Survey crews will be out to stake the right-of-way and other construction features on or about April 11, 2022. Enclosed is a copy of Sheet Number 19 of the Weld County Road 21 P&P, STA 37+00 to STA 41+00. As you can see, this shows that the roadway construction will be east of buildings and landscaping located on your Parcel Numbers 020127037002 and 020127037003. Contrary to statements expressed in your letter received by the Board of County Commissioners on November 19, 2021, your properties are burdened by a sixty (60) foot county right-of-way lying west of the western edge of the Union Pacific Railroad right-of-way. This county road right-of- way was dedicated to Weld County through a Road Petition and Road -Viewers' Report. The sixty (60) foot county road right-of-way was accepted by the Board on September 11, 1918. The Road - Viewers' Report was recorded in the Grantor -Grantee Index in the Weld County Clerk and Recorder's Office on April 20, 1922, at Reception Number 379088. A copy of Road File 100/701, which shows these documents, is enclosed. Thus, the road right-of-way of WCR 21 was established by law and noticed to the public through recording in the Grantor -Grantee Index well before you took ownership of your properties in the 1970's. That roadway is not a planned element whatsoever in the Deed and original map that I received when I purchased this property. I have included a copy of that document attached, my original map shows the Train line and its easement but has no roadway or future plan for one there. Historically speaking 2nd Street was not intended to exist in the way it now does, or to become CR 21. CR 21 Should begin at Weld County Road 124 on its North End not C.R. 126 where it is graded to now. Since this is somewhat complex, please allow me to first give some historical context around the road in question: The route that is today known as 2nd Street was initially cut in during an exceptionally bad winter when one of the occupants of Carr needed to get to farm animals approximately 6 miles to the south twice a day. That citizen improperly bulldozed a one lane dirt road to accommodate the task - That Winter access down what was traditionally known then as CR21 was impossible due to the enormous accumulation of snow that year. That unplanned and what should have technically been a temporary roadway, gradually became more and more permanent, and has throughout the years persisted, and expanded to encompass a greater and greater portion of the land that I purchased. Traditionally, CR 21 was, and I contend still is, the road running North to South Approximately 400 yards to the East of 2nd Street, over near the line of telephone poles, but due to an error of development planning many years ago the moniker of CR 21 was improperly applied to the roadway that is 2nd Street, and through time they have come to be synonymous, but I contend that is an error and should be corrected. Whereas: that roadway lies entirely on the property at the point where it crosses, and these rulings effectively deny me the property owner the right to decide what is done with one's own private property and the mineral rights thereunder - which is vexatious, and has become a source of great anxiety, as what has been happening to this point is the gradual encroachment of the roadway onto a larger and larger area of the property without consideration for how that impacts the owners, the way the land can be utilized, or the long term value of that property. This creeping encroachment is gradually reducing the length of my driveways and decreasing the easement between the roadway and the house - and is an unwanted modification to my private land. Destroying or narrowing that easement also impedes the future installation or maintenance of any utility that would require underground digging or burial such as, Phone, Optical Fiber or Cable to the property, or properties further down the road. This encroachment is felt to be antagonistic as there is simply no good reason that the road needs to exist at all and should be returned to a state similar to how it was before the road was improperly added. Also be it known that: what the County seeks to do is to further apportion to itself the private property of another person without any offer of compensation or future consideration, and to deny that landowner say over the property. What would be more fair is; if the County would make some concessions, and be more lenient towards the property owner in some other regards as they are denying Him the use and control over a significant portion of His land and re -allocating it in perpetuity for its own purposes. Additionally - there is already a road designated for truck traffic that was built to allow trucks to circumnavigate the residential portion of Carr and have access to local Highways - why is it that this truck traffic cannot use that already existing route? Also paving will significantly increase the frequency of vehicles and trucks speeding past the home, creating a hazardous condition, and it is a significant danger for both the farm animals and the young child who lives at the home. From a noise perspective it is a nuisance as well. Be it known that: I, Rusty DePorter object to the road being widened as it was not there or a part of the development plan when the property was assessed for purchase, and it already takes up a significant portion of the property now. Additionally, removal of the road would not deny anyone access to their properties beyond or adjacent to my property as two other already established routes would permit similar access. There are already routes designated for truck traffic and the trucks should be using those routes instead of 2nd Street a.k.a. "CR 21" across my property - which should have never been graded to begin with.
