A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
January 27, 2022, at 10:00 a.m. via Microsoft Teams Meeting.
Members Present: Mike McRoberts, Amy Mutchie, Denise Beltran, Jerry Adams, and Steve Barwick.
Members Absent: Jared Rauch, Michael Wailes, Shelly Bergstrom, Mark Alessi, Jeremy Young and Lucas
McConnell.

Michael Hall, Department of Planning Services stated the applicant is proposing a Minor Subdivision, case
number MINF21-0001, to split Lot B of Recorded Exemption RE -1359, which is approximately 24.38 acres in
size, into five (5) residential lots, with an average lot size of approximately 4.77 acres. Change of Zone, case
number C0Z21-0008, is in progress with the purpose of rezoning the property from the A (Agricultural) Zone
District to the E (Estate) Zone District, as typical for Minor Subdivisions. The proposed development will be
known as the Zadel Minor Subdivision. There is one (1) residence and associated outbuildings located in the
southwest portion of the site, on proposed Lot 1. The area that will comprise Lots 2 thru 5 is currently vacant,
with the exception of oil and gas infrastructure. The five (5) lots will be served by an internal paved roadway,
extending north from County Road 38. This is designated on the draft Final Plan as Tract A and will be
publicly dedicated right-of-way and privately maintained. As part of the Minor Subdivision process, required
easements shall be dedicated as part of the platting.
Section 24-5-70.A.4. of the Weld County Code, being the Minor Subdivision Final Plan procedure section,
states: "The Department of Planning Services shall schedule the Minor Subdivision Final Plan utility design on
the first available Utilities Coordinating Advisory Committee meeting prior to the Board of County
Commissioners hearing. The Utilities Coordinating Advisory Committee shall review the Final Plan for
compliance with Section 24-3-60 of the Weld County Code, as amended."
Staff requests that Section 24-5-20.A.10. of the Weld County Code, being the Minor Subdivision Standards
section states: "Drainage and utility easements within Minor Subdivision shall follow the easement standards
per Chapter 24, Article III of the Weld County Code, as amended."
Chapter 24, Article III [Subdivision Design Standards], Section 24-3-60 of the Weld County Code, being the
Easement Standards section states:
A. Fifteen (15) feet minimum drainage and utility easements are required adjacent to public road rights -
of -way, unless otherwise recommended by the Utilities Coordinating Advisory Committee for
technical purposes.
The draft Minor Subdivision plat shows fifteen (15) foot wide easements adjacent to County Road 38
and County Road 19; however, the draft plat only shows ten (10)foot wide easements adjacent to the
internal Minor Subdivision road right-of-way. Planning staff supportsthe easement layout adjacent to
the County Roads and recommends that the plat be updated to delineate fifteen (15) foot wide
easements along the lot lines that are adjacent to the internal public road right-of-way.
B. Twenty (20) feet minimum drainage and utility easements are required along internal lot lines and
shall be apportioned equally on abutting properties, unless otherwise justified by the Utilities
Coordinating Advisory Committee for technical purposes.
The draft Minor Subdivision plat shows twenty (20)foot wide easements along the internal lots lines
and such easements are apportioned equally on the abutting properties, being ten (10)feet on each
side of the joint lot line. Planning staff recommends the internal lot line easement layout as
presented.
C. Ten (10) feet minimum drainage and utility easements are required along exterior lot lines, unless
otherwise justified by the Utilities Coordinating Advisory Committee for technical purposes. Corner
exterior lots requires fifteen (15) feet.
The draft Minor Subdivision plat shows ten (10) foot wide easements along the exterior lot lines,
being the properties to the north, east and southeast of the overall Minor Subdivision boundary.
Planning staff recommends the exterior lot line easement layout as presented.
D. Easements shall be designed to provide efficient installation of utilities and drainage swales.
Proposed easements may be modified by the Utilities Coordinating Advisory Committee. Public utility
installations shall be located to permit multiple installations within the easements to avoid cross
connections, minimize trenching and adequately separate incompatible systems.
The draft Minor Subdivision plat dedicates the easements for drainage and utility purposes and there
is no reference to any such easement being exclusive. Planning staff recommends the easement
labels be accepted as presented.
As detailed above, the default Easements Standards are recommended to be approved by the Utility Board.
There does not appear to be any technical purposes, which are unique to this proposed Minor Subdivision, to
alter any of the default easements widths or locations. These easements shall then be dedicated on the Minor
Subdivision Final Plat, should the Minor Subdivision application be approved by the Board of County
Commissioners.
A condition of approval in the Minor Subdivision staff report and Resolution will be to delineate the requisite
easements as stipulated by this Utility Coordinating Advisory Committee hearing and as sourced from the
Easement Standards per Section 24-3-60 of the Weld County Code.
The Weld County Department of Planning Services recommends that this request be approved.
The Chair asked the applicant if they had any comments or questions. Andrew Baker, Applicant, stated that
they are more than happy to increase the easement along the right-of-way.
Motion: Approve the final plan for MINF21-0001 along with Staff's recommendations, Moved by Amy
Mutchie, Seconded by Denise Beltran. Motion carried unanimously.

