RESOLUTION i WHEREAS, a public hearing was held on January 20, 1971, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Blehm Land and Cattle Company, Route 1, Box I84, Milliken, Colorado, requesting permission for expan- sion of an existing cattle feed lot operation on the following described property, to-wit: The Southwest Quarter (SW4) of Section Twenty-five (25), Township Five (5) North, Range Sixty-seven (67) West of the Sixth P. M. , Weld County, Colorado, and WHEREAS, the petitioner was present and represented by counsel, Mr. Walker Miller, and WHEREAS, there was some opposition to the request of petitioner . for the expanilsion of said cattle feed lot operation, and WHEREAS, the"said requested cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld Count, said cattle feed lot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld Count, and I WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the , petitioner, and studied the recommendation of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Blehm Land and Cattle Company, Route 1, Box '84, Milliken, Colorado, for expansion of an existing cattle feed lot operation on the premises indicated above be, and it hereby is granted underI the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. . 2. That petitioner shall proceed with due diligence to expand said cattle feed lot operation and shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said cattle feed lot operation is completed, same shall contain, in addition to the facilities present at the time of hearing, those additional cattle pens, all as shown on plat as submitted and made a part hereof by reference. 4. That petitioner shall construct sealed lagoon or lagoons and water pumps as proposed.l 5. All applicable subdivision regulations and zoning regulations shall be followed arid complied with in accordance with the zoning resolutions of • Weld County, Colorado. i J . Mr. Telep will you make the record. Mr. Telep: Thank you Mr. Chairman, This cause came on for a hearing this day, January 20, 1971, at the hour of 2:00 P. M. for the application of the;Blehm Land and Cattle Company in care of Theodore Blehm of Route 1 Box 84, Milliken, Colorado, for an expansion of an existing feedlot located in the Southwest Quarter of Section 25, Township 5 North, Range 67 West of the 6th P. M., Weld County, Colorado. Let the record further reflect that this hearing was duly published as required by law in the Greeley Booster on December 11, 1970 and January 8, 1971. I Let the record further show that the applicant'is present in person and is represented by Counsel, Mr. Walker Miller. Let the record further show that Mr. Tom Richardson Attorney at Law of Greeley, Colorado, is present representing one or more of the protestants who perhaps later on at the hearing will be I heard from personally. Mr. Chairman, I guess, we are about ready to proceed. Perhaps the applicant would like to make an opening statement. Mr. Billings: Mr. Blehm would you like to..make a comment - you or i Mr. Walker either one regarding this expansion. Mr. Miller: I would like to explain to you Sam - I would like to make a coup a of remarks. I have become involved in this lateley and normally I suppose that is not important but I do think that it is important January 20, 1971 2• iehm Change of Zone to point a couple of items that I observed and looking to the record first and foremost I would like to point out that I am not quite sure that Mr. Blehm or Blehm Land and Cattle Company should have to appear I and thjs entire hearing is unnecessary. I call your attention to a resolution of the County Commissioners dated July 19th, 1967, wherein just to summarize it approval was granted for a proposed cattle feed yards subsequently to be expanded to a commercial feed-: yard to be locate in the Southwest Quarter of Section 25, Township 5 North, Range 67 West. Now I was also not present at that time but from talking to Ted, generally at that time his plan was the same as he is doing now. As the money was available and as the time was i available he made some additions to the feedlot - its called a i feedlot - a common -1,,--`sta Q'°'`j , and he was advised however, by John Watson, that he should obtain approval of the County Commission. I Had Ted has asked me, I would not have agreed to that adviselbut he has done this and I would hope that he would proceed with and work with the County Commissioners. I do think and it is very important to point out thaCit would seem to me that a resolution of this body in 1967 covers and grants approval to exactly what I I Ted Blehm - Blehm Land and Cattle Company are now doing. He has not moved onto other lands. This isjust a continuation of corrals I and some bunkers which I am sure Ted can explain better than I. I think that is a very important point to be made and he was probally misadvised to initiate this proceeding, of course it has gone through I the-Planning Commission, the Planning Commission has given its approval or at least a conditional approval and recommendation. Mr. Blehm, and let melemphasise this, has not done anything other that what he was given approval to do in 1967. But also I have a couple other points which I think are quite important to this County in a general matter. Mr. Blehm was the first man to approach this thought, it is my under- standing, with the approval in 1967. Now he is apparently doing something that he would not be required to do. This is just a genera{ observation - note that I do not believe %that this"proceeding is_,callled for under the laws and regulations that the Board has. I January 20, 1971 3 Blehm Change of Zone I I understand as the Resolution now exists by this Board and I do not want to go into details and I think Ted