MEMORANDUM TO: Maxwell Nader, Planning Services FROM: Melissa J King, PE, DRE DATE: July 21, 2022 SUBJECT: RLDF22-0002 CMH Homes LLC (Formerly RLDK21-0004) The proposal has been reviewed on behalf of the Weld County Department of Public Works and Department of Planning and Zoning. Staff comments made during this phase of the application process may not be all- inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel: 105736000015 (A northern lot will be created, deeded separately, and not included in this RLD). The project proposes to: Rural Land Division for four (4) lots with Agricultural Zone District Uses. ACCESS: Weld County Development Review has reviewed the application materials related to access. The four (4) lots are proposed to access onto CR 38 via a proposed internal road to be constructed in association with the development of the rural land division. The internal road is considered a "development access" (Sec. 8-14-40.B.) that is required to meet the Minimum Access Spacing Criteria for intersections as specified in Table 1 below. The applicant shall obtain an access permit for a location that meets the Minimum Access Spacing Criteria. All other existing accesses onto CR 38 shall be closed and reclaimed. No other access points will be permitted. The existing parcel (i.e. 105736000015) will be divided such that there will be a northern lot not associated with the proposed rural land division. This lot will have access onto CR 38 via unmaintained County Road 37 right-of-way. Sec. 8-14-30. We strongly encourage you to discuss your access location with Development Review prior to laying out your site plan. All "preliminarily approved" accesses are subject to change during the access permitting process. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHT-OF-WAY: County Road 38 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate on the plat the future and existing right-of-way and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. County Road 37 appears to have section line right-of-way on the eastern boundary of the parcel. Section line right-of-way does not exist in all sections in Weld County and should be verified before a decision to utilize it is made. Weld County commonly refers to these locations as "Non -Maintained Section Line Right - of -Way." The existence of a physical road does not imply public right-of-way and the road may be located on private property. All right-of-way should be verified and physical roads located in relationship to the public right-of-way to ensure trespassing does not occur. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and ths information shall be noted on the plat. The applicant shall delineate on the plat the existing right-of-way and physical location of existing or proposed roads. If the right-of-way cannot be verified it shall be dedicated or an adequate easement between property owners shall be provided. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware the physical roadway(s) may not be centered in the right-of-way. This road is NOT maintained by Weld County. Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at https://www.welddoy.com/departments/public works/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. RIGHT-OF=WAY USE This project appears to use Weld County Right -of -Way associated with County Road 38 . This use may require a Right -of -Way Use Permit. The Right -of -Way Use Permit is a tool to help regulate unauthorized obstructions of, excavations in, and use of the County's rights -of -way and easements by utilities and line providers by requiring permits for ALL construction activities within the Weld County rights -of -way, whether gravel or paved, and including all public drainage easements. A Right -of -Way Use Permit grants a permit holder permission to occupy, excavate, survey, perform locations, or construct facilities within the County rights -of -way or easement, and provide for the subsequent restoration upon completion. Review the following link for additional information: https://www.weldgov.com/Government/Departments/Public-Works/Permits/Right-of-Way-Permits INTERNAL ROAD The applicant shall submit the construction drawings for the design of the internal road that includes the required right-of-way specified in and all the design standards specified in Chapter 8 of the Code and an emergency vehicle turn -around that meets the safety critera as outlined in Chapter 8 of the Code. TRAFFIC There is no recent traffic data for ths portion of CR 38. The traffic information submitted with the application materials indicates that there will be only residential traffic associated with the four residences. Residential traffic is considered to be 9 vehicle roundtrips per day per residence. No additional traffic information is needed. IMPROVEMENTS ROAD MAINTENANCE AGREEMENT WITH UP -FRONT ON -SITE IMPROVEMENTS Development Review is requesting an Improvements Road Maintenance Agreement for up -front on -site improvements for an internal roadway. Per Weld County Code, Section 24.6.20 requires that the internal access roadway meet all safety criteria and design critera as outlined in Chapter 8 Article XIV of the Code. Improvements/Road Maintenance Agreement: An example agreement is available at: https://www.weldgov.com/Government/Departments/Planning-and-Zoning/Development-Review DRAINAGE REQUIREMENTS This area IS within a Non -Urbanizing Drainage Area Non -Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON - URBANIZING areas. Detention pond waived and a simple drainage narrative The applicant has submitted a drainage narrative stating that the site meets drainage exception No. 77 (i.e. nine lots or fewer with 10% or less imperviousness and no downstream impacts to County infrastructure) in Sec. 8-11-40. Drainage Policy. No additional drainage information is required. Historic Flows The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT Per Weld County Code, Section 8-12-30.B, a Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permits are issued after the planning process is complete (map recorded). An Early Release Request Form may be entertained only after the applicant, Development Review, and the Planning Department have reviewed the referral and surrounding property owner comments and the case has been heard by the Board of County Commissioners (or the case has been approved by the Director of Planning Services if it is a case not requiring Board approval). The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering Development Review representative from the Development Review for more information. The Application Fee for a grading permit is $500 (Appendix 5-M of the Weld County Code). CONDITIONS OF APPROVAL: A. An Improvements and Road Maintenance Agreement is required for on -site improvements at this location for an internal roadway. Off -site roadway improvements may be required as a part of the agreement. Road maintenance includes, but is not limited to, dust control and damage repair. The Agreement shall include provisions addressing engineering requirements, submission of collateral, and testing and approval of completed improvements. (Development Review) B. Construction drawings for the design of the internal road that includes the required right-of-way specified in and all the design standards included in Chapter 8 of the Code and an emergency vehicle turn -around that meets the safety criteria as outlined in Chapter 8 of the Code shall be submitted. (Development Review) C. The plat shall be amended to delineate the following: 1. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of-way line. This road is maintained by Weld County. (Development Review) 2. County Road 37 is an unmaintained section line right-of-way. The applicant shall verify and delineate on the map the unmaintained right-of-way and the documents creating the right- of-way. All setbacks shall be measured from the edge of right-of-way. This road is not maintained by Weld County. Any unmaintained road needs to be located/identified in relationship to the right-of-way. Show and label the section line Right -of -Way as "CR 37 Section Line Right-of-way, not County maintained." (Development Review) 3. Show and label the internal roadway and the publicly dedicated right-of-way used to access the Lots 1, 2, 3, and 4 from the maintained County Road 38, from the lots to and including the maintained County Road access point. All setbacks shall be measured from the edge of right-of-way. This road will not be maintained by Weld County. Show and label the right- of-way as "Platted Right-of-way, not County maintained." (Development Review) 4. Show and label the approved access point and the usage type (Development Access). The access location will be reviewed as a part of the plat submittal. The existing access point onto CR 38 shall be closed and reclaimed such that Lot 4's only access onto CR 38 is via the internal road (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the existing County right-of-way. (Development Review) 3. Access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Development Review) 4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. (Development Review) 5. This violation was initiated due to the presence of three unoccupied modular homes without first completing the necessary Weld County Zoning Permits or Building Permits. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff -initiated complaints. There are no active or proposed 1041 WOGLA Permits on the associated parcel. There are several oil and gas well sites in the area surrounding the parcel. 2. The parcel includes one (1) temporarily abandoned (TA) well listed in Table 2 below. Additional information regarding this temporarily abandoned well is available from the Colorado Oil and Gas Conservation Commission (COGCC). Water Division 1, Water District 2 Dear Maxwell Nader: We have reviewed the June 28, 2022 re -referral for a rural land division to create four lots and a 43.102 -acre parcel from 80.89 -acres described as the E SE 1/4 of Sec. 36, T 4N, R 66W, 6th P.M. located at 17901 WCR 38, Platteville. The southern portion of the property will be subdivided into four lots. According to the submitted material, the north 43.102 -acre parcel is not part of the rural .and division and will be vacant land. The comments in this letter supersede those provided the letter from our office dated November 23, 2021. Water Supply Demand The proposed water uses for each of the four proposed lots are household use in single-family homes and the irrigation of lawn and garden. The estimated water demand for the proposed uses was not provided. Source of Water Supply The proposed water supply for all four lots is service provided by the CWCWD. Additionally, an existing well, permit no. 327404, will be used for lawn and garden uses on the 21.686 -acre lot (Lot 4 ). According to the letter submitted in a previous referral dated March 17, 