RE: ACTION OF THE BOARD AT PROBABLE CAUSE HEARING, PCSC22-0011,
CONCERNING USE BY SPECIAL REVIEW PERMIT, USR-895 - WASTE
MANAGEMENT DISPOSAL SERVICES OF COLORADO, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 20th day of June, 2022, a Probable Cause Hearing was held before
the Board to consider setting a Show Cause Hearing to determine whether or not Waste
Management Disposal Services of Colorado, Inc., 40000 County Road 25, Ault, Colorado 80610,
was in compliance with certain Development Standards contained in Use by Special Review
Permit, USR-895, for a Solid Waste Disposal Site and Facilities, in the A (Agricultural) Zone
District, and
WHEREAS, the alleged violations were said to be occurring on property being further
described as follows:
SW1/4 of Section 7, Township 7 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing on June 20, 2022, the Board heard all of the testimony and
statements of those present and reviewed the request of the applicant for a continuance and,
having been fully informed, deemed it advisable to continue the matter to August 31, 2022, at
9:00 a.m., to allow Waste Management Disposal Services of Colorado, Inc., adequate time to
bring the site into compliance with certain Development Standards.
WHEREAS, on August 31, 2022, after hearing testimony from the Department of Planning
Services, the Board finds that pursuant to the procedure as set forth in Chapter 2 Administration,
of the Weld County Code, there is not sufficient probable cause to schedule a Show Cause
Hearing and deemed it advisable to dismiss the matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Probable Cause Hearing be, and hereby is, dismissed.

We (EHS) are receiving numerous complaints concerning blowing debris from
the North Weld Landfill I know work is underway concerning repairs to the
fence, but it appears that picking efforts and other containment efforts have not
been effective or satisfactory in removing offsite debris or containing debris to
the site As you know, this is a violation to the USR We need an updated
debns management plan for how all offside debris will be handled, when fixes
are anticipated and how future debris will be contained Based on the number
of complaints we need this information by end of day
James Reed responds to EHS
Thank you for your time this afternoon to discuss the issues we have been
currently faced with our windblown surrounding litter at NWLF Presently our
plan is to utilize two different temp agencies to maximize the amount temporary
labor litter pickers (10-15 labors) to assist in cleaning our surrounding
neighbors, working farthest from the landfill, then in Before and after litter
picking, I will follow up with our neighbors to ensure we are satisfied with the
clean up on their property
In addition, we are working on the repair for 14 of our down litter fence netting
on the south side of NWLF At this time the netting has been ordered and
planned for installation around May 9th 2022 We apologize for this
inconvenience and look to getting this issues resolved immediately

The Commissioners office continues to receive calls of complaint with the
blowing debns off of the landfill Two weeks past you indicated that the net
matenal was on order and would be delivered in 7-10 days As this date may
have passed, the planning office is seeking an update on the status of the
efforts to collect the debns from your site and more importantly the neighboring
fields and subdivisions
The debns field is widespread — County Road 21 east to County Road 29,
north of County Road 84 and south of County Road 80 — Representative
photographs taken on Sunday are attached
Please provide an update on the status of the W -M clean-up efforts and what
action Weld County can anticipate in the future to maintain compliance with
the current land use permit
James Reed reaches out to EHS
Thank you again for the support and communication upon NWLF windblown
issues surround the property Following our conversation earlier this week we
have utilized approximately 10-14 laborers per day to clean the surrounding
properties from Belmont Farms, CR 23- CR 27 North and South of HWY 14,
Drake Farms and South of NWLF litter Fencing along HWY 14 We are
currently working with our fence vendor to start installation to the 14 damage
wind panels by May 9th 2022 The present forecast is projecting 30mph
sustained and 45 mph wind gust today and tomorrow If we have any litter
exposure we will ensure to follow up with our neighbors and focus on our
surrounding property first thing Monday morning In addition we will clean
along HWY 14 to Double J Farms
High wind advisory for Northern Colorado
We [EHS] did a visual inspection of the site earlier this week Significant
progress has been made, but still needs to be monitored to ensure they
continue debns removal (which we will do) They are still working with the
fencing company to get replacement parts and hope in the next 10 days to
start repairs We have a scheduled inspection of the site coming up, this will
be noted as part of their inspection report, but at this time will not constitute a
violation EH has also been in communications with Planning and keeping
them appnsed of the situation and what, if any, actions they would like to see
They seem to be in agreement with our current approach
May 6, 2022 Planning staff conducting a site inspection of the property and property
penmeter to determine compliance with the Development Standards
associated with each permit
May 18, 2022 EHS conducts site inspection of NWLF
May 23, 2022 We [EHS] are currently working on the inspection letter, inspection performed
last Wednesday, and are planning on including the debris issue as part of that
(they are in violation of their USR by noncompliance with site Development
Standards) I think we should have the completed in the coming 10 days or so
May 27, 2022 Planning staff conducting a site inspection of the property and property
perimeter to determine compliance with the Development Standards
associated with each permit

August 15, 2022 Tom Schweitzer, W -M, reached out to Planning Services to schedule a follow-
up site inspection of the property and property perimeter to determine
compliance with the Development Standards associated with each permit
August 25, 2022 Representatives from Planning Services, Kim Ogle, and Environmental Health
Ryan Fernandez, met with Tom Schweitzer, Engineenng Manager W -M, Chris
Anderson, District Manager W -M, and Cody Myers, Operations Manager, W -
M to obtain a verbal update on progress made to bring the, facility into
compliance The group toured the facility by vehicle specifically to observe
litter control measures, including litter mesh installation, future mesh
installation, debns field onsite and off -site and implementation of a landscape
buffer adjacent to State Highway 14 -

and Special Review Permit is for a solid waste disposal site and facility as
submitted in the application matenals on file in the Department of Planning
Services and subject to the Development Standards stated herein Only 119
acres of the 170 -acre parcel shall be used for phased waste filling The
maximum height of the final grade shall not exceed an elevation of 5,210 feet
above mean sea level

