Annexation as required by Colorado Revised Statutes 31-12-108(2).
This notice is required to be sent to special or school districts by 31-12-108(2) and shall not confer any
right of review in addition to those right provided for in section 31-12-116.

Petition for Annexation
THE UNDERSIGNED (hereinafter referred to as the "Petitioners") hereby petition the Board of
Trustees of the Town of Milliken Colorado for the annexation of an area, to be referred to as the
Wiest Annexation to the Town of Milliken. Said area, consisting of approximately One Hundred
and Sixty (160) acres, is more particularly described on Attachment "A," attached hereto.
The Petitioners allege:
I . That it is desirable and necessary that such area be annexed to the Town of Milliken.
2. That the requirements of Sections 31-12-104 and 31-12-105, C.R.S., exist or have been
met.
3. That not less than one -sixth (1/6) of the perimeter of the area proposed to be annexed is
contiguous with the boundaries of the Town of Milliken.
4. That a community of interest exists between the area proposed to be annexed and the
Town of Milliken.
5. That the area to be annexed is urban or will be urbanized in the near future.
6. That the area proposed to be annexed is integrated with or capable of being integrated
with the Town of Milliken.
7. That the Petitioners herein comprise more than fifty -percent (50%) of the landowners in
the area and own more than fifty -percent (50%) and in fact own one hundred percent
(100%) of the area proposed to be annexed, excluding public streets, alleys and lands
owned by the Town of Milliken.
8. The legal description of the land owned by each signer of this petition is shown on
Attachment "B",
9. The proposed annexation of the Property complies with Section 30(1)(b) of Article II of
the Colorado Constitution.
This Petition is accompanied by four (4) copies of an annexation boundary map in the form
required by C.R.S. §3I -12-107(1)(d).
WHEREFORE, said Petitioners request that the Board of Trustees of the Town of Milliken
approve the annexation of the area described on Attachment "A". Furthermore, the Petitioners

A tract of land situated in the County of Weld, State of Colorado, to -wit:

DESCRIPTION OF THE BOUNDARIES OF THE AREA PROPOSED TO BE ANNEXED
Excepting only portions of roads or alleys as depicted herein, Petitioners are the owners of all of the
lards described as follows, which are proposed to be annexed and will be known as fin "Wiest
Annexation:
A tract of land, located in the Southwest Quarter (S1i't/4) of Section Twenty—eight (28), Township
Five North (T.55.), Range Sixty—six West (R.66W.) of the Sixth Principal Meridian (6th P.M,), County
of Weld, State of Colorado and being more particularly described as follows:
BEGINNING at the West Quarter corner of said Section 28 and assuming the West line of said SW)
of Section 28 as bearing North 00'00'02' East being a Grid Searing of the Colorado State Plane
Coordinate System, North Zone, North American Datum 1983/2011, a distance of 2653.37 feet with
all other bearings contained herein relative thereto;
THENCE North 89'38'54" East along the South line of ISO First Annexation recorded April 3, 2020 at
Reception No. 2939512 of the Records of Weld County, said line also being the North line of said
SWt /4 a distance of 1650.97 feet to the West line of Peakview Annexation recorded March 10, 2020
at Reception Na. 4573655 of the Records of Add County;
The following Two (2) courses and distances are along the Westerly and Southerly lines of said
Peakview Annexation;
THENCE South 43'27'30' East a distance of 59.02 feet;
1. THENCE North 89'38'54' East a distance of 971.80 feet to a line parallel with and 30.00 feet
East of, as measured of a right ongle to the East line of said SW1/4, said line also being the

