Section 3211 BASIC ADMINISTRATIVE PROVISIONS
1. Scope and Applicability_ This handbook sets forth the detailed
provisions incorporated by reference within the "General Provisions
for Cost-Reimbursement Type Contracts and Grants" issued by the
United States Department of Labor, Manpower Administration (MA).
Basic procedures are provided herein for acquisition, administra
tion, and disposition of Government personal property furnished to a
grantee or to an MA contractor under all cost-reimbursement and
grant-type contracts under authority of the following:
a. Manpower Development and Training Act of 1962, as
amended.
b. Economic Opportunity Act of 1964, as amended, for which
Government property is authorized the MA contractor under Part A,
Title I.
C. Civil Rights Act of 1964 (P. L. 88-352), as redelegated by
Secretary of Labor's Order No. 9-68.
d. Social Security Act, Part 1, Title I, Section 204. Work
Incentive (WIN) Program.
2. Responsibilities. Delegation of further responsibilities is as
follows:
a. Department of Labor Responsibility. The U. S. Department
of Labor, Manpower Administration, is responsible for the develop-
ment, implementation, and supervision of national manpower policies,
training centers, and programs authorized under authority of legis-
lation referred to in paragraph 1 above.
b. MA Authority. MA Order 4-69, issued under authority of
Secretary's 15-69, delegates contracting officer authority for the pro-
curement of program-oriented property and services required to
fulfill the statutory and regulatory responsibilities delegated to the
Assistant Secretary for Manpower.

c. Administration of Government Furnished Property. Under
the direction of the Manpower Administrator, the Associate Manpower
Administrator for Management and Administrative Systems is delegated
authority and assigned responsibility for the administration of Govern-
ment-furnished property in the possession of contractors, grantees,
and sponsors. The Government-furnished property shall be admin-
istered through the Office of Administrative Services, Office of
Management and Administrative Systems. The Director of the Office
of Administrative Services is designated as the MA Property Officer.
He is responsible for:
(1) Carrying out a comprehensive Federal property manage-
ment program.
(2) Insuring compliance with contract provisions relating to
property.
(3) Insuring that Government property is properly acquired,
maintained, used, and disposed of in accordance with Federal Property
Management Regulations.
3. Definitions_. The responsibilities of key personnel and the mean-
ing of certain basic terms as used in this handbook are defined below.
a. Contracting. Officer. The contracting officer is the individ-
ual duly authorized to enter into, execute, and administer contracts
on behalf of the Secretary of Labor. The term "contracting officer"
includes in its meaning a grantor.
b. _Contractor. For purposes of the MA property management
system, a contractor is the individual, firm, or organization (public
or private) with which the Department of Labor enters into a binding
legal agreement. The term "contractor" includes a grantee under a
Federal grant (including a State employment security agency grant) and a
sponsor of a Neighborhood Youth Corps project or other projects ap-
proved by the Department of Labor. Each Civilian Conservation
Center shall be treated as an individual contractor. The contractor
is accountable for all Government property in his possession until

relieved of his responsibility in accordance with the contract and Man-
power Administration regulations or interagency agreements, as
applicable.
(1) Prime Contractor. The individual, firm, or organiza-
- Lion (public or private) directly responsible to the MA contracting
officer for all phases of development and operation of an MA training
center or MA program.
(2) Subcontractor. The individual, firm, or organization
directly responsible to the prime contractor for the performance of
specific phases of an MA training center or MA program in accordance
with the terms of an agreement between the parties.
c. Grantee. An individual, firm, or organization (public or
private) to whom the Government grants money and/or property, as
available, in return for which the grantee agrees to provide certain
specified services for or within a specific period (or periods) of time.
d. Sponsor. An individual, firm, or organization (public or
private) whose agreement combines into a single contract responsibility
for several major programs during its span of activity under author-
ity of two or more major pieces of legislation, such as EOA, MDTA,
SSA among others. He may or may not personally conduct all the pro-
grams involved, but he is responsible for proper fulfillment of all
pertinent obligations to the government on the part of another (such as
his subcontractor under a particular MA contract, et al).
e. MA Property Officer. The MA property officer is the MA
representative responsible for Manpower Administration property
management. He provides guidance and assistance to MA personnel
and contractors in acquiring, controlling, and maintaining Government
property, including final certification and disposal of property in the
possession of contractors. No contract, grant, or agreement
containing property provisions may be executed at the national level
unless the property provisions have been approved by him.
f. MA Project Officer, The MA project officer (monitor, project
manager, etc. ) is the Department of Labor representative for liaison

with the contractor throughout the contract period. He reviews
the contractor's initial and subsequent property (supplies and equip-
ment) requirements during the period of the contract. On matters per-
taining to the acquisition of property, he refers the contractor to the
Manpower Administration property officer or regional contract property
officer, as appropriate.
g. Regional Contract Property Officer (RCPO). The RCP° acts
for the MA property officer in a designated region and is responsible
for administering the activities concerned with the acquisition, control,
and disposition of Federal property approved for use under agreement
with sponsors operating WIN, CEP, OJT, NYC, Mainstream and
other manpower programs. He is the principal advisor to the Regional
Manpower Administrator and the program specialist in all matters con-
cerning contractor property management. He is responsible for
reviewing property provisions of all MA contracts and agreements,
participating in contract negotiations having property provisions,
approving property provisions of all contracts and agreements prior to
their execution. No contract, grant, or agreement containing property
provisions may be executed at the regional level unless the property
provisions have been approved by him. Taking into consideration the
property specifications, project objectives, and enabling legislation,
the RCP() determines appropriate sources for acquiring property. The
RCPO provides guidance, leadership, and advice to contractors in the
appropriate utilization and control of properties acquired under contract
provisions and in establishing and maintaining property accountability
systems and operations. This includes the review and execution of all
contractor property management system input forms as well as the
dissemination of such system output listings to the contractor.
h. Federal Supply Service Officer (FSSO). The FSSO is a
representative of the General Services Administration (GSA) Federal -
Supply Service (FSS), in a designated geographical area. He advises
and assists authorized contractors and MA project officers concerning
the procedures necessary to purchase supplies and equipment through
GSA supply sources.

i. Property Management and Disposal Services (PMDS)
Officer. The PMDS officer is a representative of GSA, Property
• Management and Disposal Service, in a designated geographical area.
He advises and assists authorized contractors and MA project officers
in the acquisition of equipment from excess property sources.
j. Government Property. This term means all property fur-
nished by the Government or acquired with Federal funds by the con-
tractor for use in the performance of his contractual obligations.
Title to such property is always vested in the Government. Govern-
ment property made available to contractors is classified as either
real or personal property.
NOTE: The word "Government" in this handbook means the Federal
Government.
k. Personal Property. This term includes:
(1) Nonexpendable and MA Reportable Property. These
terms refer to the following: items of personal issue (regardless of
cost), furniture (regardless of cost), tools (regardless of cost), and
all other property having a unit acquisition cost of $50 or more.
(2) Expendable Property. Supplies and materials which are
consumed or lose their identity in contract performance or have an
expected life of less than 1 year are classified as expendable. Expend-
able property includes pens, paper, pencils, typewriter ribbons, etc.
(3) Residual Materials and Property. All serviceable mat-
erial not consumed in the performance of a contract, and all unser-
viceable or scrap equipment not consumed in the performance of a
contract is classified as residual materials or property.
1. Real Property. Parcel or parcels of land and/or land with
structures located thereon and appurtenances thereto, under control
of any Federal agency.

m. Holding Agency. A holding agency is the organization (mili-
tary or civilian), firm, contractor, or other duly authorized organ-
ization in possession of excess Government property, either as a
storage facility or as a prior user of such property.
n. National Contract. A national contract is a contract that is `
executed at the national level and may operate across regional lines.
Property for national contracts is administered directly by the MA
property officer.
o. Regional Contract. A regional contract is a contract executed
at the regional level, the performance of which is confined to only one
region. Property for regional contracts is administered by the
respective regional contract property officer (RCPO) of the region.