can explain•-the construction and the details on it Ted can explain. As it progressed I think we have here a pencil drawing of it that was probably presented at the time when it was granted approval in 1967 in which this shows the then planned constructions which the County Commissioners did approve. The not the existing but the construction as it was subsequently to be expanded to quote the resolution. Mr. Telex: May I make an observation at this point on behalf of the Board? Going back to your prefacing remelts whether this hearing need to be had or not. I think the best thing to do is - the Commissioners i will have the administrative knowledge to the fact that this is what was I done in the past and I don't think they are in a position to make a move at this time. I think that in as much as this public hearing was published and the applicant is here to,put on testimony I think we ought to proceed with the hearing. Mr. Walker: I would be in favor of proceeding or whatever. I am just making. a record that I think that I would be doing Ted a disfavor if I did noit question or object or whatever the proper word would be to the proceeding, at this time, but I would agree with you, but we might as well pl ocedes Mr. Blehm: At the time I asked for this permit Torrez Brothers had drawn up this map and this was all staked out I think which everybody knows land I have got plenty of witnesses to prove it. As I got over and got part of this corral built, which I didn't know if I should build, I didn4t know there was a time limit on this when I was suppose to build this pen - if I was to build them all within a certain time limit I didn't know. Then when I ran out of money I quit. When I got a little money 'again I started in - I started building more pens and this is the way the corral kept going. Then when I got over on this other side why along came Watson and he said well you better get your expansion permit or you are going to get into trouble. Well just to keep out of trouble I went and applied for one, which I don't actually think that I would have finished what I had planned to start with. Mr. Billings: How many head are you feeding out there now? Mr. Blehm: About 7,000. February 20, 1971 •4 Blehm Change of Zone Mr. Billings: What is your capacity 10,000? Mr. Blehm: The 10,000 would be top capacity. There probably wouldn't be over one time a year when there would be 10,000 head that could be held it those pens at any one time. Mr. Billings: Its all built? Mr. Blehm: Its all built, well I was planning on a few more pens but there weren't laid out in this plan. But this is the original plans jhich I started from when I started - everything was planned to this drawing. Mr. Billings: In your original plans, which we are getting from the Planning Commission, in which I was not involved, where your plans for 10;000 head or 5,000 head? Mr. Blehm: At the time I built this I figured I needed a lot more bunk space than we today. We feed them about on half the space now than we did the original planning of this cattle lot. We were figuring more bunk space per critter which everybody has eleminated we have about a third or fourth of what we used to have to have. Mr. Billings: Mr. Miller stated that possibly there hadn't been anybody back in for an expansion for an existing feedlot. I can't quote eny individual feedlot that there has been people back in. I was trying to establish that Mr. Blehm originally applied for feedlot holding approximately 10,000 head that we do now required and are holding hearing on all land use permits rather it be feedlots or any type of expansion. Not to long ago where the Commissioners , prettyimuch_take_it__upon themselves as a Board being able to do this either approve or deny an expansion for facility without going to a hearing of this type and because of public reaction and the possible situation that Mr. Blehm and everybody else could get themselves into regarding an expansion that hadn't been approved by this Board - I wouldn't want tg see Mr. Blehm or anybody else start construction on a new feedlot that might have an injunction by some of the neighbors because he hadn't received the proper permit or approval-by the Board of County Commissc oners. So we have established these hearings on - right down J to dog kennels. So we do have the feeling and reaction of the people in the area. I think because of ecology and this environmental thing January 20 1971 5,; Blehm Change of Zone I an everything else that is coming along. i Mr. Telep: I would like to make a further observation, Mr. Miller i that when he received a permit for the construction of a feed yard subsequently to expand it to a commercial feed yard - it didn't say anything about permission to do so and when we say subsequently it can be a year or two or twenty - this is unreasbnable and practical to think that you would have a license or a blank permit to do this five or ten or twenty year hence. Many things happen growth and expansion - who knows what can happen in the period between. So about the only construction I can give is to give a permit to do a thing is that you preclude subsequent to the hearing a permit i at least - permission to do this. I don't know after all the evidence is in - if the Commissioners will grant this expansion at this time or not and if they do you have no problem. If they i don't why maybe you can take it from there. But there are some things sometimes that lead into these things and it is pretty difficult to anticipate what is going to happen and this happened as you say about three years ago - three years ago don't you see. You know and I know or at least I think I do you don't need to agree with me that anything subsequently is contemplated is contemplated in the near