County, Colorado, adopted Subdivision Regulations for Weld County, Colorado, to
comply with the prescribed Senate Bill #35, and
I WHEREAS, the Weld County Planning Commission has recommended to the
Board of County Commissioners for recording Minor Subdivision No. 1313-14-1-MS-5
as provided in Section 9 of the Subdivision Reaulations for Weld County, Colorado.
Said subdivision is more particularly described as follows:
A tract of land located in the EA- ofthe NEI of Section 14, T2N,
R68W of the 6th P.M. , Weld County, Colorado, described as follows:

SIGN RESOLUTION REGARDING
GENERAL FUND APPROPRIATION
FOR THE YEAR 1972:
WHEREAS, the Chief Accounting Officer has advised the Board of County
Commissioners of Weld County, Colorado, that it is anticipated that the General
Fund Budget will exceed the budgetary appropriation for the year, 1972, and
WHEREAS, the Chief Accounting Officer has advised the Board that the
revenues, other than property taxes, have exceeded the estimated amount, and
WHEREAS, this is a case of an emergency caused by a contingency which
could not have been reasonably foreseen at the time of the adoption of the budget,
and
WHEREAS, by Colorado Revised Statutes, 1963, Chapter 88-1 (as amended
;- 1970) does in an emergency allow the governing body to authorize the expenditure
of funds in excess of said budget, by resolution, duly adopted by a two-thirds
\ (2/3) vote.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners,
Weld County, Colorado, the expenditures in excess of the 1972 General Fund
appropriation was made necessary by an emergency caused by a contingency which
could not have been reasonably foreseen at the time of adoption of the 1972
budget.

RESOLUTION
WHEREAS, the Denver Metropolitan Trap & Skeet Club, c/o Henry
Willis, 7650 W. 38th, Wheatridge, Colorado 80033, has requested
permission to locate a trap and skeet shooting range on the following
described property, to-wit:
A tract of land located in the Southeast Quarter (SE 4) of
Section Thirty-two (32), Township One (1) North, Range
Sixty-Eight (68) West of the Sixth P. M. , Weld County,
Colorado, except the South 75 feet thereof, containing 80
acres, more or less, and
WHEREAS, the petitioner was present and represented by Harry
Wall, President, and Thomas King, Director of said corporation, and
WHEREAS, there was some opposition to the request of petitioner
to locate said trap and skeet shooting range on the above-described
premises, and
WHEREAS, the said requested trap and skeet shooting range is
locat ed in an agricultural zone as set forth by the Weld County Zoning

WHEREAS, said trap and skeet shooting range may be authorized
upon the approval of the Board of County Commissioners of Weld

testimony and statements of those present; has studied the request of
the petitioner and studied the recommendations of the Weld County Planning
Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of the Denver Metropolitan Trap and
Skeet Club, c/o Henry Willis, 7650 W. 38th, Wheatridge, Colorado 80033,
to locate a trap and skeet shooting range on the premises indicated above
be, and it hereby is granted under the conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. That when said trap and skeet shooting range is completed,
same shall be limited in size as shown on plan as submitted.
3. Subject to meeting all requirements of the American Trap
Association and the National Skeet Shooting Association.
4. That all applicable subdivision and zoning regulations shall be
followed and complied with in accordance with the Zoning Resolutions of
Weld County, Colorado.

3 . 13 Uses permitted in the "A-P" , Airport Zone District
( 1 ) Definitions
For the purpose of this Section , the words and phrases
set forth in this Section shall have the means re-
spectively ascribed to them herein :
(a ) AIRPORT
Weld County Municipal Airport , located in Sections 2 and
3 , T5N , R65W , Weld County , Colorado .
(b) AIRPORT ELEVATION
The established elevation of the highest point on the
usable landing area (4 ,648 feet above sea level ) .
(c ) AIRPORT HAZARD
Any structure , tree or use of land which obstructs the
airspace required for , or is otherwise hazardous to , the
flight of aircraft in landing or taking off at the air-
port .