Section 3212 RESPONSIBLE KEY PERSONNEL
1. Property Administration in General. The administrative functions
associated with acquisition and maintenance of Federal property by
Manpower Administration contractors are shared by the contracting
officer, the project officer, the MA property officer, the RCP°, and
the contractor himself. Each has the responsibility for ensuring that
Government property is properly acquired, used, maintained, pro-
tected, and accounted for. .Accounting for property means not only
recordkeeping, but also assistance as required and appropriate in
sustaining the needs of the computerized contractor property manage-
ment system, particularly as supported through use of the MA 3-28,
Inventory Transcription Sheet. Thus, a comprehensive process is
provided for the protection of the Government's interests in its prop-
erty. This section sets forth certain of these responsibilities and
outlines procedures by which physical and administrative control is
maintained over Government property, including requirements of
quarterly and final inventories.
2. Responsibilities of the MA Project Officer. The MA project
officer is the liaison between the contractor and his contracting officer.
The said project officer normally has the initial contact with the con-
tractor, develops the contract and administers the project. It is,
therefore, the responsibility of such project officer to be thoroughly
alert to the property requirements of the contractor in the early stages
of contract development and to changing needs as the project progresses.
The MA project officer shall:
a. Be thoroughly cognizant of the contract property clauses.
b. Review the type of equipment and supplies (training and office)
desired, and determine those required for project accomplishment.
He must sign the property requirement list (PRL).
c. Know how to contact the RCP°. (See paragraph 3 for
address).

g. On visits to contractor's facility, ensure that:
(1) All Government equipment obtained by the contractor
through his Manpower Administration contract is properly marked
with departmental decals, or stenciled with a legend from a depart-
mental decal. (Stencil markings are to be used only on equipment
subjected to weather elements, or where operational use of decals
is impractical. )
(2) Property records are being maintained in accordance
with the MA system detailed in section 3216 of this handbook.
(3) The contractor has furnished the RCPO or MA property
officer, as appropriate, with copies of all property transaction docu-
ments and associated MA 3-28 forms for all equipment transactions.

(4) The contractor has reported details to the RCPO on
MA 3-28 forms when the status of property has changed. This includes
physical conversion of property; creation, fabrication, or manufacture
of property; change of title of property; loss of property through theft,
damage, destruction or mysterious disappearance.
h. Take proper action with respect to recommendations of the
RCPO or the MA property officer relating to usage or control of
Government property.
i. Ensure that Government-furnished materials and supplies in
the possession of contractors are held to a minimum level needed for
contract performance and that excesses are reported immediately to
the RCPO or MA property officer, as appropriate.
j. Ensure that contractor is providing reasonable care for
Government-furnished property.

4. Responsibilities of the MA Property Officer. The MA property
officer, as the MA representative responsible for Government
• property, shall familiarize himself with the contract provisions per-
taining to Government property. He shall:
a. Participate in the negotiation of all national MA contracts
containing property provisions, provide guidance and assistance to MA
personnel concerning property provisions, and approve justified
requirements prior to execution of such contracts.
b. Explore excess property sources and provide guidance and
assistance to the RCP°, the project officer, and the contractor in
locating and obtaining approved requirements (supplies and equipment).
c. Examine property records maintained by contractors, ap-
proving or taking corrective action on contractor property control
procedures.
d. Maintain centrally controlled Government property records
for the Manpower Administration.
e. Provide guidance and advice to the RCP° and other MA staff
in property matters concerning contractor's eligibility and require-
ments.
f. Issue or have issued departmental identification decals.
g. Promptly issue instructions for disposition of property ac-
quired for use under contracts.
h. Review the use and handling of Government-furnished prop-
erty in the possession of contractors to ensure full utilization and
care in handling. He shall withdraw any property not essential for
contract performance.
i. Resolve problems which may arise concerning acquisition,
maintenance, disposal, and inventory accounting of Government
property.

j. Report any deficiencies in property administration to the
RCP°, contracting officer, and the contractor, and request correc-
tive action.
k. Take appropriate action in the event of Government property
loss resulting from theft, damage, destruction, or mysterious dis-
appearance.
1. As required, convene the MA Survey Review Board to deter-
mine extent of liability, if any, for losses resulting from theft,
damaged, destroyed, or missing Government property and advise
RCPO's and/or contractors of Survey Review Board findings.
m. Have computer listings of contractor-held property pre-
pared on a quarterly basis. Listings are to be by region, state, con-
tract, and location within contract, and are to be furnished to RCPO
and/or contractors as appropriate. Require annual certification of
property lists by all contractors, attesting that all property listed is
on hand and required in continuance of contract provisions.
n. Provide guidance and assistance in establishment and mainte-
nance of logistic support operations, and arrange for acquisition of
specialized industrial or heavy construction equipment by loan or
transfer from other Government agencies.
5. Responsibilities of the RCP°. The regional contract property
officer, in his geographical area of assignment, shall act for the MA
property officer and perform the following functions:
a. Participate in the negotiation of all regional contracts contain-
ing property provisions to provide guidance and assistance to MA
personnel concerning property provisions and approve justified
requirements.
b. Provide guidance, leadership, and assistance, as required,
to contractors in acquiring equipment and supplies for their contract
performance, and perform on site reviews and evaluations of con-
tractor's procedures, policies, and performance in logistical manage-
ment utilization and inventory of Federal property and supplies.

c. Review and process Standard Form 122, Transfer Order
Excess Personal Property, after approval by project officer.
d. Issue decals in ample supply to properly identify Govern-
ment-owned property.
e. As necessary, assist contractor to obtain a cash plate to
purchase from GSA self-service stores; assist in securing GSA motor
vehicle services; and provide GSA letters of authority for MA con-
tractors to use their services.
f. Under the direction of the MA property officer, promptly
issue instructions for disposition of property acquired for use under
contracts.
g. Advise and assist contractors, as required or requested, in
the maintenance of property records and inventory functions. It is
.. particularly important for the RCPO to ensure that the contractor
makes up unique document numbers in those rare instances where
none appeared initially on acquisition documents such as invoices,
purchase order forms, or loan/rental/lease agreement forms.
h. Every 3 months forward a copy of the computer-produced
inventory list of contractor-held Government property to contractors
in his (RCPO's) region. Annual certification of this list by the
contractor is required to ensure that the property listed is in the
contractor's possession.
i, Arrange for transfer of property between contractors when
property is excess to one contractor and is needed by another con-
tractor within the same region.
j. Keep the computerized file of contractors ' addresses current
by submission of Form MA 3-26.

k. Enter the transaction codes on all MA 3-28 inventory control
forms received from the contractor and verify:
(1) That a document number appears for every line item on
the form.
(2) That State and region codes are correct.
(3) That location codes are properly entered.
(4) That loan/rental/lease source agency codes are correct.
(5) That the form is properly signed and dated.
(6) That the contractors' address information is legible
and complete, including telephone number.
(7) That all the required information is present, legible,
complete, and recorded in red pencil.
(8) That source documents are included to support each
MA 3-28 line entry and verify same.
I. The RCPO must report to the MA property officer on DL
Form 1-45, complete with required police reports and contractor's
statement, including date and time of notification of the FBI, the
circumstances involving loss, damage, or destruction of Government-
owned property. The RCPO shall recommend remedial actions.

