A RESOLUTION OF THE COUNCIL OF THE CITY OF LONGMONT, COLORADO, FINDING THAT THE
PETITION FOR ANNEXATION OF PARCELS OF LAND LOCATED IN WELD COUNTY AND BOULDER
COUNTY, STATE OF COLORADO, KNOWN AS THE PESCHEL OPEN SPACE AND QUICKSILVER ROAD
ANNEXATION (GENERALLY LOCATED ON THE EAST SIDE OF COUNTY LINE ROAD SOUTH OF ST.
VRAIN CREEK AND NORTH OF COUNTY ROAD 20.5 AND QUICKSILVER ROAD BETWEEN 119TH
STREET AND COUNTY LINE ROAD) SUBSTANTIALLY COMPLIES WITH THE COLORADO REVISED
STATUTES SECTION 31-12-107(1)
WHEREAS, a petition for annexation of certain parcels of land as described in the
attached Exhibit "A," has been filed with the Longmont City Clerk; and
WHEREAS, the petition has been referred to the Longmont City Council for a
determination of substantial compliance with the requirements of C.R.S. 31-12-107(1); and
WHEREAS, the City Council has been advised by staff, and has taken the official notice of
all maps, records and other information and other materials on file with the City of Longmont,
Colorado, regarding said petition
NOW, THEREFORE, THE COUNCIL OF THE CITY OF LONGMONT, COLORADO, RESOLVES:
Section 1
The Longmont City Council hereby finds the annexation petition substantially complies
with C.R.S. 31-12-107(1).
Section 2
The City Council shall hold a public hearing on the proposed annexation on April 12,
2022 at 7:00 p.m., in the City Council Chambers, Civic Center Complex, Longmont, Colorado, to
determine if the proposed annexation complies with the C.R.S. 31-12-104 and 105, or such
parts thereof as may be required to establish eligibility for annexation.
Section 3
The City Clerk shall publish a notice of hearing once a week for four consecutive weeks
before the hearing in a newspaper of general circulation in the area proposed for annexation.
Section 4
The resolution shall be effective upon adoption.
Section 5
The Council repeals all resolutions or parts of resolutions in conflict with this resolution,
but only to the extent of such inconsistency.

Peschel Open Space & Quicksilver Road Annexation — Legal Description
A tract of land being all of Lot B, Amended Recorded Exemption 1313-7-3-RE357 according to
the plat recorded December 22, 1994 at Reception No. 2420040 of the Weld County Records,
located in the SW1/4 of Section 7, T2N, R68W of the 6th P.M., County of Weld, State of

PETITION TO ANNEX TERRITORY TO THE CITY OF LONGMONT
The undersigned owner(s) of real property, pursuant to section 31-12-107, C.R.S.,
Municipal Annexation Act of 1965, petition the Council of the City of Longmont, Colorado, for
annexation of certain territory, and state:
1. That the territory generally located at 10190 County Road lA in Weld County Colorado
and containing 138.495 acres more or less, is more particularly described in the attached
legal description.
2. That the petitioning owners represent more than 50 percent of the area described above,
excluding public streets and alleys.
3. That Petitioners further allege that:
(a) It is desirable and necessary that such area be annexed to the City of Longmont.
(b)
The requirements of sections 31-12-104 and 31-12-105, C.R.S. exist or have been
met, including:
(i) Not less than one -sixth of the perimeter of the area proposed to be annexed
is contiguous with the City of Longmont, more specifically the perimeter of
the area is 22.420.76 feet, of which 4.281.85 feet are contiguous to the
existing municipal boundary of the City of Longmont.
(ii) A community of interest exists between the area proposed to be annexed
and the City of Longmont.
(iii) Said area is urban or will be urbanized in the near future, and is integrated
or capable of being integrated with the City of Longmont.
(iv) No land, unless separated by a dedicated public way, held in identical
ownership is divided into separate parcels unless the owners of said tract
have consented in writing to said annexation.
(v) No land or contiguous parcels of land, except as may be situated entirely
within the outer boundaries of the City of Longmont, held in identical
ownership and comprising 20 acres or more and which, together with
improvements, has an assessed valuation in excess of $200,000.00 for ad
valorem tax purposes for the year next preceding the annexation, is included
in this petition without the written consent of the landowners.
(vi) No proceedings for annexation of the area has been commenced for
annexation to another municipality.

(vii) The annexation of the area would not have the effect of extending the City
boundary more than three miles in any one year.
(viii) No partial width of any public right-of-way is included in the area proposed
to be annexed.
4. As an express condition of annexation, the owners consent to inclusion into the Northern
Colorado Water Conservancy District (District) and the Municipal Subdistrict
(Subdistrict), Northern Colorado Water Conservancy District pursuant to section 37-45-
136 (3.6), C.R.S. The owners acknowledge that, upon inclusion into the District and
Subdistrict, the owners property will be subject to the same mill levies and special
assessments as are levied or will be levied on other similarly situated property in the
District and Subdistrict at the time of inclusion of owners land. The owners agree to waive
any right to an election which may exist to require an election pursuant to Article X, section
20 of the Colorado Constitution before the District and Subdistrict can impose such mill
levies and special assessments as it has the authority to impose. The owners also agree to
waive, upon inclusion, any right which may exist to a refund pursuant to Article X, section
20 of the Colorado Constitution.
5. The petitioners below comprise the owners of more than 50% of the territory proposed to
be annexed excluding public streets and alleys, and are in fact owners of 100% of the
territory proposed to be annexed, except as listed below.

