IN THE MATTER OF ADOPTION OF ABANDONED PORTION OF
STATE HIGHWAY SYSTEM IN THE COUNTY ROAD SYSTEM:
WHEREAS, the State Highway routing of Highway 3, in Weld County
has been relocated- to follow the alignment of State Project F 006-1 (14),
and
WHEREAS, that all portions of the old highway relocated by the
construction have been abandoned as a part of the State Highway System,
and /'
WHEREAS, it is the desire of this Board that the abandoned por-
tions should remain public highways, and should be included in the County
Road System,
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
that the abandoned portions of State Highway 3, remain public highways, and
be included in the County Road System.
The above and foregoing resolution iras, on motion duly made and
seconded, adopted by the following vote:

A copy petite 'applicntion was. duly nerved on the respondent, the '
-Union:Pecifio Railroad Company; end „cm August 4, 1930, a conference was held. . ^
at Carr between the Board of-County Caasissioners, the Division Engineer of
•the Union Pacific Railroad Coiapany,' the Com iseion's Railway Engineer-and - .
' others interested, ,to consider the'matter, and otter carefully considering the ; -
' hasarde _at the present crossings heretofore referred to and the safer conditions -
at the proposed new crossing on' Stevenson Avenue, as well as the matter of ,

convenience to all concerned, the proposed changes were tentatively agreed to,
subject to the approval of the management of the rail carrier and this
Commission. The tentative agreement also provided for the straightening of
the highway at the crossings of the wys at south side of the town and the
abandonment of the highways leading to the crossings to be abandoned in the
interests of safety end as being no longer needed or necessary.
On September 29, 1930, the attorneys for the respondent filed an
answer to the application with the Commission, advising that the railroad
company had "no objection to the proposed substitution of one crossing along
Stevenson Avenue extended in the town of Carr, Colorado, and the abandonment
of the two present road crossings in the manner shown on the blue print,
Exhibit A, hereto attached and made part of this answer, provided that the
cost of the change is divided on the usual basis between told County and the
Railroad Company, the County to assume all costs on account of grading and
the Railroad Company to assume expense incident to the saving of its property."
A copy of this answer was referred to the Board of County Commissioners
of weld County and on October 11, 1930, the Board advised the Commission that -- - ----
the answer was in accordance with the tentative agreements of the aforesaid
conference, and-was therefore satisfactory to it.
3inoe, therefore, all matters concerning the application are
attnally satisfactory to the parties concerned therein, and since it is
apparent that the proposed changes in the crossings end the roads leading
thereto will be for the better convenience end safety of the public, the
Commission will now make its order authorizing the changes.
ORDER
IT IS THMtCa7ORE ORDERED, in accordance with Section 29 of the
Public Utilities 'tot, as amended April 16, 1917, that the present publie
highway grade crossing over the Union Pacific Railroad about 900 feet north
of the depot at Carr, Colorado, and the grade crossing about 800 feet south
of said depot be abandoned, and that a public highway crossing, at grade, be,
and the same is hereby, permitted' to be opened and established over and across
the right-of-way and tracks of said railroad company on Stevenson Avenue as

attended in the town of Carr, and that the two crossings on tho wye at south
side of said town shall be moved to locations on tho highway as straightened
at. that point, conditioned, however, that prior to the opening of said new
crossing, and the changed crossings, they shall be constructed in accordance
with the plane and specifications as prescribed in the Commission's Order
"In re Improvements1of Grade Crossings in Colorado", 2 Colo. P.U.O. 128.
IT IS FURTHER ORDERED, That the expense of the construction end
maiatsnenoe or grading up to the tracks at the new crossing on Stevenson Avenue
• as extended, and the two new crossings on maid wye, including drainage therefor,
shall be horns by the County of Weld, Colorado, and the expense of the
removal of the abandoned crossings, the removal of the arousing, on the wye
, and the installation and maintenance of.ssid new crossings, including necessary
crossing planking, algae and other expanse, shall be borne by the respondent,
$he Union Pacific Railroad Company.

Gentlemen:
Enclosed herewith is answer of the Union Pacific Railroad
Company to Application No. 1660.
It will be noted that the Company agrees to the opening of
the new crossing on Stevenson Avenue and the abandonment of the crossing
at M. P. 86.17 and at M. P. 85.82, as requested in your application upon
the usual terms for such matters.
Also in addition it is proposed to change the highway at the
wye so as to cross the tracks on a straight line and abandon present road
on the right-of-way and the highway leading to the old crossing at M. P.
86.17: It is the understanding of the writer that all these things were
agreed to verbally at our conference on the ground some time ago, but
before issuing the order the Commission desires your written approval of
all of the matters as specified in the answer. Kindly let us have a
prompt reply so that the matter can be closed up at once. Retain papers
for your file.

