HomeMy WebLinkAbout20222585.tiffRESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE AN INJUNCTION FOR VIOLATION OF THE WELD COUNTY CODE, CCV22-00002 - GABRIEL AND VELIA ROBLES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Gabriel and Velia Robles, are allegedly in violation of the Weld County Code, specifically Chapter 23 of the Weld County Code, as they have allegedly allowed several events to occur that are not permitted, and WHEREAS, Gabriel and Velia Robles have been assigned a Code Compliance Violation, CCV22-00002, and WHEREAS, despite efforts by the Department of Planning Services to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of September, 2022, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Gabriel and Velia Robles, property owner(s), was present at said hearing and presented testimony, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with immediate legal action against Gabriel and Velia Robles to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. My name is Gerald Coe and I have been a near neighbor of the property being referred to in this case as 0 CR 41, Hudson, CO for the past 39 years. As such, I have some thoughts I would like to share with you at today's hearing. Unfortunately, a medical appointment must take precedence so instead, I have documented my concerns in this letter. With your concurrence, my neighbor, Mark Woodward, has agreed to read it to you. Our community is, in large part, made up of good neighbors that are friendly and anxious to help but mind their own business when they are not affected. The owners of the subject site in this hearing have not been good neighbors. The business events they operate have been the catalyst on numerous occasions for totally unacceptable impacts on our community. Following are some of the things they are expecting us to put up with: 1. Very loud speaker announcements and all -day music with heavy bass beats are impossible to ignore, especially when it goes on well into the night. 2. Extreme traffic consisting of literally hundreds of cars, trucks and even busses, many of which are operated in a careless and reckless manner when leaving the site. 3. Clouds of dust hang in the air before, during and after their events due to the traffic and event activities. 4. The general area, especially the roadsides, have filled with trash, mostly beer bottles and cans but plenty of other stuff as well. 5. Gunshots, no idea what is being shot at but it's always concerning when alcohol and firearms are mixed. Bullets can easily travel beyond the property boundaries. It is my understanding that the current events on this site have been held in flagrant disregard of the Board's previous revocation of USR 15-0051. Because of this, and the safety issues listed above, I strongly urge the Board to deny continued use of the property for these events. Thank you. WHEREAS, in support of this action, the Board makes the following findings: Development Standard No. 1 states: "The Site Specific Development Plan and Use by Special Review Permit, USR15-0051, is for an Agricultural Service Establishment primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or contract basis, including commercial rodeo arenas and commercial roping arenas, to include an outdoor arena in the A (Agricultural) Zone District, subject to the Development Standards stated hereon." Development Standard No. 3 states: "The hours of operation are 12:00 p.m. to 7:00 p.m., Saturday and Sunday, May through October, as stated by the applicant(s)." The Board finds that the site is not in compliance with Development Standard #3 because there is evidence from the Weld County Sheriff's Office that the applicant held an event April 7, 2018, which is prior to the hours of operation for the facility. Development Standard No. 7 states: "No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, Section 30-20-100.5, C.R.S." Development Standard No. 8 states: "Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article I, of the Weld County Code." The Board finds that the site is not in compliance with Development Standards #6, #7, and #8 because there is photographic evidence, a written incident report, and testimony from the Weld County Sheriff's Office Deputy that the applicant held an event April 7, 2018, and left the property with substantial amounts of trash, debris, and beer cans on the ground. Development Standard No. 12 states: "The operation shall comply with all applicable rules and regulations of state and federal agencies and the Weld County Code." The Board finds that the site is not in compliance with Development Standard #12 because there is a Weld County Sheriff's Office incident report and testimony from a Weld County Sheriff's Deputy that the applicant held an event April 7, 2018, where the attendees were observed consuming alcohol, driving carelessly and recklessly, trespassing onto adjacent property, and per public testimony, discharging weapons. Development Standard No. 13 states: "The property owner or operator shall provide written evidence of an approved Emergency Action and Safety Plan on or before March 15th of any given year, signed by representatives for the Fire District and the Weld County Office of Emergency Management to the Department of Planning Services." The Board finds that the site is not in compliance with Development Standard #13 because the Emergency Action and Safety Plan is required to be updated on or before March 15 of any given year and this document has not been provided to the Department of Planning Services for 2018. Development Standard No. 23 states: "The maximum number of persons on -site for any event is limited to 350 persons as stated in the application. If there is a desire to have more than 350 persons on this site at any one time, the property owner or operator shall first obtain an approved Temporary Assembly Permit pursuant to Chapter 12, Article I, of the Weld County Code." The Board finds that the site is not in compliance with Development Standard #23 because the property owner and operator held an event on April 7, 2018 with substantially more than 350 people without first obtaining a Temporary Assembly Permit, as evidenced by a Weld County Sheriff's Office incident report, testimony from a Weld County Sheriff's Deputy, and the lack of evidence of such Permit from the Weld County Clerk to the Board's Office. The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards, as shown or stated, shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. • The site is not in compliance with Development Standard #26 because the facility is operating outside of the permitted hours of operation of 12:00 p.m. to 7:00 p.m., Saturday and Sunday, May through October of any given year. 27. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. The site is not in compliance with the Development Standards listed in the USR Resolution because the site operates outside of the permitted hours of operation, the property is left with substantial amounts of trash, debris, and beer cans on the ground at the site, and the site does not have a current Emergency Action and Safety Plan to protect the health, safety and welfare of the attendees and surrounding property owners.