Summary:
For case number USR-895, known as North Weld Landfill Unit 1, Planning Services finds the operation
of the facility is not in compliance with
Development Standard No 1 of USR-895 states
The Site Specific Development Plan and Special Review Permit is for a solid waste disposal site and
facility as submitted in the application materials on file in the Department of Planning Services and
subject to the Development Standards stated herein Only 119 acres of the 170 -acre parcel shall
be used for phased waste filling The maximum height of the final grade shall not exceed an elevation
of 5,210 feet above mean sea level
Development Standard No 11 of USR-895 states
The facility shall be operated in a manner to control blowing debris at all times Operation dunng windy
penods shall be accomplished in a manner that controls blowing debns Any debns found outside the
working face or adjacent to the facility will be picked up within 24 hours The fence on the perimeter
of the property, State Highway 14, Weld County Road 25, and roads on the penmeter of the waste
disposal facility, shall be patrolled daily by the facility staff to assure trash is picked up The manager
of the facility will respond to requests for picking up trash along these routes within 24 hours of
notification by County Health Department personnel
The following operational measures shall also be employed to control blowing litter at the site
a At the end of each day, application of six inches of soil cover shall be placed over the working
face Soil cover will be placed on waste as soon as possible on days when wind is a noticeable
problem
b The working face shall be enclosed on three sides with a minimum 15 -foot screen while
accepting waste A five-foot fence shall enclose the cell containing the working face A
six-foot fence shall be placed along the property lines of the 170 -acre parcel
c Dunng windy periods not defined as high winds according to State Health Regulations, the
size of the working face shall be reduced if trash is escaping the three -sided 15 -foot screen
around the working face The working face shall be reduced to a size that eliminates trash
escaping from the screen
d Pnor to accepting waste, a letter, approved by the Department of Planning Services' staff, shall
be mailed to all surrounding property owners within one-half mile of the landfill boundanes
The letter shall indicate the following information
i The prograrrifi that the landfill operators will use to pick up off -site windblown trash
n The name and telephone number of the person or persons to call for pick- up of
windblown trash
e The operation shall cease dunng penods when high winds are present High winds are defined
in Section 1 2 31 of the Colorado Department of Health's Solid Waste Disposal Site and
Facilities Regulations
Development Standard No 26 of USR-895 states
The property owner or operator shall comply with the Design Standards of Weld County Zoning
Ordinance
Development Standard No 27 of USR-895 states
The property owner or operator shall be responsible for complying with the Operation Standards of
Section 24 6 of the Weld County Zoning Ordinance
Development Standard No 30 of USR-895 states
The property owner or operator shall be responsible for maintaining the approved landscape plan
Development Standard No 31 of USR-895 states
The owner or operator shall comply with Weld County Ordinance 53
Development Standard No 35 of USR-895 states
The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the Permit by the Board of County Commissioners
For case number USR18-0065, known as North Weld Landfill Unit 2, Planning Services finds the
operation of the facility is not in compliance with
Development Standard No 1 of USR18-0065 states
The Site Specific Development Plan and Use By Special Review Permit, USR18-0065, is for a
Solid Waste Disposal Site and Facilities, pursuant to Colorado State Statute and as defined and
regulated by Colorado Department of Public Health and Environment, and continued use of
existing facilities site access, shop, office, scale, scale house, flare, and solid waste management
of recyclable commodities, et cetera, associated with USR-895, in the A (Agricultural) Zone
District, subject to the Development Standards stated hereon
Development Standard No 7 of USR18-0065 states
The fencing onsite shall be maintained
Development Standard No 17 of USR18-0065 states
Waste matenals shall be handled, stored, and disposed of in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions The facility shall operate in accordance
with Chapter 14, Article I, of the Weld County Code and with the approved EDOP
Development Standard No 33
The operation shall comply with all applicable rules and regulations of state and federal agencies and
the Weld County Code
Development Standard No 34 of USR18-0065 states
The property owner or operator shall be responsible for controlling noxious weeds on the site,
pursuant to Chapter 15, Articles I and II, of the Weld County Code
Development Standard No 44 of USR18-0065 states
The property owner or operator shall be responsible for complying with the Design and Operation
Standards of Chapter 23 of the Weld County Code
Development Standard No 47 of USR18-0065 states
The property owner or operator shall be responsible for complying with all the foregoing
Development Standards Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the Permit by the Board of County Commissioners
Staff recommendation
The applicant shall bnng the property into compliance, as enumerated here
Development Standard No 11 of USR-895 states

with Chapter 14, Article I, of the Weld County Code and with the approved EDOP (USR18-0065
D S #17)
The property owner or operator shall be responsible for maintaining the approved landscape plan
(Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the
earliest possible time) (USR-895 D S # 30)
Based on the concerns raised by the Departments of Public Health and Environment and Planning
Services, the Department of Planning Services requests the Board of County Commissioners review
the operation of USR-895, including Development Standards #1, #11, #26, #27, #30, #31 and #35 and
USR18-0065 including Development Standards #1, #7, #17, #33, #34, #44, and #47
The manager of the North Weld Landfill in early June 2022, James Reed, was notified of the Probable
Cause hearing in letter dated June 1, 2022 If the Board determines that the facility is not operating in
compliance with the two (2) approved USR Resolutions, the Board of County Commissioners may
schedule a Show Cause public heanng to consider revocation of the Use by Special Review permit
The Board of County Commissioners took action at the June 16, 2022 hearing and continued the two
cases to August 31, 2022 to allow Waste Management Disposal Services of Colorado, Inc to address
the issues brought to the -attention of the Board of County Commissioners

Hi Kim
We appreciate you taking the time to visit the site Thursday. The purpose of this email is to outline the
work performed at the site since the hearing, as well as plans to improve conditions and mitigate
potential nuisance conditions moving forward.
Since the spring wind events and County Commissioner's hearing, damage to the tall litter fencing has
been repaired, which included replacing 13 of the 70 tall fence panels. Twenty additional netting panels
were purchased and are stockpiled onsite to enable quicker replacement of panels in the event of future
damage. Further, we plan to install a tall litter fence along the east side of the landfill later this year or
early next year, subject to vendor availability.
Litter has been picked up from areas offsite and areas visible from adjacent roadways. At the active
disposal area, 240 feet of new, portable, 16 -foot -tall litter fences were purchased and are in
place. Combined with our previous portable litter fences, the active disposal area is surrounded on
three sides by portable litter fences. As you know, collection of wind-blown litter onsite is a daily,
continuous process, but we believe the site is in good condition and in compliance with USR
Development Standards.
Regarding the landscape plan, we are engaging a landscape contractor to install a new irrigation system,
remove dead trees and replace with new trees. Based on discussion with landscape experts, we plan to
replace deciduous trees with drought -resistant evergreens, such as Ponderosa and Pinon Pines,
approximately 6 -feet in height. Installation of the new irrigation system and removal of dead trees is
expected to begin in September; however, the landscape contractor strongly recommends that we wait
until next spring to replant new trees, to ensure a good selection of "A -Grade" trees and to allow
sufficient time for them to become established during a full growing season.
We are also planning to cap and close portions of Unit 1 that are near design grade and will not be
affected by further fill operations associated with Unit 2. Specific locations and timing are yet to be
determined, but it is anticipated to occur in 2023-2024.
Although the 2022 wind events were unprecedented and should be considered an "Act of God", we
recognize that there are opportunities to better prepare for future events and better communicate
when they inevitably occur, which will be our focus moving forward. In addition to other options being
considered, have contracted with additional temporary labor vendors, so we have access to more
laborers when a wind event occurs.

improving our operations to better serve the community and minimize potential impact on our

Planning Services and Environmental Health [EHS] reach out to James Reed Manager
NWLF by e-mail:
We (ENS) are receiving numerous complaints concerning blowing debris from the
North Weld Landfill. I know work is underway concerning repairs to the fence, but it
appears that picking efforts and other containment efforts have not been effective or
satisfactory in removing offsite debris or containing debris to the site. As you know,
this is a violation to the USR. We need an updated debris management plan for how
all offside debris will be handled, when fixes are anticipated and how future debris will
be contained. Based on the number of complaints we need this information by end of
day.
James Reed responds to EHS:
Thank you for your time this afternoon to discuss the issues we have been currently
faced with our windblown surrounding litter at NWLF. Presently our plan is to utilize
two different temp agencies to maximize the amount temporary labor litter pickers (10-
15 labors) to assist in cleaning our surrounding neighbors, working farthest from the
landfill, then in. Before and after litter picking, I will follow up with our neighbors to
ensure we are satisfied with the clean up on their property.
In addition, we are working on the repair for 14 of our down litter fence netting on the
south side of NWLF. At this time the netting has been ordered and planned for
installation around May 9th 2022. We apologize for this inconvenience and look to
getting this issues resolved immediately.
April 26, 2022 Planning email to James Reed
The Commissioners office continues to receive calls of complaint with the blowing
debris off of the landfill. Two weeks past you indicated that the net material was on
order and would be delivered in 7-10 days. As this date may have passed, the planning
office is seeking an update on the status of the efforts to collect the debris from your
site and more importantly the neighboring fields and subdivisions.
The debris field is widespread — County Road 21 east to County Road 29, north of
County Road 84 and south of County Road 80 — Representative photographs taken
on Sunday are attached.
Please provide an update on the status of the W -M clean-up efforts and what action
Weld County can anticipate in the future to maintain compliance with the current land
use permit.

