HomeMy WebLinkAbout720578.tiff County Commissioners Weld County Court House Greeley, Colorado 80631 Dear Commissioners: Pursuant to your request that the Sheriff's Review Board submit a written summary of their activities, the following is submitted: As you know, we submitted a 183-page report to your Board recom- mending various hiring and promoting procedures for the Sheriff's office, training and education procedures, promotion and administrative recom- mendations, and finally recommending pay raises for all deputies who could qualify under these recommendations, of better than $100.00 per man. On December 10, 1971 in a letter to me, Ivan Gilbaugh, Chairman of the Weld County Sheri££'s Review Boards, Sheriff Richard Martinez stated, "it is after careful and fair consideration that I, as Sheriff o£ Weld County, do hereby accept and approve the Committee's Recommenda- tions with very few minor exceptions, which will be mentioned at the next Board of County Commissioners Meeting." As you recall, at the next meeting, Sheriff Martinez made a few grammatical and semantic changes and at that meeting did accept the entire 183-page Committee proposal. I have attached a copy of that letter to this report. Shortly thereafter, your Board appropriated $40,000.00 for implemen- tation o£ this entire program conditioned upon the acceptance o£ the Sheriff and his department of the Committee's entire proposal. I have attached a copy of your resolution to this report. Subsequently, all Sheriff's deputies were administered the SCAT and MMPI tests by the University of Northern Colorado. These tests were graded and interpreted by the testing and counseling department of the University o£ Northern Colorado and were orally interpreted to our Sheriff's Review Board by Dr. David Smart of that department. Each member of the Board graded each deputy on the Review Board Grade Sheet, a copy o£ which is attached hereto. As you will note, there are ten separate categories on that grade sheet and each of the ten categories is worth a possible ten points. Each member of the Review Board gave each deputy a total score ranging 1 to 100, and all of the Review Board's final grades were then averaged for each deputy. The SCAT and MITI tests therefore only carried &weight of 10 percent each as did each o£ the remaining 8 categories. The total average percentages of the 27 deputies were as follows: 54%, 57%, 75%, 57%, 43%, 68%, 92%, 81%, 62%, 45%, 57%, 57%, 28%, 38%, 61%, 62%, 62%, 52%, 60%, 43%, 91%, 78%, 46%, 52%, 37%, 48%, 41%. The SCAT percentile band scores as administered and graded by UNC for the 27 deputies are as follows: 1-4, 5-8, 48-62, 32-42, 1-4, 99-99.3, 55-68, 37-48, 62-74, 3-6, 5-8, 0-0.8. 3-6, 7-12, 16-24, 68-80, 14-20, 8-15, 32-42, 9-18, 74-84, 37-48, 0, 7-12, 28-37, 28-37, 2-5. The MMPI evaluation scores as administered, graded and interpreted by UNC for the 27 deputies were as follows: average to below average, low average, average, low average, average, average to below average, above average, high average, below average, below average, below average, average to above average, below average, below average, below average, low average, average, average, average, below average, above average, above average, average to below average, average to below average, average, average to above average, average. The Sheriff's Review Board also considered the applications as com- pleted by the 27 deputies in their final score also. The Sheriff's Review Board also unanimously endorsed a proposal to ask the LEAA for $35,000 to finance a major crime unit for Weld County. As chairman o£ the Review Committee, I discussed with the sheriff the establishment of the major crime unit on three separate occasions; and on all occasions, the sheriff refused to cooperate in developing such a unit. On January 20, 1972, the Sheriff's Review Board sent a letter to the -3- Sheriff requesting that he endorse this proposal and the Sheriff never responded to this request. I am attaching a copy of that letter requesting endorsement from the Sheriff to this report. Finally on February 3, 1972 (See Minutes of Sheriff's Review Board of same date attached hereto the Board unanimously agreed that all deputies scoring 61% or better in total average percentage were qualified and should be retained; all deputies scoring 51% to 60% total average percentage should be placed on probation for a period o£ six months in order to qualify for permanent employment, and all deputies scoring 50% or below total average percentage were not qualified and should not be retained in the Sheriff's Department. There were eight deputies recommended not to be retained, there were eight deputies recommended to be placed on probation, and there were eleven deputies that were recommended to be retained. This information was sent to Sheriff Martinez in a letter dated February ¢, 1972. That letter is attached hereto. On February 10, 1972, the Sheriff's Review Board met with Sheriff Richard Martinez. At that time the Sheriff indicated that he would not comply with the recommendations of the Board concerning dismissal of the eight deputies. The Board then and there decided that there was no use in further wasting their time and efforts whereinupon the Review Board met with the County Commissioners on that date and requested the Committee be disbanded, a copy of the minutes of that meeting are attached hereto. As you may recollect, I had discussed and made such a proposal to the Board of County Commissioners on previous Budget Hearings, Nevertheless,% I have strived in these phases to continue my duties as Sheriff, based upon fairness to the people of Veld County, to do my