Attached, please find the calculations & pertinent title for Weld County's interests in Verdad's Johnson 01 N -65W -30-2S well.
Our title opinion originally credited Weld County with an unleased interest in Tract No. 31, however, it has since been leased to Verdad at 18.50% royalty. Tract No. 59 was leased in 1973 to Thomas
G. Vessels at 12.50% royalty. In each tract, Weld County is credited with owning 50% of the mineral interests within those tracts.

your records accordingly.
REQUIREMENT: As stated in the Comment.
5. Assumptions Pertaining to Relative Depths of Formations. For purposes of this
title opinion, we assume that the target formations (Niobrara and Codell formations) lie at depths
that are fully above 8180 feet subsurface throughout the Subject Lands.
REQUIREMENT: You should satisfy yourself as to the correctness of the
assumptions stated in the Comment.
6. Assumption in Connection with Dedications on Recorded Plats, and Exception to
Assumption in Connection with Tracts 31, 59. The Materials Examined reflect the execution and
recording of subdivisions and other plats covering the Subject Lands. These recorded plats may
dedicate easements and rights -of -way for use as public roadways and other purposes. For
purposes of this title opinion, we assume that there was no intent to create mineral ownership
interests in any public roadway or other right-of-way in the absence of a recorded conveyance
that expressly conveys all oil, gas, and other minerals. An exception to this assumption exists
where a party has taken steps to possess the minerals underlying roadways for the 18 -year
statutory period for adverse possession (C.R.S. Section 38-41-101, et seq.). By its execution of
Lease No. 205, Weld County has asserted a mineral ownership interest in the streets dedicated to
public use in the Green Acres Subdivision in the NE/4, Section 24, and as stated above we
assume that this lease is still held by production. Contemporaneously with its execution of Lease
No. 205, Weld County executed an Oil and Gas Lease covering the streets dedicated for public
use in the Nelson Subdivision located in the NE/4SE/4, Section 24, which for purposes of this
opinion we assume has terminated for lack of production. Nevertheless, this Lease, recorded at
Reception No. 1613708, may also constitute an assertion of mineral ownership over the minerals
underlying the roadways in the NE/4SE/4, Section 24, for the statutory period to acquire
ownership by adverse possession. It is not clear whether Weld County acquired these mineral
interests in the described manner as the lands in question are unoccupied and not subject to
taxation by the owner as a real property interest.
REQUIREMENT:
You should obtain and examine any available pay records
by any producers which are operating, or have operated in the past, in the E/2E/2,
Section 24, for evidence of royalties paid to Weld County by virtue of its
purported mineral interest in the public roadways in those lands. If no such
royalties have been paid to Weld County, you should obtain and record a
disclaimer of mineral interest by an authorized representative of Weld County,
and such documentation should be provided to this office for the purpose of
obtaining a supplemental title opinion.
