HomeMy WebLinkAbout730950.tiff -XV oP/7/� RESOLUTION WHEREAS, heretofore by Resolution the Board of County Commissioners, Weld County, Colorado, did employ the engineering firm of Nelson, Haley, Patterson & Quirk to submit plans and specifications relative to obtaining bids for repairing, constructing and/or re-constructing county damaged property due to recent floods, and WHEREAS, by subsequent Resolution the Board did authorize Mr. Barton Buss, Chief Accounting Officer and Purchasing Agent for Weld County, to advertise for bids to repair such flood damaged county property, and further authorized the Board to execute agreements with successful bidders relative to the repairing of county flood damaged property, and WHEREAS, the State of Colorado acting by and through the Colorado State Disaster Coordinator now has submitted an agreement relative to the receipt and administration by the County of all moneys to be received from the Federal Disaster Assistance Administration (FDAA), and WHEREAS, the Board believes it to be in the best interest of the County to cooperate with the State of Colorado in seeking Federal financial assistance under public law 606 for damages to county owned property by recent flood waters. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that said agreement providing for assistance to the county, copy of which is attached hereto and made a part hereof by reference, be, and it hereby is approved. BE IT FURTHER RESOLVED, that the Board be, and it hereby is authorized to execute the agreement as submitted and to make the same effective forthwith. WHEREAS, entities..within the,State of Colorado may receive Federal financial . The local entity will deposit said advance in a separate fund or account, subject to withdrawal only when authorized by the official representative desig- nated in Recipient's project application. In the event of a change in the of- ficial representative the Recipient will amend its project application and conduct an audit_ at_the time of change. - ' 3. The Recipient agrees 'to utilize said funds solely on line items listed in the approved project application. -4. The Recipia t--shall maintain a separate_ file with a.record of_.expend itures which will include copies of invoices, pay records, contracts, payment vouchers, cancelled checks or warrants. Each expenditure will be referred to • the appropriate line item within the project application. 5. The State will assist the recipient in establishing the proper records, but the Recipient shall have the responsibility of maintaining accurate records. 6. The Recipieneurill notify the State when all work is completed and ready for inspection. The State will arrange for the inspection of the work and - I after final inspection reports .are received, will forward them to Recipient. After the Recipient receives all final inspection reports, the Recipient will assemble these records for audit and notify the State they are ready for audit. 7. The State Controller's representative will audit the Recipient's records and prepare the proper reports for forwarding to FDAA for final audit, and the Disaster Coordinator will prepare standard Form 1034 to FDAA for final payment. 8. The .State 'shall forward that portion of the final payment, which to- gether with the advances paid to the Recipient, equal the total amount of expen- ditures approved by FDAA. 9. In the event the Recipient receives a sum in excess of that amount of expenditures approved by FDAA, the Recipient agrees to immediately upon demand by the State, refund to the State the sum in excess of said authorized expendi- tures. • 9. If the Recipient has an approved supplement to its project application it will become a part of this agreement. 10. The parties agree that any litigation involving performance under this contract or relating to this project shall be tried in Denver, Colorado. 11. The project numbers assigned to this agreement are: Federal FDAA Project No. OEP-379-DR-6 and State Project No. 10006 no more than Total approved: $ 70,926.00 of which $: 53,194.00 is to be advanced. We have prepared four copies of the Agreement for your signature, if you agree. If you disagree with any portion of these documents, please let me know without delay. After you have signed the Agreement, please re- turn all copies to this Office. I will sign as the Deputy Disaster Coordinator and arrange for the signatures of the other State officials required by State law.