8. Responsibilities of the Contractor
a. The contractor will make known his property requirements
to the project officer in the early stages of project preparation and as
required to continue contract performance. He shall include his
categorized equipment requirement list with his project proposal.
b. The contractor has primary responsibility for exercising
reasonable care and control of Government-furnished property in
his possession and for maintaining property records in accordance
with section 3216 of this handbook. His use of Government-furnished
property must be only for the purposes set forth in the contract. He
remains accountable for all Government-furnished property in his
possession until relieved of that responsibility in accordance with the
terms of the contract. Responsibility for reasonable care and control
of Government-furnished property provided under the contract and in
the possession of a subcontractor remains with the prime contractor
until relieved by the MA contract officer, MA property officer, or
RCP°.
c. The contractor shall comply with all provisions of this
handbook.
d. The contractor shall complete Form MA 3-28, Inventory
Transcription Sheet, for each property transaction completed during
the life of the contract. Completed Forms MA 3-28, together with
source documents supporting each line entry, shall be submitted
within 10 days of the completion of the transaction to the MA property
officer or RCP°, as appropriate.

e. Within 30 days of receipt of the computerized inventory list
that has been designated as the annual inventory list by the property
officer or RCP°, as required by paragraph 9a, section 3216, of this
handbook, the contractor will certify the computerized inventory list-
ing and return it to the MA property officer or RCP°, as appropriate.
The certified copy of the listing should display the following statement
stamped, typed, or legibly printed:
"The items of property listed herein are hereby
reported to be in my possession and are certified
to be only those authorized for use in the perfor-
mance of contract number__

f. All Government equipment obtained by the contractor through
his Manpower Administration contract shall be properly marked with
departmental decals, or stenciled with a legend from a departmental
decal. (Stencil markings are to be used only on equipment subjected
to weather elements, or where operational use of decals is imprac-
tical. )
g. The contractor will structure his property controls within
the framework of the MA property management system so that lost,
stolen, or damaged property is immediately identified and reported
in accordance with section 3217 of this handbook.

Section 3213 SOURCES OF PROCUREMENT
1. _General Procedures. Supplies and equipment necessary for effi-
cient operations and maintenance of an MA training center and/or pro-
gram will be procured from the sources listed below and in the se-
quence listed. Any procurement of supplies or materials in quanti-
ties that would exceed 60 days' normal usage and all nonexpendable
and MA reportable property must be authorized by the MA property
officer or RCPO as appropriate. Procedures for approval of the
needed procurement are contained in section 3214 and procedures for
obtaining assistance from each of the sources listed are set forth in
succeeding sections of this handbook.
2. Federal Government Excess. The principle source of property
for MA contractors will be excess personal property obtained through
GSA. When required property cannot be obtained through GSA excess
other sources may be used. Excess personal property is an assem-
blage of property which has been declared excess to the needs of
^ various Federal agencies but is still serviceable and available for use
by other Federal agencies. In keeping with the policy of the President
and the Secretary of Labor on reducing procurement costs, MA con-
tractors shall utilize excess property inventories to the maximum
extent possible.
3. _Purch_ase from Government _Sources. When required property
cannot be obtained from excess, the sources to be utilized shall be
by purchase from one of the following:
a. GSA self-service stores .
b. GSA stores stock.
c. GSA supply schedules and supply/service contracts
d. Defense Supply Agency (DSA) ---- principally for food,
clothing, and medical supplies.

e. Veterans Administration (VA) --- principally for food and
medical supplies.
f. Public Health Service (PHS)- --- principally for medical
supplies.
Acquisitions from DSA, VA, and PHS are negotiated through the
GSA Federal Supply Service Office serving the contractor, the RCPO,
or the MA property officer.
4. Purchase from Non-Government Sources. Approved property
may be purchased from commercial sources after all of the following
conditions have been met:
a. Same or similar item is not available from excess.
b. Same or similar item cannot be purchased from Government
sources.
c. Delivery from Government sources cannot be cbtained
within the timeframe required for approved programs.
d. Delivered price of the same or similar item is the same or
less than from Government sources. In such cases, a cost compari-
son is to be documented and forwarded to the MA property officer or
RCPO. The cost comparison procedure is as follows:
(1) Solicit three bids from vendors, at least one of
which should be a minority-owned business, if possible.
(2) Forward copies of these bids with a purchase re-
quest to the MA property officer for national contractors, or to the
RCP() for regional contractors.
(3) Written approval to purchase (or disapproval) will
be sent to the contractor.

5. Rent or Lease and Lease-Purchase. The contractor cannot rent
or lease personal property from himself or any other activity in which
he has a vested interest or activity which has a vested interest in him.
Renting or leasing is a last resort and is usually the least economical
method of obtaining required property. Leasing with an option for the
Government to purchase at contract termination, or sooner, is pref-
erable to straight leasing. Neither renting or leasing or leasing with
the option to purchase is permitted without prior written approval by
the MA property officer or the RCPO, as appropriate.
One hundred and fifty days prior to termination of a lease-purchase
agreement, the contractor shall inform the MA property officer or
RCP°, as appropriate, of the terms and conditions under which the
option may be exercised, and request a determination to exercise or
not to exercise the option to purchase. Upon receipt of the notice
that a lease-purchase agreement vill expire, the RCP° or MA prop-
erty officer will review the conditions and terms under which the
option may be exercised and make a determination to exercise or not
exercise the option within 20 calendar days. When an RCP() makes a
determination not to exercise the option, he will forward a copy of
the option to the MA property officer for consideration by other MA
activities. If the option is not exercised by an MA activity within 100
days of the option termination date, it will be reported to GSA,
PDMS, for circulation to other Federal agencies. Options not exer-
cised by a Federal activity prior to the termination date will be
terminated by the respective contractor. In no case may the contractor
exercise the option to purchase for his personal gain.

Section 3214 PREPARING FOR PROCUREMENT
1 . Identifying Property Requirements. To facilitate timely acquisi-
tion of supplies and equipment for contractors while minimizing costs
to the Government, contractors should identify property requirements
during the early stages of negotiation. A Property Requirements List
(PRL), Form MA 3-41A, of supplies, materials, equipment, and ve-
hicles, should be submitted with the project proposal to the contract-
ing office (attention: Property Officer) setting forth requirements for
project performance when the contract is awarded. When the property
requirement list has been received by the project officer, it will be
forwarded with his comments to the respective RCP°, or MA property
officer for approval of justified requirements prior to execution of the
contract. If additional equipment is required during a contract period,
the contractor shall submit: his requirements on Form MA 3-41B,
through his project officer or officers or monitor or monitors and for
their recommendations. Form MA 3-41B and the recommendations
should be forwarded to the RCP° or MA property officer as appropriate.
2. Letter of Authority. A letter of authority shall be prepared that
permits the contractor to apply directly to GSA for approved equip-
ment and supplies, as indicated below:
a. National Contractors. For those performing under a national
contract, the MA property officer shall issue the letter of authority.
A copy of the letter of authority shall be forwarded to each of the

WIN sponsor is authorized to purchase work-related equipment for
WIN participants who cannot be placed in a job without such equipment.
Pursuant to section 435(b) of the Social Security Act, costs of carry-
ing out the WIN program include funding of training, supervision,
materials, administration, incentive payments, transportation, and
other items as are authorized by the Secretary of Labor. In particular,
up to a maximum of $150 of work-related equipment for WIN enrollees
may be provided if the equipment is required to obtain a specific job.