future, and to procede with due diligence and we are interum talking about a three year/period. It may of been - it could of well have been a five year period or ten year period. Now whether that ils reasonable it is not my position to say. I think that why we are here we ought to get to the fact that he is asking for a permit to expand this feedlot operation. I hope we are clear at least to a point, for you to justify your clients expanding an existing feedlot operation which has been done. Depending upon the testimony forthcoming. We have our Planning Director here and hel hassome recommendations to make based on extensive and deep study pf thesituation and your soil conditions. Mr. Chairman I think we have to procede and hear all the testimony. Mr. Miller: I think that the application itself, if I stand correclted, mets the terms of the zoning of the surrounding area being basically "A". There is a report in here and I would assume that I I don't even know what these figures mean - deep sandy loam January 20, 1971 • • 6 Blehm Change of Zone soil, sandstone, with the summary that there is no soild problem. I So I think these things are a matter of record and we won't delay the hearing by going into such details. I would like if we could have Ted use this original plan map. He established to this point that this is the plan for the original feedlot in 1967 and request him to mark or identify what has been constructed and where he ceased to construct - perhaps this would make clear what we are doing. Mr. Blehm: Well this part here - we were going to - (set drawing up on bulletin,; board) Mr. Miller: We will mark this as petitioners exhibit "1" You stated this was drawn for you by the Torres Brothers. Mr. Blehm: Yes. Mr. Miller: In the spring of 1967? Mr. Blehm: Well it was about 15 days before I got the permit. Mr. Miller: So that would have been July of 1967. Mr. Blehm: Because I had sold the other feedlot and that is when this was drawn and they started immediately building. Mr. Miller: Alright this shows and the dark lines these are the concrete bunks. Mr. Blehm: The dark line. Mr. Millers: There are some lighter lines and these I take it are corrals? Mr. Blehm: Torrez Brothers were not interested in the corrals they just laid it out. All they were interested in were the bunks because they had to leave gateways where these lines are at to get the footages and thats how the little lines are in there. All they were interested in is the bunks because they had to leave ,openings fbr_thehdriveivays and such. Mr. Miller: The white lines are the division. Mr. Blehm: The division of the corrals yes- Mr. Miller: Were all these bunks put in or have they been put in. Mr. Blehm: They are all put in but this will never be put in - these bunks here - where this "S" is put across. Because this pen carrie� clear through that and there are too many low draws which are starting to build little lagoons in that pen. Then on this side which goes over against - which would get over near the creek January 20, 1971 7 Blehm Change of Zone i. Mr. Blehm: j to close over here - its too steep and I am not figuring I on putting that in but at that time we thought we would put this side. The otlier side is in all along - all the rest..of the, bunks are constructed. What bunks are you seeking the approval of the County? Mr. Blehm: Well what the approval was this bunk right here and this one up here was what I was after by the time Watson called my attention to it that he thought I had better get an expansion permit and I already had the bunks in. Mr. Miller: So we are talking about this bunk up here - in_fact this one right here. Will you circle the bunks we are talking about. Mr. Blehm: From here down to here. Mr. Miller: So that by the condition this bunk was in the original i plan will not be constructed. Mr. Blehm: Will not be constructed. Mr. Miller: These two bunks that are the subject matter here is that right? Mr. Blehm: Right. Mr. Miller: Both of these were contemplated in your original plan? Mr. Blehm: Yes. Mr. Miller: Could you describe generally the topography or whether it is hilly or so forth and how is it Mr, Blehm: Well the elevation or the grade on all these pens are laid the same - it all lays in a hole across there. Mr. Miller: Are there any draws? Mr. Blehm: Yes there are draws in therein every bit. This is the draw that leads down and then there is a draw from over here that comes I down on that outer side. Mr. Miller: What is the soil like there? Mr. Blehm: Well it is clay - sand and loam - I suppose - I am not to familiar with it. That is what I would call it anyhow. Mr. Miller: Have you paved it or anything like that to the inside of the fence? Mr. Blehms No. Mr. Miller: What increase in capacity would the feedlot determine as head would you say this new construction represents. %- January 20, 1971 8 thm - Change of Zone I Mr. Blehm: The new construction - about 1,500 head. Mr. Miller: What is the total capacity? Mr. Blehm: 10,000 would be the top capacity. The pens would have to be filled to capacity to get 10,000 head. Mr. Miller: Have you ever had everything filled to capacity? Mr. Blehm: No, and probably never will. There would be only one time out of the year that there would be that many. Mr. Billings: I am glad that you brought this out because I am asking you orginally you said it would hold 10,000 head and then the Planning Commissrion that lots of 10,000 head maybe you are building a capacity to 10,020, actually you are going to construct some bunks that were never put in so that you do have a total 10,000 head capacity at this i time. Mr. Blehm: Yes. i Mr. Miller: You mention the lagoon - have you constructed a lagoon? Mr. Blehm: I have put in a couple of little ponds - but we are engineering now to put in the lagoons. r Mr. Miller: I Where are the ponds first of all? Mr. Blehm: The ponds are here right down along the road - both I - right there is the little one and right here is the one to check the run-off to keep the heavier part - the only time we have had troubles` is last spring is when we had that big rainstorm and stuff started washing off on the neighbor below. Mr. Miller: Where are you contemplating putting in the new - I Mr. Blehm: Whenever the engineers get through I don't know nor i do I know how they will be constructed. Mr. Miller: You intend to put these in? Mr. Blehm: I do intend to put these in. Mr. Miller: What are the limitations if any on your intentions? Are you limited by money or anything? Mr. Blehm: Well I might be limited quite a bit - this money - its if I can get it. I imagine if I get it surveyed it wouldn't be another year and it would all be constructed. Mr. Miller: Have you got approvals from any state agencies? Mr. Blehm: No. Mr. Miller: I think that gives you a picture i Mr. Billings: Do you have any question, Harry? Mr. Ashley: No. Mr. Billings: Do you have any other people that you would like to have I testify regarding this matter. Mr. Miller: No I would again offer or point out there are some matter ,in the file which indicate '. that the Blehm Land and Cattle Company does comply with the_ requirements of the state agencies I don't really think there is anything else that we could add to the picture. We want to make this as short as possible. Mr. Billings: Who is doing the engineering? Mr. Blehm: The Soil Conservation is doing the engineering and I they have had the state engineer up there. I do think that there i is a few people that know that they are and they have been surveying for over 30 days. They get about one day a week since the storm and I they haven't been back. They won't give me any writting of any kind until they are through with the engineering and they thought it would I be another 30 days before they would have it completed because they would have to go through the state engineer. Mr. Billings: At this time Mr. Richardson we call on you and ask if you have any questions that you would like to make. I Mr. Richardson: The prime purpose of my being here and his objection i is that as a result of this lot the water has been coming down on his property and the type of water is that - that his cattle will i no longer drink from the stream that goes through the portion of the I feedlot throught the farm to the south. The farm,- to the south is owned by Mr.lBernhardt and his objection is that at the present time the small lagoons that are there are not taking care of water so that the water is pure enough-: for the cattle below to drink. Now I think that it i will be varified or can be varified that at the present time,at any rate, that tluhis water is polluting the stream that goes through•, the feedlot and on down to the south. Now I think promises have been made concerning January 20, 1971 10: Brehm Land &Cattle Co. C-Z Mr. Richardson: the present operation as well as the expansion and that the required adequate lagoons will be built to take care of the water but at the present time they haven't been built and at the present time even though studies are apparently are being made - right here in the testimony of Mr. Blehm, there has been no time set as to when those lagoons will be built. He has stated that when and if they are built that they will be built according to state regulations. But our problem at the moment is that we are being damaged by the present operation and an expansion of the operation will cause more damage because of the dairy cattle that Mr. Bernhardt has been runnning on this farm to the south have formerly been able to drink from this stream. Since the feedlot operation has been put in they will no longer will drink the water. The reason I am told that they will not drink the water is the condition of it and apparently the small lagoon that are now there are over flowing and are not doing the job they are suppoee to do. Now our apprehension in this expansion,.prbgram is that instead of lessening the problem it only increases it and we would like to have some assuramce - if it can be obtained - and if this expansion is authorized that it would be authorized subject the proper building of the' lagoons, the operation of them, and that this stream that flows I through there will come up to the standards required by the pollution board If the State of Colorado. I think the State Health Department probably, if they were asked,l would tell you that the sampling of that particular stream does not come up to the standards , the pollution standards set by the State. We feel that the Commission should be advised of this fact and the Commission should not allow the expansion until they are assured the best of their ability that the proper lagoons will be built and that the proper care of this will be taken and that any future run-off will be such that it will totally not - that dairy cattle will drink the water. Because it was used in the past but now because of such a condition they will not drink the water and it is damaging the farm definitely to the south. Now how much farther south this continues I dont' know I 1 January 20, 1971 • 11 Blehm Change of Zone there m1aybe some other people here who have farms farther south that arle experience the same problems that Mr. Bernhardt is experiencing, or has experience since the lot has gone into operation. Now we are not here to contest when the plan was adopted or not adopted or whether we should or should not have this hearing. Our major problem is we would llike to see safeguards put in to protect people to the south as far as this