ANNEXATION IMPACT REPORT
CONCERNING THE
Peschel Open Space and Quicksilver
Road Annexation
In Accordance with Section 31-12-108.5 of the Colorado Revised Statutes Annotated.
The City of Longmont is submitting the following annexation impact report to fulfill all
such required action for the above named annexation. This impact report specifically
analyzes the above annexation and identifies what impact it will have on the City of
Longmont and the municipal services that will be provided. This impact report has been
completed at least twenty-five days before the date of the Public Hearing established
pursuant to Section 31-12-108 of the Colorado Annotated Statutes.

Annexation and the City of Longmont
State statutes require that any municipality annexing property must provide "urban level
services" (i.e. water, wastewater, police, recreation, schools, and other services) to those
areas they intend to annex. The City of Longmont recognizes this responsibility and can
successfully provide these services to those areas under consideration by the City. The
City of Longmont has adopted the Envision Longmont Comprehensive Plan and
Development Regulations that both describe and require future development within the
City to meet standards that will provide for the same level of service to these new areas
as it is currently being provided within the existing City.
Peschel Open Space and Quicksilver Road Annexation
The property included in this annexation shall be known as the Peschel Open Space and
Quicksilver Road Annexation to the City of Longmont. An application for annexation,
zoning and concept plan approval has been submitted. The Envision Longmont
Comprehensive Plan designates the Peschel Open Space property's land use as Protected
Land Outside the Longmont Planning Area. The parcel is within the Coordinated
Planning Area subject to an Intergovernmental Agreement with Weld County, in which
this property is expected to be annexed to the City of Longmont per the terms of the IGA.
The property is contiguous to the City of Longmont and the total area of this annexation
is approximately 138.495 acres. The Peschel Open Space parcel included in this
annexation is currently agricultural -zoned land in unincorporated Weld County and will
be annexed to the City under the zoning of N -AG (Agricultural). Quicksilver Road is
platted public right of way in Boulder County and therefore does not have a zoning
designation.
City Boundaries § 31-12-108.5 (a) (I)
The City's present and proposed boundaries are shown on Map 1 of this Impact Report.
The City of Longmont is currently contiguous to this property on the south east sides.
The area contiguous to the City of Longmont is in excess of the 1/6t" contiguity
requirement.
Existing & Proposed Infrastructure § Section 31-12-108.5 (a) (II)
A. Storm Drainage
No development is proposed on the Peschel Open Space property, which is owned
by the City of Longmont and Boulder County. Quicksilver Road is currently
functioning as a public road. Given that no changes are anticipated in the future
for this property, it is expected that there will be no impacts to storm drainage. If
development is proposed in the future, any land development application will be
required to provide a drainage plan and report, in accordance with the City's
Storm Drainage Criteria Manual. This plan and addenda are to be reviewed and