(1) Print or type all information legibly.
(2) Item No. is assigned to items listed by starting with
1 for first item listed, then 2 for the second, 3 for the third, etc.
This number can then be used later for referring to a particular item
of property.
(3) Multiply quantity by unit cost and record the result

Section 3215 PROCEDURES FOR PROCUREMENT
1. GSA_ Excess. GSA periodically publishes lists of available excess
personal property and also maintains unpublished information on ad-
ditional property. Information concerning this property may be ob-
tained from the PMDS officer, RCPO, or MA property officer. Ex-
cess property is acquired, generally, at no purchase cost; however,
the receiver of the property must pay any incidental packing, handling,
and transportation costs. The steps in obtaining excess personal
property are as follows:
a. During the final stages of project preparation, the MA
property officer or RCP() will advise the prospective contractor of
the GSA representatives in his area who will assist him in locating
desired equipment.
b, Immediately upon execution of a contract the contracting
officer for national contracts will forward a copy of the contract and
a co of the approved property requirements list to the MA property

officer. For all other contracts, a copy of the contract and of the
approved property requirements list will be forwarded to the RCPO.
c. Upon receipt of a copy of an executed contract, the MA
property officer or RCP°, as appropriate, will issue a letter author-
izing the contractor to utilize GSA supply sources in the acquisition of
supplies and equipment. Copies of the letter issued by the MA
property officer will be furnished to the national GSA-FSS and PMDS
offices and their regional offices. Copies of the letter issued by the
RCP() will be furnished to the regional GSA-FSS and PMDS. The
letter advises all concerned that the contractor is eligible to obtain
excess personal property and/or purchase personal property or
services from GSA supply sources,
d. The contractor must transmit copies of the property list
of items approved for project accomplishment to the Chief, Utiliza-
tion Branch, Personal Property Division, PMDS, GSA, in the GSA
regional office nearest him.

e. Items approved for acquisition subsequent to startup re-
quirements are to be submitted to GSA-PMDS on GSA Form 1539.
This requests GSA-PMDS personnel to assist in locating suitable
items and making them available by the required date for project
implementation.
f. The contractor, when notified that needed items are avail-
able as excess property, should arrange for inspection through the
GSA regional property specialist or area utilization officer responsi-
ble for the excess material. If such property is acceptable to the
contractor, material must be frozen with the GSA regional property
specialist or area utilization officer responsible for the specific
excess item. Standard Form 122, Transfer Order Excess Personal
Property, must be prepared immediately and submitted to the RCP()
or MA property officer for approval. The normal GSA freeze period
is 10 days. Processing steps with regard to acquisition, assistance,
and approval are as follows:
(1) The contractormayobtain blank forms SF 122 by pur-
chase from the GSA Federal Supply Service stock catalog (item no.
7540-823-8106) or from the FSS Self-Service Stores. An initial
supply may be furnished by the RCP° or the MA property officer.
(2) Assistance in preparing the SF 122 will be provided by
the GSA-PMDS officer, the RCPO, or the MA property officer.
(3) Upon completion of the SF 122, the contractor will sub-
mit the original and 4 copies to the RCP() or, in the case of national
contracts, to the MA property officer for signature approval.
(4) If, the RCP° or MA property officer disapproves the
SF 122, the form is returned to the contractor with a note of explana-
tion. The contractor must immediately contact the GSA-PMDS
officer and remove the freeze.
(5) The approved SF 122 will be forwarded to the GSA-PMDS
officer for GSA approval.

Supply Service Stores Stock Catalog. If the contractor's requirements
cannot be met through excess personal property inventories, the GSA
representative may suggest acquisition from stores stock. The con-
tractor must place his order for store stock items through the GSA
regional office in his area, using Standard Form 344.
FEDSTRIP is a simplified purchase method. If FEDSTRIP is used,
the instructions of the Federal Supply Service officer must be
followed. The FSS officer will assist the contractor in placing orders
for stores stock by regular purchase orders or FEDSTRIP. If the
contractor orders by regular purchase order or forms other than
FEDSTRIP, the order must cite the letter of authority, include the
contract number in the space provided on the Government purchase
order form (if used), and contain the following statement;
"This order is placed in behalf of the U.S. Department
of Labor in furtherance of U. S. Government contract
no. , pursuant to written
authorization dated Billings
(Letter of Authority Date)
are to be sent to

a. _Transportation. The contractor need not arrange for
transportation since the Government purchase order for stores
stock items includes delivery charges.
b. _Billing. GSA will bill the contractor directly for stores
stock items after shipment has been made. Upon receipt of the bill,
the contractor must pay GSA promptly and precisely as billed (without
change due to shortages, damages, or incomplete deliveries).
Discrepancies are to be handled by followup actions.
c. _Receipt of Stores Stock Items. Upon delivery of stores
stock items by the carrier, the contractor should make a careful
physical check to ensure that requested material has been delivered.
The contractor must sign the bill of lading and retain and file the
original copy. He must fill in Form MA 3-28, inventory transcrip-
tion sheets for reportable items and forward the MA 3-28 to the RCP°

or to the MA property officer, as appropriate, along with a copy of
the requisition, receipted invoice, or GSA packing slip.
d. Discrepancies. If discrepancies are found, they should be
processed in accordance with GSA Handbook, FPMR 101-26. 307. The
GSA representative should be contacted for guidance.
3. Supply Schedules and Supply/Service Contracts. The Federal
Supply Schedule represents GSA's contracts with commercial organi-
zations whereby Government agencies and their authorized contrac -
tors may obtain supplies and services from these firms, such as
repair of, and supplies for, office machinery, typewriters, adding
machines, etc. If the contractor's requirements cannot be met from
excess property inventories or stores stock, he may order directly
from the supplier in accordance with the provisions of the Supply
Schedule or other GSA contracts. The GSA regional FSS officer will
provide the contractor with information pertaining to the use of such
contracts. Each order shall be accompanied by a copy of the letter
of authority, if not previously provided, and shall contain the GSA
contract number and the following statement:
"This order is placed in behalf of the U. S. Department
of Labor in furtherance of U. S. Government contract
no. , pursuant to written
authorization dated _ _

a. Transportation. Normally, the delivery charges for
Federal Supply Schedule items are not included in the bill.
b. Billing . The vendor of Supply Schedule items and Supply/
Service contracts bills the contractor directly. Discrepancies are to
be handled as outlined in paragraph 2 above.
c, Receipt of Schedule Item_ s. Upon delivery of Supply Sched-
ule items by the vendor, the procedure in paragraph 2 c above must
be followed.

(6) If the GSA-PMDS officer disapproves, the SF 122 is re-
turned to the RCP° or MA property officer, whichever was the origi-
nator, with a note of explanation.
(7) The GSA-approved SF 122 will be distributed as follows:
(a) Original and one copy goes to the holding agency.
(b) One copy is retained by GSA.
(c) One copy is returned to the ordering agency.
(d) RCP° or MA officer, as appropriate, will promptly
provide the contractor with a copy and retain a copy.
g. (1) Upon receipt of a GSA-approved copy of the SF 122, the
contractor should promptly contact the holding agency and make
arrangements for pickup or shipment. In no case should the contrac-
i^+ for authorize pickup of the property prior to notification by the holding
agency that the property is ready for pickup. If the contractor elects
to have the property shipped commercially, he must provide the
holding agency with complete and precise shipping instructions and
request that the commercial bill of lading be endorsed as follows:
"Transportation hereunder is for the
Government and the actual total
transportation charges paid by the
contractor to the carrier(s) are to
be reimbursed by the Government. "
NOTE: By this endorsement the carrier is put on notice
that transportation costs are to be at Government rates and the con-
tractor becomes aware that his allowable reimbursable transporta-
tion costs for excess personal property must not exceed Government
transportation rates. (This endorsement is applicable only to inter-
state shipments.)