(d ) AIRPORT REFERENCE POINT
The point established as the geographic center of the air-
port lancing area . The reference point at Weld County
Municipal Airport is a point 2 ,700 feet west of the east
line of Section 2 , T5N , R65W , Weld County , Colorado and
2 ,200 feet north of the south line of said Section 2 .
(e ) HEIGHT
For the purpose of determining the height limits in all
surfaces set forth in this Section and shown on the
zooing map , the datum shall be mean sea level elevation
unless otherwi spec"l ed .
(f) INSTRUMENT RUNWAY
The East-West Runway , No . 9-27 , equipped , or to be equip-
ped with a precision electronic navigation aid , landing
aid , or other air navigation facilities suitable to per-
mit the landing of aircraft by an instrument approach
under restricted visibility conditions and described as
follows :
1 . Instrument Runway : A tract of land in Sections 2 and
3 , T5N , R65W , situated in Weld County , Colorado , or
more particularly described as follows : Beginning at
the intersection of State Highway 263 and Darling
Ranch Road , thence North 74° 12 ' west a distance of
8 ,500 feet ; said 8 ,500 feet is the centerline of
the Instrument Runway , which extends 50 feet on each
side of said centerline .
(g) NON- INSTRUMENT RUNWAY
Ruhways that are not equipped with electronic navigation
equipment . The non-instrument runways are the crosswind
runway (Runway 15-33 ) and thn parallel practice runway
(Runway 9L-27R ) .
(h ) RUNWAY
The area of the Airport constructed and used for landing ,
and taking off , of aircraft .
( i ) STRUCTURE
An object constructed or installed by man , including but
not limited to buildings , towers , smoke stacks , overhead
transmission lines , signs , drill rigs and cranes . This
definition applies to this zone district only .
(j ) THRESHOLD
That imaginary line on the runway perpendicular to the
runway centerline which marks the useful limit of the
runway . The threshold of all runways is the physical
end of that particular runway with the exception being
Runway 27 which has its threshold 1 ,050 feet west of the
physical end .
(2 ) AIRPORT SURFACES
In order to carry out the provisions uf this Section , there
y are hereby created and established certa ' n AIRPORT SURFACES
that include all c the ;d and air,naz lying below air-
port imaginary air surfaces . Such imaginary surfaces consti -
tute the height limits of ground objects . Any ground object
protruding into or through an imaginary surface would be a
hazard to air operations . The land areas of the AIRPORT
SURFACES are shown on Weld County Municipal Airport Zoning
Map consisting of one sheet prepared by Nelson , Haley,
Patterson and Quirk , Engineering Consultants , and dated
April 10 , 1972 , which is attachPd _o, *,his SP_ction_and maw
a part thereof. The various surfaces are hereby established
and disTreea -a-s follows :

(a ) INSTRUMENT APPROACH SURFACE
An Instrument A
pproac;� Surface s established at that
end of the instrument runway used for precision in-
strument landings and takeoffs . The Instrument Ap-
proach Surface is trapezoidal in shape and has a width
of 1 ,000 feer, at a u s cance of 200 feet beyond the end
of the runway , widening thereafter uniformly to a width
of 16 ,000 feet at a distance of 50 ,200 feet beyond the
end of the runway , its centerline being the continua-
tion of the centerline of the runway .
( b) NON-PRECISION INSTRUMENT APPROACH SURFACE
The Non-precision Instrument Approach Surface is estab-
lished at that end of ar instrument runway not used for
precision instrument approaches . The Non-precision In-
strument Approach Su ,-face is trapezoidal in shape and
has a width of 1 ,000 feet at a distance of 200 feet be-
yond the threshold , widening thereafter uniformly to a
width of 4 ,000 feet at a distance of 10 ,000 feet beyond
the runway threshold , its centerline being the contin-
uation of the centerline of the runway .
(c ) NON- INSTRUMENT APPROACH SURFACE
A ,Non-instrument Approach Surface is established at each
end of all non-instrument runways for non- instrument land-
ings and takeoffs . The Non-instrument Approach Surfaces
are trapezoidal in shape and have a width of 250 feet at
a distance of 200 feet heyond each end of the runway , wid-
ening thereafter uniformly to a width of 1 ,250 feet at a
distance of 5 ,000 feet beyond each end of the runway , its
centerline being the continuation of the centerline of
the runway.
( 3 ) HEIGHT LIMITATIONS WITHIN DESCRIBED SURFACES AND AIR SPACE
Except as otherwise provided in this Section , no structure
or tree shall to erected , altered , allowed to grow , or main-
tained in the area within any surface created by this Section
to a height in excess of the height limit herein established
for such surface , or by Paragraph 77 . 23 of the Federal Avia-
tion Regulations . Such heigi. c limitations are hereby estab-
lished for each of the surfaces as follows :
(a ) HORIZONTAL SURFACE
No structure or object of natural growth shall penetrate
the airspace above 4 ,798 feet above mean sea level with-
in the Horizontal Surface.
(b) INSTRUMENT APPROACH SURFACE
Height limits on all objects within the Instrument Ap-
proach Surface are hereby established according to the
following schedule :

The height limit range for the west approach is based
upon one foot in height for each 50 feet in horizontal
distance beginning at a point 200 feet from the runway
edge and extending 10 ,?00 feet from the end of the west
approach ; thence one foot in height for each 40 feet in