Gentlemen:
Your letter of October lst. .inclosing blue prints and answer
attached of the Union Pacific Railroad Company concerning
the abandonment of two crossings and the establishment of
one crossing on 3tovenuon Avenue at Carr, Colorado.
I am directed by the Board of County Commissioners, after
carefully considering the last paragraph of your letter
and. directed. to state that the contents thereof, is
agreed by the Board of County Commissioners and accepted
by them, which is earring out the verbal agreement between
all parties at interest at the time of the conference on the
grounds.
The Board acknowledged with appreciation, the prompt service •
and courtesy extended in this matter and will take necessary
steps at once to carry out the Counties end of the agree- •
ment for grading necessary roads etc.

Southeast Quarter (SFr) and the East Half ( E2) South-
west Quarter (SW*) of Section Twenty (20) , Township
Eleven (11) North of Range Sixty-six ( 66 ) , the land of
Nora Coleman, has in part been abandoned and should be
quit claimed back to her.
• RESOLVED , That the -Board of County Commissioners
• hereby appoint T. L. Powars as their commissioner to
execute quit claim deed to Nora"Coleman, of that strip of
land across said_-W2 of SE4, and the El of SW- of Section
. - 20 , Township 11 North of Range 66 West of the 6th P. M.

On the 19th of last month I mailed you a Vield County
warrant Do. 6753 Series "II" for 4.13.00 to apply as damages
for lend taken for right of way fur road purposes on land
showing title in- the Union Pacific Railroad Company.
This warrant included an amount of ;6.00 damages for a strip
of ground through section 5, T. 10 N. R. 66 W. 6th 7. M. .
which lend is claimed by Geo. Scheidemantel of Wenatchee,
7ashirgton. In as much as the 36.00 claimed by kir. Scheidemantel
was included in the warrant for :1+13.00 drewn in favor of the Union
T'aoifio railroad Company, I thought beat to forward the full amount
to you and payment could be made to Mr. Scheidemantel or his daug-
hter from your office. I am just in•, recG,ipt of a letter from
Mr. Scheidemantel in regard to this matter, which I en enclosing
herewith for your attention.

13th inst. , concerning county road through Section 5, Township 10,
Range 66, Weld County, Colorado, known as County Road No. 592, and
which you say has also been designated as a State Road.
Further referring to your letter of October 16th, 1915,
to Mr. George Scheidemantel of Wenatchee, Washington, which I have
today returned to him, you are hereby authorized to pay the amount
of $6.00, which was awarded Union Pacific Railroad Company, for
said right of way, to Mr. Scheidemantel.

advise that damages in the amount of $6.00 was awarded to the
• Union Pacific Railroad Company for right of way herein referred to.
-Weld County Records showed at the time that the road was granted
that section 5, Township 10, Range 66, was held by the Union Pacific
Railroad Company. You or your daughter may have had- a contract
of purchase at that time. •
The above warrant is now in our hands and we can deliver
same to your daughter upon consent of the Railroad Company.

records sholt that said road was granted by the Board of County.
Commissionors on the 6th day of December,` 1913.
' This road is known of record rs county Road. No. 592, and
bus also been designated as a State Road, being the main traveled
road between Greeley and Cheyenne, Wyoming. Quite a sum of money
was spent improving this road and it is now in first class shape
for public travel. ;

Dear Sir :
The answer to your letter of the 6th has been somewhat delayed
by the writer' s absence from town, but we trust that the delay has
not inconvenienced you.
We are enclosing herewith a quit-Claim in a swfiewhat different
form from the one you sent us, the difference being that in case of
abandonment, the land conveyed shall revert to the grantor, as was
provided by the agreement between our company and the Board of
Commissioners .
In as much as you desire to specify the payment for fences, bill
of which was rendered you, as the consideration of the deed, we have
included in the deed only the lands situated along the main highway,
and not including the branch to Carr. The reason of this is that
there may be a payment to be made by the County to this company in
case it becomes necessary for us to build fences along this last named
branch, as set forth in Paragraph Fourth of our Contract, which provid-
ed that in case a certain other county road could not be vacated, then
the County would stand the expense of building approximately five
miles of fence along this Carr branch. As this matter has not been
definitely settled, we concluded that the simplest way would be to
omit the strips of land contained in the Carr branch right of way
until some conclusion has been arrived at. Otherwise, it would be

impossible for us to state the actual consideration of the deed.

the receipt of which is hereby acknowledged, and of the laying out and opening of said road, hereby agree to give
the right of way through our lands as shown by the plat accompanying this petition, and relinquish all claims for
damage by reason thereof.

