BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, MAY 23, 2022
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, May 23, 2022, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Scott K. James, Chair
Commissioner Mike Freeman, Pro-Tem
Commissioner Perry L. Buck
Commissioner Steve Moreno
Commissioner Lori Saine
Also present:

• MINUTES:
1) APPROVAL OF MINUTES OF MAY 4, 2022 (CONT'D FROM 5/18/2022): Commissioner Saine moved
to continue the Minutes of the Board of County Commissioners, as printed, to Wednesday, May 25, 2022,
at 9:00 a.m. Commissioner Moreno seconded the motion, and it carried unanimously.
Ei 2) APPROVAL OF MINUTES OF MAY 9, 2022: Commissioner Buck moved to approve the Minutes
of the Board of County Commissioners, as printed. Commissioner Moreno seconded the motion, and it
carried unanimously.
El PUBLIC INPUT: No public input was given.
El AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed.
Commissioner Freeman seconded the motion, and it carried unanimously.
• COMMISSIONER COORDINATOR REPORTS: Commissioner Buck attended the Greeley
Homeless Housing meeting and reported it was very informative, and took a tour of the growth expansion
in Weld County. Commissioner Saine reported the Department of Human Services is still adjusting to the
new legislative measures that have been passed recently.

• WARRANTS:
1) GENERAL WARRANTS - MAY 20, 2022: Commissioner Buck moved to approve the General
Warrants, as printed. Commissioner Freeman seconded the motion, and it carried unanimously.
• NEW BUSINESS:
1) CONSIDER CONTRACT ID #5809 SERVICE AGREEMENT FOR BIOMEDICAL WASTE DISPOSAL
SERVICES (INFORMAL BID #B2200052) AND AUTHORIZE CHAIR TO SIGN - TRILOGY MEDWASTE
WEST, LLC: Mark Lawley, Director of the Department of Public Health and Environment, stated this
agreement was the result of a bid that was presented as a formal bid; however, due to the low cost
associated with this agreement, it was eligible to go straight to contract. He further stated this agreement
was awarded to the lowest bidder, Trilogy MedWaste West, LLC, for the collection and disposal of
biomedical waste for the Department of Public Health and Environment, Coroner's Office, and the
Forensic Crime Lab. Commissioner Saine moved to approve said agreement and authorize the Chair to
sign. The motion was seconded by Commissioner Freeman, and it carried unanimously.
• 2) CONSIDER RENEWAL APPLICATION FOR A FERMENTED MALT BEVERAGE OFF -
PREMISES (COUNTY) LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - CIRCLE K'STORES,
INC., DBA CIRCLE K STORE #2709846: Bruce Barker, County Attorney, indicated the store location is
at 10963 West Interstate 25 Access Road, Longmont, and further stated he reviewed the application, and
it is complete, with no concerns from any referral agencies. The applicant was not present, and no public
testimony was offered concerning this matter. Commissioner Moreno moved to approve said renewal
application and authorize Chair to sign. The motion was seconded by Commissioner Freeman, and it
carried unanimously.
El 3) CONSIDER RENEWAL APPLICATION FOR A HOTEL AND RESTAURANT (COUNTY)
LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - R AND D 14 CORRIDOR, LLC, DBA DEWEY'S
BAR AND GRILL: Mr. Barker indicated this establishment is located at 41611 Marble Avenue, in
Stoneham, and further stated he reviewed the application, and it is complete, with no concerns from any
referral agencies. The applicant was not present, and no public testimony was offered concerning this
matter. Commissioner Buck moved to approve said renewal application and authorize Chair to sign. The
motion was seconded by Commissioner Saine, and it carried unanimously.
• 4) CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR
TO SIGN - LEVI TREVINO: Commissioner Freeman moved to approve said appointment and authorize
Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously.
Ei PLANNING:
1) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - DANIELA FLORES AND PAULA GRADO (CONT'D FROM
4/18/2022): Caitlin Perry, Assistant County Attorney, stated this is a hearing from a continued request for
violation certification in the amount of $10,850.00, with daily penalties to be certified as a lien against the
property located in Milliken, Colorado. She stated the Board of County Commissioners heard this matter
on November 15, 2021, February 14, 2022, and April 18, 2022, and most recently granted a 35 -day
continuance to today, to allow the site to become compliant with the Weld County Code. Ms. Perry
reported the property owners have made substantial progress in getting the property into compliance, by
submitting to get permits for the cargo containers, removing fuel tanks that were of concern to the fire
district, and they are in the process of getting a cement foundation poured, and are keeping in contact
with the Department of Planning Services. Ms. Perry stated at this time it is staff's recommendation to
deny certification and waive the accrued daily penalties. Tonya Johnson, Zoning Compliance Officer,

displayed a vicinity map for the record, as well as photos of the site from her inspection conducted on
May 18, and 19, 2022. She stated there are still minor items that are non -compliant, but she is confident
all will be corrected within the next few days, as stated by the applicant, Modesto Flores. Commissioner
Saine moved to deny said certification of zoning violation penalties as special assessment, and waive
the accrued penalties. Commissioner Moreno seconded the motion, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:14 a.m.
These Minutes were approved on the 6th day of June, 2022.
