FINDINGS AND RESOLUTION CONCERNING CHANGE OF ZONE PETITION OF DACAPO DEVELOPMENT COMPANY The petition of Dacapo Development Company, P. O. Box 219, Dacono, Colorado, requesting a change of zone from "A" Agricultural District to "E" Estates District - Planned Unit Development, of a parcel of land more particularly described as follows, to-wit: That portion of Section 7, Township 2 North, Range 67 West of the 6th P. M. , Weld County, Colorado, lying East on the Union Pacific Railroad, more particularly described as follows: Beginning at the Southeast Corner of said Section 7 and considering the South line thereof to bear South 89° 23' 29" West; Thence along the South line of said Section South 89° 23' 29" West 2, 621. 21 feet to the South Quarter Corner of said Section; thence continuing along said South line South 89° 23' 29" West 2, 129. 25 feet to the Easterly right-of-way line of the Union Pacific Railroad as described in Deeds recorded in Reception Numbers 154750 and 142117, Records of said County, as further evidenced by existing right-of-way fences in the field. Thence along said Easterly right-of-way line the following courses: North 0° 55' 26" West 632. 01 feet to the beginning of a tangent curve concave to the South- east having a central angle of 29° 44' 58" and a radius of 3, 719. 72 feet; thence Northeasterly along the arc of said curve 1, 931. 27 feet to the end of said curve; thence tangent to said curve North 28° 49' 31" East 3, 335. 20 feet to the North line of said Section• thence along said North line North 89° 56' 58" East 11. 35 feet to the North Quarter Corner of said Section; thence continuing North 89° 56' 58" East, 2, 680. 41 feet to the Northeast Corner of said Section; thence along the East line of said Section South 0° 00' 06" East 2, 660. 54 feet to the East Quarter Corner of said Section; thence continuing South 0° 00' 06" East 2, 698. 66 feet, more or less, to the Point of Beginning, came on for hearing on October 23, 1973, and the Board of County Commissioners of the County of Weld, State of Colorado, having heard the testimony and evidence adduced upon said hearing and having con- sidered the testimony, evidence and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant failed to sustain the burden of proof as to the need for a change of zone or that the present zone is erroneous or that circumstances warrant a change of zone at this time. Ph°3 15 730021 , J //`t' 2. Th-e evidence and investigation show that the inhabitants of the immediate vicinity of the area sought to be rezoned are unanimously opposed to the change of zone. 3. The evidence discloses that the present zoning is complementary to the surrounding area, and that rezoning of subject land would not be compatible with the surrounding land use and not in conformity with the Weld County Comprehensive Plan. 4. Rez-oning of subject land would constitute spot-zoning and that as such it would not be -consistent with the Weld County Development policy and its comprehensive plan. 5. The proposed land unit development does not conform to Section 106-2-37, CRS 1963, as amended, (HB 1553)as the Weld County Health Department is on record as stating that it will not approve con— ventional septic tanks or evaporation systemsfbrthis area and will require a central sewage treatment facility. 6. The proposed planned unit development does not c-onform to Se-ction 92-36-�(1) CRS, 1963, as amende-d, (-HB 1529), as both the geological report submitted by the applicant (pp 1, 3) and a preliminary review by the Colorado Geological -Survey reveals that the area proposed for rezoning is underlain by coal beds. 7. The evidence and investigation show-that there is a need for further study -and development of a comprehensive plan for the greater tri-town area of Dacono, Fre-derick and Firestone, and therefore, any rezoning of subject propertyat this time would be premature and not in the interest -of good planning. 8. That each of the pre_ceding findings inand of themselves and independent of each other _constitutes a separate and individual ground for denial of the change of z-one. RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has heard the application of Dacapo Development Company, P. O. Box -219, Dacono, Colorado, for change of zone from "A" Agricultural District to "E" Estates District - Planned -Unit_Development, of a parcel of land as hereinabove recited and made a part hereof by reference, and W13EREAS, said Board hassuade its findings on the evidence and testimony submitted to it, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendations of the Weld County Planning Commission and has given the sam-e such weight as it in its discretion deems proper, and is now fully adviser] in the premises. -2- NOW, THEREFORE, BE IT RE-SOLVED, that the petition of Dacapo Development Company, P. O. Box -219, Dacono, Colorado, requesting a change of zone from "A" Agricultural District to "E" Estates Di-strict - Planned Unit Development, -of a