(2) One of the following methods of shipment or pickup must
be shown on the order:
(a) Commercial bill of lading is attached.
(b) Collect, commercial bill of lading.
(c) Pickup: specify name and phone number of individ-
ual to be contacted when material is ready to be picked up.
Billing office address, for shipping charges as well as packing, crat-
ing, and handling (if required must be shown on the order.
h. The MA property officer or RCP°, as applicable, will re-
tain one copy of the executed SF 122 for his files.
i. Upon receipt of the excess property, the contractor must:
(1) Sign and date Form SF 122, to indicate date property is
received.
(2) Fill in Form MA 3-28, Inventory Control Form.

4. GSA_Self-Service_Stores. GSA self-service stores are retail
supply facilities operated by GSA. They contain small quantities of
administrative supplies and office items. The customer may examine
and select supplies with immediate pickup of merchandise. However,
no purchase is permitted without a GSA shopping plate. The MA
property officer or RCPO will assist the contractor in obtaining the
shopping plate in accordance with the letter of authority held by the
contractor. Use of a shopping plate by a contractor will be restricted
to the contract period as set forth in the letter of authority.

5. Local Purchasing. Personal property may be purchased from
local sources if it is more economical to the Federal Government.
The procedure is outlined in paragraph 4, section 3213, of this hand-
book. A copy of the receipted invoice for purchased, approved, re-
portable property must be forwarded to the RCPO or MA property offi-
cer, as appropriate, together with a completed Form MA 3-28 con-
taining the pertinent information.

6. _Rent, Lease, or Lease-Purchase Agreements. When required
property is not available through GSA sources and renting or leasing
proves to be more economical than purchase, the MA property officer
or RCP° may give permission to rent or enter into a lease-purchase
agreement. In this event, the following clause shall be included in
all contracts, agreements, and grants entered into in behalf of the
Manpower Administration:
"The contractor shall not, while using Federal funds in
the performance of this contract, rent, lease or lease-
purchase personal property without prior written consent
of the MA property officer or RCP°, as appropriate.
Moreover, the contractor agrees to have the substance
of this clause inserted in any subcontract or equivalent
instrument entered into in the performance of the
contract. "
a. The procedure for obtaining concurrence for a rental, lease,
or lease-purchase agreement is as follows:
(1) The contractor shall forward three copies of the pro-
posed rental, lease, or lease-purchase agreement and cost compari-
son figures to GSA purchase price to the contracting officer. Any
proposed lease-purchase agreement must contain the following clause:
"The option to purchase contained in this agreement may
be exercised by a duly authorized representative of the
Federal Government on behalf of the United States and
may not be exercised by the lessee. "
(2) If he concurs, the contracting officer will retain one
copy and forward two copies of the proposed agreement, cost compar-
ison figures, and his written concurrence to the MA property officer
or RCPO, as appropriate.
(3) When a lease-purchase agreement is approved by the
MA property officer or RCP°, such agreement must show an assign-
ment to Manpower Administration, U. S. Department of Labor, with
the option to purchase at any time during the lease.

(4) One copy of the approved rental, lease, or lease-pur-
chase agreement will be transmitted to the contractor by the MA prop-
- erty officer or RCPO. Written authorization is sent to the contractor
regardless of whether the contract is national or regional.
(5) One copy of the written authorization of the MA property
officer or RCPO will, in all cases, be forwarded to the contracting
officer.
b. For the computerized inventory portion of the MA Contrac-
tor Property Management System, rental, lease, or lease-purchase
transactions shall be recorded on a completed Form MA 3-28 and
forwarded in accordance with paragraph 8 d, section 3212 of this
handbook. For the purpose of the CPM System, rental, lease, or
lease-purchase agreements are considered rental and must be so
reported.
c. One hundred and fifty days prior to the expiration date of a
lease-purchase agreement, the contractor shall comply with the provi-
sions of paragraph 5, section 3213 of this handbook. In the event the
approval is given to purchase, Form MA 3-28 must be appropriately
completed, removing the rental status of the item and indicating the
acquisition of property by purchase in accordance with section 3216 of
this handbook. A copy of this document shall be forwarded to the
RCP° or MA property officer, as appropriate.

7. Procurement under Contract Extention. A new letter of authority
will be issued by the MA property officer or RCPO, as applicable,
setting forth the new period of the contract. All other procedures
remain the same as those for the contract as originally written.
8. Procurement by Prime Contractors for Subcontractors. The
prime contractor is responsible for informing all his subcontractors
that they are to utilize Federal supply sources to the maximum extent
in performance of the subcontract. It is also the responsibility of the
prime contractor to advise his subcontractors of the Government's
requirements regarding Government property. However, the prime
contractor is responsible for all property requirements of a subcon-
tractor, and all property and accountability transactions shall be
processed between the contractor and MA property officer or RCP°,
as appropriate, in accordance with the provisions of this handbook.
9. Procurement under Renewal Contracts. Under a renewal contract
of a prior contract whose period of performance is complete and whose
/" property requirements are similar, the Government-owned property
held by the contractor under the prior contract will be transferred to
the renewal contract by an "on-paper-only" transfer action. The
sample letter of transfer in paragraph 10 below shows confirmation of
the transfer of accountability for Government property from a prior
contract to a renewal contract. The MA property officer or RCP°,
as appropriate, will prepare and submit an MA 3-26 and MA 3-28
to transfer all property from the prior contract to the renewal contract.
No action is required by the contractor to accomplish the transfer in
the computerized inventory portion of the MA Contractor Property
Management System.

Section 3216 PROPERTY RECORD CONTROL
1. Title to Approved Property All property furnished by the
Government or acquired by a contractor under the terms of his con-
tract for which he is reimbursed with Federal funds is Government
property, and title to such property is always vested in the Govern-
ment. Title to the Government property shall not be affected by the
incorporation or attachment thereof to any property not owned by the
Government, nor shall such Government property or any part thereof
be or become a fixture or lose its identity as personalty by reason of
affixation to any realty.
2. Property Records Transactions. Proper documentation by all
levels of personnel concerned with the orderly administration of
actions as to personal property within the context of this handbook is
essential to the conduct of sound business. Because of the large
number of property actions, the many thousands of contractors in-
volved, and the geographically wide distribution of contractor sites,
^ property control actions are documented and controlled by the com-
puterized inventory portion of the MA Contractor Property Manage-
ment System. Hence, all key personnel from contractor to MA
property officer share a responsibility for ensuring proper input data
and distribution of output data from the system. Recordkeeping
requirements of the contractor, RCP°, and MA property officer are
set forth in this section. Form MA 3-28, Inventory Transcription
Sheet, is to be used to enter property transactions into the computer-
ized inventory portion of this system. This system is designed to
provide complete visibility of all Government property in the hands of
contractors and to provide the contractor a definitive method for
internal control. It is the only system authorized for use by con-
tractors. The contractor should obtain hand receipts for his inter-
• nal property assignments. The location code described in this hand-
book will provide the means for this control as all output listings will
be by location code.

b, General Instructions for Completing Form MA 3-28. This
form is to be prepared in three copies. The original and one copy are
to be forwarded to the MA property officer or RCP°, as appropriate,
and the third copy is to be retained by the contractor until he has re-
ceived and verified his computerized listing. Attached to the origi-
nal MA 3-28 should be the acquisition, transfer, rental, or loan docu-
ment, such as an invoice or purchase order.
(1) All entries on the original copy of the form are to be
made in RED PENCIL only.
(2) Unless otherwise indicated, all data entries will be from
left to right.
(3) A separate space must be used for each letter, number,
and punctuation mark, and a blank space will be used to separate
words.
(4) All letters are to be capitalized.

