M. in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing a petition of c-) Air Dusters, Inc. , a Colorado corporation, Roggen, Colorado, requesting a change of zone from "A" Agricultural District to "C" Commercial District, and WHEREAS, the petitioner was present, being Carl Schellenberg, President of the corporation, and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners, that the petition of Air Dusters, Inc. , a Colorado corporation, for change of zone from "A" Agricultural District to "C" Commercial District, said area being more particularly described as follows: That part of Block 2, vacated alley and vacated Second Street adjacent to said Block 2, First Addition to the Town of Roggen, a subdivision of a part of the Northwest one quarter of Section 6, Township 2 North, Range 62 West of the 6th P. M. , Weld County, Colorado, described as: Beginning at the Southeast corner said Block 2; thence S87° 16' 00" W on an assumed bearing along the South line said Block 2 a distance of 456. 20 feet to the Southwest corner said Block 2; thence N00° 05' 31" E along the West line said Block 2 a distance of 103. 60 feet to a point on the Southerly R. O. W. line of Interstate 80; thence N55° 43' 00" E along said Southerly R. O. This is a request for a Change of Zone from "A" Agricultural District to "C" Commercial District as requested by Air Duster, Incorporated, Carl Schellenberg of Roggen, Color-ado. Mr. Telep will you make the record. Mr. Telep: Let the record show that this cause came on -for a hearing this day, October 14, 1970 at the hour of 2:00 P M. for that part of a vacated allay -Block 2, First Addition to the Town of Roggen and further described in metes and bounds and contain 2.513 acres more or less. Let the record further show that there is on file a copy of a resolution dated August 19, 1970 recommending favorably for this Change of Zone. Let the record further show that Air Dusters Inc. I presume that is a Colorado corporation. Mr. Schellenberg: Thats right. Mr. Telep: Zs here represented by Carl Schell-enberg and Chris Schellenberg. Mr. Telep: Let the record further show that notice of this meeting covering said legal description has been published asrequired by law on September 10 and October 5. Mr. Chairman, I believe we are in order to proceed further with this hearing. Mr. Billings: Mr. Lorensen do you have any recommendations? Mr. Lorensen: Yes sir — The location is on the southeast corner of the Roggen interchange. I might point out. The interchange is in the proper place for the location - for the highway - commercial and -on the existing site is a motel which can be considered highway commercial and the addtional amount of ground is for a service station. So we feel that (1) the existing use, which is a motel, and the existing piece -of ground, which is proposed for the service station is the proper location for commercial. 2 Mr. Lorensen: The second reason for approval is to bring the non conforming motel use — the motel is located in an agricultural zone. Rezoning would make the motel conforming use to the proposed zone. The surrounding land use to the north and west are compatible for this use. This is the reason for the recommendation of approval. Marshall -Anderson: What is the area we are talking about? Mr. Lorensen: 2.513 acres. The motel I would say covers about 50 to 60 percent of it. Mr. Schellenberq: No it would be less than 1/3 of it. It would have orginally covered a 4 of the block - course the highway took off a part of it so lets say it covers - 1/3 of it. Marshall Anderson: The _County road runs north and south of there - right -across from the Conoco Station. Mr. Bowles: Next to the junkyard. Marshall Anderson: Alright I know where it is. Mr. Bowles: Does the record show that Norville E Noe and Carolyn E. Noe are colaborators in the zone change. They were added along with Air Dusters at Burman's suggestion to bring a non-conforming use. We asked for the balance of Lot 2 - Mr. Lorensen: Yes they have been Norville E. Noe and Carolyn E. Noe. Their signatures are on the application for rezoning. Mr. Bowles: These were gotten after the original application was started because they had agreed that they would join in that. Mr. Telep: This is the vacated part of the alley and part of that street. Mr. Bowels: Yes, and you see Noe gets part _of -the alley too. This is why the application reads all of Block 2 excepting that portion given by a highway right-of—way for B0S and this would of tourse include 3 Mr. Bowles: Noes and I believe this is what the map shows. Mr. Telep: This is -true and the vacation and abondonment is done that way and as a result a quit claim deed to the present owners, whoever they may be and if there is a landowner who owns - a contiguious landowner then it is a question who gets that land. This agreement might it might entail a quiet title. Mr. Billings: Do you have anything else Burman? Mr. Lorensen: No sir. Mr. Billings: I think the record should show that the recommendation of the Weld County Planning Board is unanimously in favor of this Change of Zone from "A" Agricultural District to "C" Commercial District . Mr. -Bowles is there anything else you would like to add to this. Mr. Bowles: 1 think not as long as the Noes were included on it. Mr. Billings: There is no one present against the Change of Zone. Let the record show that 3 people are here in favor of this change from "A" Agricultural to "C" -Commercial. Is there any further discussion Mr. Telep? Mr. Telep: I don't have anything else Mr. Chairman. Mr. Billings: At this time I would entertain a motion to either approve or deny the change. -Harold Anderson: Mr. Chairman I move that the request for a Change of Zone be granted. Marshall -Anderson: I second the motion. Mr. Billings: The motion is seconded and I will make it unanimous, that we approve the Change of Zone from "A" Agriculture to "C" Commercial District for Air Dusters, Inc.
