The purpose of these funds and the established goal for JAG 2022 is to support implementation of sustainable programs or to provide resources that prevent or reduce or address crime, delinquency, recidivism, or improve outcomes for those affected by crime, using innovative, multidisciplinary, evidence -based, promising or best practices. The State anticipates that approximately $2.4million will be available for the 2022 JAG grant projects. This is a competitive grant. The Sheriffs Office would like to apply for $207,828. This would cover 2/3s of the 2023 Body -Worn Camera data storage cost and maintenance plan for the 281 additional BWCs outfitting SO Admin, Court and Detentions deputies that WCSO. The application is a continuation request to the 2021 JAG grant, which awarded Weld County Sheriff's Office $200,000 towards the purchase of the additional BWCs and its service plans for one year. The 2022 JAG grant funds would assist in covering the 2023 cost of $311,742 for the ongoing data storage and maintenance plan. What options exist for the Board? (include consequences, impacts, costs, etc. of options): Approve to apply for JAG 2022 grant funding in the amount of $207,828 to cover a portion of the ongoing 2023 BWC program cost of the 281 cameras that were purchased and implemented in 2022. The Weld County Sheriffs Office (WCSO) is seeking funding under the 2022 Edward Byrne Memorial JAG Program to secure the continuity for its Body Worn Camera (BWC) expansion project in 2023. The expansion of its BWC program costs $864,485, covering a period of 39 months. Due to the large unanticipated capital expense, required by State legislation (SB20-217), long term financial planning was not possible to secure essential funds. The BWC program serves the citizens of Weld County, sworn officers of WCSO, and will ensure compliance with SB20-217, by assigning each sworn WCSO deputy a BWC. The goal is to establish long term program self-sustainability, to build increased community trust through improved transparency and accountability, in addition to reducing use of force in its court and detention units. The project will be measured by comparing use of force data before and after the additional BWCs implementation. 8. Problem Statement: Refer to the JAG Application Instructions to see the additional questions that need to be addressed. What problem are you trying to solve? Use local or state information or data that supports your problem statement. Strong relationships and mutual trust between communities and their serving Law Enforcement (LE) agency are critical to maintain public safety, as well as effective policing. LE relies on its community input to solve crime in neighborhoods and community members look for police actions that incorporate principles of procedural justice and legitimacy. Recent national incidents, involving police use of force and other occurrences have some communities question the legitimacy of the police. WCSO deputies are consistently building relationships within their communities. By patrolling neighborhoods, attending town events etc., they are building rapport with citizens. The implementation of the BWCs has not changed that process, it has enhanced it. Wearing BWCs will result in improved outcomes for those affected by crime through increased transparency, accountability, improved collection of evidence. The awareness that the interaction is recorded, can normalize the reaction of both parties. Transparency increases when LE shows the public how incidents transpire. Accountability increases by reviewing post event recordings to determine if LE personnel followed policy and the law. Evidence collection improves because recordings capture incident dynamics that would otherwise be lost. BWCs can generate awareness and help deescalate incidents in which suspects and LE are involved because the interaction is recorded. The utilization of BWCs suggests that officers and citizens are more likely to behave more respectfully when the interaction is recorded (Braga, 2017). In 2020 WCSO outfitted its Patrol Division with 80 BWCs as a pilot program and financed the implementation solely through Weld County general funds. In the summer of the same year SB20-217 was written into law by governor Polis and set forth that LE agencies must outfit officers with BWCs by July 2023. In 2022, the WCSO purchased an additional 281 BWCs, storage and service plans to comply with SB20-217. The extension of 281 BWCs to the Administration, Courts and Detentions units ensures that the Sheriffs Office is in compliance with the mandates of SB20-217. Pre pandemic, in 2019, WCSO detentions deputies handled an average daily inmate jail population of 752. Court deputies attended 21,868 court hearings and handling 1049 arrests during the year. This data shows that Detention and Court deputies have significant daily interaction with inmates and the community. In 2020 Weld County recorded a population of 328,981 and in 2022 it's expected to be an estimated 353,523, forecasting a 7.5% increase over two years. This growth will have a direct effect on WCSO's deputies who are on the street, in the jail or in court because interactions with the community will rise. The 281 additional BWCs for sworn deputies, along with storage and service plans, were priced at a total of $864,485 over 39 months. WCSO paid $241,001 for equipment, data storage and service plans in 2022. The cost in 2022 was funded through $200,000 from 2021 JAG funds, $25,695 from the OJA grant award and 15,306 by Weld County General Funds. The cost to continue the program in 2023 will be $311,742 and covers data storage and service plans for the 281 BWCs. Adding 281 additional BWCs to the existing WCSO program, covering sworn deputies in the Administration, Detentions and Courts Division, is a substantial undertaking and requires a significant amount of capital to cover direct costs associated with the purchase of the cameras, data storage and redaction. Legislation provided