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF
MILLIKEN FINDING SUBSTANTIAL COMPLIANCE WITH THE
REQUIREMENTS OF SECTION 31-12-107(1) OF THE MUNICIPAL
ANNEXATION ACT OF 1965 AND INITIATING ANNEXATION
PROCEEDINGS FOR THE WIESTANNEXATION
WHEREAS a written petition was filed with the Town Clerk requesting the
annexation of certain property to be known as the Wiest Annexation; and
WHEREAS the Board of Trustees for the Town of Milliken desires to initiate
annexation proceedings in accordance with law;
IT IS THEREFORE RESOLVED by the Board of Trustees of the Town of
Milliken, Colorado, this 20th day of June 2022, as follows:
1. That the Board hereby accepts the annexation petition for the Wiest
Annexation, more particularly described in Exhibit A, which is attached hereto and made
a part hereof.
2. That the Board hereby finds and determines that the annexation petition
and accompanying map are in substantial compliance with section 31-12-107(1) of the
Municipal Annexation Act of 1965, which is referred to herein as the "Act."
3. That the Board hereby sets a public hearing to be held on August 10, 2022,
at the hour of 6:30 PM or as soon thereafter as the matter may come on for hearing, in the
public hearing room at the Milliken Police Department building at 1201 Broad Street in
the Town of Milliken to determine if the proposed annexation complies with section 30
of article II of the Colorado Constitution and sections 31-12-104 and 31-12-105 of the
Colorado Revised Statutes or such provisions thereof as may be required to establish
eligibility under the terms of the Act.
4. That, the Board in accordance with Section 16-7-50(b)(5) of the Milliken
Municipal Code also hereby sets a public hearing before the Town's Planning
Commission ("Commission") on Wednesday, August 3, 2022, at 7:00 PM or as soon
thereafter as the matter may come on for hearing, in the public hearing room at the
Milliken Police Department building at 1201 Broad Street in the Town of Milliken,
Colorado, regarding the proposed annexation.
5. That the Notice attached hereto be adopted as a part of this Resolution,
and the Town Clerk is directed to publish a copy of this Resolution and said Notice as
provided in the Act.

matter may come on for hearing, in the public hearing room at the Milliken Police
Department building at 1201 Broad Street in the Town of Milliken, Colorado, the Board
of Trustees of the Town of Milliken will hold a hearing for the purpose of finding and
determining whether the property proposed to be annexed meets the applicable
requirements of section 30 of article II of the Colorado Constitution and sections 31-12-
104 and 31-12-105 of the Colorado Revised Statutes and is considered eligible for
annexation.
That, in accordance with Section 16-7-50(b)(5) of the Milliken Municipal Code,
the Town's Planning Commission ("Commission") will conduct a public hearing on
Wednesday, August 3, 2022, at 7:00 PM or as soon thereafter as the matter may come on

Petition for Annexation
THE UNDERSIGNED (hereinafter referred to as the "Petitioners") hereby petition the Board of
Trustees of the Town of Milliken Colorado for the annexation of an area, to be referred to as the
Wiest Annexation to the Town of Milliken. Said area, consisting of approximately One Hundred
and Sixty (160) acres, is more particularly described on Attachment "A," attached hereto.
The Petitioners allege:
1. That it is desirable and necessary that such area be annexed to the Town of Milliken.
2. That the requirements of Sections 31-12-104 and 31-12-105, C.R.S., exist or have been
met.
3. That not less than one -sixth (1/6) of the perimeter of the area proposed to be annexed is
contiguous with the boundaries of the Town of Milliken.
4. That a community of interest exists between the area proposed to be annexed and the
Town of Milliken.
5. That the area to be annexed is urban or will be urbanized in the near future.
6. That the area proposed to be annexed is integrated with or capable of being integrated
with the Town of Milliken.
7. That the Petitioners herein comprise more than fifty -percent (50%) of the landowners in
the area and own more than fifty -percent (50%) and in fact own one hundred percent
(100%) of the area proposed to be annexed, excluding public streets, alleys and lands
owned by the Town of Milliken.
8. The legal description of the land owned by each signer of this petition is shown on
Attachment "B".
9. The proposed annexation of the Property complies with Section 30(1)(6) of Article II of
the Colorado Constitution.
This Petition is accompanied by four (4) copies of an annexation boundary map in the form
required by C.R.S. §31-12-107(1)(d).