Thank you again for the support and communication upon NWLF windblown issues
surround the property. Following our conversation earlier this week we have utilized
approximately 10-14 laborers per day to clean the surrounding properties from
Belmont Farms, CR 23- CR 27 North and South of HWY 14, Drake Farms and South
of NWLF litter Fencing along HWY 14. We are currently working with our fence vendor
to start installation to the 14 damage wind panels by May 9th 2022.The present
forecast is projecting 30mph sustained and 45 mph wind gust today and tomorrow. If
we have any litter exposure we will ensure to follow up with our neighbors and focus
on our surrounding property first thing Monday morning. In addition we will clean along
HWY 14 to Double J Farms.

We [EH5] did a visual inspection of the site earlier this week. Significant progress has
been made, but still needs to be monitored to ensure they continue debris removal
(which we will do). They are still working with the fencing company to get replacement
parts and hope in the next 10 days to start repairs. We have a scheduled inspection of
the site coming up, this will be noted as part of their inspection report, but at this time
will not constitute a violation. EH has also been in communications with Planning and
keeping them apprised of the situation and what, if any, actions they would like to see.
They seem to be in agreement with our current approach.

Summary:
For case number USR-895, known as North Weld Landfill Unit 1, Planning Services finds the operation
of the facility is not in compliance with:
Development Standard No. 1 of USR-895 states:
The Site Specific Development Plan and Special Review Permit is for a solid waste disposal site and
facility as submitted in the application materials on file in the Department of Planning Services and
subject to the Development Standards stated herein. Only 119 acres of the 170 -acre parcel shall
be used for phased waste filling. The maximum height of the final grade shall not exceed an elevation
of 5,210 feet above mean sea level.
Development Standard No. 11 of USR-895 states:
The facility shall be operated in a manner to control blowing debris at all times. Operation during windy
periods shall be accomplished in a manner that controls blowing debris. Any debris found outside the
working face or adjacent to the facility will be picked up within 24 hours. The fence on the perimeter
of the property, State Highway 14, Weld County Road 25, and roads on the perimeter of the waste
disposal facility, shall be patrolled daily by the facility staff to assure trash is picked up. The manager
of the facility will respond to requests for picking up trash along these routes within 24 hours of
notification by County Health Department personnel.
The following operational measures shall also be employed to control blowing litter at the site:
a. At the end of each day, application of six inches of soil cover shall be placed over the working
face. Soil cover will be placed on waste as soon as possible on days when wind is a noticeable
problem
b. The working face shall be enclosed on three sides with a minimum 15 -foot screen while
accepting waste. A five-foot fence shall enclose the cell containing the working face. A
six-foot fence shall be placed along the property lines of the 170 -acre parcel.
c. During windy periods not defined as high winds according to State Health Regulations, the
size of the working face shall be reduced if trash is escaping the three -sided 15 -foot screen
around the working face. The working face shall be reduced to a size that eliminates trash
escaping from the screen.
d. Prior to accepting waste, a letter, approved by the Department of Planning Services' staff, shall
be mailed to all surrounding property owners within one-half mile of the landfill boundaries.
The letter shall indicate the following information:
i. The program that the landfill operators will use to pick up off -site windblown trash.
ii. The name and telephone number of the person or persons to call for pick- up of
windblown trash.
e. The operation shall cease during periods when high winds are present. High winds are defined
in Section 1.2.31 of the Colorado Department of Health's Solid Waste Disposal Site and
Facilities Regulations.
Development Standard No. 26 of USR-895 states:
The property owner or operator shall comply with the Design Standards of Weld County Zoning
Ordinance.
Development Standard No. 27 of USR-895 states:
The property owner or operator shall be responsible for complying with the Operation Standards of
Section 24.6 of the Weld County Zoning Ordinance.
Development Standard No. 30 of USR-895 states:
The property owner or operator shall be responsible for maintaining the approved landscape plan.
Development Standard No. 31 of USR-895 states:
The owner oroperator shall comply with Weld County Ordinance 53.
Development Standard No. 35 of USR-895 states:
The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the Permit by the Board of County Commissioners.
For case number USR18-0065, known as North Weld Landfill Unit 2, Planning Services finds the

Development Standard No. 7 of USR18-0065 states:
The fencing onsite shall be maintained.
Development Standard No. 17 of USR18-0065 states:
Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions. The facility shall operate in accordance
with Chapter 14, Article I, of the Weld County Code and with the approved EDOP.
Development Standard No. 33
The operation shall comply with all applicable rules and regulations of state and federal agencies and
the Weld County Code
Development Standard No. 34 of USR18-0065 states:
The property owner or operator shall be responsible for controlling noxious weeds on the site,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
Development Standard No. 44 of USR18-0065 states:
The property owner or operator shall be responsible for complying with the Design and Operation
Standards of Chapter 23 of the Weld County Code.
Development Standard No. 47 of USR18-0065 states:
The property owner or operator shall be responsible for complying with all the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the Permit by the Board of County Commissioners.
Staff recommendation:
The applicant shall bring the property into compliance, as enumerated here:

Based on the concerns raised by the Departments of Public Health and Environment and Planning
Services, the Department of Planning Services requests the Board of County Commissioners review
the operation of U5R-895, including Development Standards #1, #11, #26, #27, #30, #31 and #35 and
USR18-0065 including Development Standards #1, #7, #17, #33, #34, #44, and #47.
The manager of the North Weld Landfill in early June 2022, James Reed, was notified of the Probable
Cause hearing in letter dated June 1, 2022. If the Board determines that the facility is not operating in
compliance with the two (2) approved USR Resolutions, the Board of County Commissioners may
schedule a Show Cause public hearing to consider revocation of the Use by Special Review permit.
The Department of Planning Services is recommending the Show Cause hearing be set out six (6)
months from the date of this hearing to allow time for Waste Management to address the issues
presented here, and to bring the facility into compliance with the two approved USRs, USR-895 and
USR18-0065.

--DEVELOPMENT STANDARDS
WASTE SERVICES CORPORATION
1. The Site Specific Development Plan and Special Review Permit
is for a solid waste disposal site and facility as submitted
in the application materials on file in the Department of
Planning Services and subject to the Development Standards
stated herein. Only 119 acres of the 170 -acre parcel shall
be used for phased waste filling. The maximum height of the
final grade shall not exceed an elevation of 5,210 feet above
mean sea level.
2. Approval of- this plan -may create a vested property right
pursuant to Article 68 of Title 24 C.R.S., as amended.
3. Only household, industrial, and commercial solid waste shall
be accepted. This includes only non -hazardous,
non -radioactive waste. No liquid waste of any nature,
including semi -solid sludges and septic tank pumpage, shall
be accepted. All waste received at the facility shall be
inspected by all practical means available to insure the
appropriate wastes are being disposed at the facility. The
hours of operation shall generally be between 7:00 a.m. and
4:30 p.m., Monday through Saturday. The facility will be
closed on major legal holidays.
4. A manager, knowledgeable in operating a solid waste disposal
facility, shall be on the site when the facility is receiving
waste.
S. Each phase shall be constructed for waste filling by
excavating, lining the active area, .placing a leachate
collection system, filling with waste, and cover. A letter
from the Weld County Health Department and Colorado
Department of Health authorizing the use of phases 2, 3.a,
and 3.b shall be delivered to the Department of Planning
Services before using these phases.
6. The size of the working face shall not exceed 150 feet in
width and 15 feet in depth.
7. The clay liner and cap shall meet the following requirements:
a. The construction of liners shall be supervised by a
Colorado Registered Professional Engineer. The engineer
shall submit a final evaluation report on the
construction of each liner segment. The report shall
certify the liner meets the required specifications.
This report shall be reviewed for approval by the Weld
County Health Department and Colorado Department of
Health.

