DEVELOPMENT STANDARDS
HIGH SIERRA WATER SERMCES, LLC, CIO NGL WATER SOLUTIONS DJ, LLC
3MJUSR 18-07-1654
1. The Site Specific Development Plan and Amended Use by Special Review, USR14 0081 (fonnery known as
MUSR11-0004), for Mineral Resource Development Facilities, Oil and Gas Support and Service (Class II
Oilfield Waste Disposal Frailty - salt water Injection alley, water mewling, a buck tanker washout facility,
mesas soles processing facility and a tank storage area with confinement) In the A (Agricultural) Zone Districts
as indicated in the application materials on tile and Subject to the Development Standards stated hereon.
Approval of this plan may create a vested properly right pursuant to Section 23-0.0 of the Weld County Code.
No disposal of waste. other than Class II, as currently defined by the Environmental Protection Agency. Is
permitted. Any changes from the approved Class II Use will require en amendment to the Use by Special
Review Perm*.
4. Al liquid wastes received at the facility shall be unloaded on the unloading pad. The unloedingneading pad
leak detection system shall be constructed and operated In accordance elfin the approved design. The
unloading pad shall be cleaned eta frequency that prevents oils end other wastes from bulldog upon the pad.
During whiter months, the facility shall maintain the unloading pad free of ice.
5. leash d waste data and environmental monitoring data shall be made avaflable to the Weld County
Department of Pudic Health and Environment (WCOHE), upon request. The WCDHE reserves the right to
require additional monitoring.
6. All liquid and solid wastes (as defined In the Solid Wastes Disposal Sites and Facilities Ad, Section
30.20100.5, C.R.SJ shall be stored and removed for final disposal in a manner that proteda against surface
and groundwater contamination.
7. No permanent disposal of wastes shall he permitted at this site. This is not meant to include those wastes
specifically excluded horn the definition of a sold waste in the Solid Wastes Disposal Sites and Facilities Ad,
Section 30-20-100.5, C.R.S.. or those wastes outlined in the approved Engineering Design and Operation Plan
(EDOP).
e, Any stained or contaminated soils on the facility shall be removed and disposed of in accordance with
applicable rules and regulations. All spills 0411 be documented and records will be kept on-alle for WCDPHE
review upon request. Al spins will be reported to local, state and federal agencies In accedence with all state
and federal regulations.
9 Any vehicle or equipment washing areas shall capture all effluent and prevent discharges In accordance with
the rules and regulations of the Water Duality Control Commission, and the Environmental Protection Agency.
10, All tanks will be labeled In accordance with Colorado Oil and Gas Conservation Commission and National Fire
Protection Association (NFPA) requirements.
11. The facility shall comply with the approved Groundwater Monitoring Plan. Groundwater monitoring and leak
detection resultswtll be mooned to WCDPHE In accordance with the Groundwater Monitoring Plan reposing.
12. All stotmwaler which has come into contact with Wass materials on the ails, shall be confined en the site. In
the event the storm water is not adequately controlled on the site, upon written notification from Es WCDPHE
or Colorado Department of Public Health and Environment (CDPHE), a comprehensive altewlde Stormwaar
Plan shall be developed or amended and implemented. Al contaminated saes shall be Covered and stored on
an impervious surface to prevent and contain same water that may come into contact Wm the solids. The
Sanmvda Plan must be approved, in writing, by the WCDPHE or CDPHE, prior to implementation.
13. Waste materials shall be handled. sated, and disposed of In a manner that controls fugitive dust. fugitive
palalete emissions. blowing debris, and other potential nuisance conditions. Laboratory wastes Mil not be
disposed of in the fadlily's septic system. The fadllry shell operate In accordance wth the approved Waste
Handling Plan, at all times,
14. The facility shall operate in accordance with the CDPHE approved Design end Operations Plan(s). The facility
shall recycle at lead 75% of the total waste weight or volume processed d lose solids processing facility and
water beet neat and conditioning (recycling) facility. Should the facility not recycle 75% of the nelelal, en
amendment 10 this Use by Special Review Permit or a Certificate of Designation may be required. A copy of
the annual Recycling Facility Annual Reporting Forn shall be submitted to the CDPHE and the WCDPHE by
March 1st of each year.

16. Fugitive dust and fugitive particulate emissions shall be controlled on this Ma. The facility shall operate in
accordance with the approved Dust Abatement Plan, at all times.

delineated in Section 14-9-30 of the Weld County Code, or with all applicade state noise .lutes and/or
regulations.
18, Adequate dnnOng. handoashing and toilet facilities shall be provided for employees and patrons of En fadilty,
at all times. If employees or contractors are on -Site for less than Mn (2) consecutive hours a day, or less than
two (2) full-time employees are on_she, portable toilets and bottled water are adaptable. Records of
maintenance and proper disposal for portable toilets shall be retained on a quanedy bads and amiable for
review by the Weld County Department of Public Health and Environment. Portable tenets shall be serviced by
a cleaner licensed In Weld County and shall contain hand senthzers.
19. Sewage disposal for the facility shall be by septic system. Any septic system located on the propady must
comply wit all provisions of the Weld County Code, pertaining to Oh ells Wastewater Treatment Systems.
20, A permanent, adequate weber supply shall be provided for drinking end sanitary purposes. The fediiy shall
utilize the private water supply.
21. All potentially hazardous chemicals must te handled in a safe manner In awardame with product labeling and
Ina manner that minimizes the release of Hazardous eir Pollutant (HAPs) and Volatile Organic Compounds
(VOCs). All chemicals must be stored severely, on an impervious surface, and In accordance with

Works to determine if roadway Improvement triggers have been met.

32. Buildings, equipment and structures shall conform to the requirement of the various codes adopted at the

Codas, 2006 International Energy Cade, 2012 International Fuel Gas Coda, 2011 National Electrical Code,
2009 ANSI 117.1 Aacassidlty Code and Chapter 29 of the Weld County Code.

the activities carded oat on the property comply with the Conditions of Approval and Development Standards
stated herein and all applicable Weld County regulations.
35. The Use by Special Review area shell be limited to the plans shown hereon and governed by the foregoing
Standards and all applicable Weld Court/ regulations. Substantial flanges from the plans or Development
Standards, as shown or sated, shall require the approval of an amendment of the Permit by the Weld County
Board of Courtly Commissioners before such daltges from the plans or Development Standards are
permitted. Any other changes shag be tiled to the office of the Department of Planning Services.
36. The properly comer or operator shall be responsible for complying w)h all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of
the Permit by the Board of County Commissioners.
