James, Chair - EXCUSED Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck - EXCUSED Commissioner Steve Moreno Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick County Attorney, Bruce Barker Department of Planning Services representative, Chris Gathman Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated April 11, 2022, and duly published April 13, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Edward Audet, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0004, for Buildings exceeding the maximum building coverage in subdivisions in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Chair Pro-Tem Freeman instructed the applicant and reviewed for the public, with two (2) of the five (5) Commissioners being excused, the vote must be unanimous for the case to be approved. Chris Gathman, Department of Planning Services, presented a summary of the proposal and location of the site, stated there is an existing single-family home and garage on the property, and the new building would be 2,400 square feet, exceeding the code by 804 square feet. Mr. Gathman explained the applicant intends to store classic cars, motorcycles, and a boat in the new building, which will be for personal use. He explained the parcel has an existing, unpermitted access onto Patrick Street, which is a local, gravel road with a 60 -foot right-of-way, via Casler Avenue, which is a privately maintained road with platted right-of-way in Aristocrat Ranchettes, and no traffic information is available. He further stated the site will generate typical residential traffic and the applicant has submitted a Drainage Narrative reflecting the site meets a Stormwater Drainage Detention exception. Mr. Gathman displayed a sketch of the proposed layout of the new building, and entered the favorable recommendation of the Planning Commission into the record as written. Cc in. CrP/NN/CO TS/9 /22 2022-1505 PL2824 HEARING CERTIFICATION - EDWARD AUDET (USR22-0004) PAGE 2 Fri Lauren Light, Department of Public Health and Environment, relayed the residence is served by an individual well and they have a septic system permitted for four (4) bedrooms. She noted one (1) Development Standard that addresses setbacks for the building to the septic system, which is located to the southeast of the existing residence, and staff has no outstanding issues with the request. Edward Audet, applicant, reiterated his proposed use of the new building and, in response to Chair Pro-Tem Freeman indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards. El No public testimony was offered concerning this matter. The Board reviewed the Conditions of Approval and Development Standards and made no amendments. El Commissioner Saine moved to approve the request of Edward Audet for a Site Specific Development Plan and Use by Special Review Permit, USR22-0004, for Buildings exceeding the maximum building coverage in subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing was completed at 10:06 a.m. This Certification was approved on the 22nd day of June, 2022.