b. A two -foot thick clay liner with a maximum permeability
of 1.0 x 10 to the power of minus 7 centimeters per
second shall be installed following excavation -to final
depth.
The clay liner shall be placed in six (6) inch lifts and
compacted with a sheepsfoot compactor until•,t reaches a
compacted dry density equal to or greater than 95:0
percent of the standard protector density (ASTMD-698).
The moisture content of the material shall be maintained
from zero ,to four percent of the optimum moisture.
content. The.material used for the liner shall have a
plasticity index greater than ten, and have greater than
50 percent of the material passing a number 200 sieve.
c. Geotechnical testing shall be completed prior to
material installation to ensure the liner meets the
proper specifications. This shall include the
collection of a representative sample from each 3,000
cubic yards of intended liner material and from each
6,000 cubic yards of cap material. Testing shall
include a standard protector density test, a number 200
sieve wash, and plasticity index test.
d. An independent soil and material testing firm shall
observe and test materials placed for the liner and cap.
This testing shall include the cotpaction density and
moisture content at no less than a 100 -foot spacing for
each six-inch lift of liner material and 300 -foot
spacing for each scat inches of cap material.
e: The compacted cap material shall pass a minimum of 90
percent standard protector density test.
f. The completed portion of each phase shall be covered
with topsoils and revegetated as soon as practically
possible. The cover will be a minimum of three and
one-half feet.thick with the bottom two feet consisting
of compacted clay, one foot consisting of unspecified
soil, and one-half foot of topsoil for reclamation.
g. To ensure that adequate material is available for the
liner, daily cover and cap, an annual Material balance
shall be made by a qualified engineer.

8. The facility shall be operated in a manner which protects
against surface and groundwater contamination. A groundwater
monitoring plan, including leachate detection and groundwater
monitoring wells, periodic sampling, and monitoring shall be
implemented by the facility operator. This plan shall be
reviewed and approved by the Colorado Department of Health
and the Weld County Health Department. The plan shall be
reviewed at least once every two years by the State and
County Health Departments. Changes and updates to the plan
shall be facilitated by the operator as required by the
reviewing -agencies.
9. The leachate collection system shall be placed above the clay
liner in the bottom of each phase. This shall consist of a
six-inch outside diameter schedule 80, perforated PVC drain
pipe installed in the bottom center of a 24 -inch keyway. A
12 -inch outside diameter steel riser pipe shall extend from
the base of the sump to the surface beyond the filling area.
10. Surface water run-on shall be controlled to ensure that it
will not be allowed to enter the active working face. Also
any surface water which falls on the working face will not be
allowed to leave the site.
11. The facility shall be operated in a manner to control blowing
debris at all times. Operation during windy periods shall be
accomplished in a manner that controls blowing debris. Any
debris found outside the working face or adjacent to the
facility will be picked up within 24 hours. The fence on the
perimeter of the property, State Highway 14, Weld County Road
. 25, ..and roads on the perimeter of the waste disposal
facility, shall be patrolled daily by *the facility staff to
assure trash is picked up. The manager of the facility will
respond to requests for picking up trash along these routes
within 24 hours of notification by County Health Department
personnel.
The following operational measures shall also be employed to
control blowing litter at the site:
a. At the end of each day, application of six inches of
soil cover shall be placed over the working face. Soil
cover will be placed on waste as soon as possible on
days when wind is a noticeable problem.

In addition, the groundwater monitoring parameters shall be.
modified to include all parameters listed in the document
submitted by the Colorado Department of Health titled, TABLE
I INITIAL BACKGROUND MONITORING. The first eight quarters
of monitoring, or some portion of it, may be concurrent with
landfilling.
The applicant shall comply with Section 2.2.3 (b) and (c) of
the Colorado Department of Health's Solid Waste Disposal_Site
and Facilities Regulations in terms of the analytical method
and statistical evaluation of groundwater monitoring data.
Generally, if toxicity exceeds 300 parts per billion in any
one sampling event, the operator shall include a volatile
organic compounds analysis for all wells until further notice
by the Colorado Department of Health. However, this
requirement may be modified once background data is collected
for the site.
13. Operational inspections of the entire facility shall be made
on a quarterly basis for the life of the landfill operation.
The inspections shall be made by an independent contractor
experienced with landfill operations. The inspections shall
be made to ensure that the landfill operation is progressing
in accordance with all aspects of the approved landfill plan.
Inspection reports shall be prepared and submitted to both
the weld County Health Department and the Colorado Department
of Health.
14. A system of wet/dry monitoring wells shall be placed on
500 -foot centers around the site and installed in a phased
manner as landfilling occurs. These wells shall be tested
for the presence of groundwater and methane gas.
All wells shall be completed to a minimum of ten feet beneath
the base of the landfill and with perforated intervals
reaching to within ten feet of the surface of landfill.
Construction of the wet/dry wells shall consist of a one -inch
outside diameter, PVC casing, with glued joints placed in
six-inch diameter borings. The casing shall be drilled or
slotted. The annular space shall be gravel packed to
approximately one foot above the slotted interval of the
casing. The remaining annular space shall be backfilled with
dry bentonite. Installation shall be as follows:

20. Fugitive dust shall be controlled on site at all times. In
the event that fugitive dust from the facility is determined
to be a nuisance by the weld County Health Department, a dust
abatement plan shall be submitted within ten days to the
Department for review and approval. Implementation of the
approved dust abatement plan shall begin within 24 hours of
approval by the County.
21. The septic system for the proposed office shall be designed
by a Colorado Registered Professional Engineer according to
the' held County' Individual Sewage Disposal Regulation:;.
Z2. The maximum permissible noise level shall not exceed the
industrial limit of 80db(A), as measured according to
25-12-102, Colorado Revised Statutes.
23. In the A (Agricultural) Zone District, drilling for -oil and
gas is a use by right and mining requires approval of a Use
by Special Review Permit. The landfill owner shall notify
the Department of Planning Services prior to drilling for oil
and gas. Prior to drilling, the Colorado Department of
Health and the Weld County Health Department will review
plans for drilling oil and gas on the 170 -acre parcel. The
review shall identify any impacts on the solid waste disposal
facility and determine compliance with all applicable
regulations.
24. The office and maintenance buildings, shall be painted and
maintained in an earthtone color.
25•. All construction on the property shall.be in accordance with
the requirements of the Weld County Building Code Ordinance.
26. The property owner or operator shall be responsible for
complying with the Design Standards of Section 24.5 of the
Weld County Zoning Ordinance.
27. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24.6 of the
Weld County .Zoning Ordinance.
28. Metal signs shall be posted at the customer entrance way.
The signs shall be a minimum of three feet in width and four
feet in length.

