portable toilets will be supplied to employees. Any
water hauled to the site must be obtained from a legal source.
Proposed water supply sources are "existing water rights associated with the property and/or a
groundwater well" covered by an SWSP. The applicant proposes to replace depletions with Last Chance
Ditch Company shares. A well permit application and SWSP request have not been filed with this office.

If reclamation of the mine site will produce a permanent water surface exposing groundwater to
evaporation, an application for a plan for augmentation must be filed with the Division 1 Water Court at
least three years prior to the completion of mining to include, but not be limited to, long-term
evaporation losses and lagged depletions. If a lined pond results after reclamation, replacement of
lagged depletions shall continue until there is no longer an effect on stream flow.
A review of our records show well permit nos. 239442-A, 45973, and 9705-F located on the subject
properties:
• Permit no. 239442-A was issued March 12, 2002 as the replacement well for existing well no.
239442. The well is permitted for fire protection, ordinary household purposes inside not more
than 1 single-family dwelling, the irritation of not more than 0.25 acres of home gardens and
lawns, and the watering of domestic animals. As permitted, the well cannot be used for the
gravel mine.
• Permit no. 45973 was issued May 24, 1971 and the well was decreed in Division 1 Water Court
case no, W-3351 as Strong and Herren Farms, Inc. Well #2 for domestic and stock watering
purposes. Use of this well must be in compliance with the permit and decree. The welt cannot
be used for the gravel -mine...
• Permit no. 9705-F was issued August 25, 1965 for irrigation use and the well was decreed in
Division 1 Water Court case no. W-3351 as Strong and Herren Farms, Inc. Well M. The well is
not currently covered under a court -approved augmentation plan, therefore the welt cannot
pump until such time as it is either covered under a court -approved augmentation plan or
substitute water supply plan approved by the State Engineer.

Please see the attached Aerial. It wouldn't let me edit it in PDF so I did my best in MS -Paint on my computer
with just my mouse. This is the idea in my mind we are trying to implement. All we are doing is shifting the
prescribed full movement access with the allowable wiggle room in the access control plan slightly to the
West.
You'll see my Aerial calls out three notations. Those three notations are:
Note 1- "Access Point 356 shifts slightly to the west, to the location where the hand -drawn dark blue access
points intersect the highway.
Note 2- "Access Point 358 shifts slightly to the west at the future date. This shift is not occurring now
because the associated landowner on the North side is not a party to this development. COOT askes our
County Planning partners to jointly with CDOT require the Northern landowner use the new dark blue
access point when the any one of the following conditions are met per the State Access Code:
�A 20% increase in the daily traffic counts using the north side of Access Point 358
--The property redevelops and changes the tenor of property uses and/or vehicles using the access (I.E.
Moving from Agricultural to some other Industrial/Residential/Commercial use)
The property goes through a County Land Use process (i.e. a Recorded Exemption) and CDOT requests
with a referral comment that the applicant begin using the new dark blue access.
Once the non-affiliated Northern landowner begins utilizing the dark blue access point for any of these
above reasons, it will be their responsibility to close Northern access #358 in the CDOT Right -of -Way. That
is a standard term and condition of all closure permits we write. Until the Northern landowner implements
something on their parcel which triggers one of those scenarios, they are free to continue to use #358 in its
present shape and condition., potentially for years and years depending on how quickly that parcel
develops.
Note 3- "In furtherance of Note 2 above, CDOT asks our County Planning Partners to help ensure that an
easement on the Dixie Water property is codified in some legal land use way. That access easement will
be needed to eventually give the Northern landowner of 358 the legal right to access the dark blue
intersection. CDPT is not a land use authority here so we can only rely on the County's abilities.

Honestly the easement mentioned in Note 3 is the linchpin to this entire scenario. If the County cannot
guarantee the legal existence of that easement then the only fast forward is for these Developers now to
go back to building the access point exactly on the section line, despite the hydrological and utility
complications that causes for construction implementation.

Attached is the updated referral from Development Review for 2MJ U SR2I -02-1343, concerning access
and other comments.
Also attached is the April 7, 2022 email from Tim Bilobran which outlines the access points to be closed on
Hwy 66 as well as the accepted point of ingress and egress for the Nix Pit.
In early May 2022, Planning staff received a new proposal for access, (4.0 Entrance Plan)
This proposal to move the entrance to the west is not reflected per comments from CDOT in
correspondence received in the April 7, 2022 email.
Per your request, Planning reviewed the 4.0 entrance plan and also reviewed the alignment of access
points to the north.
Planning Services also reviewed the most recent comments from CDOT, for compliance with the 4.7.2022
email.
In this email, the proposed and accepted alignment closed the Raptor Materials (Varra) access. A new
shared access with Raptor and Brannan would be constructed to the east of the current Varra access on
lands owned by Nix.
This access would align the Nix Pit (CDOT AP#356) with the Morris properly (COOT AP#358) directly
north. The Morris access is a historic access that continues to be utilized daily.
The newly proposed 4.0 alignment moves the access to the west and utilizes CDOT AP#354 and Dixie
CDOT AP#355 as the new intersection. Both were previously slated to be closed per 4.7.2022 email. This
proposed new alignment would close the active CDOT AP# 358 access which is currently utilized by Morris
and require a new road to be constructed to meet the proposed new alignment on lands owned by others
not a part of this application. Weld County Planning discussed this internally, and determined that the
access points in review for the application are located on the south side of Hwy 66 only. New alignments
affecting the north side of the highway, including any new construction, should be mutually agreed to by all
parties affected by any proposal to close or re -align current and active drives entering onto the State
Highway.
Planning Services is requesting clarification on the location of the COOT approved access. Currently Weld
County is understanding that the alignment supported is CDOT is AP#356 and CDOT AP#358 located
directly north. Please provide written comments if this is not the case.

