James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno - EXCUSED Commissioner Lori Saine — EXCUSED Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Karin McDougal Department of Planning Services representative, Maxwell Nader Department of Public Health and Environment representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated October 11, 2022, and duly published October 14, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Pierce Hardy Limited Partnership, c/o 84 Lumber Company, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0020, for a Lumberyard and Transloading facility outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. Chair James instructed the applicant and reviewed for the public, with two (2) of the five (5) Commissioners being excused, the vote must be unanimous for the case to be approved today. El Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal and described the existing buildings, the proposed buildings and open-air sheds, and the fencing plan. He stated most customers will be general contractors; however, the facility will be open to the public, materials will be delivered by railcars, as well as semi -trailers, and the Great Western Railroad of Colorado and 84 Lumber have already created an agreement for use of the rail and a new spur is proposed. Mr. Nader explained approximately ten (10) to 12 tractor trailers will be entering and exiting the site, with 15 to 20 delivery trucks accessing the site on a daily basis. He stated business hours will be 7:00 a.m. to 6:00 p.m., Monday through Friday, and 8:00 a.m. to 12:00 p.m. on Saturdays, with the proposed number of employees being ten (10) full-time and five (5) part-time, with 200 people expected per day. He explained there will be 45 parking stalls, with three (3) being ADA compliant, and described the screening. He shared, per the Development Review staff, there are two (2) existing accesses, with County Road (CR) 64 being cc : p4. (TP /MN /DA) 01/16/2.3 2022-3143 PL2845 HEARING CERTIFICATION - PIERCE HARDY LIMITED PARTNERSHIP, C/O 84 LUMBER COMPANY (USR22-0020) PAGE 2 the main access, but does not meet the minimum access spacing criteria, and the applicant shall obtain an access permit for the location. He shared the existing access on North 59th Avenue will be for emergency vehicles only, it is under the jurisdiction of the City of Greeley, and the City is proposing a round -about. He explained CR 64 is a paved, arterial road which requires 140 feet of right-of-way, with a current traffic count of 2,258 vehicles per day, twenty percent (20%) trucks, and the 85th percentile speed is 50 MPH. He also reviewed the anticipated vehicle trips and haul route and noted a Final Traffic Impact is required. He stated Development Review is requesting an Improvements and Road Maintenance Agreement for dust control, damage repairs to specified haul routes, triggered off -site improvements and up -front, off -site improvements, which may include a contribution of a proportional share of the County's cost associated with the proposed roundabout. Additionally, the applicant has submitted a pre -Drainage Report in which a variance detention is requested, and a Final Drainage Report, is required prior to recording the USR map. Mr. Nader stated the site is located within the three (3) mile referral area of the City of Greeley, whose advisory comments were related to the design of the site, which is captured in the landscape plan, as well as stormwater drainage requirements which will be captured in the Drainage Report. He described the surrounding uses, displayed images of the site and surrounding views, and entered the favorable recommendation of the Planning Commission into the record as written. El Lauren Light, Department of Public Health and Environment, stated water is supplied by the North Weld County Water District, and the applicant has an existing commercial septic system sized for 15 people. She explained if the use is increased, the system will have to be reviewed for expansion, a dumpster will be utilized for waste, the noise restriction is to the Light Industrial limit, DS #9 — #17 address Environmental Health items, and there are no outstanding issues with this request. El Jim Zaunich, applicant, relayed the history of 84 Lumber, and shared they have 250 facilities across the country, with 300 employees at headquarters, and 4,000 - 5,000 employed nationwide. He provided the hours of operation, explained all sales are from outside salesmen, and reiterated the site size, buildings and traffic expected from delivery trucks and customer vehicles, with the goal to utilize the existing access. In response to Chair James, the applicant explained the rail cars will be onsite long enough for loading and unloading. El No public testimony was offered concerning this matter. El The Board discussed the COA and DS as presented. Commissioner Freeman suggested the number of employees reflected in DS #4 be increased to 15 full-time and 10 part-time, for future growth. The Board agreed to all of the aforementioned changes. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. El In response to Chair James, Mr. Zaunich indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. 2022-3143 PL2845 HEARING CERTIFICATION - PIERCE HARDY LIMITED PARTNERSHIP, C/O 84 LUMBER COMPANY (USR22-0020) PAGE 3 Ig Commissioner Freeman moved to approve the request of Pierce Hardy Limited Partnership, do 84 Lumber Company, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0020, for a Lumberyard and Transloading facility outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 10:44 a.m. This Certification was approved on the 19th day of December, 2022.