15. The landfill owner shall notify the Colorado Department of
Health and Weld County Health Department within five (5).

pick up off -site windblown trash.
ii. The name and telephone number of the person or
persons -to call for pick up of windblown trash. .16.
e. The operation shall cease during periods when high winds
are present. High winds are defined in Section 1.2.31
of the Colorado Department of Health's Solid Waste
Disposal Site and Facilities Regulations.
12. The site operator shall keep the following records on site to
be available for County and State review:

Health's Solid Waste Disposal Sites and Facilities

If determined by either department, confirmation testing will
be required. If an environmental problem is confirmed, the
operator will have an additional 30 days to evaluate the data
and present a specific plan of action.
A methane gas venting system shall be installed in the
12 -inch outside diameter steel riser pipe.
. The landfill operator shall maintain recycling bins at the
landfill entrance to receive mixed glass, newspaper,
aluminum, and recyclable plastic containers.
. Post -closure inspections shall include documentation of
surface cracking, erosion, slope angles, drainage, and
condition of vegetation. One of the inspections each year
will be made in late spring, when damage would most likely
occur due to thaw and run off. Any damage or other
deficiencies shall be promptly repaired.
The facility shall be operated in a manner which controls
odors. Odors detected off site shall not equal or exceed the
level of 31 -to -1 dilution threshold as measured pursuant to
Regulation 2 of the Colorado Air Pollution Control
Regulations.
29. During the life of the landfill, the applicant shall-maintaia
advisory signs on State Highway 14, if permitted by the
Division of Highways. The signs shall advise landfill users
the distance to the site and that all loads must be covered.
30. The property owner or operator shall be responsible for
maintaining the approved landscape plan.
31. The owner or operator shall comply with Weld County Ordinance
53.
32. The Use by Special Review shall not be transferred to another
operator or to any successors in interest or lessee of the
described property for operation of the facility without
written approval from the Board of County Commissioners.
33. Personnel from the Weld County Health Department, Weld County
Department of Planning Services, and Colorado Department of
Health shall be granted access onto the property at any
reasonable time in order to ensure the activities carried out
on the property comply with the Development Standards stated
herein and all applicable Weld County Regulations.
34. \The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services._ _ _
35. The 'property over or operator shall be responsible �o
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.
36. The applicant shall construct right -turn deceleration and
acceleration lanes and left -turn deceleration and
acceleration lanes prior to accepting and disposing of any
landfill waste. The engineering design shall be approved by
the Colorado Division of Highways.

Good morning
The Commissioners office continues to receive calls of complaint with the blowing debris off of the
landfill. Two weeks past you indicated that the net material was on order and would be delivered in 7-
10 days. As this date may have passed, the planning office is seeking an update on the status of the
efforts to collect the debris from your site and more importantly the neighboring fields and subdivisions.
The debris field is widespread — County Road 21 east to County Road 29, north of County Road 84 and
south of County Road 80 — Representative photographs taken on Sunday are attached.
Please provide an update on the status of the W -M clean-up efforts and what action Weld County can
anticipate in the future to maintain compliance with the current land use permit.

Subject: North Weld Landfill — 2022 First Semi -Annual Inspection
Dear Mr. Reed:
On May 18, 2022, Weld County Department of Public Health and Environment (WCDPHE), conducted a routine
inspection of the North Weld Landfill, located at 40000 Weld County Road 25 West of Ault in Weld County,
Colorado. The purpose of the inspection was to assess the facility's compliance status with respect to the Solid
Waste Disposal Sites and Facilities Act, CRS 30-20-100.5 et. seq. (the Act), the Regulations Pertaining to Solid
Waste Disposal Sites and Facilities, 6 CCR 1007-2, Part 1 (the Regulations), the facility's Certificate of
Designation (CD) and associated Use by Special Review (USR) permits. Currently, the site is operating under hvo
separate Use by Special Review Permits and CDs, USR-895 is associated with Unit One and USR18-0065 is
associated with Unit Two. However, both sites may share monitoring which covers the entirety of the sites.
WCDPHE will differentiate between the sites as needed with regard to specific violations in Development
Standards.
On May 7, 2021, Swift River, on behalf of Waste Management submitted "First Half 2021 Groundwater
Monitoring 14 -Day Notification of Statistically Significant Increase Above Background (SSI) for Chloride at Well
MW -10," in compliance with the Regulations to notify the Division and WCDPHE. The letter is confirmation of a
verified SSI above background for chloride at MW -10. In a letter dated November 10, 2021, titled, "CDPHE
Determination with Condition- North Weld Landfill (NV6'LF), Ault, Colorado- First Half 2021 Groundwater
Monitoring Alternative Source Demonstration (ASD) for Chloride at Well MW -10" it was determined that he State
general concurs with the evidence presented for the ASD. Please ensure any specific conditions outlined by the
CDPHE are followed.
According to the 2021 First Semi -Annual Groundwater Monitoring Report, there were multiple control limit
exceedances for inorganic parameters. Nitrite at monitoring well MW -9. Chloride, Beryllium, Lead, and Iron at
monitoring well MW -10. The following exceedances are outlined:
• Reported concentration for nitrite in MW -9 was 0.71 mg'L and was above the NPPL of 0.50mg/L,
therefore is identified as an initial NPPL exceedance.
• Verification re -sampling for chloride in MW -10 during this sampling event reported a concentration of
16mg'L and the CUSUM value 16mg/L remained above the control limit, resulting in an SSI during this
sampling event. Reported concentration for beryllium at in MW -10 was 1.5ug/L and above the NPPL of
1.0ug/L, therefore identified as an initial exceedance. Reported concentration for lead at MW -10 was
7.5ug/L and above the NPPL of 5.4ug/L, therefore identified as an initial exceedance. Reported
concentration for iron at MW -10 was 23mg/L and the CUSLTM of 22mg'L were above the control limit of
9mg/L, therefore identified as an initial statistical exceedance.
Verification re -sampling for all initial exceedances reported will occur during the regular 2021 Second Semi -

According to the 2021 Second Semi -Annual Groundwater Monitoring Report, there were no control limit
exceedances of inorganic parameters or VOC's reported above reporting limits. Chloride and turbidity were
reported to have decreased back to historic levels for MW -10. On November 10,2021, CHPHE approved WM's
ASD request for chloride in MW -10. Reported concentration for nitrite in MW -9 was non -detect and the initial
exceedance was not verified in the 2H21 groundwater report. Reported concentration for beryllium at in MW -10
was non -detect and therefore the initial exceedance was not verified in the 2H21 groundwater monitoring event.
Reported concentration for lead at MW -10 was non -detect and therefore the initial exceedance was not verified in
the 2H21 groundwater monitoring event. Reported concentration for iron at MW -10 was 4.6 mg/L and the CUSUM
of 4.2 mg/L which were below the control limit of 9mg/L, therefore the initial exceedance was not verified in the
2H21 groundwater monitoring event. It appears that the exceedances of inorganic parameters in the 1H21 GWMR
have been resolved in the 2H21 groundwater monitoring report. WCDPHE will continue to monitor future
groundwater monitoring events for any exceedances.
North Weld Landfill operates under an approved 2009 gas remediation plan prepared in response to previous elevated
methane concentrations. Since the original remediation plan, the facility has also incorporated additional monitoring of
GP -06, GP -07, and GP -05, with GP -05 and GP -06 currently being monitored monthly. The third Quarter 2021 Landfill
Gas Monitoring Report dated October 19, 2021, reported detections of methane in perimeter probes. GP-21was reported
at 6.0%, which was above regulatory threshold. Methane was also detected in GP -22 above regulatory threshold at
5.8%. The 2021 Fourth Quarter Gas Monitoring Report, on December 14, 2021, methane was detected in perimeter
probe GP -22 at 11.5c1/0 which exceeds the regulatory threshold. Methane was also detected in perimeter probe GP -20 at
1.3%, which is below the regulatory threshold. The 2022 First Quarter Gas Monitoring Report, on March 14, 2021,
methane was detected in perimeter probe GP -21 at 0.3% which is below the regulatory threshold. Methane was not
detected in any other probes, the shop, scale house, office, or confined spaces during this monitoring event. A table of
monitoring results for monthly events is provided below, with GP -05 continuing to remain under threshold while GP -06
shows a reduction from previous sampling to below threshold limits. GP -21 continues to remain under the regulatory
threshold since October 2021. GP -22 had methane exceedances in November and December of 2021 but has since
returned to below the regulatory threshold since January 2022. WCDPHE will continue to monitor future quarterly gas
monitoring reports for any exceedances.