We therefore petition your honorable body to cause to be laid out and opened a County road as above described,
and we, the owners of the land through which said road is sought to be laid out, in consideration of the sum of
one dollar to us each and severally in hand paid by the said County of
the receipt of which is hereby acknowledged, and of the laying out and opening of said road, hereby agree to give
the right of way through our lands as shown by the plat accompanying this petition, and relinquish all claims for

'MEMORANDUM OF AGREE!5,IIT , between Warren Live Stock Company,
a corporation, hereinafter termed the "Company" , and Weld County,
State of Colorado, hereinafter termed the "County" .
Whereas, the County desires to secure from the Company an
easement for a public road commonly known as the State Highway
between Greeley and. Cheyenne , together with a certain branch common-
ly known as the Collins road, extending from the state highway to
Carr , Colorado , along such portions of the above described roads
where the lands of the Company are tr versed, as the line of the
above road has been laid out by the County Engineer of Weld County.
WITTESSETH: That the Company agrees to execute and deliver
to the County proper conveyances of right-of-way as above described,
for such portions of the roads as traverse lands owned by the
• Company, the right-of-way thus granted to be ,for public highway
purposes , and to. revert to the Company in case of abandonment of
such use, in consideration of the following terms and conditions ,
which the County hereby covenants to keep and perform.
First , that the survey of the road as now made be changed so
that the center line of the road will run from the point where the
Section line between Sections 21 and 22 intersect the Colorado-
Wyoming line southward along the above Section line to the Southeast
corner of said Section 21 , and thence by the most feasible route to
connect with the present survey, instead of being located westward
of this Section line as the road is now surveyed, provided , that
such -a change is at all practicable. -
Second, that the bridge to be erected across Owl Creek near
the ranch known as the Lazy D ranch, shall be securely railed, and
that the Company shall have perpetual right to connect the fences
bounding the right-of-way of the highway at this point , to each of
the four corners of this railing, in such a way that • there shall be
no water open to stock upon the right of way of the highway at this
point . Furthermore, if practicable, the said bridge shall be made
high enough to serve as a runway for cattle.

Third, that the County shall pay the Company its expenses in
removing fence now standing on the east , side of Sections 7 , 19 ,
and 30, and on the west side of Section 32, all in Township 10

North, Range 66 West , and re-erecting this fenceAalhig the boiThdary
line of the right-of-way of the highway. Or, in other words, that
the County shall bear the total expense of the four miles of new
fence, but shall not be charged for any material taken from the
fence now standing and used in building this new fence, except the
cost of tearing down such material.
Fourth, That the County shall either abandon totally that
portion of County Road No. 436, lying between the town of Carr and'
the range line between Ranges 66 and 67 , or shall change that por-
tion of the road above said, so that it shall run from the south-
east corner of Section 36, Township 11, Range 67 , westward along
the township line to a point where it intersects the present road
along the east side of the Union Pacific-Railroad. - Or , if the
County does not abandon or change the portion 'of County Road No .
436 as above noted, then, and in that case only, the County shall

bear the total expense of fencing^the two and one-half miles of
the new County road running from Carr eastward to the range line

between Ranges 66 and 67 , except , however , that such old fence

material as now stands upon the Section line between ,Sections 24 and
25 , Township 11, Range 67 , may be used without expense to the County
in constructing such right-of-way fence . And in case the present
right-of-way of the portion of the County road No . 436, as above
specified , is vacated by the County, the County shall quit=claim
to the owners of land traversed by this portion the right-of-way
so abandoned.
And in further consideration of these covenants to. be kept and
performed by the County, the Company hereby agrees that the County
shall not be liable for the expenses of changing any fences belong-
ing to the C°mpany along the right-of-way of the highway north of

entered into between this County and The 'rarren Live Stook
Company. I notice that your quit claim deed for ri_;ht of
way for this line of road is limited to two years, provided
thet same shall cease to be used or maintained for road purposes
for such a length of time. This was not r: part of our agree-
ment, however, T am of the opinion that -it will rake little
difference FS there is barely any possibility of such a. thing
4or"ing to pass. •
We h€.ve petition re uosting the abandonment of the old
Slayton Hcnoh Peed, .x436, commencing at ti,,o point set forth in
our ngreenent, which the .Commissioners expect to act upon at the

We have yours of November 3rd and in reply will say that we will be
glad to take the matter of deeds up as soon as you have them prepared.
By the way, we have finished the work of changing the fence along the
main branch of the highway and enclose a statement of the expense for the
same, which the Commissioners will doubtless be glad to close up at the same
time that they are finishing the other matters connected with the highway.
This leaves "in the air" only the matter of some fencing on the' Carr
branch in case a certain old established county road be not changed or
vacated; as per agreement .

Gentlemen:-
We hand you herewith brief form of agreement already signed by us and
containing the main points discussed at our recent meeting. Believe that
this will be quite siatisfactory to you and if so request that you return
one copy after having signed.
The writer and his father recently looked over the route of the road
just south -of the Wyoming boundary to, see whether the change as proposed
in paragraph first of the agreement would be feasible. We are rather of
the opinion that such a change would not be practicable. However, would like
very much to have the county engineer look over it before beginning actual
construction work.
As to the fence near Dover which we shall have to change, we should like
Very much to have -the county engineer set stakes along the boundary of the -
right of way at such points as we have to move the fence at his earliest •
possible convenience as we can put a force of men at work moving this fence
within a very short time. We should be glad to be notified just as soon as
these stakes are set so that we can start moving this fence at once.