approved prior to approval of any plats. The developer, at their expense, would
construct any drainage facilities needed to control irrigation and storm water as
required by the drainage plan. These facilities would include but not be limited to
improvements to the primary collection and detention facilities.
B. Streets
No development is proposed on the Peschel Open Space property, which is owned
by the City of Longmont and Boulder County. Given that no changes are
anticipated in the future for this property, it is expected that there will be no
impacts to the existing street network. If development is proposed in the future,
any land development application will be required to submit a traffic study for
City approval upon development application, unless waived by the city. The fully
develop the property, the developer may need to construct certain on -site and off -
site transportation improvements, as identified in the approved traffic study.
Quicksilver Road is currently functioning as a public road. In December of 2020
Longmont City Council approved an IGA with Boulder County concerning use,
maintenance, and repair of Quicksilver Road. This IGA focuses on the use of
Quicksilver as an approved truck route for hauling mined material taken from the
Irwin -Thomas property to the west. Among numerous other provisions related to
use, maintenance, and repair of this roadway, item 10 of the agreement states that
the City agrees to pursue the annexation of Quicksilver Road.
C. Water Distribution
No development is proposed on the Peschel Open Space property, which is owned
by the City of Longmont and Boulder County. Quicksilver Road is currently
functioning as a public road. Given that no changes are anticipated in the future
for this property, it is expected that there will be no impacts to water distribution.
If development is proposed in the future, any land development application will
be required to extend water mains to the site and to the extreme boundaries of the
development which shall be completed in accordance with the Updated Treated
Water Master Plan and the updated Wastewater Master Plan, as amended and
updated. The size of line to serve the development, and any subsequent final City
oversizing with be detailed in the Public Improvement Agreement (PIA) with the
developer.
Currently, there is limited water transmission capacity to serve this property when
build -out occurs in the existing annexed developments. The allocation of water
service shall be on a first -come, first -served basis at the time of final plat
recording as outlined in the PIA.
If development is proposed in the future, the developer may be responsible for the
off -site construction of the water mains necessary to serve the site. At a
minimum, to serve the site, the developer must pay participation fees for the
existing water mains that will serve this site.
D. Wastewater Collection
No development is proposed on the Peschel Open Space property, which is owned
by the City of Longmont and Boulder County. Quicksilver Road is currently
functioning as a public road. Given that no changes are anticipated in the future
for this property, it is expected that there will be no impacts to wastewater
collection. If development is proposed in the future, any land development
application will be required to extend wastewater mains to the site and to the
extreme boundaries of the development which shall be completed in accordance
with the Updated Treated Water Master Plan and the Updated Wastewater Master
Plan, as amended and updated. The size of line to serve the development, and any
subsequent final City oversizing will be detailed in the Public Improvement
Agreement (PIA) with the developer.
If development is proposed in the future, the developer may be responsible for the
off -site construction of the wastewater mains necessary to serve the site.
The allocation of wastewater treatment service shall be on a first -come, first -
served basis at the time of final plat recording and as outlined in the PIA. All
smaller on -site sewer lines will be the sole responsibility of the developer. At a
minimum, to serve the site, the developer may pay participation fees for the
existing sewer mains that will serve the site.
E. Electric Distribution
No development is proposed on the Peschel Open Space property, which is owned
by the City of Longmont and Boulder County. Quicksilver Road is currently
functioning as a public road. Given that no changes are anticipated in the future
for this property, it is expected that there will be no impacts to electric
distribution. If development is proposed in the future, any land development
application will be required to pay the City for the cost of any electric utility
extension or facility relocation that development of the property requires. If
relocation requires additional or expanding easements, the Developer shall
provide the easements to the City, without cost, subject only to encumbrances
acceptable to the City. Expense for acquisition of easements shall be eligible for
reimbursement to the developer from adjacent or other benefitting property
owners according to City policy in effect at the time of development as detailed in
the PIA.
If development is proposed in the future, the developer shall reimburse the City's
electric utility for all costs associated with the transfer of service territory within
the property to the City from other electric utilities. These costs shall include, but
are not limited to: transfer or removal of existing services, buy-out of utility

facilities, and lost revenue payments for the period stipulated by the agreement.
The terms of transfers shall be dictated by current applicable service territory
transfer agreements between the City and other electric utilities, including any
specific agreement reached concerning the property or by Colorado statutes.
Transfer of the service territory, existing customers, and resulting costs may occur
in stages at the City's discretion.
If future development is proposed all development approvals, building permits,
and certificates of occupancy shall be subject to payment of all reimbursable
costs.
F. Fire and Emergency Services
The western boundary of the Peschel Open Space property is approximately 2.2
miles from Fire Station #3, located at 1000 Pace Street in Longmont, and the
property is within the required 5 minute, 59 second response time as set by LMC
15.05.150.E. Current emergency access to the property is from County Line
Road.
G. Parks and Open Space
The Peschel Open Space property is an existing public open space and nature area
owned jointly by the City of Longmont and Boulder County with a conservation
easement. A designated City greenway is located north of this parcel adjacent to
St. Vrain Creek.
Existing and Proposed Land Uses § Section 31-12-108.5 (a) (III)
The existing land use for the Peschel Open Space property is public open space. The
property is currently zoned Agricultural in Weld County. Upon annexation the parcel
will be zoned N -AG (Agriculture). The proposed zoning is in conformance with the
Envision Longmont Comprehensive Plan designation of Protected Land Outside the
LPA. The concept plan for this property indicates it will remain as public open space, as
depicted on Map 2 of this Impact Report.
Preannexation Agreements § Section 31-12-108.5 (b)
There will not be an annexation agreement for this property. The Peschel Open Space
property is owned jointly by the City of Longmont and Boulder County and pursuant to
an existing IGA between the two entities, both parties agree that the City of Longmont
shall annex this property. Moreover, the Coordinated Planning Area IGA between Weld
County and City of Longmont agrees that Longmont will annex this property into its
jurisdiction.
Quicksilver Road is located within Boulder County and pursuant to an existing IGA
between the two entities, both parties have agreed that City of Longmont shall annex
Quicksilver Road between 119th Street and County Line Road.

Summary: Upon annexation, the City of Longmont will provide the above listed
services to this property. All of the services provided to this parcel are used by the
citizens of Longmont and would not change due to this annexation. The property owner
will be required to pay for any service expansion when this property develops and would
provide these services as outlined in the City of Longmont Municipal Code, Regulations
and the Annexation Agreement.
Financing of Municipal Service Expansion § Section 31-12-108.5 (d)
The decision to provide urban services (including the extension of utilities) to the
property shall be at the sole discretion of the City. Service extension to the property may
come through the approval of a public improvements agreement or through the City's
construction of improvements through the Capital Improvement Plan and such decision

to extend services will be made according to the policies of the City at the time which
include, but are not limited to, the Longmont Municipal Code and the Envision
Longmont Comprehensive Plan.
