WHEREAS, pursuant to the provisions of the Special District
Control Act, Article 18, Chapter 89, C.R.S. '63, as amended, a
public hearing was held on April 15, 1974, for the purpose of hear-
ing a petition to consider a service plan relative to establishment
of the Western Hills Fire Protection District within a proposed area
as indicated on Exhibit A, attached herewith, and
WHEREAS, the petitioners were present and represented by
Kenneth T. Colwell, counsel for petitioners, and
WHEREAS, there was some opposition to request of petitioners
for the establishment of said Western Hills Fire Protection District,
and
WHEREAS, in accordance with the aforementioned statute,
said Fire Protection District may be authorized upon the approval
of the Board of CountyCommissioners of Weld County, Colorado,
and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request
of the petitioners and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application to establish the Western Hills
Fire Protection District within the boundaries as indicated in Exhibit
A attached hereto and made a part hereof by reference, be, and it
hereby is approved under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the state health department.
2. That all applicable subdivision regulations and zoning regu-
lations shall be followed and complied with in accordance with the
zoning resolutions of Weld County, Colorado.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 17th day of
April, A. D. , 1974.

PUBLIC HEARING
THE SERVICE PLAN OF THE PROPOSED
WESTERN HILLS FIRE PROTECTION DISTRICT
NOTICE is hereby given of a hearing before the Board of
County Commissioners of Weld County, Colorado, on the
15th day of April, 1974, at the hour of 10 :00 A.M. , at the 4-H
Building at Island Grove Park, Greeley, Colorado, for the
purpose of considering the Service Plan of the proposed
Western Hills Fire Protection District. This notice is
given pursuant to Special District Control Act, Article
18 , Chapter 89, Colorado Revised Statutes 1963 as amended.
Copies of the Service Plan are on file at the Office
of the Board of County Commissioners located at the Weld
County Courthouse, Greeley, Colorado, and may be
inspected during regular business hours.
The Service Plan for the proposed Western Hills Fire
Protection District sets forth a proposal for providing
protection services to an area surrounding the City of
Greeley, Colorado. The Service Plan provides for financial,
engineering, architectural, construction and tax information
concerning the formation of said District.
Withing 20 days after the completion of the hearing, the
Board of County Commissioners will consider the approval
of the Service Plan.
All interested parties under the law will be afforded
an opportunity to be heard at said hearing.
This notice given and published by order of the Board
of County Commissioners of Weld County, Colorado.

RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Glenn Anderson that the following resolution be intro-
duced for passage by the Weld County Planning Commission :
Be it therefore Resolved by the Weld County Planning Commission
that the following be adopted by the Board of County Commissioners :
The approval of the Western Hills Fire Protection District .
To be recommended favorably to the Board of County Commissioners for
the following reasons :

Reasons for favorable recommendation to the Board of County
Commissioners :
1 . The required service plan and its elements have been
submitted in accordance with 89-18-4 CRS , The Special
District Control Act .
2 . The service plan appears to be workable .
3 . The financial statement has been checked and found
accurate by the County Finance Officer .
4 . It is the judgement of the Weld County Planning Commission
that fire protection is desireable and further , it compliments
the Weld County Comprehensive Plan in that it provides fire
protection to areas that are proposed for growth .
SUBJECT TO :
1 . Relocation of proposed east fire station further east to
at least the vicinity of Lynn Grove Cemetary .

Western Hills Fire Protection District must be notified of
hearings pertaining to formation.