water run-off is concerned and Mr. Blehm, if I may ask you a question - What size lagoons are you contemplating-at this time? Mr. Blehm: I don't know - I don't know until engineering. i Mr. Richardson: j Have you - I see - have the engineers given you any indication as to how soon they will be concluded with their program? Mr. Blehm: They said it would be the first part of March before they would be through with their engineering part and they might be delayed a little longer since the storm hit. They got one day a week I to where this engineer can work on this. Mr. Richardson: Does your program provide this - that until you -Rmi•Jv the proper size lagoons fare built are you putting contemplating/more cattle or in other words what I am saying is if the Commission allows you the expansion program to proceede will you fill it with cattle before the lagoons are thre? Mr. Blehm: Well I won't be putting in any more cattle than I have now. 1 Mr.Richardson: I see. Mr. Blehm: I Well tt could be 2 or 3 more hundred that it was. The pens are all full. Mr. Richardson: I Well if they authorize you this expansion program, my i point is, after you have built your expansion will you fill it with i cattleibefore you have your lagoons? Mr. Blehm: Well they are filled now. They are already constructed. Mr. Miller: Tom they are already constructed. Mr. Richardson: They are already there all of them - I see - so this i expansion is approval of what already has been built - is that - Mr. Miller: In effect that is already what has happened. Mr. Richardson: Alright. Now Mr. Bernhardt can tell you what he has experienced prior to the installation and what he has found since the installation has gone in so that if Mr.Commissioner if you would like to have Mr.Bernhardt tell you his experience with his cattle since this operation has gone into effect. Mr. Bernhardt would like to say a rew words. January 20, 1971 - 12 Blehm Change of Zone • . Mr. Bernhardt: : _ I farm south of Mr. Blehm he started farming there in 1967 . ' and didn't have his corrals built and the cattle drank the water satisfactorily. . In 1968 some manure problems developed, the cattle wouldn't drink the water and in 1969 the storm came and filled my stock watering pond and I had no , way of watering the cattle at all in any shape or for to the south. I have some pict. res -of the stock watering pond and the run-off and it wasn't pleasant. The Health Deparmtent was also out to check it out too. - Mr. Billings: Do we have anyone else, Tom who would want to testify? • . Mr. Saur: I live right west of Ted Blehm and as .far as the feedlot is concerned I think they are necessary in some cases. We didn't have any trouble with any animals or anything until he came over the hill last fall and he built four new corrals on the west side of the slope. Since that day you can't hang your clothes out to dry and if you hang your bedding out and when you bring it in it smells like manure - well its not very plesant. - - �- - . Mr. Billings: Is there anyone else who would like to comment? • If not I might make a few comments myself. I was at a meeting yesterday we met regarding what the federal governemnt is going to do require us to o in regards to farming and Mr. Glen Paul from the Health Department is herb and ,maybe it would be of advantage Paul if you would explain to these people the health requirements that are required of these - lagoons and the requirements of the state health department. , Mr. Paul: I am Glen Paul of .the Weld County Health 'Departmen-t ' The Air Pollution Commission have regulations and guidelines on lagoons . they are changing classifications of the streams and any pollution -as I understand from Mr. Frank Rosek of the Water Pollution Commission of the State Health Department that they or we are to. take samples and if - above and below the stream - and when the affluent comes into a stream and when it goes out and that these certain standards ' . . are met. If they don't meet the water pollution standards they will be givin so many days to comply. I might state new- here that we can not prove now - we haven't had enough evidence and samples taken but in my opinion - Mr. Blehm is polluting not only Mr. Bernhardts place but the river also. It will be- at this meeting that Mr. Billings and I were at yesterday - he will be required not only to Mr. Blehms feedlot but all fedd lots in the County of Weld to take samples January 20, 1971 13, Blehm Change Of Zone this is before - well its starting in July of this year. Mr. Billings: Thank you Mr. Paul. A little more elaboration on this I was quite concerned and I think all farmers and feeders whether it be cattle, sheep or anything else in the county,— )Weld County and in Colorado will have to be vitally concerned about this because some of these regulations are getting pretty stiff. We are even going �o have to let them know how much waste water comes off from our irrigated farms and back into the river and how much it is polluted. i I think maybe we are getting over emphasized on ecology. I don't know I madelthe statement at a meeting that maybe Weld County is going to have to go back to grassland, I hope not, but, I think probably - I wanted) Mr. Paul to explain just what the federal government and the state is going to demand of all feedlot operators, and all farmers in thel future so that you are all aware - especially Mr. Blehm or anybody who is in the cattle feeding industry - there is not a great if deal of profit in it, for what you have to invest,/they are going to have you comply with all these regulations I think you are going to have [to look real closeto anything you do anymore - it is going to be a critic4ituation after the first part of the year. I think probably