Approval Condition 5 of USR18-0065 requires completion of the following requirements prior to acceptance of waste in
Unit 2 at North Weld Landfill which is planned to begin early next month:
A. The facility shall submit evidence to the Weld County Department of Public Health and Environment that
financial assurance has been obtained in accordance with CDPHE regulations pertaining to solid waste sites and
facilities.
B. The applicant shall develop an Emergency Action and Safety Plan with the Office of Emergency Management
and the Fire District. The plan shall be reviewed on an annual basis by the Facility operator, the Fire District and
the Weld County Office of Emergency Management. Submit evidence of acceptance to the Department of
Planning Services.

WMDSC has addressed these requirements as described below:
Condition 5A.: Financial assurance has been submitted to and approved by CDPHE as documented in correspondence
between WMDSC and CDPHE provided the first attachment.
Condition 5B.: The Facility Emergency Action Plan was prepared by facility management and accepted by the Office of
Emergency Management and the Fire District in December 2019. I believe Bill Hedberg previously
provided the finalized plan to the Department of Planning Services but have also included it as the
second attachment.

Dear Mr. Schweitzer:
The Solid Waste Unit of the Colorado Department of Public Health and Environment,
Hazardous Materials and Waste Management Division (the "Division") has conducted a review
of the Financial Assurance for North Weld Sanitary Landfill. The Financial Assurance Submittal
was reviewed for compliance with Section 4.0 of the Regulations Pertaining to Solid Waste
Sites and Facilities, 6 CCR 1007-2 (the "Regulations").
The submittal included a revised Certificate of Insurance, policy number CPCS99-0013
effective through May 7, 2022. The coverage has been increased to a total of $4,859,781 for
closure and $6,726,339 for post -closure. As a result of the Division's review and analysis, the
Division hereby approves your 2021 Financial Assurance submittal as the financial mechanism
for closure and post -closure care costs of the facility.
The Division is authorized to bill for its financial assurance review pursuant to Section 1.7 of
the Regulations, and an invoice will be transmitted under separate cover.

The Colorado Department of Public Health and Environment Hazardous Materials and
Waste Management Division (Division) has received the following closure/post-closure
financial assurance -related documents for the North Weld Landfill (Facility).
Closure/Post-Closure Plan. Prepared by Waste Management. Document dated
November, 2021.
DRAFT Financial Assurance Plan (with closure and post -closure costs). Prepared by
Waste Management. Document updated November 2021.
The above -referenced documents were submitted to the Division to meet the
requirements set forth in the Solid Waste Regulations, 6 CCR 1007-2, Part 1
(Regulations) and Approval Condition 3 of the Division's June 25, 2018
Recommendation of Approval letter for North Weld Landfill Unit 2. Based on the
review, the Division approves the Plan and cost estimates. Please submit the finalized
Financial Assurance Plan (with Certificate of Insurance) to Tanya Gray for approval
prior to waste placement in Unit 2.
The approved closure cost estimate is $4,859,780.63 and the post -closure cost
estimate is $6,726,338.46.
The Department is authorized to bill for its review of technical submittals pursuant to
Section 1.7 of the Regulations. An invoice for the Division's review of the above
referenced document will be transmitted under separate cover.

Dear Mr. Todd:
In a letter dated June 25, 2018 to the Weld County Board of County Commissioners, the
Division provided a Recommendation of Approval with Conditions for Waste
Management Disposal Services of Colorado, Inc's. (WMDSC's) application for North
Weld Landfill, Unit 2.
Approval Condition 3 in the letter required that the financial assurance mechanism for
closure and post -closure care be in -place and approved by the Division prior to
acceptance of material in Unit 2. In accordance with Section 4.5.1 of the Colorado
Regulations Pertaining to Solid Waste Disposal Sites and Facilities, 6CCR-1007-2
(Regulations) as amended July 15, 2018, enclosed is a draft Financial Assurance Plan
that includes the closure and post -closure cost estimates for the Division's review and
approval. The Plan, which had been previously prepared for Unit 1, has been updated
to include Unit 2.
Supporting the closure and post -closure cost estimates, also enclosed for review and
approval is an updated Closure and Post -Closure Plan that adds Unit 2 to the previously
approved Unit 1 closure and post -closure plan.
The 2021 inflation adjustment factor of 1.012 used for the cost estimates was approved
by the Division on May 12, 2021. As information, the Regulations require that closure
and post -closure cost estimates be replaced every five years. The last replacement for
NWLF occurred in 2017, so new cost estimates will be prepared for the Division's
review in early 2022.
The first disposal cell in Unit 2, Phase 4 Module 1, is scheduled for completion by the
end of this year and we anticipate the first placement of waste in the new cell by midway

into the first quarter of 2022. Accordingly, the Division's review and approval of the
enclosures at the earliest opportunity will be appreciated.
Upon receipt of the Division's approval of the updated closure and post -closure cost
estimates, WMDSC will proceed with obtaining the financial instrument and finalize the
Financial Assurance Plan.

Chemical/product is delivered by various common carriers via SH-14 to CR-25, then onto
internal facility roads.
10. Action Items and Response:
Dyed diesel is delivered to and stored in a 10,000 tank on skids, currently stored near the center
of Unit 1 (USR 895). Gasoline and used oil are delivered to and picked up from yard area north
of maintenance shop. Other industrial chemicals used at the facility are stored in the
maintenance shop. Diesel and Gasoline tanks are double -wall, steel construction to minimize
rupture and spill potential. Used Oil container is steel within earthen secondary containment.
Other petroleum products are stored in the shop with secondary containment. Highest risk of
spill is during transfer from delivery vehicles or to facility vehicles for intended use. Spill
containment supplies are readily available at transfer locations to minimize impact in the event of
a spill.
11. Reportable Quantities and Spill Reporting
a. Reportable Quantities
Mandated by Section 312 of the Emergency Planning and Community Right -To -Know
Act (EPCRA) — also known as SARA Title III — the Tier II form captures information about the
types, quantities, and locations of hazardous chemicals at a given facility. The form also lists
contact information for the facility's designated emergency point -of -contact.
NWLF is required to maintain Safety Data Sheets (SDSs) under the Occupational Safety and
Health Administration (OSHA) regulations for hazardous chemicals stored or used in the work
place. Facilities with chemicals in quantities that equal or exceed the list of lists thresholds
must report.
b. Reporting Requirements
Tier II reports must be submitted annually to the appropriate agencies each year before March
S'. This requirement is strictly followed by WMDSC.
c. Spill Reporting
The North Weld Landfill will complete the Weld County online spill reporting form in the
event of a spill which is required to be reported to the Colorado Department of Public
Health and Environment. We will also report that spill to the Weld County LEPC. This
form can be found at https://www.co.weld.co.us/appsl/oem/spillreport/index.cfm
d. Coordination with First Responder Agencies:
WMDSC representative(s) are available to meet with first responders as often as the response
agency deems necessary to review emergency plan implementation and to tour the facility.
This initial Plan and subsequent updates will be submitted for their review. Tier II reports
are filed annually no later than March 1'. SDS information is available online through
Verisk 3E, at all times. Notification signs are placed prominently around the facility with
Verisk 3E access information.
e. Safety and Training Review:
Each year, applicable employees are provided with all necessary information concerning the
proper handling of a chemical spill or accident. Training will be documented using an
attendance sheet signed and dated by each employee completing the training, referencing
detailed training materials reviewed. Also, proper use of cleanup and containment tools and
procedures will be demonstrated as necessary. Any new or updated information or
procedures will be provided to employees immediately when applicable.
