RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) AND AUTHORIZE CHAIR TO SIGN - SERVICE EMPLOYMENT REDEVELOPMENT, JOBS FOR PROGRESS NATIONAL, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for the Workforce Innovation and Opportunity Act (WIOA) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Workforce Development Board, and Service Employment Redevelopment, Jobs for Progress National, Inc., commencing July 1, 2022, and ending June 30, 2026, with further terms and conditions being as stated in said memorandum of understanding, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. THIS MEMORANDUM OF UNDERSTANDING is entered into this 2,1 day of opVt. 1 , 2022, by and between the Board of County Commissioners, on behalf of the Weld County Department of Human Services and the Weld County Workforce Development Board, hereinafter collectively referred to as "County," and Service Employment Redevelopment (SER) Jobs for Progress National, Inc., hereinafter referred to as "Partner". Purpose The purpose of this Memorandum of Understanding (MOU) is to establish an agreement between the County and the Partner, hereinafter referred to as the "Parties", concerning respective roles and responsibilities for implementation of the provisions of Section 121(c) of the Workforce Innovation and Opportunity Act (WIOA) of 2014. Additionally, this MOU is to coordinate resources to prevent duplication and ensure the effective and efficient delivery of workforce development services in Weld County. This MOU also establishes joint processes and procedures that will enable the Parties to integrate the current service delivery system, resulting in a seamless and comprehensive array of education, human service, job training and other workforce development services to Weld County residents. Parties to this document will coordinate and perform the activities and services described herein within the scope of legislative requirements governing the Parties' respective programs, services and the requirements of our partner. Parties to this document also agree to the responsibilities, obligations, and accomplishment of the performance standards and desired outcomes described in this MOU. Term of this Memorandum of Understanding (MOU) This Memorandum of Understanding ("MOU" or "Agreement") shall be effective beginning July 1, 2022 through June 30, 2026. Joint Roles and Responsibilities of both County and Partner 1. Coordinate the scheduling and services of shared participants and develop a shared informal referral and follow up form. 2. Cross train staff to increase high quality services, referrals and access to programs. 3. Jointly case manage customers enrolled in programs under the County or Partner and share assessment results as appropriate. 4. Provide informational brochures to customers at each partners main location. 5. Coordinate job development and employer relations activities. 6. Review options for coordinating intake forms and data requirements. 7. Explore opportunities for coordination and submission of grants or other funding opportunities to enhance or strengthen employment opportunities for Older Americans. 8. Provide information on points of entry into ConnectingColorado. 9. Review job orders and other services and make referrals as appropriate. 10. Development of career pathways and sector partnerships. o20 ,202 ./02O/ Roles and Responsibilities of Partner 1. Train the County and/or other Partner staff in the role and mission, goals and philosophy of the Partner. 2. Provide program specific assessments for customers and share the information with the County's shared customers. 3. Assist customers in accessing ConnectingColorado at the Partner's office or provide information to customers on accessing ConnectingColorado at a point of entry that the customer desires. 4. Provide opportunities for the County staff to attend Partner's training as appropriate. 5. Assist the Weld County Workforce Development Board (WCWDB) in an annual review of the systems access for Older Americans and provide input in technology assistance. 6. Participate in the Business Services strategies to include, but not limited to, hiring events, career events and job development for co -enrolled participants by targeting business engagement opportunities and expanding awareness of employment opportunities for Older Americans. 7. Provide the full range of services available as appropriate for co -enrolled customers which would include: a. Counseling and guidance provided directly by a counselor during the individual's plan of services. b. Training services. c. Placement services. d. Supportive services. Roles and Responsibilities of County 1. Provide opportunities for cross training staff, which may include but is not limited to: a. Use of the One -Stop Resources. b. Utilization of the open job orders list, distributed weekly. c. Assisting job seekers with accessing and completing applications in ConnectingColorado. d. Providing the following information regarding services available at the County for participants co -enrolled in partner programs: i. Orientation to the programs. ii. Intake and eligibility processing. iii. Basic assessment. iv. Career planning. v. Case management. vi. Coordinated job search, job development, and job placement activities. vii. Hiring and career development events. viii. Follow-up as required by funding sources. 2. Maintain a website that provides on-line information regarding services that are available at the County. Performance The Parties jointly agree to high performance for the workforce development system and Older Americans. It is the intent of each partner to support continuous improvement for program delivery and high -quality services through the workforce system wherever participants access services. Performance will be measured by: 1. Sharing results of participants satisfaction surveys. 