RESOLUTION WHEREAS, a public hearing was held on June 10, 1974 in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of John J. Miller, General Manager of KCOL, 1612 LaPorte Avenue, Fort Collins, Colorado, requesting approval of site for the construction of a radio communication tower on the following described property, to-wit: A tract of land situate in the Northwest 4 of the Northwest a of Section 7, Township 8 North, Range 67 West of the 6th P. M. , County of Weld, State of Colorado being more par- ticularly described as follows: Considering the West line of the Northwest 4 as bearing 500O00'00" E. , and with all bearings contained herein relative thereto; commencing at the Northwest corner of said Section 7; thence S00°00'00" E. , 364. 94 feet to the point of beginning; thence on a prolongation of said line S00°00'00" E. , 564. 00 feet; thence N 90 00'00" E. , 594. 00 feet; thence N00°00'00" W. , 564. 00 feet; thence S 90°00'00" W. , 594. 00 feet to the point of beginning. SUBJECT to a 30 foot road right-of-way on the West and SUBJECT to any right-of-way, easements, restrictions as now on record or in use; Said tract contains 7. 691 acres more or less, and WHEREAS, the petitioner was present and represented by Oliver Coburn, Chief Engineer for K. C. O. L. ,and WHEREAS, there was no opposition to the request of petitioner for the location of a radio communication tower, and WHEREAS, the said requested location for the radio communication tower is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (2) of the Zoning Resolution of Weld County, said location for the radio communication tower may be authorized on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed, NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of John J. Miller, General Manager for K. C. O. L. , 1612 LaPorte Avenue, Fort Collins, Colorado, to locate a radio communication tower on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. PL0793 740366 2. That petitioner shall proceed with due diligence to effect said construction of the communication tower and that it shall have up to one year from date hereof to begin the construction of any and all facilities therefor; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. Subject to receiving evidence of approval of the Federal Aviation Agency and of the Federal Communications Commission. 4. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Dated this 12th day of June, A. There has not been enough time for notification of certain State agencies in several instances. There also has not been enough time for their response before the meeting date. It's difficult to write staff comments and discuss them with the applicant(s). It is recommended we allow 30 days lead time on all cases (SUP, Zone Changes, etc. ). This will allow sufficient time for return input plus comply with State regulations. Planning Commission has the right to set reasonable procedures outside anything else. Procedure by policy has to be approved by the Planning Cori::+i .s ion, the staff can't just do it on �• their own. 'LOTION: By Mr. Heitman, To approve .: pre-submittal time on all appli- cations. Mr. Kavalec, Zoning Inspector, regarding the violation of storage of heir: equipment in an agricultural zone. Mr. Nordon has been notified that he was in violation and had ten days to comply with the zoning regulations. Since he was notified, Mr. Nordon has moved in more equipment and does not appear to be complying. RESOLUTION: Be it therefore resolves to recommend to the Board of County Commissioners that legal action be taken against Mr. George Nordon. Motion by Mr. Nix, seconded by ''r. Anderson. Coburn stated the request was for zoning for ap- proval of a radio tower on the Larimer-Weld line about three miles east of Wellington . They want to put in a radio tower and have a minimum guided radius for required safety standards . The height of the tower , at maximum , would be 400 feet . The parcel is about 7 acres . Planning staff recommends approval for the following reasons : ( 1 ) Agrees with Weld County Compre- hensive Plan and Weld County Zoning regulations as an allowable use in the Agricultural zone . The brick edifice would be left intact and utilized with minor interior mod- ification to house transmitting equipment essential to operate an approved (F.C.C. ) Class C FM Station operating on assigned Channel 300(dial position 107. 9) . The information supplied herewith hopefully complies with the requirements set forth in the PROCEDURAL GUIDE FOR CONDITIONAL USE PERMIT APPLICATION. A steel tower 400 feet in height would be required at or in the immediate vicinity of referenced building for the purpose of radiating the radio frequency signals generated by the transmitting equipment located within that building. Transmitting towers require structural support by means of a system of guy-lines arranged at different levels on the tower and properly terminated at anchors embeded in the ground. The proposed 400 foot tower if erected at this site would require three (3) points of ground anchorage separated by 120 degrees and each extending 278 feet from the supporting base of said tower. To acquire additional property to accomodate such a guyed antenna ; The applicant has negotiated a 3 month optional contract (herewith attached) with the owners of that land which is immediately contiguous to the AT&T tract. Purchase of such adjacent vacant land will of necessity be contingent upon approval of the various agencies involved. Id est. , Weld County Zoning Commission, Federal Aviation Administration and the Federal Communications Commission. The intended use of the subject tract and contiguous area would be for the purposes previously stated, no habitation is involved, therefore, sewage and water facilities or soil survey do not appear to be a matter of issue. Traffic to and from the site would be minimal and beyond the installation-phase would be limited to visits by maintenance personnel only. The referenced tower located at this site would be subject to FAA obstruction lighting requirements and in general appearance would conform to that of all other lighted radio towers in the Weld/Larimer County vicinity. No pollution would be generated as the result of proposed operation. No glare beyond that of conventional tower obstruction lighting. No extraneous noise level incident to operation. No fire hazard The tower would be erected to acceptable structural engineering standards and designed to withstand wind loading conditions and conform to all other safety considerations.
