RE: APPROVE AMENDMENT #1 TO INTERGOVERNMENTAL AGREEMENT FOR
FUNDING OF CAPITAL IMPROVEMENTS ON EAST COUNTY LINE ROAD/COUNTY
ROAD 1, AND AUTHORIZE CHAIR TO SIGN - BOULDER COUNTY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Amendment #1 to the Intergovernmental
Agreement for Funding of Capital Improvements on East County Line Road, aka County Road 1,
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and Boulder
County, with further terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Amendment #1 to the Intergovernmental Agreement for Funding of
Capital Improvements on East County Line Road, aka County Road 1, between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Department of Public Works, and Boulder County, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 21st day of December, A.D., 2022.

PASS -AROUND TITLE: IGA Amendment #1 between Boulder County and Weld County for WCR 1 and
WCR 20.5 Roundabout Design

Brief description of the problem/issue:
Attached is the Amendment #1 for the Boulder/Weld County IGA and signed by Boulder County. The BOCC
signed the original IGA with Boulder in 2021. This IGA identified Boulder County and Weld County evenly
sharing in the engineering design cost (50/50) for the roundabout at CR 1 (East County Line Road) and CR
20.5. During Boulder County's consultant selection process, it was apparent the $360k each agency originally
agreed to (Boulder and Weld) would not be enough to complete the design. Therefore, Boulder County is
requesting both entities to increase their portion by $140k with a $500k not to exceed amount for Weld County.
Therefore, the total amount for the contracted design is $1 million to be split evenly ($500k Weld and $500k
Boulder). Atkins was the Engineering firm selected by Boulder County to perform the design. Also attached is
the original 2021 IGA for reference. The County Attorney's office has reviewed and approved the amended
IGA.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options):
• Allow the attached Agreement to be placed on the next available BOCC agenda for signature.
• Request a work session to discuss.
Recommendation:
Staff recommends approval of the amended agreement as written.

First Amendment to Intergovernmental Agreement
between Boulder and Weld Counties
Concerning Funding of Capital Improvements on
East County Line Road / Weld County Road 1
Thisirst Amendment to Intergovernmental Agreement (the "Amendment") is entered into
as of the lirday of Urc niacv , 2022, by and between the County of Boulder, a body corporate
and politic of the State of Colorado ("Boulder County" or "Boulder"), and the County of Weld, a
body corporate and politic of the State of Colorado ("Weld County" or "Weld") (each a "Party"
or, collectively, the "Parties").
RECITALS
WHEREAS, the Parties entered into that certain Intergovernmental Agreement concerning
funding of capital improvements on East County Line Road / Weld County Road 1, dated A_ uust
18, 2021 (the "IGA"), for the purpose of funding certain improvements to East County Line Road/
Weld County Road 1, a roadway shared between the two Parties; and
WHEREAS, the Parties wish to amend the IGA to increase the not to exceed amount for
design of the Capital Improvements; and
WHEREAS, the Parties have followed the procedure required for each to enter into this
Amendment.
AGREEMENT
NOW THEREFORE, in consideration of the above and the mutual covenants and
promises set forth herein, the receipt and sufficiency of which is hereby acknowledged, the Parties
agree as follows:
A. Section A (2) of the IGA be updated to read as follows_
Boulder will invoice Weld for fifty percent (50%) of the contracted design cost, less
any outside contributions, not to exceed $500,000 (five -hundred thousand dollars and
00/100 cents), upon execution of this First Amendment. Neither the invoiced costs nor
the payment will include any payroll costs or cost of right-of-way acquisition. Weld
shall pay all design invoices from Boulder within sixty (60) days of receipt of the same.
B. Except as expressly amended herein, all other provisions of the Agreement, exhibits,
and appendices are unaffected and shall continue in full forces and effect in accordance
with its terms
