("Meisner Property"). The Meisner Property is farmed by Mr. Keith Amen and will remain an active farm following completion of PSCo's proposed project. This letter is in response to Public Service Company of Colorado's ("PSCo") Section 1041 Application filed under USR21-0018 ("Application"), which includes the construction of approximately 16 miles of a 230-KV transmission line ("Transmission Line") in Weld County. As proposed, a portion of the Transmission Line from the WAPA Ault substation to the Husky substation will cut through the southwest corner of the Meisner Property. Mrs. Meisner opposed PSCo's original Section 1041 permit application filed under Case No. USR 18-0100 in 2018 because the original preferred route at that time proposed cutting between the southern boundary of Mr. Amen's property in the NW 'A of Section 3, Township 7 North, Range 66 West, and the northern portion of the Meisner Property. This route risked disrupting the intricate, decreed system of wells and related irrigation infrastructure used for farming their lands that exists under both the Meisner Property and Mr. Amen's property. Since dismissal of PSCo's 2018 Application by the County, PSCo has been working with Mrs. Meisner to find an alternative route, the result of which is the current proposal to cross the southwest corner of the Meisner Property. Based on discussions with PSCO representatives, it is Mrs. Meisner's understanding that the Transmission Line will cross her property at a specific location in the southwest corner, and no towers, facilities, or other infrastructure will be installed on her property. PSCo and Mrs. Meisner are currently in negotiations to memorialize this understanding in writing, along with PSCo providing other conditions and protections to protect Mrs. Meisner's interests in her property. S EXHIBIT In the event that PSCo's proposed route changes throughout the Application review process, whereby the Transmission Line would cross a different portion of the Meisner Property or impact her property in any different manner, Mrs. Meisner reserves the right to provide additional comments related to any revised proposed route and as the project progresses to make sure that there will be no impacts to her agricultural land and farming operations, as well as any irrigation equipment and systems, ditches and wells on the Meisner Property or on Mr. Amen's property to the north. Mrs. Meisner further asks that the County applies the same consideration when reviewing this Application that it applied in its review of PSCo's 2018 Application to ensure compliance with Weld County's Right to Farm policy and the Weld County Code, including, in particular, Chapter 21 of the Code that mandates that PSCo's Application be approved only if certain criteria is met to ensure protection of agricultural lands in this community. Hebrews 10:24 EXHIBIT 70 Members of the Weld County Planning Commission; This letter is in reference to the Xcel Energy Northern Colorado Area Plan and written on behalf of the Haythorn, Milne, Booth, Keirnes and Fagerberg families. These families are generational members of the town of Eaton and its surrounding communities. Combined, this group owns over two and a half miles of contiguous land on the west side of the Highway 85 corridor, stretching from CR 74 to Highway 392. None of the aforementioned land has any agreements in place with Xcel. It is our group's desire to continue working alongside the town of Eaton in promoting the town's pragmatic, yet steady, approach to growth. We feel that it is this very approach that has preserved the area's rural appeal and made Eaton one of the most desirable towns in northern Colorado. The Fagerberg family made clear its commitment by recently annexing 160 acres into the town and placing a Conservation Easement on the 200 -acre farm on the southern border of Eaton; ensuring this acreage will permanently remain farmland and provide town residents with an unobstructed view of the Rocky Mountains. Our group has several concerns about the permanent impact these 140' tall towers and transmission lines will leave on the town and county. Not only do the immediate visual impacts need to be considered, but also the influence this project will have on the quality and likelihood of future commercial and residential developments in and near Eaton and the surrounding Highway 85 corridor. The route Xcel is requesting to use fails to protect the town's recreational parks and ushers in an industrial feel both to the north and south of town. Moreover, this route does not best mitigate the devaluation of home values in the Eaton Commons and Hawkstone subdivisions. Once the dates of the Planning Commission and County Commissioners meetings were revealed, it presented an alarming timeline that is incompatible with responsibly analyzing the project. Consequently, the vast majority of impacted entities have yet to respond with referrals. Most notably, the Town of Eaton, Town of Ault and the Weld County Department of Public Works. We feel this large scale, permanent project is one that deserves a full examination. There is not an opportunity for the Town of Eaton, and others, to fully review the application. Our group sent a letter to the Town of Eaton requesting that a forum be provided for public comment. We received a letter back stating that the Town of Eaton has no plans to allow for public comment on the matter. For the abovementioned reasons, our group's stance remains that these transmission lines should enter the proposed Eaton substation from the east side of Highway 85. We feel the proposed route introduces a clear encumbrance to the development of the Highway 85 corridor and does not support the Weld County Master Plan. Furthermore, it would be premature for the Weld County Planning Commission to make a recommendation on this matter prior to receiving referrals. I attended most of the public meetings on behalf of the GWTA, and we are satisfied that our concerns about the line routing and substation location were heard and considered. The final plan creates no impacts on the Great Western Trail and we are in favor of the design and location of of the facilities. We agree the final site selected for the substation in the industrial area of Eaton is by far the best site. And the transmission line route which runs parallel to Highway 85, other than when it must connect with the substation, is also the best alternative available. While it is never easy for a new infrastructure plan to move through the many stages of planning, Xcel Energy has been working in the community from the start to make sure that the new transmission line follows an efficient line while also listening to the community to make sure that they acknowledge the challenges of a small community and many privately owned sections of land. Through focus groups, community feedback, and informational programs to the community Xcel has excelled at creating a welcoming atmosphere for input from the community while also adapting many recommendations from the local citizens. As a community we look forward to the more consistent power that this transmission line looks to provide, and we hope that Weld County will approve the request for Xcel Energy so that they may began construction and complete this major improvement to our infrastructure in Weld County. The new substation would be located in Eaton's industrial area, and the transmission line will mostly follow along the highway before continuing south to Greeley. Our residents, our club members, and our region need this infrastructure in place as soon as possible. This project will help our communities with future plans and improve the economic development opportunities in the region. The project will help increase electrical capacity through the extension of transmission lines to allow for growth by providing necessary long term infrastructure upgrades closer to developing areas. The current system in this area does not have the capability to reliably meet the existing and additional load growth anticipated in the vicinity. We are in support of this project with the understanding that Xcel Energy is working with all applicable local jurisdictions to ensure requested process and procedures, terms and regulatory requirements are met.
