This facility is considered an existing major source of NOx and VOC under the TV and NANSR programs. This project is considered the addition of the two replacement engines. Several ROPE sources were permitted during 2021 and 2022 due to a regulatory change and not due to the addition of the new equipment. For that reason, these projects will not be grouped with the engine like -kind replacement. Federally enforceable limits of combined units of all individual criteria pollutants are below the significant emissions increase as defined in Regulation 3, Part D, Section II.A.44; therefore, this modification is not considered a Major Modification as defined in Regulation 3, Part D, Section II.A.23. As a result, this modification is not subject to NANSR review or PSD review. Significant emissions increase was based on the Actual -to -potential test for projects that only involve construction of a new emissions unit(s) as defined in Regulation 3, Part D, Section I.B.2. where SEI = PTE - BAE and BAE is defined in Regulation 3, Part D, Section II.A.4.c as zero. Therefore, SEI = PTE. However, uncontrolled VOC emissions are over the significant emissions increase as defined in Regulation 3, Part D, Section II.A.44; therefore, the source is avoiding NANSR requirements by obtaining federally enforceable limits and it is subject to public notice requirements. The Division has determined that this permitting action is subject to public comment per Colorado Regulation No. 3, Part B, Section III.C due to the following reason(s): • the source is requesting a federally enforceable limit on the potential to emit in order to avoid other requirements. The Division has made a preliminary determination of approval of the application. A copy of the application, the Division's analysis, and a draft of Construction Permit 22WE0235 Et 22WE0236 are available on the Division's website at https://www.colorado.gov/cdphe/air-permit-public-notices 2.02 COLORADO Department of Public Health 6 Environment The Division hereby solicits submission of public comment from any interested person concerning the ability of the proposed project or activity to comply with the applicable standards and regulations of the Commission. The Division will receive and consider written public comments for thirty calendar days after the date of this Notice.
