UNION PACIFIC RAILROAD C. D. NO. 5845-L-D 5845-L

EXPIRES JULY 31 , 1978:
WHEREAS, the Union Pacific Railroad Company has tendered
to the County of Weld, State of Colorado, an agreement extending to
and including July 31 , 1978, the term of contract dated September 1 ,
1938, covering lease of a portion of the right-of-way of the Railroad
Company to be used for highway purposes, Pierce, Colorado, said
agreement being identified as Union Pacific Railroad Company's
C. D. #5845-L-D: 5845-L: Audit #47925, and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, has considred carefully said agreement, and believes it
to be in the best interests of the County to accept said agreement.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the terms of the agreement
submitted by the Union Pacific Railroad Company be, and the same is hereby
accepted.
The above and foregoing resolution was, on motion duly
made and seconded, adopted by the following vote:

shall be and hereby is extended to and Including July 31 . 1978_ , and that all the terms and conditions
thereof,as heretofore (If supplements to the original agreement are indicated above) or herein (if any special provisions are written
below) amended, shall remain in full force and,effect during the extended term. said agreement with the amendments and supplements
(If any) to bo subJect to termination prior to the•expiration of the extended term in tho same manner as is provided therein for termi-
nation prior to the expiration of the term hereby extended.
Special Provisions: In consideration of the extended term herein provided,
the Lessee shall pay to the Lessor upon the execution and delivery of this
instrument the sum of One Dollar ($1. 00) and shall, during said extended
terms keep, observe and perform all of the covenants and agreements set
out in the above—mentioned agreement as a consideration for the making
thereof.

ik WHEREAS, UNION PACIFIC RAILROAD COMPANY has tendered
to the COUNTY OF WELD, STATE OF COLORADO, an agreement extend-
ing to and including July 31, 1978 , the term of contract
dated September 1 , 1938 , covering lease of a portion of the
right of way of the Railroad Company to be used for highway
purposes, Pierce, Colorado; said agreement being identified
as Union Pacific Railroad Company' s C. D.No. 5845-L-D; and

WHEREAS, the Board of County Commissioners of
, jgjd County , State of mnlorarin has said proposed agree
ment before it and has given it careful review and consider-
;ation; and
WHEREAS, it is considered that the best interests
of said County of Weld, State of Colorado,
'will be subserved by the acceptance of said agreement;
THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF WELD COUNTY, STATE OF COLORADO:
• That the terms of the agreement submitted by Union
ii Pacific Railroad Company as aforesaid be and the same hereby
';are accepted in behalf of County of Weld, State of Colorado;

ii That the Chairman of the Board of County Commission-
filers of said County hereby is authorized, empowered and direc
ted to execute said agreement on behalf of said County, and !
that the County Clerk hereby is authorized and directed to at
test said agreement and to attach to each duplicate original I
of said agreement a certified copy of this resolution.
