James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Department of Public Works representative, Elizabeth Relford The following business was transacted: I hereby certify that pursuant to a notice dated February 4, 2022, a public hearing was conducted to consider the Petition of the Weld County Department of Public Works to vacate a portion of County Road 44 within Union Pacific Railroad right-of-way near or adjacent to U.S. Highway 85, subject to dedicated and recorded easements and rights -of -way. Bruce Barker, County Attorney, made this a matter of record. (Clerk's Note: Due to technical issues with recording software delay, this introduction was not captured.) Elizabeth Relford, Department of Public Works, presented a brief summary of the petition and summarized this vacation of County Road (CR) 44 adjacent to U.S. Highway 85 as a part of the Peckham Interchange Improvements Project that the Colorado Department of Transportation (CDOT) will be executing, through Jalisco International, Inc., by the end of 2023. Ms. Relford stated this application was approved by the Board of Commissioners to submit to the Public Utilities Committee (PUC) on April 28, 2021, and approved by the PUC on July 14, 2021; however, she noted differences between the CR 33 Petition to Vacate a portion of Union Pacific right-of-way, including location, and higher volume of traffic due to CR 44 being an arterial route with 1,522 vehicles daily, with about 50% being commercial trucks. She stated there is an improved grade separation anticipated in this area, due to the higher traffic flow connecting to the U.S. Highway 85 corridor. Ms. Relford displayed aerial images, briefly explained the legal description with the map for reference, and described the construction plans for this location, including the addition of a roundabout. She confirmed no referral agencies responded to the notification; therefore, the conclusion is there are no concerns. Ms. Relford commented they ensured a 30 -foot -head combine will be able to utilize the roundabout. No public testimony was offered concerning this matter. Commissioner Moreno moved to approve the Petition of the Weld County Department of Public Works to vacate a portion of County Road 44 within Union Pacific Railroad right-of-way near or adjacent to U.S. Highway 85, subject to dedicated and recorded easements and rights -of -way. The motion was seconded by Commissioner Saine, and it carried unanimously. There being no further discussion, the hearing was completed at 10:10 a.m. This Certification was approved on the 2nd day of March, 2022.