Dear Mr. Zadel:
This letter is in response to your request for water service commitment for four 5/8 -inch standard
residential taps for a property yet to be platted generally located northeast of the intersection of Weld
County Road 19 (WCR 19) and Weld County Road 38 (WCR 38), or more generally described as
follows:

The District provides water service within its service area as defined by the District. The provision of
water service by extension of existing water lines of the District to the above property and the
installation of taps for lots is done under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. The Board of the District may alter and amend the Rules and Regulations
at any time, and the provisions of service are subject to alteration and amendment based on changes in
the Rules and Regulations of the District.
We currently own and operate a 6 -inch diameter waterline along WCR 38 that extends approximately
910 feet east of WCR 19. The District also owns and operates a 2.5 -inch diameter waterline along
WCR 19. We currently serve the existing property through tap #3564, which is identified as Lot I on
the Zadel Minor Subdivision Sketch Plan (map) attached with your commitment request. The
remaining four properties proposed for service are identified on the map attached with the request as
Lots 2, 3, 4, and 5. We will provide service to Lots 2, 3, 4, and 5 for the requested four 5/8 -inch standard
residential taps, subject to the limitations in this letter and the following additional limitations on the
provision of water service:
1) All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations. All
improvements must conform to District Specifications.
2) Service to Lot I can remain and continue with the existing tap #3564.
3) Service to Lots 2, 3, 4, and 5 will require a 6 -inch mainline extension that ties into the
existing 6 -inch diameter waterline located in WCR 38 and continues to the north into the
proposed cul-de-sac. Tap connections for Lots 2, 3, 4, and 5 should be connected to the
required 6 -inch waterline.
Please see attached Exhibit A for a graphical representation of the required mainline
extension.
4) Little Thompson Water District does not accept cash in lieu payments for water rights
for developments. The developer will be required to provide water rights to meet the
minimum projected needs of the proposed development at 0.70 acre-feet per tap, totaling to
2.80 acre-feet. Please contact the District's Water Resources Manager, Nancy Koch, at 970-
344-6388 to discuss in more detail.
5) It is required that the proposed parcels be included in the tax authority for the Little
Thompson Water District. To complete the District inclusion process, please contact Judy
O'Malley with Little Thompson Water District at 970-344-6306.
6) Where fire hydrants are required, there is a $2,000 per fire hydrant fee that needs to be paid
prior to installation of the fire hydrant (installed by your contractor). The Developer would
also be responsible for the system upgrades required to meet any fire flow requirements.
Fire flow was not evaluated for this commitment request.
7) The developer will need to provide complete waterline design plans stamped by a
professional engineer for review and approval by the District.
This commitment letter will expire two years from the date of this letter if the taps have not been
purchased, paid for and installed by that date of expiration. Please note that tap fees can change at any
time within this two-year period. The current fee for each 5/8 -inch standard residential tap where
installation is provided by the developer is $11,450. These fees do not include the raw water dedication
of 0.70 acre-feet per tap that is required to be provided by the Developer as noted in item 4 above.

THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE; AND THIS LETTER IS
ISSUED WITH THE SPECIFIC LIMITATION THAT THE DISTRICT MAY CHANGE THE
RULES, REGULATIONS AND TARIFFS APPLICABLE TO THE ABOVE PROPERTY AT
ANY TIME WITHOUT NOTICE TO YOU OR ANY PERSON.
