A public hearing was conducted on April 27, 2022, at 10:00 a.m., with the following present:
Commissioner Scott K. James, Chair
Commissioner Mike Freeman, Pro-Tem
Commissioner Perry L. Buck
Commissioner Steve Moreno
Commissioner Lori Saine
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 27, 2022, and duly published
January 29, 2022, in the Greeley Tribune, a public hearing was conducted on March 23, 2022, to
consider the request of W3 Legacy, LLC, for a Change of Zone, COZ21-0012, from the
A (Agricultural) Zone District to the 1-3 (Heavy Industrial) Zone District, at which time the Board
deemed it advisable to continue the matter to April 27, 2022, to allow for all five (5) Board
members to be present. Bruce Barker, County Attorney, made this a matter of record.
Tim Naylor, AGPROfessionals, LLC, authorized agent, requested a withdrawal of the
application, based on the action previously taken by the Board concerning Change of Zone,
COZ21-0010.
El Commissioner Buck moved to accept the request of W3 Legacy, LLC, to withdraw the
application for a Change of Zone, COZ21-0012, from the A (Agricultural) Zone District to the
1-3 (Heavy Industrial) Zone District. The motion was seconded by Commissioner Saine, and it
carried unanimously. There being no further discussion, the hearing was completed at 11:37 a.m.