code that can be numeric, alphabetic, or a combination of alphabetic
and numeric entries. Each contractor is to develop and assign loca-
tion codes for all Government property in his possession. Computer
listings will be by location within each contract. The location code
will provide a means for positive property control and will enable the
contractor to utilize the listing in obtaining hand receipts for property

5. Table of Source/Receiving Agent Codes. These codes can be
found on the "Contractor Property Inventory Guide".
6. Contractor's Records_. The contractor is obliged to maintain
records of all reportable Government property acquired under his
contract. These records are subject to Department of Labor audit.
The contractor must maintain a file containing copies of:
a. The original approved property requirements list for
his contract.
b . Documents substantiating property acquisition, transfer,
and disposition.
c. Quarterly computer list of Government-furnished prop-
erty in his possession. These runs are received from the RCPO for
maintaining property inventory.
7. _R_C_PO's_ Records. The RCP° is responsible for maintaining a -
separate property control file for each contractor using Government-
furnished property in his region. Each file shall contain:
a. The original approved property requirements list for
each contract under his cognizance.
b. A copy of each contract and any amendments thereto
which affect either property or the contract period.
c. A copy of each document (SF 122, invoice, purchase
order, etc. ) substantiating property acquisition, transfer, or
disposition.
d. Yearly computer list of Government-furnished property
certified by each contractor.
8. MA Property Officer's Records. The MA property officer is
responsible for maintaining the MA contractor property file stored as
computer retrievable data. Using this data, he is responsible for

distributing to the RCP° in each region a quarterly computer listing
of all Government property in the possession of MA contractors. He
shall maintain the following records.
a. Directives, departmental circulars, Government regula-
tions, and correspondence pertaining to Government property.
b. Reports of property reviews and applicable audit reports.
c. Contractor property acquisition, transfer, and disposi-
tion documents for national contracts.
d. A copy of each national contract and amendments thereto
which affect either property or the contract period.
e. The original approved property requirements list for
each national contract.
.. f. The contractor's current computer list.
9. Physical Inventories. Two inventories of Government-owned
property in the possession of contractors shall be made: one is
periodic; the other is taken on a per contractor basis just prior to
contract completion. Review actions are taken by both the RCP°
and the MA property officer.
a. Yearly Inventories. The annual inventory (September
30) is necessary in order to maintain adequate control over the prop-
erty. Taking inventory consists of sighting, tagging, describing,
recording, and reporting property concerned. Every 3 months, the
MA property officer or RCP° will forward a computer list to each
contractor, and once a year two copies of the inventory listing, one
of which is for inventory certification and return to the MA property
officer or RCP°, as appropriate.
b. Action by_the RCPO for Reg_ional Contracts. Upon re-
_
ceipt of the contractor's certified annual inventory listing, the RCPO
will review for additions and deletions made by the contractor or

assure that the Government property has been properly consumed in
the performance of the contract. He will attempt to resolve any dis-
crepancies disclosed with the contractor. Any remaining unresolved
discrepancies must be reported in writing to the contracting officer.
The certified annual inventory listing is filed by the RCPO for region-
al contracts.
c. _Action by the MA Property Officer. The MA property
officer will take action in accordance with the facts of the situation to
resolve any discrepancies. The MA property officer will notify the
RCP° in writing of actions taken and the RCPO will initiate the neces-
sary property record adjustment. When the contracting officer or
his designated representative initiates the closeout action, he includes
notice to the MA property officer that closeout actions are pending.
Upon notification of contemplated termination 30 days prior to contract
completion, or upon receipt of information that Government property
is no longer needed for use: under the contract or subcontract, the MA
property officer will initiate disposal action. The initial disposal
action will consist of furnishing the contractor a computer listing of
all Government-owned property in his possession. Upon return of the
listing with certification, the MA property officer will verify the com-
pleteness of expenditure for equipment with audit records. When all
records are in order, the MA property officer will complete disposal
action, close out the master property control file, and transmit
certification to the contracting officer for inclusion in his official
contract file.
d. Final Inventory. A final inventory of Government-
owned property in the possession of contractors must be made 30
days prior to completion of contracts or, in the event of termination,
upon receipt of instructions from the contracting officer. This final
inventory will be accomplished in the same manner as a periodic
physical inventory: i. e. , by comparison of a computer listing
furnished by the RCPO against actual holdings. Upon completion of a
final inventory the contractor will insert the following statement, if
appropriate, after his certification and signature:

Section 3217 REQUESTING RELIEF-OF-
ACCOUNTABILITY FOR GOVERNMENT PROPERTY
1. Conditions Leading to a Contractor's Request for Relief-of-Account-
ability. The procedure opposite to acquisition of government property
is the procedure by which relief of accountability for property is
accomplished. This is done through transfers, disposals, and other
methods, all of which are referred to as relief-of-accountability
actions. Among the major conditions leading to a contractor's request
for relief-of-accountability are the following:
a. Excess to Needs. At times a contractor may decide that
certain Government property he is using is excess to his needs. Such
items include but are not limited to personal property items of
furniture, personal issue, and handtools. The appropriate procedure
for his requesting relief-of--accountability will depend upon which of
the following categories apply:
(1) Real Property (See section 3220 Real Estate to be
published).
(2) Personal Property
(a) The item of property is in serviceable condition and
usable without repair.
(b) The item of property if damaged or worn but can be
repaired for a cost less than or equal to 25 percent of its original
acquisition cost. That is, the item is considered to be repairable.
(c) The item of property is damaged or worn but can
not be repaired for a cost less than or equal to 25 percent of its origin-
al acquisition cost. That is, the item is considered to be nonrepairable.
(d) The property in question is a collection of leftover
material such as remaining; sections of piping, tubing, wiring, boards,
etc. That is, the item is considered to be residual material property.

b. Missing, Destroyed, or Damaged. As soon as property is
discovered to be missing from inventory or is destroyed or damaged,
the contractor will immediately initiate appropriate relief-of-account-
ability action by reporting forthwith the pertinent details in writing to
the contracting officer. Suspected theft of Government property shall
be immediately reported to the local police authorities and the FBI. •
If the property is a serialized item, the serial number, manufacturer's
name, and cost should be furnished to the authorities. If the property
is not recovered within a period of not more than 30 daysta police
report thereof should be secured and forwarded to the RCP° or to the
MA property officer, as appropriate, with a request to be relieved of
accountability. A Board of Survey will review details submitted on such
missing, destroyed, or damaged property and a copy of its report on
Form DL1-45 will be forwarded to the contractor, advising him wheth-
er he is pecuniarily liable or is relieved of accountability.
c. Permission to Cannibalize. When the contractor desires per-
mission to cannibalize Government property, relief-of-accountability
for the item of property is required.
d. Permission to Trade In. When the contractor desires to trade
in items of Government property, relief-of-accountability is required.
e. Convenience of DOL. The Department of Labor may exercise
its right of convenience with the result that the RCP° or MA Property
Officer, as appropriate, will initiate the action to relieve the con-
tractor from accountability of Government property.
f. Closeout Procedures. A required part of the closeout proce-
dures is the relief-of-accountability of all Government property in the
possession of the contractor.
Z. Procedures for Requesting Relief-of-Accountability. The contrac-
tor should state, by memo to the RCPO or MA Property Officer, as
appropriate, certain conditions under which he desires relief-of-
accountability. That is, he should briefly explain which of the follow-
ing classes apply and why:

a. Excess to needs.
b. Missing, destroyed, or damaged.

