NUMBER R1763302 - JCK GRAVEL, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, were
presented with a Petition for Abatement or Refund of Taxes for Account Number R1763302 at a
duly and lawfully called regular meeting held on the 6th day of June, 2022, at which meeting there
were present the following members: Chair Scott K. James, and Commissioners Mike Freeman,
Perry L. Buck, Steve Moreno, and Lori Saine, and
WHEREAS, notice of such meeting and an opportunity to be present has been given to
the taxpayer and the Assessor of said County, with said Assessor, Brenda Dones, being present
and taxpayer, JCK Gravel, Inc., not being present, and
WHEREAS, the Board of County Commissioners has carefully considered the attached
petition, and is fully advised in relation thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Board concurs with the recommendation of the Assessor and
the petition be, and hereby is, approved, and an abatement or refund be allowed as follows:

SUBJECT:
The subject property is in Unincorporated Weld County just outside Firestone town limits. The 36.72
acres are located on Highway 119 just west of the St Vrain State Park.
LEGAL:

Abatement Request:
The subject is being appealed by the owner, Katherine Oliver. The owner stated that there is no access
to the property and in 2013 the property was flooded washing away the path that allowed access and
rendering the parcel unbuildable. The property is deeded as a Life Estate and once Katherine is
deceased, the ownership transfers to the State of Colorado.
Description and analysis of what was provided:
The owner called and spoke to me about all the details of this piece of ground. The majority of the
parcel, 32 acres, is located in a floodway and 4 acres are located in a 100 -year flood plain. This only
leaves 0.7 buildable acres. A physical inspection on March 15th, 2022, verified that there is no entry to
the parcel and the flood of 2013 indeed turned the buildable portion into a marsh land with cattails. The
Life Estate deed was researched revealing that the Life Estate is irrevocable.
Final Analysis:
We didn't have all the information on this parcel when we changed the land from Ag to MRA. Once the
owner called and we discussed the issues with the land, I believe we have the wrong value placed on the
parcel.
Per the inspection and the research from all the information the owner gave me, I have determined the
value of the land to be minimal value, or unbuildable value of $500 dollars per acre. I recommend we
lower the value to $18,360.