at this time Mr. Lorensen I would ask you to make any comments of the County Planning Commission regarding this. Mr. Lorensen: Mr. Chairman, I would like to ask two questions - of Mr. Brehm first and make one observation because of what has happened in the) meantime. I did have a conversation with the Soil Conservation District people and there was a piece of information that was passed along ito us and it said to the effect the type of drainage you have going (through your property - the lagoon that is proposed across the ravine part of the deepest part to the west - the state engineering office said that they would not allow one to be built - that is what the Soil Conservation people said tome. Do you have anything from i the State Engineer saying you can build in there? Mr. Blehm: I haven't got a thing and they said there wouldn't be a thing until they got through getting all the soil test run and all the surveying to see where they could be built. January 20, 1971 14• Blehm Change of Zone Mr. Lorensen: Well I would apprise you that this could be a problem even to build one to even build one from the information that I picked up. Mr. Blehm: Well - it could be. The one side there was one kind of sand that wouldn't hold water. It wouldn't seep water very long I once you get fertilizer in it because it is the best sealer you can get. Mr. Lorensen: Then there was one other point that is one of our zoning inspectors , Mr. Bill Doke, talked to you about reducing your cattle,to the previous level that you had before the expansion. Before this aledge expansion occured - have you made any plans about that? Mr. Blehm: No Mr.Lorensen: In other words I would assume at this time when you feed out your last batch that you would replace them? Mr. Blehm: Well if I get the cattle in. Mr. Lorensen: Well, Mr. Chairman, the site was recommended for approval, however, there were quite a number of conditions attached to it. These subject conditions are as follows.: approval by the Health! Department with the requested report - the Health Department I has requested an engineering report to show that it is feasible. Also we had requested a plot plan to show expansion - this has not been presented and that there is limitation of feedlot being limited to a maximum of 10,000 head - which is what he had stated. That the completion of construction would be within one year. This would include I the lagoons as well as the pens, of course he has already constructed tte pens. We reduced his legal - it was reduced in our notification it was: the Southwest Quarter of Section 25. But the entire thing hingeslupon the fact that the lagoons must be properly constructed and I think there is a question now as to whether one lagoon really can be constructed at all from the information we have. Mr. Blehm: Who gave you the information? I Mr. Lorensen: Mr. Jim Crabbe of the Soil Conservation District. This is not an official report. Mr. Blehm: I I beleve I can clarify that because of Todd the engineer at Fort Collins that is doing the engineering said he didn't think that they wjre going to have a problem - we knew we were going to have a problem on one side but we have a lot of other ways to go. i January 20, 1971 15 Blehm Change of Zone I Mr. Blehm: C - r - a - b - b - e Mr. Lorensen: Yes sir. Mr. Blehm: He doesn't have a thing or do thing out there- he is not the one doing the surveying. Mr. Lorensen: No he doesn't - he just passed the information on. Mr. Billings: I think that possibly - that maybe one thing that is a little unique as far as I am concerned that is basically I believe that feedlots were approved as shown on this map and the total feedlots that were constructed on the map - so we are actually reducing the orginally feedlots to what was/approved back in 1967. It is rather unique to some of the situations that we have had. I think it all goes back to something that I know Mr. Blehm that no matter what this i offices decision is - it is going to be controlled by the State Health Department and the County Health Department so I would have to ask you a question - I think which is back to what the people are objecting to and that would be - if this is approved will you then establish proper rules that are required by the State Health i Department? Mr. Blehm: I wouldn't put them if it it wasn't. Mr. Billings: I think this is something we have no control over and I know that the regulations are pretty stringent and I should be able to assume that the engineers that are doing this undoubtedly I know the regulations and rules of the State Health Department on these lagoons and that they are constructed and operated according to the State Health Department. I can assure Mr. Bernhardt his problem major should be solved. By this picture I can't tell how much/run-off you would have because if had some of the types of rains that we have i had but I assume that the engineering department would establish lagoons to handle something for a 25 or a 50 year flood. This is the normal procedure that they go through so I am sure this would be required by the Health Department. I think that at this time unless there are other people that would like to testify or Mr. Miller of Mr. Richardson would like to add further comments - probably until some of these requirements are known - so the Health Department can f give us some recommendation and until your engineering firm can give you thieir study it would be impossible for this Board to make a decision one way or another until we do have the approval by the State Health Department that the lagoons will meet the requirements. Unless Mr. Richardson or Bernhardt have some other objections or some other January 20, 1971 . '. 