2021, the CWCWD can serve the property provided that all requirements set forth by the CWCWD are met. This office has not received information that these requirements have been met. The CWCWD provided information about their water supplies in September of 2018. They primarily rely on Colorado -Sig Thompson (C - BT) water to supply retail water customers. As of September 2018, the CWCWD owned 5,832 C -BT units and 100 Windy Gap units. The yield of C -BT units and Windy Gap units varies from year to year based on conditions and storage. The dry year water yield is 3,800 acre-feet per year and the average yield is 4,800 acre-feet. In addition, the CWCWD continues to develop additional water supplies, including participating in the Northern Integrated Supply Project (NISP). According to the CWCWD, their current demand is 5,500 units with a commitment to serve 31 additional units. Well permit no. 327404 was issued June 27, 2022 pursuant to section 37-92-602(3)(b)(II)(A), (A), C.R.S. for the use of an existing well (constructed under permit no. 217001, now cancelled) for fire protection, ordinary household purposes inside not more than three (3) single-family dwellings, the watering of poultry, domestic animals and livestock on a farm or ranch and the irrigation of not more than one (1) acre of home gardens and lawns. If the Applicant is unable or unwitting to comply with these requirements, the well must be re - permitted as a non-exempt well pursuant to a court approved augmentation plan or be plugged and abandoned prior to approval of the rural land division. Everything else in the letter looks fine. As far as the permit goes, it does not look like the invoice for the application fee has been paid. I can start working on the permit application once it is paid for. It shouldn't take too long to get the permit issued, but I did notice the application is incomplete so how long it takes to issue the permit depends on how long it takes to get all of the information required for the application to be considered complete. I am copying Elisa Koonik who submitted the application. Once the letter is revised and the well is re -permitted, the county can request an updated letter from our office. Water Division 1, Water District 2 Dear Maxwell Nader: We have reviewed the September 28, 2021 referral for a rural land division to create four lots from 80.89 -acres described as the E 1/2 SE'/ of Sec. 36, T 4N, R 66W, 6th P.M. located at 17901 WCR 38, Platteville. The Exhibit Map provided shows there will be a lot of 18.178 acres, three lots of approximately 6.35 acres, and one of 43.102 acres. There is an existing residence that will be located on the 18.178 -acre lot and another home will be constructed on this same lot to replace the existing home. Residential buildings are also proposed on each of the 6.35 -acre lots. It appears that the 43.102 -acre parcel is not part of the rural land division and will be vacant land. Water Supply Demand Proposed water uses and estimated water demand for this subdivision were not provided. The Applicant must provide the proposed water uses and estimated water demands for the lots. Source of Water Supply The proposed water supply for the 18.178 -acre lot and the three 6.35 -acre lots is service provided by the CWCWD. According to the fetter dated March 17, 2021, the CWCWD can serve the property provided that alt requirements set forth by the CWCWD are met. This office has not received information that these requirements have been met. The CWCWD provided information about their water supplies in September of 2018. They primarily rely on Colorado -Big Thompson (C -BT) water to supply retail water customers. As of September 2018, the CWCWD owned 5,832 C -BT units and 100 Windy Gap units. The yield of C -BT units and Windy Gap units varies from year to year based on conditions and storage. The dry year water yield is 3,800 acre-feet per year and the average yield is 4,800 acre-feet. In addition, the CWCWD continues to develop additional water supplies, including participating in the Northern Integrated Supply Project (NISP). According to the CWCWD, their current demand is 5,500 units with a commitment to serve 31 additional units. Hello Mr. Nader — Our office has been in contact with Clayton Homes regarding Parcel 105736000015 with an address of 17901 CR 38. We had provided a Can Service letter in March stating that the parcel can be served within our District and if a subdivision requiring 10 or more taps is to be served, the purchase and transfer of raw water will be required. It is our determination that per the Weld County Assessor property portal, these 79 acres have not been split up to create separate parcels to date. The letter as shown dated March 17, 2021 should suffice for the availability of water service. If separate parcels are created, a can serve letter may be required for each parcel. A separate study process will also be required once the parcels are split as well. We do not currently provide water service to the property but I do believe there is a water well for that service that may or may not be able to stay with the existing house. If a study is completed at a later date and the tap fees are not feasible, the District will require a Non -Opposition letter to be requested for the Division of Water Resources. We are understanding that this parcel may be split into additional lots but since that has not happened yet, we are only providing the one letter.