3. Closeout Procedures. Closeout procedures for normal termi-
nation of a contract require the following actions:
a. The MA property officer or RCPO, as appropriate, will
forward to the contractor a final contract inventory listing 45 days
prior to contract expiration date.
b. The contractor will return the listing after certification in
the following manner:
+� (1) He will make a physical inventory to ensure that the
property listed is in his possession.
(2) He will affix a certification notation to the listing in-
cluding the following statement:
"The items of Government property listed herein
are hereby certified to be only those authorized under
contract number ________

should also affix the following statement:

(3) He will certify his inventory within 15 days. In the event
that the Government property has not been placed under the Contrac-
tor-Property Management System for any reason, such as early contract
termination, etc. , and a computer inventory list will not be available,
authorization must be obtained from the MA property officer or RCP°,
as appropriate, for proceeding with closecu-t procedures. This en-
tails the use of Forms MA -718 and MA-728 as detailed in section
3117.
c. The contractor, upon receipt of instructions from the MA
property officer or the RCPO, will take the indicated actions which
will include directions as to the appropriate forms to be completed and
the addresses to receive the forms.
4. Transportation Costs_. The contractor who is acquiring the ex-
cess property will pay all transportation costs incidental to the ship-
ment and the shipping contractor will pay all transportation costs for
property shipped to a DOL holding facility.
5. Contractor Liability. The contractor, unless relieved by the ^\
Manpower Administration Board of Survey, is pecuniarily liable for
any loss of or damage to Government property, or for expenses in-
cidental to such damage or loss.

7. Condition Codes
Code Expanded definition
N-1 New or unused property in excellent condition. Ready for use and identical or interchange-
able with new items delivered by a manufacturer or normal source of supply.
N-2 New or unused property in good condition. Does not quite qualify for N-1 (because slightly
shopworn, soiled, or similar), but condition does not impair utility.
N-3 New or unused property in fair condition. Soiled, shopworn, rusted, deteriorated, or damaged,
to the extent that utility is lightly impaired.
N-4 New or unused property so badly broken, soiled, rusted, mildewed, deteriorated, damaged,
or broken that its condition is poor and its utility seriously impaired.
E-1 Used property but repaired or renovated and in excellent condition.
E-2 Used property which has been repaired or renovated and while still in good usable condition,
has become worn from further use and cannot qualify for excellent condition.
E-3 Used property which has been repaired or renovated but has deteriorated since recondition-

R-2 Used property in good condition but considerable repairs required. Estimated cost of repairs
would be from 11% to 25% of acquisition cost.
R-3 Used property, in fair condition, but extensive repairs required. Estimated repair costs would
be from 26% to 40% of acquisition cost.
R-4 Used property, in poor condition, and requiring major repairs. Badly worn, and would still
be in doubtful condition of dependability and uneconomical in use if repaired. Estimated
repair costs between 41% to 65% of acquisition cost.
X Salvage. Personal property that has some value in excess of its basic material content but
which is in such condition that has no reasonable prospect of use for any purpose as a
unit (either by the holding or any other Federal agency) and its repair or rehabilitation
for use as a unit (either by the holding or any other Federal agency) is clearly impractical.
Repairs or rehabilitation estimated to cost in excess of 65% of acquisition cost would be
considered "clearly impractical" for purpose of this definition.

Section 3218 MOTOR VEHICLES
1. Inclusion in Property Requirements List. If motor vehicles are
required in the operation of the contract, the required vehicular in-
formation must appear on the Property Requirements List, Form MA
3-41A or MA 3-41B (Supersedes Form MA-726) , The vehicular re-
quirements are then considered during the contract negotiation and, if
approved by the contracting officer, the requested vehicles will be
furnished by a GSA interagency motor pool. A letter of authority
must be issued by the MA property officer or RCP°, as appropriate.
2. Interasency Motor Pool Vehicles.
a. Federal agencies may authorize cost-reimbursement-type
prime contractors and their subcontractors, when required in the
operation of a contract, to obtain interagency motor pool vehicles and
related services, including:
r
(1) Fuel and lubricants.
(2) Vehicle inspection.
(3) Maintenance and repair of vehicles.
(4) Vehicle storage.
(5) Commercially rented vehicles for short-term use.
• b. The MA authorization (see paragraph 3) to the contractor to
use interagency motor pool vehicles shall be in writing and shall cite:
(1) The contract number.
(2) Any applicable limitations on the authority.
(3) The period of eligibility.

(4) Number and type of vehicles, related services author-
ized, and period of use.
(5) Billing instructions and a complete billing address.
(6) Any other pertinent information: _
c. Two copies of the MA authorization letter shall be trans-
mitted to the appropriate GSA regional office, Transportation and
Communications Service, Motor Equipment Division, with the request
that:
(1) The services contained in the authorization be made
available to the contractor, and
(2) All costs involved be billed to the contractor.
d. The contractor shall supply a list, by name, of those em-
ployees authorized to request vehicles and related services.
e. Insurance requirements for interagency motor pool vehicles
are the same as those outlined in paragraph 6 below.
f. Contractors shall report accidents involving interagency
motor pool vehicles immediately to the chief of the motor pool assign-
ing the vehicles, the contracting officer 's field representative, and
the State, county, or municipal authorities as required by law. Noti-
fication shall be on Standard Form 91, Operator Report of Motor
Vehicle Accident, with a copy of Standard Form 94, Statement of
Witness, when applicable.
g. Government motor vehicles shall be stored in facilities
which provide protection from pilferage and damage. In the interest
of economy, open storage shall be used whereever practicable and
feasible.
h. For assignment of vehicles to individuals, see paragraph 12
below.

4. - Acquiring Vehicles Through Excess. If GSA vehicles are not
available to the contractor and, if approved by the contracting officer,
the contractor may be authorized to screen for approved vehicles.
The initial approval authorizes acquisition from excess sources only.
To obtain vehicles through excess, the following steps are necessary:
• a. The contractor should contact the PMDS officer and the
RCP() in his area or, in the case of national contracts, the MA prop-
erty officer, in order to determine whether the desired type of vehicle
is available through excess, where it is located, and a complete de-
scription of the vehicle.
b. The contractor should inspect the vehicle and, if satisfied,
request the GSA, PMDS officer, that it be frozen. Upon his confirma-
tion of availability and freeze, the contractor shall immediately pre-
pare a SF 122.
c. Upon approval, the SF-122 is forwarded to GSA by the RCPO
or MAPO, as applicable, with information copy to contractor. GSA
will send the approved SF--122 to the holding agency for release of the
identified vehicle.
d. The contractor must obtain insurance for the vehicle in
accordance with the requirements specified in this section before
picking it up from the holding agency.
5. Open Market Purchase. If open market purchase of a motor
vehicle is being requested, the contractor must solicit and submit a
minimum of three bids. Each of these bids must be from competitive
•
bidders, at least one of whom must be a minority-owned dealership.
This request must be subrnitted in writing to the MA property officer,
with supporting evidence that the vehicle was not available from
excess or the GSA interagency motor pool.
6. Title and Insurance. The title to motor vehicles remains vested
in the Government. The vehicle title must show the owner as the U. S.
Department of Labor, Manpower Administration. The contractor
must obtain liability and property damage insurance on each Govern-
ment-owned vehicle in his possession, with minimum financial

responsibility limits of $100, 000 per person and $300, 000 per acci-
dent for bodily injury, and $5, 000 per accident for property damage.
The contractor must provide a copy of insurance certification to the
RCP° in the area or, in the case of a national contract, to the MA
property officer.
7. Registration and License Plates. The contractor must register
and license each vehicle he acquires. Official registration certifi-
cates and license plates will be obtained by applying to the RCP() or
designated issuing official.
a. Application must be accompanied by:
(1) A copy of the SF-122 used in acquiring the vehicle.
(2) In the case of purchased vehicles, properly executed
and certified bills of sale attesting to Government ownership.
(3) The necessary descriptive information for completing
the Manpower Administration Registration, Certificate.
b. The contractor must submit a completed Form MA 3-28
and a copy of the Inventory Transcription Sheet to the RCP() or MA
property officer, as appropriate. This action provides current in-
formation to the computeri2:ed part of the Contract Property Manage-
ment System.
c. When a motor vehicle is removed from Government service
or transferred to another agency, the Department of Labor license
•
plates shall be removed and destroyed. Additionally, any transfer or
disposition of motor vehicles must be accompanied by submission of a
completed Form MA 3-28, Inventory Transcription Sheet, and copy.
8. U. S. Government Motor Vehicles Operator's Identification Card
SF-46.
a. All operators of Government-owned motor vehicles must
possess a valid U. S. Government Motor Vehicle Operator's Identifi-
cation Card SF-46. To obtain a card the contractor must submit the

following items to the RCP° or designated issuing official:
(1) Completed Driving Record of Government Vehicle
Operator, DL Form 1-119. (See paragraph 10).