16 Blehm Change of Zone points they want to bring out - I think we are talking about lagoons being operated so that they are not causing any problems. Mr.' Sauer i he did have a problem here again you get back to this thing in 1967 he did have approval for his feedlots and he could handle 10,000 head of cattlle in this. and we bring out that this approval by the Planning i Commission does limit the feedlot to 10,000 cattle. At the completion after our approval. everything has to be within one year/ Unless you have some other questions I think we are kind of a standstill until we get these I other reports. Mr. Lorensen: Mr. Chairman, I think it would be advisable in the light of the problem, from our point of view, if Mr. Blehm would reduce his level of operation until the lagoons and everything had been i engineered out to where there is a solution to a problem. We've requested this of Mr. Blehm to reduce the feedlot capacity to where it was before the expansion took place and I think this would be reasonable at least from our point of view and in question of the hazzards that have been presented by the health department. To restrict it to the previous level and as these cattle feed out not tobring new ones in until the lagoon is placed and in operation. Mr. Miller: Let me make some observations here I think this is I primarily - Ted - I think that the fact that he is here is an effort on hislpart to comply with the rules and regulations. Everybody is very very aware and I firmly believe personally that ecology and all these things are a tremendous problem. I think there is a danger of I over reacting to everything on any givenpolitical issue. I have to i observe, Mr. Paul did say, he can not prove these allegations. I would also have to observe I am not real sure what Mr. Richardson was saying. I Mr. Berhardt talked about unusual rank and I think it would be quite improper to penalize Mr. Blehm on the basis of what people think and i the political atmosphere. It is very easy to over react and I think Mr. Blehm has indicated that he is going to construct lagoons in accordance with requirements and I don't think that until it is i established that he is violating the existing requirements - plus I don't think - I don't think it is going to be the same kind of problem it was last year. It is an entirely an act of God whos going to have the heavy rain. I would just like to.make those_observations January 20, 1971 I 1,7 Blehm Change of Zone I � Mr. Lorensen: Our office has taken the position that Mr. Blehm essentially is in violation because he is in violation because has created the expansion and all we are asking that he do is to reduce to the level that he had before the expansion occured. Mr. Billings: How many cattle do you have at this time do you have in this expansion? Mr. Blehm: About 1,500 Mr. Billings: About 1,500 Mr. Blehm: I can take them over in the other pens today - it wouldn't make any difference - I would still have all the cattle. Mr. Billings: Well its like I say it is still a unique situation and I don't want to cause any hardships on somebody trying to make a I livingjfeeding cattle and sure don't want to cause any hardships on people ,on down the line who are trying to water cattle out of the same stream I would hope that through the cooperation of Mr. Blehm that possibly as he moves some of these cattle out and until he gets his lagoons constructed if he could hold down the cattle in those areas I that could be causing the problem - I don't know if it would cause any more or any less problem than if you crowd them all into one bunch ofipens. This is hard to establish one way or another. I think also that I would also like to have Mr. Paul start taking tests above and below so we do establish what the problem is now and I then as soon as the lagoons are in we will be able to establish to the people who are objecting that this problem has been cured. Mr. Paul: I might state Mr. Chairman to Mr. Blehm and to the comments on ecology when anyone now puts a feedlot right on a stream I and correct me if - but the way I understand it - I was__ with Mr. Lorensen when he was talking to Jim Crabbe. The way I understood it also that the lower level at the time of the lagoon - where he is going to plan to put in the lagoon you can not dig a hole and have that for a lagoon this has to be sealed before with some manure_or with some petroleum product.; So this will have to be tight no leakage into ground or the way I understand the order of the commission - the water of the State of Colorado that is all the water - even undergmind - I mean that is the definition they have in thel Water Pollution Commission. I think that anyone to build a lagoon not or where it is at ground level but even from the waste. Realizing last year was big year - with the storms. You have some pretty steep 1 January 20, 1971 I „ 18 Blehm Change of Zone slopes lover there. I am afraid you are going to be in"trouble with your neighbors, of which you have stated, that they will meet the state requirements. Mr. Richardson: I feel that we are pretty familiar with what is going on here by that I mean we are simply asking some assurance before this expansion goes in - it is already in - before the pens are ° proper filled that the/lagoons are established to take care of the run-off is ourlproblem and I think that we have been concerned as this lagoons operation has continued and things have been promised that they have not gone in and the over there are not serving the purposl and so rather than compounding the problems by continuing the operation with 10,000 head in the feedlot - we feel that should be slowed! down until the proper lagoons are set this is our main point. Mr. Billings: Is this going to be a possibility, Mr. Blehm, that you could probably reduce