parcel of land indic-ated above ba, and it hereby is denied on each -of the grounds _set forth in the Board'-s findings therein. The geologic report is adequate, but we would have-preferred to have _received eceived the log of the test holes referred to in the report (called Exhibit B) . By way of evaluation, we would think that percolation rates might be too slow in many parts of the area (because of the high clay fraction in the soils) . In addition, bedrock is very shallow in the south central -part of the tract, as depicted on _Exhibit C of the _geologic report. Taking both of these factors into account, we would suspect that conventional leach fields would not be feasible over much of the area. A second item that should be considered is the possibility that the area may be underlain by -coal. Although there is no indication from available information that coal has been extracted, the _possibility remains that reserves of coal that are, or may be, economic underlie the tract. This / brings up two questions: (1) What is the ownership of the mineral _rights? The _U.S.B.M. Report of Investigation #67_26 states that the II. P. Railroad was given ownership of coal deposits in the odd-numbered sections of an area that includes this tract. -At this -time it would seem advisable to determine current ownership of mineral rights and how these might interfere with the proposed land use. (2) The second point _is that the proposed land use change would fall under the purview of HE -1529 if there are _sig- nificant -reserves of coal underlying the area. Information ,that I can obtain only establishes that the Laramie Formation (which is -the coal-bearing formation) is present. The subdivision is located within the attendance areas of the Frederick Elementary -School, Frederick Junior High School, Erie High School, and Longmont Senior High School. Our September 14, 1973, enrollment figures indicated that the Frederick Elementary was 61-5, Frederick Junior Nigh School 267, Erie -Senior High School 492, and Longmont Senior High School 1,518. Our rated capacities of the same landings are as follows: Frederick Elementary 551, Frederick Junior High 378, Erie High -School 756, and Longmont Senior -High 1,4-02. Secondary Schools are rated at $5% capacity due to conditions that prevent 100% utilization during all times of the day. The Career Development Center lee a capacity of 240 and serves moth the Erie Senior High School and Longmont Senior High School. Their Center allows each building to house more children dependent on the number enrolled et the Center and away from the buildings _luring the day. A comparison of capacities and current enrollments indicates that Frederick Junior High School and -Erie Senior High School could adequately house children generated from the Longview Air Tark Subdivision. But due to the development occurring in the "Glens of Dacono" Subdivision, these figures are -questionable. 2. The subdivision appears to be _designed to safely handle chil- dren, but would cause additional busing from the area to the schools involved. We also question the roads surrounding the subdivision in their ability to safely handle the added traffic generated by the subdivision. Without road improvement in the area, school buses, in addition to the increased traffic, could have difficulty during the adverse weather conditions 4 1c ,r 1?Fcfi v ;w trans_porting children -to and from their schools. Therelbre, we suggest that the county_roads be considered and possibly improved to handle the added traffic and to decrease safety hazards inherent in transporting children to and from school. In summary, the Longview Air Park would cause some di₹'fi-culty in housing children in the Frederick Elementary Schools. 1 would however, like to indicate that the developer has discussed the project with -the St. Vrain Valley -School District and has indicated his willingness to provide some housing or lousing alternatives in the "_Glens of Da.cono", a subdivision he is also developing. We also believe that our average yield ratios per household may be slightly high for the subdivision since the Icrice range of the homes would favor children in the upper elementary and junior_senior high school categories. We do believe the safety aspect of the roads should receive considerable attention. The soils are of the Ascalon series and are quite uniform throughout the proposed development. They are deep, well drained sandy loans formed by wind and water deposits. These soils would have only slight restrictions for both septic tanks and building excavations. They are quite erosive by wind and water and some cover should be maintained at all times with minimum disturbance at any one time. f We were unable to comment on flood hazards and hydrology as none was computed and submitted as called for in Senate Bill 35. We estimate that there are some 3,500 acres of drainage area above the proposed development from U. S. Geological Survey quadrangle maps.
