S ince this permit was granted pursuant to the prior zoning which was faulty and subsequently corrected on December 29 , 1976 , by the filing and recordation of the Official Zoning Map and Resolution , it is my opinion that the 70 , 000 turkey limitation cannot be enforced by Weld County . In the event that a limitation is considered by the Board of County Commissioners in the future , I would recommend that an amendment to Special Use Permit # 118 be considered by the Board after following the procedures of the Zoning Ordinance concerning amendments to S pecial Use Permits . Turkey Farms , Inc . , 3758 Osage Street , Denver , Colorado , requesting permission for expansion of an existing turkey farm operation on the follow - ing described property , to -wit : North - half ( N 1 /2 ) of Section Twenty - One ( 21 ) , Township Twp ( 2 ) North , Range Sixty - seven ( 67 ) West : the East - half ( E 1 /2 ) of the Northeast Quarter ( NE 1 /4 ) of Section Twenty ( 20 ) , Township Two ( 2 ) North , Range Sixty - seven ( 67 ) West of the 6th P . Weld County , Colorado , and WHEREAS , the petitioner was present , and WHEREAS , there was no opposition to the request of petitioner for the expansion of an existing turkey farm operation , and WHEREAS , the said requested expansion of an existing turkey farm operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution , and WHEREAS , according to Section 3 . 3 ( 3 ) of the Zoning Resolution of Weld County , said turkey farm operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County , and WHEREAS , the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission , and having been fully informed ; NOW , THEREFORE , BE IT RESOLVED by the Board of County Commissioners , that the application of Leonard Strear dba S . L . S . Turkey Farms , Inc . , 3758 Osage Street , Denver , Colorado , for expansion of an existing turkey farm operation on the premises indicated above be , and it hereby is granted under the conditions following : 1 . That any water and sanitation facilities to be installed shall be approved by the State Health Department . 2 . That petitioner shall proceed with due diligence to expand said existing turkey farm operation and that he shall have up to one year from date hereof to begin construction for the expansion thereof . 3 . That when completed said turkey farm operation shall not be expanded to more than 70 , 000 turkeys at any one time . 4 . That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County , Colorado . ( b ) A complete and accurate legal description of the prop - erty . The legal description must be acceptable to the County Attorney , and no Special Use Permit case can be scheduled until such legal description is provided . ( c ) A soil survey of the site proposed for the special use . ( e ) With any of the following uses a WASTE INVENTORY form n eeds to be filled out , cattle , sheep and swine feed lots , chicken and turkey farms , kennels or any other o peration that confine any number of animals which may cause pollution or a nuisance . ( f ) A petition form is supplied for the purpose of gaining support of the proposed use by land owners within 500 ' o f the site . Having your neighbors approval is not man - datory , but all surrounding land owners are notified by certified mail of the County Commissioner ' s hearing and are invited to attend to make comment on the proposed use . On the reverse side of the form the names of all adjacent land owners within 500 ' are to be supplied . If the site is a part of a larger parcel owned by the applicant , the applicant will provide the list with re - spect to the outer boundary of the 1 araer parcel . This information can be found in the County Assessor ' s office . ( g ) The Special Use Permit application shall be signed by the fee owner ( s ) of the parcel of property to be con - sidered for a special use , or by a duly authorized legal agent of said fee owner ( s ) .
