HomeMy WebLinkAbout20221172.tiffRESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF COUNTY ROAD 64, AKA 0 STREET, RIGHT-OF-WAY WITHIN UNION PACIFIC RAILROAD RIGHT-OF-WAY NEAR U.S. HIGHWAY 85 - DEPARTMENT OF PUBLIC WORKS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Petition for Vacation of Right -of -Way from the Weld County Department of Public Works, 1150 O Street, Greeley, Colorado 80631, a copy of said petition and a list of the adjoining property owners marked Exhibit "A", being attached hereto and included by reference, requesting vacation of a portion of right-of-way for County Road 64, aka O Street, being more fully described as follows: Public road right-of-way lying within Union Pacific Railroad right-of-way located in the SW1/4 of Section 29 and the NW1/4 of Section 32, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, as further described in Exhibit "B" WHEREAS, the Department of Public Works has recommended approval of said request since that portion of right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, any persons owning dedicated and recorded easements and rights -of -way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of right-of-way, with said vacation to become effective upon recording as required below. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Petition for Vacation of Right -of -Way from the Weld County Department of Public Works, be, and hereby is, accepted. PURPOSE Weld County Public Works has been coordinating with the Colorado Department of Transportation (CDOT), and Union Pacific Railroad (UPRR), related to the negotiated closure of twelve county road crossings of UPRR, of which this application specifically applies to one crossing located east of U.S. 85 at Weld County Road (WCR) 64, also known as O Street. On August 31, 2020, the Weld County Board of County Commissioners unanimously approved submitting the O Street application to the PUC. The Public Utilities Commission (PUC) approved closing the WCR 64 crossing on January 13, 2021. While the process for closing a railroad crossing is done through the PUC, the process for Weld County to vacate road right-of-way (ROW) is done in accordance with the requirements of C.R.S. Section 43-2-303(2)(b) and Weld County Code Chapter 8, Article 16. Therefore, the purpose of this request is to vacate portions of O Street (WCR 64) as part of this application with the advice and assistance from the County Attorney's Office. BACKGROUND The history of the US 85 Corridor is lengthy, and involves Union Pacific Railroad Company (UPRR), Weki County and CDOT. In 1923, UPRR entered into a 50 -year lease with Weld County for the Highway 85 right- of-way. In 1931, UPRR and Weld County entered into a new year-to-year lease of Highway 85 and terminated the prior 50 -year lease. In 1957, UPRR and CDOT entered into a 50 -year lease of the Highway 85 right-of-way allowing CDOT to have highway facilities within the right-of-way. That lease terminated December 31, 2006. Since the termination, and for the past twelve years, both CDOT and UPRR have been negotiating the resolution of the matter which culminated in a Purchase and Sale Agreement. UPRR, Weld County and CDOT have worked together strategically, to enable the closure of crossings that would allow trains to park or pass within railroad sidings that presently have at -grade highway -rail crossings, thus improving rail operations, and removing random crossing occupation by trains within the county to provide better vehicular circulation and more reliable access routes for emergency services. CDOT entered into the Purchase and Sale Agreement with UPRR in order for CDOT to obtain full fee ownership for those portions of the highway located within railroad right-of-way, while still providing UPRR rail capacity as a result of the purchase to ensure the functional integrity of both the CDOT and UPRR transportation systems and to improve the safety of the corridor by reducing potential vehicle/train conflicts. Therefore, the purpose of this request is to improve the safety of the U.S. HWY 85 corridor by vacating portions of Weld County Road 64 (0 Street) east. On August 31, 2020, the Commissioners unanimously approved CDOT submitting the PUC application to close WCR 44 public railroad crossing, contingent upon the Peckham Interchange improvements. See attached letter. iU , i efilEF Eaton Fire Protection District Eaton Fire Protection District, Est. 1914 April 18, 2022 To: Weld County Dept. of Public Works Re: O Street (WCR-64) Petition to vacate the right-of-way By closing the right-of-way at WCR-64 east of Hwy -85 there is an impact on the Fire District's response to emergencies in that area. • Closing the ROW would require EFPD to take a longer route to an emergency reported from addresses west of WCR-41 on O Street; this route adds nearly 1 mile to the distance and adds two additional intersections to navigate when responding to emergencies. - The addition of 1.5 miles adds approximately 3 to 4 minutes to the response time - The addition of 2 intersections of county roads increases the risk of traffic accidents - The IFC in section 503.1.1 Additional Access. The Fire Code Official is authorized to require more than one fire apparatus access road based on the potential for impairment of a single road by vehicle congestion, condition of terrain, climatic conditions or other factors that could limit access. - The IFC in section 503.2.5 Dead Ends. Dead-end fire apparatus access roads in excess of 150 feet in length shall be provided with an approved area for turning around fire apparatus. While these concerns are relatively minor, the increase risk to emergency responders, traveling to emergency incidents is possibly the highest risk our responders incur. Given that the O Street corridor will have additional future development, that will also increase the risk based on times travelled. Currently EFPD responds to an annual average of 15 (or fewer) incidents to that area of O Street. While the Fire District does not oppose the vacating of the RoW, we do recognize that it will increase the risk to our responders and require additional considerations related to the IFC. Based on our discussions from the WCR 44 & 33, I am looking for assistance on how you would like to see this final railroad closure go.