best by establishing the Law Enforcement necessary to control one of our nation's major problems, Crime. Therefore, it is after careful and fair consideration that I, as Sheriff of Weld County, do hereby accept and approve the Committee's Recommendations with very few minor exceptions, which will be mentioned at the next board of County Commissioners Meeting. I wish to thank and congratulate the Committee for their interest, time and tremendous job on their sincere recommendations. We are most certainly fortunate to have such dedicated citizens, Robert A. Miller, Barton Buss, George Miller, Clyde Bennetts and you, Mr. Gilbaugh, of Weld County on this Committee. It is my hope and wish that the Board of County Commissioners also approve these Committee Recommendations in the interest of all concerned citizens of Weld County. Martinez Weld County Sheriff ' s Office Greeley , Colorado Dear Rich : As you know , a proposal has been made by the Weld County • Peace Officers for an LEAA grant for a major crime unit for this area. This major crime unit , in accordance with the written proposal which you have would assist All law enforcement • agencies in our county , upon request , and would aid and supervise major crimes . Along with the personnel assistance would go various equipment such as finger printing and photography equipment. The grant would total approximately $35 ,000 and we have sufficient reason to believe that the money is available if we , act promptly . This is the same proposal I have talked with you frequently about and expressed to you a personal interest in. I have this day brought this proposal before the Sheriff 's Review Board and they have voted to wholeheartedly endorse this proposal and accordingly would request a letter of support for this proposal from you at your earliest convenience . Ver t my yours vaY' ri Gilbaugh, MEETING OF SHERIFF'S REVIEW BOARD February 3, 1972 The meeting was called to order by the Chairman Ivan Gilbaugh at 3:00 p.m. , on Thursday, February 3, 1972. Members present: Ivan Gilbaugh, George Miller, Robert Miller, Guy Elliott and Barton Buss. After lengthly, loud, and heated discussion concerning information being discussed that was untrue and confidential , it was decided to let bygones be bygones and that all information will be released by no individual , but through the Board and when the truth is told, it will be no problem to remember what you said. Motion by Robert Miller, seconded by George Miller to recommend to Sheriff Martinez that all deputies with 61% or above total average percentage shall be considered qualified deputies and should be retained on the Weld County Sheriff's Department; all deputies scoring 51%-60% total average percentage should be placed on probation for a period of six months and in order to qualify for permanent employment, the probationary people should consult with the training officer to establish the program, similar to the testing and training program of a recruit deputy and upon satisfactory completion will be placed on permanent status; all deputies scoring 50% or below total average percentage are not qualified and should not be retained on the Weld County Sheriff's Department. These recommendations are made in accordance with Section II, paragraph E, pages 28 and 29, of the Review Board Recommendations. Further that Guy Elliott be excused from voting because of insufficient background. Roll call vote: Ayes - Robert Miller, George Miller, Barton Buss and Ivan Gilbaugh. Nayes - none. Motion carried unanimously. Motion by Robert Miller, seconded by Barton Buss to attach a listing by name of the deputies to be retained, those on probation and those to be not retained, to the letter to the Sheriff outlining the recommendations in the previous motion. Roll call vote: Ayes - Robert Miller, George Miller, Barton Buss and Ivan Gilbaugh. Nayes - Guy Elliott. Motion by Barton Buss, seconded by Robert Miller to recommend to the Weld County Commissioners implementation and adjustment of the salary schedules as recommended by this Board for all qualified deputies, retroactive to January 1 , 1972, due to the fact that these raises should not be considered a 27% raise, but a complete reclassi- fication of all jobs with new qualifications and requirements for all deputies. Motion carried unanimously. There being no further business, the meeting adjourned at 6:45 p.m. , with the next meeting to be held Friday, February 4th, at 1 :00 p.m. Barton Buss MEETING OF SHERIFF'S REVIEW BOARD February 10, 1972 The meeting was called to order by the Chairman Ivan Gilbaugh at 2:00 p.m., on Thursday, February 10, 1972. Members presents Ivan Gilbaugh, Bob Miller, George Miller and Barton Buss. Members absent: Guy Elliott. Also present was Richard Martinez. The purpose of this meeting was to consider 1972 monthly salaries for qualified deputies in the Sheriff's Department. Sheriff Richard Martinez indicated that he would not comply with the recommendations of the Review Board concerning dismissal of eight deputies. The Board decided there was no use in wasting further time and a meeting was arranged with the Weld County Commissioners. At this meeting, Board Members informed the Commissioners that a lot of time had been spent concerning recommendations that have been made, and since the Sheriff would not comply, the Committee had served its purpose and accomplished very little, and there was no use in wasting further time; the committee should be dismissed. The County Commissioners will make a decision on this matter next Wednesday, February 16, 1972. There being no further business the meeting was adjourned at 4:05 p.m. Barton Buss Hello
