100 Ste 1, Nunn, CO 80648; (970) 692-0018, filed an application to conduct a(n) Surface mining and reclamation
operation, at or near Section , Township 9N, Range 66W, 06th Principle Meridian, in Weld County. Please be advised
that the permit area may be located in more than one Section, Township, and Range. Affected lands will be reclaimed
to support a(n) Rangeland post -mining land use. The application decision date is scheduled for November 16, 2022.
A copy of the application is available for review at the Weld County Clerk & Recorder's office and at the office of the
Division of Reclamation, Mining and Safety.

FOR REGULAR (112) CONSTRUCTION MATERIALS EXTRACTION OPERATION
NOTICE TO THE BOARD OF COUNTY COMMISSIONERS
Weld COUNTY
VIP MINE LLD (the "Applicant/Operator") has applied for a Regular (112) reclamation
permit from the Colorado Mined Land Reclamation Board (the "Board") to conduct the extraction of construction materials
operations in Weld County. The attached information is being provided to notify you of the
location and nature of the proposed operation. The entire application is on file with the Division of Reclamation, Mining, and
Safety (the "Division") and the local county clerk and recorder.
The applicant/operator proposes to reclaim the affected land to RANGELAND use. Pursuant to
Section 34-32.5-116(4)(m), C.R.S., the Board may confer with the local Board of County Commissioners before approving of
the post -mining land use. Accordingly, the Board would appreciate your comments on the proposed operation. Please note
that, in order to preserve your right to a hearing before the Board on this application, you must submit written comments on the
application within twenty (20) days of the date of last publication of notice pursuant to Section 34-32.5-112(10), C.R.S.

1. To the best of my knowledge, all significant, valuable and permanent man-made structure(s) in existence at the time
this application is filed, and located within 200 feet of the proposed affected area have been identified in this application
(Section 34-32.5-1 15(4)(e), C.R.S.).
2. No mining operation will be located on lands where such operations are prohibited by law
(Section 34-32.5-115(4)(f), C.R.S.;

Please accept this application for a new mining permit per the Regular 112 Operation application. This
application is consistent with the 'Construction Materials Rule 6'. This application has been prepared in
accordance with the 'Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for the
Extraction of Construction Materials' Effective July 15, 2019. Please refer to the attached Exhibits presented per
section 6.4 'Specific Exhibit Requirements -112 Reclamation operation'.
6.4.1 EXHIBITA — Legal Description

6.4.4 EXHIBIT D — Mining Plan
(a) This mine operation will consist of stripping the topsoil and storing in on the west end of the property.
The gravel will be mined out with excavators and screened to produce CDOT Class 5 and 6 roadbase
material. This material will be exported via WCR 29 to WCR 100. Larger aggregate will be piled and
stored onsite to be sold separately. Reclaiming will begin along the east end adjacent to Industrial Drive
by placing the topsoil at this location and reseeding.
(b) Earthmoving will be done with excavators, dozers, scrappers and trucks.
(c) No water is anticipated for this mining as the water table is so low.
(d) We anticipate beginning with the eastern most 10 acres and working west then north. The topsoil will
be stockpiled on the western edge of the property.
(e) We would like to start operations in July 2022 and anticipate mining these 40 acres over the next 5 years
with an anticipated reclamation beginning March of 2025.
The top 2 to 6 inches of topsoil of the 10 acres will be scrapped off and stockpiled along the west
end of the property to take 2 to 5 days per 10 acres. The next 20 to 25 feet will be mined for road
base. We anticipate mining 10 acres at a time over a one-year process. We anticipate reclamation
taking 5 to 30 days for soil placement and seeding.
(f) Please see the attached Exhibit C.h for location and arial mapping.
(i) The nature, depth and thickness of the deposit is approximately 60 feet. We are only mining the first
20 to 25 feet of the deposit.
(ii) The nature of the stratum immediately beneath the material is gravel `Dacono Clay Loam'.
(g) The Primary commodity is CDOT Class 5 and 6 Roadbase. The secondary commodity is aggregate larger
than % inch, typically 1 inch to 6 -inch cobble.
(h) The roadbase is to be sold and used for gravel public/private roadways and structural fill material. Larger
aggregate will be sold and used for construction operations, landscaping, etc.
(i) No explosives will be used in the mining of this gravel resource.
(j) Industrial Drive (WCR 29) is an existing gravel roadway in the Town of Nunn. This roadway has a driving
surface 30 feet in width in a 60 -foot Right -Of -Way. This roadway will be maintained by VIP Mine LLC
while the mine is in operation. No new improvements are needed for this roadway. No drainage or
runoff conveyance structures are anticipated for this site.
6.4.5 EXHIBIT E -Reclamation Plan
(1) Reclaiming this site will consist of placing the stored topsoil on top of all exposed areas 2 to 5 inches in
depth. The final side slopes shall not exceed 3 foot horizontal to 1 foot vertical (3:1). The topsoil will be
reseeded with native grasses. Reseeding will be done if necessary, within the first six months. No shrubs
or trees are proposed for reclamation. Drainage will be kept on site. The storm water will discharge into
the ground as the water table is very low.
(2) The reclamation reseeding will be done by drilling the seed in to the topsoil. This reclamation reseeding
will be done in the spring or early summer. We anticipate using a seed mix of slender hair grass, slender
wheat grass and annual hairgrass at a rate of 5 to 15 lbs per acre. We will consult with the local USGS for
their desired seed mix at the time of reclamation. The reseeding will be evaluated four months later and
reseeded if the reclamation has not covered at least 70% established.