Height limits on all objects within the Transitional
Surfaces of the Instrument Runway are hereby establish-
ed as follows :
One foot in height for each sever ( 7 ) feet in horizontal
distance beginning at any point 500 feet normal to , and
at the elevation of , the centerline of the instrument
runway , extending 200 feet beyond each threshold thereof,
extending to a height of 150 feet above the established
airport elevation Article A. 2 . ) . In addition to the
foregoing , there are established height limits of one
foot vertical height for each seven feet horizontal dist-
ance measured from the edges of all approach surfaces for
the entire length of the approach zones and extending up-
ward and outward to the points where they intersect the
horizontal or conica zone , z height limit of one foot
for each seven feet of horizontal distance shall be main-
tained beginning at the edge of the instrument approach
zone and extending a distance of 5 ,000 feet from the
edge of the precision instrument, approacn zone measured
norttal to the centerline of the runway extended .
(d )) NON - INSTRUME: ' ARFR; :. ;:1 SURFACE
Height limits on all objects within the Non- instrument
Approach Surface are hereby established as follows :
One foot in height for each 20 feet in horizontal dist-
ance beginning at a point 200 feet from , and at the
centerline elevation of , the end of the non-instrument
runway avid extending to a point 5 ,200 feet from the end
of the runway.
(e) TRANSITIONAL SURFACE FOR NON- INSTRUMENT RUNWAYS
Height limits on all objects within the Transitional
Surface of the Non-instrument Runways are hereby es -
tablished es follows :
One foot in height for each seven (7 ) Feet in horizon-
tal distance beginning at any point 125 feet normal to ,
and at the el ovet icn of , the centerline of non-instru-
ment runways , extending 200 feet beyond each end thereof ,
extending to a height of 150 feet above the established
airport elevation which is 4 ,646 feet above mean sea
level . In addition to the foregoing , there are estab-
lished height limits of one foot vertical height for each
seven foot horizontal distance measured from the edges of
all approach zones for the entire length of the approach
zones and extending upward and outward to the points where
they intersect the horizontal or conical surfaces .
(f) CONICAL SURFACE
Height iimits on ill objects within the Conical Surface
are hereby established as follows :
One Foot in height for each twenty feet of horizontal
distance beginning at the periphery of the Horizontal
Surface , extending to a height of 350 feet above the lir-
port elevation .
(4 ) PERFORMANCE REGULATIONS
Notwithstanding any other provisions of this Section , no
• use may be made of land within any surface established by
this Section in such a manner as to create electrical in-
terference with radio communication between the Weld
County Municipal Airport and aircraft , make it difficult
for plots to distinguish between airport lights and other
lights , result in glare In the eyes of pilots using the
airport , impair visibility in the vicinity of the airport
or otherwise endanger the landing , taking off, or maneuver-
ing of aircraft at the airport or in the vicinity of the
airport .
(a ) TRANSITION SURFACE
Transition Surfaces are established adjacent to each
instrument and non-instrument runway and approach
surface as indicated on the zoning map . Transition
surfaces symmetrically located on either side of run-
ways have variable widths as shown on the zoning map .
Transition surfaces extend outward from a line 125
feet on either side of the centerline of the non- instru-

ment runway , tor -tht- lengtn or sucn runway plus 4UU
feet on each end ; and 500 feet on either side of the
centerline of the instrument runway , for the length of
such runway plus 200 feet on each end , and are paral -
lel and level with such runway centerlines . The
Transition Surfaces along such runways slope upward
and outward one (1 ) foot vertically for each seven ( 7 )
feet horizontally to the point where they intersect
the horizontal surface . Further , Transition Surfaces
are established adjacent to both instrument and non-
instrument approach surfaces for the entire length of
the approach surfaces . These Transition Surfaces have
variable widths , as shown on the zoning map . Such
-ransition Surfaces `lare symmetric? lly with either
side of the r';nway ^,roach surfaces from the base of
such surfaces and slope upward and outward at the rate
of one ( 1 ) foot vertically for each seven (7 ) feet
horizontally to the points where they intersect the
surfaces of the horizontal and conical surfaces . Addi -
tionally , Transition Surfaces are established adjacent
to the instrument approach surfaces where they project
through and beyond the limits of the conical surface ,
extending a distance of 5 ,000 feet measured horizon-
tally from the edge of the instrument approach surfaces
at right angles to the continuation of the centerline
of the runway .
( b) HORIZONTAL SURFACE
A horizontal plan 150 feet above the established airport
elevation, the perimeter of which is constructed by
swinging arcs of 10 ,000 feet from the center of each end
of the primary surface of the instrument runway and con-
necting these arcs with tangent lines .
(c ) CON, CAL SURFACE
A Conical Surface is established as the area that com-
mences at the periphery of the horizontal surface and
extends outward therefrom a distance of 4 ,000 feet .
The Conical Surface does not include the instrument ap-
proach surfaces and transition surfaces .
(5 ) NON-CONFORMING USES
The regulations prescribed in this section shall not be con-
strued to require the removal , lowering , or other changes or
alteration of any structure or object of natural growth not
conforming to this section as of the effective date of this
section , or otherwise interfere with the continuance of any
nonconforming use . Nothing herein contained shall require
any change in the construction , alteration , or intended use
of any structure , the construction or alteration of which was
begun prior to the effective date of this section and is dil -
igently prosecuted ; provided , however , the owner of any non-
conforming structure or object of natural growth is hereby
required to permit the installation , operation and mainten-
ance thereon of such markers and lights as shall be deemed
necessary by the Board of County Commissioners to indicate to
the operators of aircraft in the vicinity of the Weld County
Municipal Airport , the presence of such non-conforming struc-
tures or object of natural growth . Such markers and lights
shall be installed , operated and maintained at the expense of

(6) VARIANCES
Any application filed under Section 3 . 13 ( 5 ) for a variance to
the provision of this section shall be submitted for comment
to Vie Federal Aviation Agency and the Board of County Com-
missioners prior to consideration of such application by the
Board of Adjustment .