(2) Completed -Physical Fitness Inquiry for Motor VehicL
Operators, SF-47. (See paragraph 9)•
(3) Photostatic copy of applicant's current valid State
motor vehicle operator's license. If State law prohibits the copying
of an operator's license, a note of 'certification of possession of a
valid State motor vehicle license, signed by the designated official,
may be substituted.
(4) A partially completed U.S. Government Motor Vehicle
Operator's Identification Card, SF-46. (See paragraph g below).
b, Blank Forms DL, 1-119 and SF-47 may be obtained from the
RCP° or designated issuing officer. Upon receipt of the information
above by the officer, he will review the application data and, where
deemed appropriate, issue the SF-46. Restrictions appearing on the
applicant's State driver's license will also be listed on the SF-46.
The SF-46 is valid for 1 year from the date of issuance. The SF-46
may be renewed by submitting to the issuing officer, at least 15 work-
ing days prior to expiration date, the following information:
(1) Completed Driving Record of Government Vehicles
Operator, DL Form 1-119, conspicuously marked "RENEWAL".
In the "Action" space at the bottom of the form the following statement
of certification must be inserted by the designated official:
"Renewal applicant is physically fit to drive. "
(2) Photostatic copy of applicant's current valid State
operator's license. If State law prohibits the copying of an operator 's
license, a certification note of possession signed by the designated
official may be substituted,.

c. All items on DL Form 1-119 must be completed except the
spaces marked "Number, " "Date issued, " and "Expiration". These
are to be completed by the designated officer.
d. For both initial applications and renewal requests the center
or project director will complete the space Review and Certification
by Designated Official" on the SF-47 and the space "Action" on the DL
Form 1-119. In the bottom :space for authorization "subject to the condi-
tions" on the 1-119, specify the types of motor vehicle the driver is
qualified and authorized to operate.
e. If the contractor does not receive a successor contract, the
designated officer shall ensure that the contractor returns all SF-46's
at the completion or termination of his contract.
f. The minimum age is 18 years for operators of vehicles
carrying 10 passengers or more. In addition, a chauffeur carrying
that capacity of passengers must have a chauffeur's license meeting
the minimum State requirements and demonstrated ability to operate
this type of vehicle as certified by the contractor.

11. Official Legend and Agency Identification. Each Government-
owned motor vehicle acquired by a contractor for official purposes
shall display the official legend: "For Official Use Only, U. S. Gov-
ernment " and the agency identification. The identification will be
displayed through the use of decals provided by the Department of
Labor.
The full name of the Department and the service in which it is used
shall be conspicuously displayed on each motor vehicle and located
as follows:
a. On passenger cars, station wagons, ambulances, buses,
carryalls, fire trucks, trucks, and tractors, centered on both front
door panels or in an equivalent position if there is no door.
b. On trailers, vertically centered on both sides of front
quarter of the vehicle.
r c. On motorcycles (sidecars only), vertically centered on the
outside panel of the sidecar.
12. _Assignment of Motor 'Vehicles to individuals. U. S. Government
vehicles are assigned to the contractor as a legal entity as opposed to
an assignment to any individual or group of individuals within the
contractor organization. Any Government motor vehicle in the
possession of contractors will be assigned only for purposes related
to contract performance. No vehicle will be assigned for exclusive
use of an individual. Penalties will be imposed for the use of, or
authorization for use of, motor vehicles contrary to contract related
performance.
a. Overnight retention of a U. S. Government vehicle by an
individual is prohibited except as provided below.
b. An operator of a U. S. Government vehicle is permitted to
retain it overnight only when it is necessary to do so to accomplish

normal duty hours. Repetitive requirement requests must be sub-
mitted in writing, in advance, to the MA property officer for approval.
These requests are to identify the days of the week and purpose for
the overnight retention. Each case involving overnight retention of
vehicles must be approved by the MA property officer or his desig-
nated representive.
c. Names of individuals authorized to approve emergency over-
night retention of vehicles are to be submitted to the MA property
officer through channels.
d. Cases of approved emergency overnight retention of
vehicles are to be reported to the MA property officer on or before
the 10th of the month following emergency approval.
13. Motor Vehicle Report, Form MA 3-42
a. All contractors will prepare a Motor Vehicle Report, Form
MA 3-42.
b. The report is to be cumulative and cover semiannual peri-
ods ending on June 30 and December 31.
c. Reports are due by July 15th for the period ending June 30
and by January 15th for the period ending December 31.
d. Reports are to be submitted to the MA property officer or,
in the case of regional contracts, through the RCPO.
e. The report will cover every Department of Labor (MA)
Government-owned vehicle utilized by the contractor for purposes
related to the performance of the contract with the exception of
vehicles assigned to vocational training shops for use as training aids.

14. _Operation and Inspection of Motor Vehicles According_ to State
Law_, Motor vehicles operated by contractor personnel, trainees, or
enrollees and displaying Federal license plates must be operated in
accordance with the existing motor vehicle statutes and regulations of
the State in which they are being operated. Motor vehicles displaying
Department of Labor license plates must be inspected by an approved
State inspection station and on the same periodic cycle established by
law for like vehicles for the State in which the vehicle is based.

Section 3219 LIABILITY INSURANCE
1. Motor Vehicle Insurance. Prior to the operation and utilization of
a motor vehicle, the contractor must obtain liability and property
damage insurance on each said Government-owned vehicle in his
possession. The Manpower .Administration requires insurance cover-
age with minimum financial responsibility limits of $100, 000 per perEon
and $300, 000 per accident for bodily injury, and $5, 000 per accident
for property damage. The contractor must provide a copy of insurance
certification to the RCP() in his area or, in the case of national con-
tracts to the MA property officer.
2. Liability to Third Persons.
a. The contractor shall procure and maintain workmen's compen-
sation, employer's liability, comprehensive general liability (bodily
injury), and comprehensive automobile liability (bodily injury and
property damage) insurance, with respect to performance under the
n contract, and such other insurance as the contracting officer may
from time to time require with respect to performance under the
contract; provided, however, that the contractor, in fulfillment of his
obligation to procure workmen's compensation insurance, may, with
the approval of the contracting officer, maintain a self-insurance
program; and provided further, that with respect to workmen's com-
pensation, the contractor is qualified pursuant to statutory authority.
All insurance required shalt be in such form, in such amounts, and
for such periods of time as the contracting officer may from time to
time require or approve, and with insurers approved by the con-
tracting officer.
b. The contractor must agree, to the extent and in the manner
required by the contracting officer, to submit for the approval of the
contracting officer any other insurance maintained by the contractor
in connection with the performance of the contract and for which the
contractor seeks reimbursement thereunder.
c. The contractor shall be reimbursed for the portion allocable
to the contract of the reasonable cost of insurance as required or
approved pursuant to the provisions of this section.