fill area; within 100 feet of fill limits and more than 100 feet inside the Facility property boundary. Land use to the
south of the Facility is agricultural with no structures in the nearby vicinity. GP -21 and -22 are located along the eastern
limits of the fill area; within 100 feet of fill limits and more than 1,000 feet inside the Facility property boundary. The
Facility will continue monthly monitoring at gas monitoring probes GP -05, and -06 and assess the collection system's
effectiveness. Based on these details as well as the results of the above -listed reports, the Division accepts the gas
monitoring reports for 2020." WCDPHE agrees with the CDPHE letter and does not see need for further action
regarding the 2009 Remediation Plan or the perimeter probes at this time. Please continue to include WCDPHE on
future landfill gas monitoring reports, correspondence, and construction of expanded gas collection system. Based on
the decrease in methane and the approval from the State, additional notation of this issue will not occur in future
inspection reports unless a statically relevant increase is noted in the report
The Weld County Health Department has received numerous complaints about blowing debris and nuisance conditions
taking place at the North Weld Landfill. It was found that during high winds, the facilities netting located along the
South side of the facility, boarding State Highway 14, was damaged beyond repair. The facility has responded to Weld
County Health Department personnel request to pick up blowing debris and has had weekly check ins on the status of
the situation. However, the netting is still not repaired. The netting is planned to be replaced by a third -party contractor
as soon as possible. The facility has also responded to neighbors' complaints and has been making efforts to control any
blowing debris and to cleanup neighboring properties with continuing high wind conditions. It was noted during the
first semi-annual inspection, that the facility has started working on the fluff layer for Unit Two and will soon be
moving its working face to this unit which WM personnel believe will help blowing debris from moving off site. Please
continue to include WCDPHE in updates on the repair of netting for the facility
According to USR-895, which is associated with Unit 1(the unit closer to HWY 14 and has been the primary disposal
unit for the facility), the facility is in violation of the following Development Standards during the 2022 First Semi -
Annual Inspection:
Development Standard No. 1 of USR-895 states:
The Site -Specific Development Plan and Special Review Permit is for a solid waste disposal site and facility as
submitted in the application materials on file in the Department of Planning Services and subject to the Development
Standards stated herein. Only 119 acres of the 170 -acre parcel shall be used for phased waste filling. The maximum
height of the final grade shall not exceed an elevation of 5,210 feet above mean sea level.
Development Standard No. 11 of USR-895 states:
The facility shall be operated in a manner to control blowing debris at all times. Operation during windy periods shall
be accomplished in a manner that controls blowing debris. Any debris found outside the working face or adjacent to
the facility will be picked up within 24 hours. The fence on the perimeter of the property, State Highway 14, Weld
County Road 25, and roads on the perimeter of the waste disposal facility, shall be patrolled daily by the facility staff
to assure trash is picked up. The manager of the facility will respond to requests for picking up trash along these
routes within 24 hours of notification by County Health Department personnel.
The following operational measures shall also be employed to control blowing litter at the site:
a. At the end of each day, application of six inches of soil cover shall be placed over the working face. Soil cover
will be placed on waste as soon as possible on days when wind is a noticeable problem
b. The working face shall be enclosed on three sides with a minimum 15 -foot screen while accepting waste.
A five-foot fence shall enclose the cell containing the working face. A six-foot fence shall be placed along the
property lines of the 170 -acre parcel.

face shall be reduced if trash is escaping the three -sided 15 -foot screen around the working face. The working
face shall be reduced to a size that eliminates trash escaping from the screen.
d. Prior to accepting waste, a letter, approved by the Department of Planning Senices' staff, shall be mailed to all
surrounding property owners within one-half mile of the landfill boundaries. The letter shall indicate the
following information:
i. The program that the landfill operators will use to pick up off -site windblown trash.
ii. The name and telephone number of the person or persons to call for pick- up of windblown trash.
e. The operation shall cease during periods when high winds are present. High winds are defined in Section 1.2.31
of the Colorado Department of Health's Solid Waste Disposal Site and Facilities Regulations.
Development Standard No. 35 of USR-895 states:
The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of
the Permit by the Board of County Commissioners.
The facility has recently started operating in Unit 2 under USR18-0065. Unit 2 has a separate USR and CD from Unit 1
(USR-895). The Waste Identification Plan (WIP) for both Units 1 & 2 are pending acceptance from CDPHE. Currently
the facility is operating under an interim variance that CDPHE approved on December 3, 2021, which temporarily
amends portions of the facility's WIP related to acceptance of TENORM wastes. The owner/'operator of the facility
plans to provide a revised WIP by March 31, 2022, to facilitate their desire to have the facility registered under Part 20.
According to USR 18-0065, during the 2022 First Semi -Annual Inspection, the facility is found to be in violations of
the following Development Standards:
Development Standard No. 1 of USR18-0065 states:
The Site Specific Development Plan and Use By Special Review Permit. USR18-0065, is for a Solid Waste
Disposal Site and Facilities. pursuant to Colorado State Statute and as defined and regulated by Colorado
Department of Public Health and Environment, and continued use of existing facilities: site access, shop, office,
scale, scale house, flare. and solid waste management of recyclable commodities. et cetera, associated with USR-
895. in the A (Agricultural) Zone District. subject to the Development Standards stated hereon.
Development Standard No. 7 of USR18-0065 states:
The fencing onsite shall be maintained.
Development Standard No. 17 of USR18-0065 states:
Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris,
and other potential nuisance conditions. The facility shall operate in accordance with Chapter 14, Article I, of
the Weld County Code and with the approved EDOP.
Development Standard No. 47 of USR18-0065 states:
The property owner or operator shall be responsible for complying with all the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of
the Permit by the Board of County Commissioners.

RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR A SOLID WASTE DISPOSAL SITE AND FACILITY - WASTE
SERVICES CORPORATION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 27th day of June, 1990, at the hour of 10:00 a.m.
in the Chambers of the Board for the purpose of hearing the
application of Waste Services Corporation, c/o Brad Keirnes, 6037
77th Avenue, Greeley, CO 80634, for a Site Specific Development
Plan and Special Review Permit for a solid waste disposal site and
facility located in the A (Agricultural) Zone District on the
following described real estate, to -wit:
The SW} of Section 7, Township 7 North, Range
66 West of the 6th P.M., Weld County, Colorado
WHEREAS, said applicant was represented by Brad Keirnes,
president of Waste Services Corporation, and John Houtchens,
Attorney, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant, the recommendations of the Weld County Planning
Department and the Weld County Health Department and all of the
exhibits and evidence presented in this matter and, having been
fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the
application requirements of Section 24.7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24.4.2 of the Weld County Zoning Ordinance as follows:
a. The proposed use is located in an agricultural area
and the 170 -acre parcel is currently used for
dryland farming. The soils located on this parcel
are considered non -prime agricultural land. The
operation of the proposed use will not interfere
with agricultural activities in this area. For

these reasons, the proposed use complies with the
Comprehensive Plan's Agricultural Goals and
Policies.
b. The proposed use conforms to all applicable
federal, state, and local regulations. The site
design, facility operation plan, Conditions of
Approval, and Development Standards will make the
use compatible with the surrounding agricultural
uses. For these reasons, the proposed use complies
with the Comprehensive Plan's Environmental Quality
and Natural Resource Goals and Policies.
c. The proposed use is located in the A (Agricultural)
Zone District. The parcel is used for dryland
farming, and prime farm land would not be removed
from production. The proposed Conditions and
Development Standards will make the use consistent
with the intent of the A (Agricultural) Zone
District.
d. The proposed use will be compatible with the
existing surrounding land uses. Surrounding land
use activities include dryland and irrigated
farming operations.
e. The proposed use will be compatible with the future
development of the surrounding area. The
surrounding area is intended to remain agricultural
and provide for the conduct of other uses by right,
accessory uses, and uses by special review in the A
(Agricultural) Zone District.
f. The proposed use is not located in an Overlay
District area.
g The applicant has selected a parcel used for
dryland farming in the locational decision for the
proposed use.
h. The Conditions of Approval and Development
Standards provide adequate provision for the
protection of the health, safety, and welfare of
the inhabitants of the neighborhood and the County.
i. The submitted application materials demonstrate a
need for the proposed solid waste disposal site and
facility. The northern Weld County area does not
have a long range, cost effective, solid waste