the cattle that you have there until we get these lagoons in. I don't know what stage you are at - I am looking at both sides here - as someone who also has some farmland i and feeds cattle also. I have to look at it from the side for the restrictions that are going to be put on it and on all of us who are already feeding cattle. I think that the only way we are going to survive in feeding cattle or anything else is to meet these requirements as fast as we can or the state and federal health departments are going to come out there and say Mr. Blehm you have a cease and desist order on "X" date and if you make any i profit at all you will eat it up in this. Mr. Paul: The costs are $2,500.00 per day thats the dumps. protect Mr. Billings: Alright I am looking at it to/the man who is trying to i feed 'cattle and the man who also wants to farm. I would have to agree with Mr. Miller I think maybe these people are getting a little more radical than they need tole. That we have very little or no says=of the llws that are passed at the state and federal level concerning these: things. I think that we are going to have to - in fact I would recommend that we take this under advisement until we do receive your engineers plans for the lagoons and that we receive approval by the I i January 20, 1971 I 19 lehm Change of Zone State Health Department. I do realize that if these don't meet there requirements that they are the ones who are going to be coming but there and shutting you down. I think we are all going to be around long enough. to see this still an agricultural county i even though they try to tell us that we are not. I can see where we have had other hearing similar to this and we have pretty well given out the same advise to the people with the expansion of feedlots. We are pretty well trying to bring out the fact that the laws that are being passed - the ecology route and the pollution I of strelams and everything are going to limit almost any operation to what you can do or if you can do anything at all unless you can comply with these regulations and I certainly hate to see you have a feedlot here with 10,000 head of cattle and because we don!jt have the lagoons in to feed these cattle - to have them come out in 130 days and say this is it and give you so many day toleither get in the lagoons or get out of the business. I don't like this route a₹ all. My opinion is that everybody should I be totally knowledgeable about the regulations we've got to comply With. I think really at this time until we see your engineers drawings .and the approval of the State Health Department that the lagoons will meet their requirements that we will just take this under advisement until that time. I question and would probably ask our County Attorney - I don't know what he would say- I dnn&t think that I can sit here as a County Commissioner and tell you that you can feed so many head of cattle. I think maybe we can sit here and say you can't have cattle in those pens until we have approved. Here again you have 10,000 in the existing pens that you have before you can have these - I can see where if I tell you youlte got tolmove them into the exisitng pens that you are going to crowd them and they are not going to put on the gain that they should and it is going to create problems for you. I hope that through your cooperation in not increasing the amount of cattle that your feeding until youdget the lagoons approved and get them in. Weld County Court House Greeley, Colorado 80631 f Dear Sir, • I A survey was made this date of the feedlot of the Blehm Land and Cattle Company, by personnel of the Weld County Health Department. This survey was made with kelation to any possible surface or ground water pollution resulting from feedlot drainage. This feedlot lavers an area of approximately 1,210,000 square feet; and is located in a natural drainage area leading. to the Little Thompson River which is about one and one-half miles to the south. For all intent and purpose the feedlot at present drains directly into seep water areas and a small creek These waters follow the natural drainage across neighboring land to the Little Thompson River. In reviewing the situation with Mr. Blehm, it appears possible that the construction of several retention ponds strategically placed, would contain all feedlot drainage. This would correct the present condition of water pollution by the feedlot. Mr. Blehm has readily consented to obtain the services of a qualified engineer to study and report on .the problem. Until this report is forth coming, and a possible abatement program initiated, no opinion on site approval for the foodlot can made. I own the E2 of Sec. 23 and the W2 of Sec. 24, T5N, R67, Weld County, and am presently living in San Clemente, California. It will not be possible to attend the public hearing in Greeley on January 20, 1971. It may be possible for my son Duke L. Phillips of Boulder, Colorado to attend the meeting, and this letter will authorize him to further express py views and represent me in this matter. The area of the high ground in the near vicinity of the proposed expansion of feedlots is an ideal location for future residential development, being reasonably located in relation to the shopping and commercial facilities of Greeley. We have plans in this regard which will be aversely affected by expansion o£ feedlots to this vicinity. There is no question but that the noxious odors from a feedlot will have a very detrimental effect on the land values of•surrounding property. In view of the above it is sincerely hoped that it will be your considered judgment that denial of the expansion of feedlots to the area above would be the most beneficial to the property owners of this pa rt of Weld County.