RESOLUTION
WHEREAS, a hearing was held on December 18, 1972, in the chambers
of the Board of County Commissioners, Weld County, Colorado, for the
purpose of hearing the petition of Rick Dill, Box 488, Ault, Colorado 80610
requesting permission to locate a dairy operation on the following described
property, to-wit:
A parcel of land more particularly described as being the
South 320 feet of the Southwest Quarter of the Southwest
Quarter (SW4SW4) of Section Thirty (30), Township Eight
(8) North, Range Sixty-five (65) West of the Sixth Principal
Meridian, Weld County, Colorado, containing 10 acres,
more or less, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of petitioner to
locate said dairy operation on the above described premises, and
WHEREAS, the said requested dairy operation is located in an
Agricultural Zone as set forth by the Weld County Zoning Resolution,
and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution
of Weld County, said dairy operation or any expansion thereof may be
authorized upon the approval of the Board of County Commissioners of
Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of the
petitioner and studied the recommendations of the Weld County Planning
Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Rich Dill, Box 488, Ault,
Colorado 80610, to locate a dairy farm operation on the premises
indicated above be, and it hereby is granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. That petitioner shall proceed with due diligence to construct
said dairy operation and shall have up to one year from date hereof to begin
construction of same; otherwise, the Board may, for good cause shown, on
its own motion, revoke the permit herein granted.
�. 3. That when said dairy operation facility is completed, same shall
be limited in pen size to 37, 000 sq. ft. , all as shown on plan as submitted.
4. That all applicable subdivision and zoning regulations shall be
followed and complied with in accordance with the Zoning Resolutions of
Weld County, Colorado.

FINDINGS AND RESOLUTION
CONCERNING INDIANHEAD SUBDIVISION PLAT
The petition of Interladco, Inc. , c/o Warren Strobbe, requesting
approval, execution and recordation of a subdivision plat of the Northeast
Quarter (NEB'-) of Section Eighteen (18), Township Five (5) North, Range
Sixty-seven (67) West of the Sixth P. M. , Weld County, Colorado, designated
as "Indianhead Subdivision" hereinafter referred to as the "plat", came
on for hearing on October 30, 1972, and the Board of County Commissioners
of the County of Weld, State of Colorado, having heard the testimony and
evidence adduced at said hearing and having considered the testimony,
evidence and recommendations of the Weld County Planning Commission
filed with said Board, and having carefully weighed the same, now makes
the following findings:
1. The evidence and testimony disclose that the applicant failed
to sustain the burden of proof as to the need for a subdivision of this nature
and size in a rural and remote area of the county;
2. That said plat encompasses land located with an area zoned
"A" Agricutural and favorable consideration would have an undue adverse

effect on existing agricultural uses adjoining and adjacent to the proposed
subdivision;
3. The evidence and testimony show that the inhabitants of the
immediate vicinity of the area proposed to be subdivided are unanimously
opposed to the subdivision;
4. The evidence and testimony show that said subdivision would
create an undue burden on existing fire and police protection services,
and additionally, would create an undue burden on the existing facilities
of School District Re-5J;
5. The evidence and testimony, including personal inspection of
the subdivision site, disclose that a subdivision of this nature in said
rural and remote area of the county would only tend to encourage urban
sprawl and uncontrolled expansion within the county;
6. The evidence and testimony disclose that the remoteness and
isolation of this subdivision from existing residential and commercial
development with their conveniences and amenities, and said location
being outside of the normal growth pattern for this type of residential
development make it reasonably forseeable that the impact of this urban
use will be detrimental to the development of agriculture in Weld County;

7. The evidence and investigation show that there is a need for
an environmental impact study and development of a comprehensive
plan for the greater Loveland, Greeley and Windsor areas, which would
include the area sought to be subdivided, and therefore, approval of the
plat for said subdivision at this time would be premature and not in the
interest of good planning.
FURTHER, The Board makes the following additional findings:
8. Said final plat is in violation of the Weld County Subdivision
Regulations, as revised April 21, 1971, in the following respects:
(a) Section 5. 1(3) requiring (good and sufficient dedication
of all streets . . . as shown on the plat to the public)".
(b) Section 3. 7 - requiring reservation of "Suitable are
for school, park, through street or similar public purposes,
and where . . . , not dedicated on the plat . . . . arrange-
ments for said transfer of title shall be agreed upon prior
to approval of the final plat".
(c) Section 3. 6 (1) prohibiting platting lots in areas
subject to flooding (Block 3, Lots 20, 21 and 22).
9. Non-conformance of final plat with preliminary plat which shows
minimum 150' right of way for U. S. Highway No. 34.
10. No provision for maintenance of proposed sewage treatment
facility.
11. No provision for adequate fencing and maintenance along Greeley
Loveland Ditch and Farmer's Ditch.
12, That each of the preceding findings in and of themselves and
independent of each other constitutes a separate and individual ground for
denial of the plat.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has heard the petition of Interladco, Inc. ,
c/o Warren Strobbe, requesting approval, execution and recordation of
a subdivision plat of a parcel of land as hereinabove recited and made a
part hereof by reference, and
WHEREAS, said Board has made its findings on the evidence and
testimony submitted to it, including personal inspection of subdivision
site, which findings precede this resolution and by reference are incor-
porated herein and made a part hereof, and
WHEREAS, the said Board has carefully considered the final plat,
evidence and testimony and the recommendations of the Weld County
Planning Commission and has given the same such weight as it in its
discretion deems proper, and is now fully advised in the premises;