an implementation period of three years to achieve compliance with the program. This timeline puts strain on the county's budget process because it was unplanned, included a relative short notice and short implementation period for a project that size. The BWC program encompasses other cost besides the equipment, data storage and maintenance plans, such as personnel who manages the program and data, IT support, staff training time on camera use, video review, and video expungement and redaction, policy development, implementation and follow up. Calculating the existing cost and the anticipated cost in the next two years, WCSO has to commit approximately $723,863 per year on a long-term basis for its entire BWC program. Implementing additional cameras at the same time as COVID19 proves to be another challenge. COVID19 has affected all industries, including law enforcement. Expenses rise faster compared to revenue due to inflation. The inflation rate in January 2022 has reached 7%. Projects planned for 2021 through 2023, that increase officer safety, need to be delayed and/or cancelled to accommodate the additional BWCs implementation. WCSO plans to build the yearly additional program cost into its operational budget over the next several years, trying to eventually sustain the entire BWC program. Currently, the yearly program service coverage remains subject to Weld County's budget approval each year. 9. Implementation Plan: What do you plan to do? What are the steps in your process? Your response should address the 5 questions located in the JAG Application Instructions. The project will allow the sustained expansion of the current BWC program in 2023. The 2022 JAG grant funding will help pay for the future "Software as a Service" (SaaS) component of the BWC system. The SaaS is essential to the operation of the BWC system because it allows the collection, storage and retrieval of the digital video recordings. The SaaS component is the ongoing multiyear cost of the project since the hardware (BWCs and waypoints) were purchased in 2022. Receiving grant funding will offset the substantial future costs that would otherwise have to be made at the expense of other critical programs and funding necessities. The implementation of an additional 281 BWCs and its continued usage in 2023 will impact the Administration, Court and Detentions units of WCSO. Use of force incidents is one data point that is collected on a day-to-day basis agency wide. The goal is to compare the 2022-2024 data to pre BWC implementation. The data output and comparison will show if the implementation of the BWCs will influence the use of force within WCSO. Data collected will also be used for training purposes and enhance the overall interaction between citizen and LE officer. Weld County is committed to the success of the project. Weld County spent $193,612 on the project in 2022, including equipment, data storage, service plan, and salary for 2 additional BWC Techs. To highlight its continued commitment to the future success of the project, Weld County will invest $254,220 in 2023 for the continuation of the 281 BWCs implementation project. This amount includes $103,914 for the BWCs data storage and service plan and $150,306 for salary and benefits of 2 additionally hired BWC Techs. The implementation of the project will consist of allocating all awarded grant funds plus matching funds from Weld County to the 2023 cost of the program. Being able to pay for the ongoing service and data storage plan in 2023 will ensure that the program can continue and that WCSO will meet the SB20-217 compliance deadline of July 2023. Although the equipment is purchased in 2022, the implementation process will extend into 2023 when officers are outfitted and trained, policies amended and implemented. The WCSO and the Weld County Board of Commissioners are responsible for the overall project. Captains of the Administration Division and Detentions will be responsible for ensuring that the implementation process of the additional BWCs for WCSO's Administration, Court and Detentions units will run smoothly, that issues will be addressed and solved as specific unit groups are being activated throughout the agency. The captains will ensure that policies and procedures are updated and that training will be provided. The Budget Manager will oversee the program funding process and all program expenditures. Weld County overcame the initial challenges of the project when BWCs were first fielded in 2020. The infrastructure supporting the current BWC system, is already in place and working. Implementing 281 additional BWCs and its program throughout three units, affecting 281 staff members and support services, calls for a staggered process. A project timeline has been built and will be followed. The timeline starts out in 2022 with the purchase of the BWCs and extends into 2023 with the implementation and training of staff. Scheduled meetings to review project updates will help to identify if issues need to be addressed and if all deputies can be actively using the BWCs by July 2023. Outfitting deputies with BWCs is a State mandated program. Weld County has already begun to plan for the cost of this capital extensive program and accounts for part of it in its future budget session. Additional grant funding for 2023 is being sought to offset the recurring future cost of the SaaS component and service plan for the added 281 BWCs. Implementing Agency 10. As per SB20- 217, these events are required to be captured via body worn camera when depiies are performing a task that requires anticipated use of force, including cell extractions and restraint chairs. By collecting the data associated with these events, different strategies can be used to mitigate future incidents or improve current tactics. It is mandated that 100% of these types of incidents be documented via video. Funding for the continued BWC implementation will assist in paying for the data storage and service plan in 2023.
