WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, it has come to the attention of the Board that there is a
need for a county-wide communication facility, and
WHEREAS, the City of Greeley, Colorado, presently has a communi-
cation facility and is desirous of cooperating with the county in sharing
said facility with the county upon a mutually agreed cost sharing basis, and
WHEREAS, the City of Greeley, Colorado, has submitted an Agree-
ment whereby the cost to the county of operating such a joint communication
facility would be subject to increase or decrease depending on the number
of personnel and communication traffic, and
WHEREAS, the Board has determined that a jointly operated communi-
cation facility between the County and the City of Greeley would be in the
best interests of the County, and to accept said Agreement, copy attached
for ready reference and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that said Agreement as sub-
mitted by the City of Greeley, Colorado, providing for the joint operation
of a communication facility, copy of which is attached hereto and made a
part hereof by reference be, and it hereby is approved.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is
authorized to execute the Agreement as submitted and to make the same
effective forthwith.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 12th day of June A.D. ,
1974.

AGREEMENT FOR COMMUNICATIONS SYSTEM
THIS AGREEMENT made and entered into this 12th day of June,
1974 by and between the County of Weld, hereinafter called "County", and
the City of Greeley, Colorado, hereinafter called "City".
WITNESSETH:

WHEREAS the County desires to develop and operate a County-wide
Radio Communications System (hereinafter called "system") to aid the
County government and the governments of towns and cities within the
County in rendering law enforcement and fire protection and other emer-
gency services to the public;
WHEREAS the contemplated system ultimately would be headquar-
tered in the new County Services Building being planned for construction
adjacent to the Weld County Courthouse;
WHEREAS the City recognizes that the proposed system will benefit
all citizens of Weld County, including those residing within the Greeley City
limits;
WHEREAS the parties agree that the system should be put into effect
as soon as possible, without waiting for the completion of the new County
Services Building;
WHEREAS space is now available at the Greeley City Complex from
which the system can be temporarily operated and the City is willing to
donate that space on the conditions hereinafter set forth which are designed
to place the financial burden for the system on the County and which are
also designed to assure that the City's own communications system is not
interfered with;
WHEREAS in order to put the system into effect in the space at the
Greeley City Complex, without thereby interfering with the City's own com-
munications system, it will be necessary to install new equipment at a cost
of $13, 767. 00 and it will be necessary for approximately five full time
employees to be hired to operate the system;
WHEREAS the County wishes the system to be implemented at the
Greeley City Complex and wishes to agree to the conditions set forth below,
and the City wishes to obligate itself to donate the space and to otherwise
participate in the temporary operation of the system, as set forth below;
NOW THEREFORE, in consideration of the facts recited above and
of the mutual promises and undertakings set forth below, it is mutually
agreed as follows:
1. Within a reasonable time after instructed to do so by the County,
the City will cause the equipment described generally on Exhibit A at-
tached hereto to be installed in the present communications office located
in the Greeley City Complex. The equipment shall be purchased from and
installed by the Motorola Communications Company, and it is expected that
the total cost of the equipment and installation will be $13, 767. 00. The
County will pay that amount, or such other final billing amount from
Motorola Communications Company, following installation.
2. Following installation of equipment the City will use its best
efforts to hire new employees to receive and dispatch calls through the
system. These individuals will be employees of the City and will not be
subject to any control or direction by the County. The City does agree to
train and instruct the new employees so that they will perform their duties
consistent with the requirements of the system. The employees will be
classified under the City Employee Classification Plan as Communications
Operators. At the present time the starting wage for employees in that
classification is $460. 00 per month and the cost of fringe benefits for
employees in that classification is an additional $48. 00 per month.
3. The City will have the final decision as to the number of addi-
tional employees to be hired, from time to time, in order to operate the
system. It is anticipated that five additional full time employees will be
needed to operate the system. The City will promptly inform the County
of the exact number hired, and if that number is to be increased or de-
creased in the future or if their wages are to be changed, advance notice

will be given to the County.
4. The City will inform the County of the total compensation paid
by the City to the additional employees each month, including the break-
down as to each employee, and containing a separate statement of the
basic wage, payroll deductions, and fringe benefits contributed by the
City. Within 10 days after the receipt of such information, the County
will pay to the City the correct amount to fully reimburse the City for the
amounts it paid to and for the employees.
5. The County may unilaterally terminate this agreement at any
time by giving the City written notice of termination. Such termination
will be effective as of the end of the month during which the notice is
given. However, if the notice is delivered to the City after the twentieth
day of a month, the termination will be effective as of the end of the next
following month. If the County does terminate the agreement, it will be
required to reimburse the City for any severance payments made to the
additional employees, if their employment with the City is severed by
reasons of the County's termination of this agreement. "Severance pay"
as used in the preceding sentence shall include any vacation pay, sick
leave pay, and any other compensation customarily made to terminated
City employees. If the County terminates this agreement, the City shall
retain complete ownership of the equipment referred to above and will have
no obligation to reimburse the County for any portion of the cost of such
equipment and installation.
6. The City may unilaterally terminate this agreement at any time
after eighteen months from the date of this agreement, by giving the County
written notice of termination. Such termination will be effective as of the
end of the month during which the notice is given. Upon termination by the
City after the eighteen month period, the City will retain complete owner-
ship of the equipment referred to above and will have no obligation to reim-
burse the County for any portion of the cost of such equipment and installa-
tion. The City also will have the right to terminate this agreement, and to

retain ownership of such equipment, if the County defaults with respect
to its obligations hereunder within said eighteen month period.