did sign on January 1, 1971, a Memorandum of Understanding for Cooperative
Extension Work for Weld County, Colorado, and
WHEREAS, it is mutually agreed between both parties that the
Memorandum of Understanding between Weld County, Colorado, and Colorado State
University for Cooperative Extension work dated January 1, 1971, is hereby
amended by the supplemental agreement hereto attached and made part of this

RESOLUTION
RE: EMPLOYMENT OF CUSTODIAL PERSONNEL FOR THE WELD COUNTY
WELFARE DEPARTMENT.
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Weld County Department of Public Welfare is in
need of the services of three custodial personnel to be assigned specifically
to the County Welfare Department, and
WHEREAS, Eugene McKenna, Director of the Weld County Depart-
ment of Public Welfare, has submitted three proposed employment contracts
relative to employment of three custodial personnel to be specifically assigned
to the Welfare Department, and
WHEREAS, the Board believes it to be in the best interests of the
County to enter into such agreements on the basis recited therein.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that said agreements providing for
the services of three custodial personnel to be assigned to the Welfare Depart-
, ment, copies attached hereto and made a part hereof by reference, be, and
they hereby are approved.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is

RESOLUTION
RE: REGULATING INSTALLATION OF OVERHEAD UTILITY LINES
ACROSS COUNTY ROADS.
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, has determined that overhead utility lines in Weld County are
so structured presently that said utility poles and/or structures are
located too close to existing county road rights-of-way; and
WHEREAS, the Board has determined that it would be in the best
interest of the County to have an adequate and uniform setback governing
the installation of all poles or support structures carrying overhead
utility lines across county roads.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, and it hereby directs and
orders that all overhead utility lines crossing county roads, where the
'� origin or a main route of said utility lines are not parallel to said county
roads, shall maintain a pole or support structure setback of at least
100 feet in each direction from the centerline of said county road.
BE IT FURTHER RESOLVED, that where the aforementioned pro-
vision for said pole or support structure setback from a county road
cannot be met due to terrain features or other adverse conditions, then in
such event, special written permission shall be obtained from the Board
of County Commissioners for each such deviation.
The above and foregoing Resolution was, on motion duly made and

WHEREAS, the various governing Boards of the respective Towns and
Cities, School Districts, Junior College Districts, Fire Protection Districts,
Water Districts, Sanitation Districts, Irrigation Districts, Drainage Districts,
Regional Transportation District, Northern Corrado and Central Colorado Water
Conservancy Distri:ts in Weld County, Colorado, have certified to this Board
the amount necessary to pay for maintaining and operating indebtedness for the

on the South section line of said Section 24, a distance of 3,410 feet east of
the Southeast corner of said Section 23 and a portion of County Road No. 59

owned by the aforementioned petitioner, and
WHEREAS, some objections to said petition for the closing of the
aforementioned portions of such County Roads have been received in the office
of the Board of County Commissioners, Weld County, Colorado, and
WHEREAS, the Board, after investigation of the facts and circumstances
of the petition and request for closing of the aforementioned portions of said
County Roads and upon good cause shown, believes it to be in the best interests
of the County to close such portions of the aforementioned County Roads as indicated
on plat marked "Exhibit A" submitted with petition, and
WHEREAS, the Board has satisfied itself that no roadway or part thereof
will be vacated so as to leave any land adjoining said roadway without an established
roadway connecting said land with another established roadway.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners,
Weld County, Colorado, that that portion of County Road No. 54 along the south side
of Sections 23 and 24 in Township 5 North, Range 64 West of the Sixth P. M., east

Weld County, Colorado, dated the 12th day of October, 1889, and recorded
October 14, 1889, in Book 86, Page 273, Weld County Records, said
Board declared an easement and right of way for public roadway over and
across 30 feet on each side of the common section line dividing Sections 23
and 24 in Township 5 North, Range 64 West of the Sixth P. M. , Weld County,
Colorado, and other property; and
WHEREAS, upon good cause shown, the Board of County Commissioners,
Weld County, Colorado, has determined to relinquish, quitclaim and vacate
said easement and right of way;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that it does by these presents
remise, release forever, quitclaim and vacate 30 feet on each side of the

RESOLUTION
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, may exempt certain divisions of land pursuant to its authority
under C. R. S. 106-2-33(D), 1963, as amended, and
WHEREAS, Senate Bill #35 provides for an exception of transfers
of land or property by operation of law or by order of court, but does not
provide any exception where a conveyance is by agreement and deed under
threat of condemnation, and
WHEREAS, the Division of Highways, State of Colorado, has
requested a blanket exemption of division of lands purchased for public
purposes per letter of November 29, 1972, attached hereto and made a
part hereof by reference, and
WHEREAS, the Board has determined that it would be in the best
interest of Weld County that said request be granted.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County
Commissioners, Weld County, Colorado does hereby exclude, under
106-2-33(3)(D), C. R. S. 1963, as amended from the provisions of Article
6, Section 2, C. R. S. 1963, as amended, any transfer or subdivision of
property or parcel of land, for public purposes, to or from the State of
Colorado, its agencies or divisions.
BE IT FURTHER RESOLVED, and the Board so finds that such a
division for transfer of land is not within the purposes of C. R. S. Article
106, Section 2.

WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a parcel of land more
particularly described as follows, to-wit:
A tract of land located in the Northwest Quarter of Section 27,
Township 5 North, Range 66 West of the 6th P. M. , being a part

1. Subject to a green belt being established around the perimeter

RESOLUTION
WHEREAS, the Weld County Planning Commission by Resolution
has recommended to the Board of County Commissioners that the Weld
County Construction Standards (heretofore referred to as "Appendix E")
be amended in certain respects; and
WHEREAS, said amended construction standards are attached
hereto and made a part of this Resolution by reference; and
WHEREAS, the Board of County Commissioners approves said
amended construction standards in their entirety;
NOW, THEREFORE, BE IT RESOLVED, that the Weld County
Construction Standards as shown on the attached exhibit, be and the same
are hereby adopted; and that said amended construction standards shall

RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, had long been concerned with the problem of solid
and/or liquid waste disposal in Weld County, and
WHEREAS, Weld County was obligated to bring the whole county
into compliance with the law, so as to promote the health, safety, prosperity,
security and general welfare of the inhabitants of Weld County, and
WHEREAS, pursuant to law, the Board did issue a number of
certificates of license of designation for waste disposal sites within the
County, and
WHEREAS, there was no solid and/or liquid waste management
system in Weld County, providing for the location, regulation, collection,
storage and/or disposal of waste, and
WHEREAS, the Board determined that the waste disposal sites duly
licensed were not fulfilling the needs of the inhabitants of Weld County,
and
WHEREAS, heretofore and on July 2, 1969, Weld County did enter
into a contract with the Weld County Landfill, Inc. , a Colorado corporation,
providing for the operation and maintenance of certain certified dumps in
Weld County, and
WHEREAS, the Board has now determined that the operation and
management by Weld County Landfill, Inc. of its certified dumps in Weld
County is most commendable and fulfills the needs of Weld County by pro-
viding all of its inhabitants access to all of its dumps so certified, and
WHEREAS, the Board believes it to be in the best interests of Weld
County, that Weld County Lanfill, Inc. continue to operate and manage its
certified dumps pursuant to its contractual obligations hereinabove
referred to.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that pursuant to the authority of
law, the Board as the Weld County licensing authority, hereby orders
that all certificates of license of designation for waste disposal sites, not
in operation, other than those certificates issued to Weld County Landfill,
Inc, and those certificates issued to The City of Longmont, Colorado, the
City of Berthoud, Colorado and Paul McClure of Eaton, Colorado, be, and
the same hereby are revoked; that all such certificates, to -wit:

a part hereof by reference, for a total purchase price of Seven Thousand

WHEREAS, a public hearing was held on January 2 0, 1971, to the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing the petition of Blehm Land and Cattle Company,
Route 1, Box 84, Milliken, Colorado, requesting permission for expan- ,
Sion of an existing cattle feed lot operation on the following described
property, to-wit:
The Southwest Quarter (SW-I) of Section Twenty-five (25),
Township Five (5) North, Range Sixty-seven (67) West
of the Sixth P. M. , Weld County, Colorado, and
WHEREAS, the petitioner was present and represented by counsel,
Mr. Walker Miller, and
WHEREAS, there was some opposition to the request of petitioner
for the expanision of said cattle feed lot operation, and
WHEREAS, the said requested cattle feed lot operation is located
in an agricultural zone as set forth by the Weld County Zoning Resolution,
and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution
of Weld County, said cattle feed lot operation or any expansion thereof
may be authorized upon the approval of the Board of County Commissioners
of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of the
petitioner, and studied the recommendation of the Weld County Planning
Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Blehm Land and Cattle Company,
Route 1, Box 84, Milliken, Colorado, for expansion of an existing cattle
feed lot operation on the premises indicated above be, and it hereby is
granted under the conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. That petitioner shall proceed with due diligence to expand said
cattle feed lot operation and shall have up to one year from date hereof
to begin construction for the expansion thereof.
3. That when expansion of said cattle feed lot operation is completed,
same shall contain, in addition to the facilities present at the time of hearing,
those additional cattle pens, all as shown on plat as submitted and made a
part hereof by reference.
4. That petitioner shall construct sealed lagoon or lagoons and water
pumps as proposed.
5. All applicable subdivision regulations and zoning regulations shall
be followed and complied with in accordance with the zoning resolutions of
Weld County, Colorado.