All,
We will accept this second version of the traffic study and expect all the auxiliary lanes outlined in the
conclusions to be constructed, including the westbound acceleration lane as you leave the private
parcel. The access point on the south is expected to be shared between the two industrial uses so please
work with county planning to ensure all relevant cross parcel easements are appropriately recorded.
When you are ready to proceed to construction plan creation I have some handy design primer
documents which I can send over if you need them. Please let me know.
A 0137 application form needs to be filled out for the shared joint access. Per the access control plan
accesses 352, 362 and 368 on this graphic below should be closed with a separate 0137 application
form, especially as you consider the links of acceleration lanes from this new shared access and the
accelerations lanes heading into County Road 19. The existence of the right in and right out shown at
395 is still a possibility in the future if needed.

Per your comments on the initial submittal of the traffic impact study for this project, I have attached a
revised traffic study for your review. The traffic signal warrant evaluation for the site access has been
revised to remove the northbound right turn volume from the calculation as an acceleration lane is
proposed for this movement. Without the right turn volume, the MUTCD warrant volume thresholds are
not met and a traffic signal is not justified. To mitigate the deficient level of service at this intersection, a
left turn acceleration lane is proposed.
Please let me know if you have any questions or concerns related to this. If it looks acceptable to you

We will accept this second version of the traffic study and expect all the auxiliary lanes outlined in the
conclusions to be constructed, including the westbound acceleration lane as you leave the private
parcel. The access point on the south is expected to be shared between the two industrial uses so please
work with county planning to ensure all relevant cross parcel easements are appropriately recorded.
When you are ready to proceed to construction plan creation I have some handy design primer
documents which I can send over if you need them. Please let me know.
A 0137 application form needs to be filled out for the shared joint access. Per the access control plan
accesses 352, 362 and 368 on this graphic below should be closed with a separate 0137 application
form, especially as you consider the links of acceleration lanes from this new shared access and the
accelerations lanes heading into County Road 19. The existence of the right in and right out shown at
395 is still a possibility in the future if needed.

I spoke with Tim Bilobran and he said that the newest traffic study states that traffic coming from the
project is not high enough to warrant a traffic signal and that the first traffic study actually over
estimated turn movements, which triggered the signal initially. The latest traffic study has not been
signed off on by CDOTs traffic engineer, but Tim was fairly certain that it will be. They will be required to
build out turn lanes, but not a signal (At least at this time). He said that a signal could still be approved at
that location in the future, even if it is not shown on the PEL maps. He said that a signal could be
approved if it was Y2 mile between other county road intersections, even if not included in the PEL
maps,

Thank you for your comments. I will perform the MUTCD volume warrant calculations with the right
turns removed. I had initially calculated it with the right turns since the turns are primarily trucks and I
wasn't sure that a right -turn acceleration lane would be warranted, but it makes sense to remove these
trips from the calc. I believe installing a traffic signal is probably the best long-term solution for this
intersection when considering the plans for the property on the north side of Highway 66. A left turn
acceleration lane would not be a great option long-term once eastbound left turning traffic is introduced
at the intersection to access the northern property. I agree that either a signal or a left -turn acceleration
lane should be installed at the intersection for the short-term condition to mitigate the deficient level of
service and the preference would be for the signal since it addresses both short-term and long-range
plans. In any case, I will rerun the volume warrant calculations and see where we stand.
This site is unique as the user (Brannan) has control over the distribution and routing of their aggregate
trucks. Most development sites don't have this type of control over the traffic accessing their site.
Because of this, I may look at different truck routing splits with more oriented to/from I-25 than US 85
and see what impact that might have on the signal warrants and impacts to other study area
intersections. I should have some clarity on this in the next few days. Feel free to call me to discuss if
you have any issues with this approach.

I will follow up with more information tomorrow. The study's materials and technical data were so
comprehensive that our traffic design engineers could not fit the review into their existing workload.
CDOT is paying for a third -party traffic engineering firm to review the study and provide feedback.
I know that review is progressing but they have a few questions for CDOT before they complete the
review. I have a conference call scheduled tomorrow morning to address their questions. I will be in
touch afterwards regarding their perspective timeline for finishing.

Thank you for your patience. Our comments are:
1. The TIS looks good, but I would ask them to double check the lengths of the turn lanes on SH
66 to verify that they meet the Access Code criteria. Maybe a table showing what the Code says
and what's actually out there.
2. I would suspect that the lanes are okay except maybe the westbound to southbound left turn
lane storage may be inadequate given the new increased volumes. All the lane checkup metrics
should continue to be in passenger car equivalents.
3. The conclusion about the signal at Highway 66 & CR 19 is probably spot on. CDOT agrees
that the signal should be installed via this development in the first phase. The ACID indicates
that this is an acceptable location for a signal.
An access permit will need to be obtained from this office to upgrade the CR 19 intersection.
ROW request is per the PEL preservation footprint (kmz attached again for ease of reference).