2. Sharing performance expectations by funding sources and the performance outcomes as requested. Resources Resources available to the County under the operating cost of the Workforce Development System include: 1. Wagner-Peyser: Basic Labor Exchange for employers and job seekers. 2. WIOA: Adult, youth, dislocated workers. 3. Colorado Works Temporary Assistance for Needy Families (TANF): Cash assistance recipients. 4. Employment First: Supplemental Nutrition Assistance Program (SNAP) recipients. 5. Weld County Youth Conservation Corps' (WCYCC) AmeriCorps. 6. Other programs and discretionary projects that may become available. Resources available to the Partner to serve individuals with barriers through in -kind contributions within the workforce system in Weld County: 1. Partner funded professional training that will be made available to County staff when appropriate. 2. Staff resources to assist Business Services as appropriate. 3. Staff resources to assist customers in accessing one -stop services available in ConnectingColorado, such as reviews of open job orders and quality job applications. 4. Joint case management as appropriate. Modifications This Agreement may be modified in writing, in whole or in part, upon approval of the signers. Termination This Agreement may be terminated at any time by either party giving thirty (30) days written notice to the signers. No portion of this MOU shall be deemed to create an obligation on the part of the County of Weld, State of Colorado, to expend funds not otherwise appropriated, as this MOU is subject to the availability of funding. Therefore, the County may terminate this MOU at any time if the source of funding for the services made available to Partner is no longer available to the County, or for any other reason. Partner reserves the right to suspend services to participants if funding is no longer available. Entire Agreement This MOU contains the entire agreement and understanding between the parties with respect to the subject matter hereof and may not be changed or modified except as stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. Partner and the County may not assign any of its rights or obligations hereunder without the prior consent of both parties. No Third -Party Beneficiary It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. Governmental Immunity No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act §§24-10-101 et seq., as applicable now or hereafter amended. Independent Organization Partner agrees that it is an Independent Organization and that the Partner's officers, agents or employees will not become employees of the County, nor entitled to any employee benefits from the County as a result of the execution of this MOU. Partner shall perform its duties hereunder as an Independent Organization. Partner shall be solely responsible for its acts and those of its agents and employees for all acts performed pursuant to this MOU. Partner, its employees and agents are not entitled to unemployment insurance or workers' compensation benefits through the County and the County shall not pay for or otherwise provide such coverage for Partner or any of its agents or employees. Unemployment insurance benefits will be available to Partner and its employees and agents only if such coverage is made available by Partner or a third party. Partner shall pay when due all applicable employment taxes and income taxes and local head taxes (if applicable) incurred pursuant to this MOU. Severability If any term or condition of this MOU shall be held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced without such provision, to the extent that this MOU is then capable of execution within the original intent of the parties. Nondiscrimination and Equal Opportunity As a condition to the award of financial assistance from the County of Labor under Title I of WIOA, the grant recipient assures that it has the ability to comply with the nondiscrimination and equal opportunity provisions of the following laws and will remain in compliance for the duration of the award of federal financial assistance: Section 188 of the Workforce Innovation and Opportunity Act, which prohibits discrimination against all individuals in the United States on the basis of race, color, religion, sex (including pregnancy, childbirth, and related medical conditions, transgender status, and gender identity), national origin (including limited English proficiency), age, disability, or political affiliation or belief, or against beneficiaries on the basis of either citizenship status or participation in any WIOA Title I -financially assisted program or activity; Title VI of the Civil Rights Act of 1964, as amended, which prohibits discrimination on the basis of race, color and national origin; Section 504 of the Rehabilitation Act of 1973, as amended, which prohibits discrimination against qualified individuals with disabilities; The Age Discrimination Act of 1975, as amended, which prohibits discrimination on the basis of age; and Title IX of the Education Amendments of 1972, as amended, which prohibits discrimination on the basis of sex in educational programs. The grant applicant also assures that, as a recipient of WIOA Title I financial assistance, it will comply with 29 CFR part 38 and all other regulations implementing the laws listed above. This assurance applies to the grant applicant's operation of the WIOA Title I -financially assisted program or activity, and to all agreements the grant applicant makes to carry out the WIOA Title I -financially assisted program or activity. The grant applicant understands that the United States has the right to seek judicial enforcement of this assurance.