FINDINGS AND RESOLUTION
CONCERNING CHANGE OF ZONE
PETITION OF RUSSELL A. WADE
The petition of Russell A. Wade, Route 1, Box 112A, Erie, Colorado,
requesting a change of zone from "A" Agricultural District to "C" Commercial
District of a parcel of land more particularly described as follows, to-wit:
The South 200' of the West Half of the East Half of the
Southeast Quarter of the Southwest Quarter (W E- SE4SW4)
of Section Twenty-three (23), Township One (1) North,
Range Sixty-eight (68) West of the Sixth P. M. , Weld
County, Colorado,
came on for hearing on December 18, 1972, and the Board of County
Commissioners of the County of Weld, State of Colorado, having heard the
testimony and evidence adduced upon said hearing and having considered
the testimony, evidence and recommendations of the Weld County Planning
Commission filed with said Board, and having carefully weighed the same,
now makes the following findings:
1. Theevidence discloses that the applicant failed to sustain the
burden of proof as to the need for a change of zone or that the present
zone is erroneous or that circumstances warrant a change of zone at that
time.
2. The evidence discloses that the present zoning is complementary
to the surrounding area.
3. The evidence discloses that the proposal would constitute spot
zoning and that if a commercial activity was allowed, it would encourage
strip commercial development along County Road No. 6 and that this would
not be in the interest of good planning.
4. The evidence and investigation shows that there is a need for a
study and development of a comprehensive plan for Weld County, which
would include the area sought to be rezoned, and therefore, any rezoning
of subject property at this time would be premature and not in the interest
of good planning.
5. That each of the preceding findings in and of themselves and
independent of each other constitutes a separate and individual ground for
denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, has heard the application of Russell A. Wade, Route 1,
Box 112A, Erie, Colorado, for a change of zone from "A" Agricultural District
to "C" Commercial District of a parcel of land as hereinabove recited and
made a part hereof by reference, and
WHEREAS, the Board has made its findings on the evidence and
testimony submitted to it, which findings precede this Resolution and by
reference are incorporated herein and made a part hereof, and
WHEREAS, the said Board has carefully considered the petition,
evidence and testimony and the recommendations of the Weld County
Planning Commission and has givaithe same such weight as it in its
discretion deems proper, and is now fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, that the petition of
Russell A. Wade, Route 1, Box 112A, Erie, Colorado, requesting a change
of zone from "A" Agricultural District to "C" Commercial District of a
parcel of land indicated above be, and it hereby is denied on each of the
grounds set forth in the Board's findings therein.

WELD COUNTY DENTAL CONTRACT
This contract executed at Greeley, Colorado, this 17th day of
January , 197 3 , by and between the Board of County Commissioners
of Weld County, Colorado, hereinafter called the County, and the Weld County
Dental Society, hereinafter called the Society:
WITNESSETH:
That in consideration of the mutual promises and obligations and other con-
siderations herein expressed, it is mutually agreed until December 31, 1973:
1. The Weld County Dental Society shall render dental services as outlined in
the fee schedule for the county indigents who are in need of this service of
the sum of Three Thousand Nine Hundred Fifty Dollars ($3,950.00)per quarter.
Payment is to be made as soon as possible after the close of each calendar
quarter to the Colorado Dental Service, Denver, Colorado, acting for the Weld
County Dental Society.
2. The Society will appoint an Administrative Committee to assist in checking
bills for services rendered.
3. The Society will appoint its own committee, which shall be empowered to make
all other needed arrangements to properly administer and fairly divide the
funds among all participating members rendering service, and conduct the bus-
iness of the Society under this contract. The decision of this committee
shall be final and binding to all doctors participating in this contract. It

is expressly understood, however, that any member of the Weld County Dental
Society may be present at any meeting of such committee and have full oppor-
1 tunity to examine the books to see that the funds are divided fairly and with-
out prejudice among all participating doctors who have performed services during
the preceding month. The members of the committee act only as agent for the
Society and in no case shall they be held liable.
4. Any participating doctor suspected of irregular bills or falsification of his
records may be disqualified from participating in the contract by the Adminis-
trative Committee.
5. The Society will, so far as it lies within the power of its members, see that
proper dental care and service is rendered to all indigents of weld County.
6. It is understood by all parties to this contract that Title XIX of the Social
Security Act (Medicaid) will be implemented to provide dental services for
children of public assistance recipients. Effective January 1, 1973 eligible
children from 0 through 5 will have coverage. After July 1, 1973, all children
of eligible public assistance recipients up to the age of 21 are covered. Bill-
ing for services rendered will be made directly to the fiscal agent by the pro-
vider of service.
7. Any unexpended funds at the end of the year 1973 shall revert back to weld
County, Colorado.