The existing land use for this site is native pasture grass. The proposed post -mining use is native pasture
grass. The properties to the west and south are native pasture grass. The properties to the north and
east are large acre industrial.
This mining operation and reclamation will abide by the Division of Reclamation, Mining, and Safety
Code of Colorado Regulations Rule 3.1. Grading will be done to ensure adequate compaction and
stability. Erosion control will be done throughout the mining operation. No acid or toxic materials are to
be used in this mining process. Side slope shall be 4:1 maximum. No pollutants are anticipated to be
released from this site. No ground water is anticipated for this site. No wildlife will be affected at this
site. Any buildings will be temporary and removed for reclamation. Signs will be placed at the entrance
of the site of the name of the operator and permit numbers. Spills will be reported and cleanup up
immediately, if a spill happens.
6.4.6 EXHIBIT F — Reclamation Plan Map
(a) Please see the attached Exhibit F for a map of the mining area showing contours at 10 -foot intervals.
(b) The areas not being mined will stay as native grasses. The stockpiled topsoil will have a silt fence
around its perimeter. The topsoil will be placed on the final grade and seeded.
We have spoken with Tory Florain, US Forest Service in Ault CO —1-970-443-1993
trov.florain@state.co.us, about final grade and grass species.
6.4.7 EXHIBIT G — Water information
This mining operation is not expected to directly affect groundwater systems. We have dug holes in the
area to 25 feet depth and not encountered groundwater. If groundwater is found in this area. We will
stop excavation in that area and cover that area to at least one foot above ground water.
No water is expected to be used in the mining of this area. Intermediate storm water will be confined to
an area at the southeast corner of the site and allowed to percolate into the soil.
6.4.8 EXHIBIT H — Wildlife information
(1) We have contacted the local wildlife conservation officer —Troy Florian 970-443-1993.
(a) No significant wildlife resources at this site.
(b) This site is located within the Town limits of the Town of Nunn. This site is not a migration route.
(c) No threatened or endangered species are found on this site.
(d) No effect on wildlife is anticipated for the mining of this area.
6.4.9 EXHIBIT I — Soils Information
(1) The topsoil on this site is `Dacono Clay Loam'. According to USGS, this soil type in this area is only
good for farming if irrigated. Historically this site has never been farmed. Please see Exhibit C.

6.4.10 EXHIBIT J — Vegetation Information
(1) The vegetation for this area is native prairie grassland consisting of sparse low grasses. The topsoil
on this site is 'Dacono Clay Loam'. According to USGS, this soil type in this area is only good for
farming if irrigated. Historically this site has never been farmed. Please see Exhibit C.
6.4.11 EXHIBIT K — Climate
The climate for this area is 'plains' with low relative humidity, abundant sunshine, infrequent rain and
snow, moderate to high wind movement and temperatures ranging from mid -90's in the summer to low
teens, to below freezing, in the winter.
6.4.12 EXHIBIT L— Reclamation Costs
(1) We anticipate reclamation costs to be $4,521 per acre, as provided below:
Final grading = $450 per acre
Placing topsoil = $3,500 per acre
Seed = $60 per acre
Seed drilling = $100 per acre
Cost of Reclamation = $4,110 per acre
10% Misc. cost (reseed if less than 70% established, etc.) = $411 per acre
Anticipated Total cost = $4,521 per acre
6.4.13 EXHIBIT M — Other Permits and Licenses
This mining operation will be obtaining a local Town of Nunn Application for zoning Variance in
accordance with the Town of Nunn Code. No other permits are anticipated for this site, except the
