WHEREAS the parties entered into an Agreement for client confidentiality of emergency rent and utility assistance applications, (the "Original Agreement") identified by the Weld County Clerk to the Board of County Commissioners as document No. 2021-0840, approved on March 24, 2021. WHEREAS the parties hereby agree to amend the term of the Original Agreement in accordance with the terms of the Original Agreement and any previously adopted amendment, which is incorporated by reference herein, as well as the terms provided herein. NOW THEREFORE, in consideration of the premises, the parties hereto covenant and agree as follows: • The Original Agreement was set to end on December 31, 2021. • The Original Agreement was amended on: • December 15, 2021 to extend the term date through December 31, 2022. • These Amendments, together with the Original Agreement, constitutes the entire understanding between the parties. The following additional changes are hereby made to the current Agreement: 1. Term This Agreement is being renewed for a third full year term, for the period of January 1, 2023 through December 31, 2023. • All other terms and conditions of the Original Agreement remain unchanged. As such, both parties agree to maintain client confidentiality, to share information in an effort to avoid duplication, and to use client information for the sole purpose of processing emergency assistance in accordance with federal funding program guidelines. The Department requests to renew this Agreement for a second term for the dates of January 1, 2022 through December 31, 2022. The County has no financial obligations under this Agreement. Neighbor to Neighbor, is a nonprofit housing organization located in Larimer County. Each party will use the confidential information only for the purposes of distributing emergency rent and/or utility assistance unless another use, such as complying with open records laws, is required by law. No term or condition of this agreement shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act §§24-10-101 et seq., as applicable now or hereafter amended.