VISION CARE SERVICES CONTRACT
This contract executed at Greeley, Colorado this 17th day of
January , 19 73 , by and between the Board of County
Commissioners of Weld County, Colorado, hereinafter called the County, and
the Optometrists and Ophthalmologists of Weld County, hereinafter called
the Association.
WITNESSETH:
That in consideration of the mutual promises and obligations and other con- .
siderations herein expressed, it is mutually agreed until December 31, 1973
that:
1. All eyeglass services shall be provided by prior authorization in writing
by the Weld County Department of Public Welfare.
2. Glasses are to be provided for children of recipients of Aid to Dependent
Children assistance, children of General Assistance recipients, children
in foster home care, and for adults in cases of necessity where funding
allows.
3. The fee for examination is established at $12.00; the County to pay $10.00;
the patient to pay $2.00.
4. The cost of lenses is to be determined by a standard lens service fee of
$5.00 per pair for single vision lenses, $7.00 per pair for bifocal lenses,
and S9.00 per pair for tri-focal lenses plus laboratory prescription prices
for lenses from the current Bausch and Lomb price list.
5. The cost of frames is to be determined by a standard frame service fee of
$5.00 plus actual laboratory cost of the frame from the manufacturer's cur-
rent price list. If a lower priced frame is used, the County will be billed
the lower cost. If a higher priced frame is used, the patient will pay the
additional laboratory price over $3.00.
6. Temples and minor frame repairs not exceeding $5.00 in cost are to be billed
at customary charges. Lens and frame replacements are to be billed as stated
in paragraphs four and five.
7. The patient is to pay 15 per cent, to the nearest dollar, of the lens and
service fees and material costs.
8. The exceptions to the above 15 per cent to be paid by the patient are wel-
fare children in foster care homes and for repairs and lens and frame re-
placements.
9. All patient fees must be paid by receipt of the lenses and frames.
10. A committee consisting of representatives of the Optometric and Ophthal-
mological professions will recommend policies and initiate procedures of
the Program and will review the billings and adjudicate any unusual fees.
Billings will be adjudicated quarterly the first three quarters of the year
• and monthly the fourth quarter of the year. This committee will furnish a
semi-annual report of expenditures of funds in detail to the County Welfare
Department and the County Commissioners.

hereinafter called the County, and the Weld County Medical Society, hereinafter called II Society.
WITNESSETH:
That in consideration of the mutual promises and obligations and other considerations
herein expressed, it is mutually agreed until December 31, 1973, that:
IF
1. The Society shall render or cause to be rendered by members of the Weld County
Medical Society all necessary medical and surgical services for the County indi-
gent who are sick or injured, except cases which must be hospitalized. The in-
digent groups to be cared for will be those not covered by Medicaid, namely Gen-
i eral Assistance and medically indigent patients, and any other indigent not
covered by Medicaid. er gen group __

2. The fee schedule used will be the same as that published for State Medicaid

patients.
3. The County for its patients will furnish all other necessary surgical supplies
and medicines on prescriptions written by the doctor, under such instructions
and restrictions as the County may from time to time direct.
4. The Society will appoint an Administrative Committee to assist in checking
bills for drugs and supplies and services, if requested.
5. The County will furnish all necessary hospitalization for patients certified
as County cases. The Society agrees to perform the laboratory and X-ray out-
patient work at the hospital, and not in the doctor's office, except by ad-
judication.
6. The Society will appoint its own committee, which committee shall be empowered
to make all other needed arrangements to properly administer and conduct the
business of the Society under this contract. The decision of this committee
shall be final and binding to all doctors participating in this contract. It
is exnressly understood, however, that any member of the Weld County Medical
Society may he present at any meeting of the committee.
7. The participating physicians will bill the County Department of Public Welfare
I by the 10th of the month following the month of services. The County Depart-
ment of Public Welfare will audit the billings to determine whether they are
for certified cases. All billings for services not included within the estab-
lished medical fee schedule will be referred to the Administrative Committee
for adjudication.

The billings will be submitted on vouchers supplied by the County Welfare De-
partment. When physicians are in a group situation, a bill will be submitted
to their own bookkeeping department, and they in turn will submit the total of
these bills on one voucher to the Welfare Department. Payment is to be made
directly to the physician.
The anesthesiologist will submit vouchers to the same denartment as do other
physicians.
8. Any participating physician suspected of irregular bills or falsification of
his records may be disqualified from participating in the Contract by the Ad-
ministrative Committee.
9. The County will furnish ambulance service when necessary.
10. Dental services are not included in this Contract.
11. It is further agreed that if any member of this Society refuses to give
medical attention to a County patient, the head of the Welfare Department
or the County Commissioners reserve the right to call any member of the Ad-
ministrative Committee who will see that proper service is rendered.
12. The Society will, so far as it lies within the power of its members, see
that proper medical care and service is rendered to all indigents of Weld
County not covered by Medicaid.
13. The County agrees to pay the Staff designated by the Society the sum of
Five Hundred Dollars ($500.00) per month for all necessary medical and
surgical care of indigents confined in the Weld County General Hospital,
and the Staff also agrees to give all necessary medical and surgical care
in the hospital outpatient clinic to all welfare patients who are inmates
of the County jail. It is emphasized that this money is not to be used to
compensate physicians, but it is to be used for scientific and educational

14. It is mutually agreed that should the County lease the weld County General
Hospital to any organization for management and operation, the provisions
contained in Paragraph Number 13 will be non-effective at the end of the
calendar month during which the Society receives notice thereof, but said
notice shall not be less than ten days before the end of the month.