disposal facility. The landfill located in the
Town of Nunn has been closed. The Eaton landfill
located two and one-half miles northeast of Eaton,
which also serves a portion of northern Weld
County, is scheduled for closure in April, 1991,
or when it's full, whichever comes first. The
nearest regional landfill is the Central Weld
Landfill. This 108 -acre landfill is located two
miles northeast of the Town of Milliken. The
proposed site has a primary service area of
approximately 339 square miles with a population of
20,000 people. The service area includes the Towns
of Ault, Eaton, Nunn, Pierce, Severance, and
Windsor. The service area also includes a portion
of northern Greeley and inhabitants of
unincorporated Weld County.
The proposed site has been recommended for approval
by the Colorado Department of Health and the Weld
County Health Department. The site will provide a
long range, cost effective facility capable of
meeting the existing and future needs of the
service area population.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for a
solid waste disposal site and facility on the hereinabove
described parcel of land be, and hereby is, granted subject to the
following conditions:
1. The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the Weld County Clerk and
Recorder's Office within sixty (60) days of approval by
the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.
3. Prior to recording the special review plat:
a. The applicant shall submit a revised cover and
revegetation plan approved by the Colorado

Department of Health. The plan shall be reviewed
by the Greeley Soil Conservation Office and its
recommendation submitted to the Colorado Department
of Health and Department of Planning Services. The
plan shall consider the requests of the Colorado
Division of Wildlife. The plan shall outline the
design effect of a 25 -year, 24 -hour precipitation
event on the crown and area created by the four to
one sideslope. The integrity of the crown shall be
addressed. The seeding of the sideslope shall
include all sod forming species. The plan shall
also consider the effects of wind erosion at the
site.
b. The applicant shall submit a revised leachate
collection and removal system approved by the
Colorado Department of Health.
c. The applicant shall submit a performance agreement
guaranteeing closure and post -closure monitoring of
the solid waste disposal site and facility. The
agreement shall outline the costs associated with
closure and post closure monitoring. The Board of
County Commissioners shall approve the agreement
and the form of performance guarantees. The agreed
upon guarantee shall be submitted to Weld County.
d. The applicant shall submit a landscape plan for the
200 -toot setback area along the south property
line, and for the additional area on the parcel
east and adjacent to the property as described in
the June 22 letter from Mr. Brad Reirnes. The plan
shall be referred to the Greeley Soil Conservation
Service and Division of Wildlife for review
recommendations. The plan shall be approved by the
Department of Planning Services.
e. The plat shall be amended to show:
1. A total of 75 feet of right-of-way reserved
from the centerline on the north side of State
Highway 14.
2. The boundaries of the four phases used for the
waste filling.
3. The boundaries of the approved landscaped
plan. The type, size, and location of plant

material within the landscaped area shall be
identified.
f. The applicant shall submit an agreement for the
construction of right -turn deceleration and
acceleration lanes and left turn deceleration and
acceleration lanes approved by the Colorado
Division of Highways. The plat shall be amended to
show the right -turn and left -turn deceleration and
acceleration lanes.
g•
The applicant shall submit a letter from the
Colorado Division of Highways stating that the
design of the surface runoff flow toward the
highway drainage system has been reviewed, and it
will not exceed the historical runoff rate.
h. The applicant shall submit a road improvement and
maintenance agreement for Weld County Road 25. The
agreement shall be approved by the Board of County
Commissioners.
The above and foregoing Resolution was, on motion duly made

DEVELOPMENT STANDARDS
WASTE SERVICES CORPORATION
1. The Site Specific Development Plan and Special Review Permit
is for a solid waste disposal site and facility as submitted
in the application materials on file in the Department of
Planning Services and subject to the Development Standards
stated herein. Only 119 acres of the 170 -acre parcel shall
be used for phased waste filling. The maximum height of the
final grade shall not exceed an elevation of 5,210 feet above

2. Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 C.R.S., as amended.
3. Only household, industrial, and commercial solid waste shall
be accepted. This includes only non -hazardous,
non --radioactive waste. No liquid waste of any nature,
including semi -solid sludges and septic tank pumpage, shall
be accepted. All waste received at the facility shall be
inspected by all practical means available to insure the
appropriate wastes are being disposed at the facility. The
hours of operation shall generally be between 7:00 a.m. and
4:30 p.m., Monday through Saturday. The facility will be
closed on major legal holidays.
4. A manager, knowledgeable in operating a solid waste disposal
facility, shall be on the site when the facility is receiving
waste.
5 Each phase shall be constructed for waste filling by
excavating, lining the active area, placing a leachate
collection system, filling with waste, and cover. A letter
from the Weld County Health Department and Colorado
Department of Health authorizing the use of phases 2, 3.a,
and 3.b shall be delivered to the Department of Planning
Services before using these phases.
6 The size of the working face shall not exceed 150 feet in
width and 15 feet in depth.
7. The clay liner and cap shall meet the following requirements:
a. The construction of liners shall be supervised by a
Colorado Registered Professional Engineer. The engineer
shall submit a final evaluation report on the
construction of each liner segment. The report shall
certify the liner meets the required specifications.
This report shall be reviewed for approval by the Weld
County Health Department and Colorado Department of
Health.

b. A two -foot thick clay liner with a maximum permeability
of 1.0 x 10 to the power of minus 7 centimeters per
second shall be installed following excavation to final
depth.
The clay liner shall be placed in six (6) inch lifts and
compacted with a sheepsfoot compactor until it reaches a
compacted dry density equal to or greater than 95.0
percent of the standard protector density (ASTMD-698).
The moisture content of the material shall be maintained
from zero to four percent of the optimum moisture
content. The material used for the liner shall have a
plasticity index greater than ten, and have greater than
50 percent of the material passing a number 200 sieve.
c. Geotechnical testing shall be completed prior to
material installation to ensure the liner meets the
proper specifications. This shall include the
collection of a representative sample from each 3,000
cubic yards of intended liner material and from each
6,000 cubic yards of cap material. Testing shall
include a standard protector density test, a number 200
sieve wash, and plasticity index test.
d. An independent soil and material testing firm shall
observe and test materials placed for the liner and cap.
This testing shall include the compaction density and
moisture content at no less than a 100 -foot spacing for
each six-inch lift of liner material and 300 -foot
spacing for each six inches of cap material.
e. The compacted cap material shall pass a minimum of 90
percent standard protector density test.
f. The completed portion of each phase shall be covered
with topsoils and revegetated as soon as practically
possible. The cover will be a minimum of three and
one-half feet thick with the bottom two feet consisting
of compacted clay, one foot consisting of unspecified
soil, and one-half foot of topsoil for reclamation.
g. To ensure that adequate material is available for the
liner, daily cover and cap, an annual material balance
shall be made by a qualified engineer.

