RE: APPROVE ACCEPTANCE OF QUIT CLAIM DEED FOR WELD COUNTY WAY -
COLORADO DEPARTMENT OF TRANSPORTATION (CDOT)
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 4th day of May, 2022, the Board approved an Intergovernmental
Agreement for the devolution and maintenance of Weld County Way (County Road 64, aka
O Street, near U.S. Highway 85), with the Colorado Department of Transportation (CDOT), and
WHEREAS, in accordance with said intergovernmental agreement, the Board has been
presented with a Quit Claim Deed for Weld County Way from the Colorado Department of
Transportation, 10601 West 10th Street, Greeley, Colorado 80634, to the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Department of Public Works, with further terms and conditions being as stated in said quit
claim deed, and
WHEREAS, after review, the Board deems it advisable to approve and accept said quit
claim deed, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Quit Claim Deed for Weld County Way from the Colorado
Department of Transportation, to the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Public Works, be, and
hereby is, approved and accepted.

QUITCLAIM DEED
THIS DEED is dated auk,/ ' " , 2022, and is made between the Department of Transportation, State of
Colorado , the "Grantor", of the Cand County of Denver and State of Colorado, and the County of Weld, a body
corporate and politic of the State of Colorado, by and through its Board of County Commissioners, Colorado, the
"Grantee," whose legal address is 1150 "O" Street, Greeley, Colorado 80631, of the County of Weld and State of
Colorado.
WITNESS, that the Grantor, for and in consideration of the sum of Ten dollars and other good and valuable
consideration, ($10.00) the receipt and sufficiency of which is hereby acknowledged, does hereby remise, release,
sell and QUITCLAIM unto the Grantee, and the Grantee's heirs and assigns, forever, all the right, title, interest,
claim and demand which the Grantor has in and to the real property, together with any improvements thereon,
located in the County of Weld and State of Colorado, described as follows:

DESCRIPTION
A tract or parcel of land No. RW-1 of the Department of Transportation, State of Colorado Project No. C 0853-120
containing 618,639 sq. ft. (14.202 acres), more or less, in the Northeast Quarter of Section 32, Township 6 North,
Range 65 West, of the 6th Principal Meridian, Weld County, Colorado, said tract or parcel being more particularly
described as follows:
Parcel "A" of Recorded Exemption No. 0803-32-1-RE3216, recorded January 7, 2002 at Reception No. 2914851,
together with all access rights on and to US 85.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and privileges
thereunto belonging, or in anywise thereunto appertaining, and all the estate, right, title, interest and claim
whatsoever of the Grantor, either in law or equity, to the only proper use, benefit and behoof of the Grantee, and the
Grantee's heirs and assigns, forever, except: easements, covenants, reservations, restrictions and rights -of -way of
record, reserving, however, unto the Grantor, that if at any time the Grantee ceases to use the road or a portion
thereof for the purposes of a county highway or city street, title to the road or portion thereof shall revert to the
Department of Transportation, State of Colorado.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day and year
first above written.