8. The facility shall be operated in a manner which protects
against surface and groundwater contamination. A groundwater
monitoring plan, including leachate detection and groundwater
monitoring wells, periodic sampling, and monitoring shall be
implemented by the facility operator. This plan shall be
reviewed and approved by the Colorado Department of Health
and the Weld County Health Department. The plan shall be
reviewed at least once every two years by the State and
County Health Departments. Changes and updates to the plan
shall be facilitated by the operator as required by the
reviewing agencies.
9. The leachate collection system shall be placed above the clay
liner in the bottom of each phase. This shall consist of a
six-inch outside diameter schedule 80, perforated PVC drain
pipe installed in the bottom center of a 24 -inch keyway. A
12 -inch outside diameter steel riser pipe shall extend from
the base of the sump to the surface beyond the filling area.
10. Surface water run-on shall be controlled to ensure that it
will not be allowed to enter the active working face. Also
any surface water which falls on the working face will not be
allowed to leave the site.
11. The facility shall be operated in a manner to control blowing
debris at all times. Operation during windy periods shall be
accomplished in a manner that controls blowing debris. Any
debris found outside the working face or adjacent to the
facility will be picked up within 24 hours. The fence on the
perimeter of the property, State Highway 14, Weld County Road
25, and roads on the perimeter of the waste disposal
facility, shall be patrolled daily by the facility staff to
assure trash is picked up. The manager of the facility will
respond to requests for picking up trash along these routes
within 24 hours of notification by County Health Department
personnel.
The following operational measures shall also be employed to
control blowing litter at the site:
a. At the end of each day, application of six inches of
soil cover shall be placed over the working face. Soil
cover will be placed on waste as soon as possible on
days when wind is a noticeable problem.

b. The working face shall be enclosed on three sides with a
minimum 15 -foot screen while accepting waste. A
five-foot fence shall enclose the cell containing the
working face. A six-foot fence shall be placed along
the property lines of the 170 -acre parcel.

to all surrounding property owners within one-half mile
of the landfill boundaries. The letter shall indicate

i. The program that the landfill operators will use to
pick up off -site windblown trash.
ii. The name and telephone number of the person or
persons to call for pick up of windblown trash.
e. The operation shall cease during periods when high winds
are present. High winds are defined in Section 1.2.31
of the Colorado Department of Health's Solid Waste
Disposal Site and Facilities Regulations.
12. The site operator shall keep the following records on site to
be available for County and State review:
a. Quarterly inspection by an independent engineer.
b. Litter policing reports.
c. Volume and types of incoming waste.
d. Results of wind, methane and water quality monitoring.
e. Any special waste accepted at the facility.
f. Construction quality assurance and control
documentation.

In addition, the groundwater monitoring parameters shall be
modified to include all parameters listed in the document
submitted by the Colorado Department of Health titled, TABLE
I, INITIAL BACKGROUND MONITORING. The first eight quarters
of monitoring, or some portion of it, may be concurrent with
landfilling.
The applicant shall comply with Section 2.2.3 (b) and (c) of
the Colorado Department of Health's Solid Waste Disposal Site
and Facilities Regulations in terms of the analytical method
and statistical evaluation of groundwater monitoring data.
Generally, if toxicity exceeds 300 parts per billion in any
one sampling event, the operator shall include a volatile
organic compounds analysis for all wells until further notice
by the Colorado Department of Health. However, this
requirement may be modified once background data is collected
for the site.
13. Operational inspections of the entire facility shall be made
on a quarterly basis for the life of the landfill operation.
The inspections shall be made by an independent contractor
experienced with landfill operations. The inspections shall
be made to ensure that the landfill operation is progressing
in accordance with all aspects of the approved landfill plan.
Inspection reports shall be prepared and submitted to both
the Weld County Health Department and the Colorado Department
of Health.
14. A system of wet/dry monitoring wells shall be placed on
500 -foot centers around the site and installed in a phased
manner as landfilling occurs. These wells shall be tested
for the presence of groundwater and methane gas.
All wells shall, be completed to a minimum of ten feet beneath
the base of the landfill and with perforated intervals
reaching to within ten feet of the surface of landfill.
Construction of the wet/dry wells shall consist of a one -inch
outside diameter, PVC casing, with glued joints placed in
six-inch diameter borings. The casing shall be drilled or
slotted. The annular space shall be gravel packed to
approximately one foot above the slotted interval of the
casing. The remaining annular space shall be backfilled with
dry bentonite. Installation shall be as follows:

15. The landfill owner shall notify the Colorado Department of
Health and Weld County Health Department within five (5)
working days if the following occurs:
a. The leachate system shows the presence of liquids
following the placement of the first lift.
b. Groundwater monitoring results detect a greater than .01
variation from the background results, in accordance
with Section 2.2.3 (c) of the Colorado Department of
Health's Solid Waste Disposal Sites and Facilities
Regulations
If determined by either department, confirmation testing will
be required. If an environmental problem is confirmed, the
operator will have an additional 30 days to evaluate the data
and present a specific plan of action.
16. A methane gas venting system shall be installed in the
12 -inch outside diameter steel riser pipe.
17. The landfill operator shall maintain recycling bins at the
landfill entrance to receive mixed glass, newspaper,
aluminum, and recyclable plastic containers.
18. Post -closure inspections shall include documentation of
surface cracking, erosion, slope angles, drainage, and
condition of vegetation. One of the inspections each year
will be made in late spring, when damage would most likely
occur due to thaw and run off. Any damage or other
deficiencies shall be promptly repaired.
19. The facility shall be operated in a manner which controls
odors. Odors detected off site shall not equal or exceed the
level of 31 -to -1 dilution threshold as measured pursuant to
Regulation 2 of the Colorado Air Pollution Control
Regulations.

20. Fugitive dust shall be controlled on site at all times. In
the event that fugitive dust from the facility is determined
to be a nuisance by the Weld County Health Department, a dust
abatement plan shall be submitted within ten days to the
Department for review and approval. Implementation of the
approved dust abatement plan shall begin within 24 hours of
approval by the County.
21. The septic system for the proposed office shall be designed
by a Colorado Registered Professional Engineer according to
the Weld County Individual Sewage Disposal Regulations.
22. The maximum permissible noise level shall not exceed the
industrial limit of 80db(A), as measured according to
25-12-102, Colorado Revised Statutes.
23. In the A (Agricultural) Zone District, drilling for oil and
gas is a use by right and mining requires approval of a Use
by Special Review Permit. The landfill owner shall notify
the Department of Planning Services prior to drilling for oil
and gas. Prior to drilling, the Colorado Department of
Health and the Weld County Health Department will review
plans for drilling oil and gas on the 170 -acre parcel. The
review shall identify any impacts on the solid waste disposal
facility and determine compliance with all applicable
regulations.
24. The office and maintenance buildings shall be painted and
maintained in an earthtone color.
25. All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
26. The property owner or operator shall be responsible for
complying with the Design Standards of Section 24.5 of the
Weld County Zoning Ordinance.
27. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24.6 of the
Weld County Zoning Ordinance.
28. Metal signs shall be posted at the customer entrance way.
The signs shall be a minimum of three feet in width and four
feet in length.

29. During the life of the landfill, the applicant shall maintain
advisory signs on State Highway 14, if permitted by the
Division of Highways. The signs shall advise landfill users
the distance to the site and that all loads must be covered.
30. The property owner or operator shall be responsible for
maintaining the approved landscape plan.
31. The owner or operator shall comply with Weld County Ordinance

32. The Use by Special Review shall not be transferred to another
operator or to any successors in interest or lessee of the
described property for operation of the facility without
written approval from the Board of County Commissioners.
33. Personnel from the Weld County Health Department, Weld County
Department of Planning Services, and Colorado Department of
Health shall be granted access onto the property at any
reasonable time in order to ensure the activities carried out
on the property comply with the Development Standards stated
herein and all applicable Weld County Regulations.
34. The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.

35. The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.
36. The applicant shall construct right --turn deceleration and
acceleration lanes and left -turn deceleration and
acceleration lanes prior to accepting and disposing of any
landfill waste. The engineering design shall be approved by
the Colorado Division of Highways.
